Regulation 1992.2CommencementThis regulation
commences on 1 July 1992.3Definitions(1)In this regulation—“allowable annual turnover”, for
an applicant for a licence or a licensee,means the
allowable annual turnover calculated for the applicant orlicensee under the board’s policies.“ANTA”meanstheAustralianNationalTrainingAuthorityestablishedunder the ANTA
Act.“ANTA Act”means theAustralian National Training Authority Act
1992(Cwlth).“approved
assessor”means a person endorsed by Construction
TrainingQueenslandtoassess,againstthedraftconstructionstandards(levels 4–6), the competency of persons to
carry out the scope of workrelevant to a general building or
house building licence.“approved authority”, for
a class of licence, means—(a)a registered
training organisation; or(b)apersonregisteredasanationalbuildingandconstructionindustry skills
assessor, for the class of licence, on the nationalregister of assessors.

AuthorityRegulation 1992s3“approved managerial qualification”,foranindividualapplyingforacontractor’slicence,isthesuccessfulcompletionbytheindividualof—(a)a course of management for licensed
contractors at a registeredtraining organisation; or(b)thecourseinbusinessmanagementforthehousingindustryconducted by the
Housing Industry Association; or(c)thesubjectsofferedbytheQueenslandMasterBuilders’Association in the following areas—(i)basic estimating;(ii)debt
recovery;(iii)commercial
contract administration;(iv)site supervision
of domestic sites;(v)accountingandbookkeepingforbuildersandsubcontractors; or(d)amanagementcourseapprovedbytheauthorityundersection 4C.“builder
contractor’s licence”means a licence of a class mentioned
inschedule 2, part 1, 2, 30 or 31.“building certifier”has the meaning
given under theBuilding Act 1975.1“Building Code of Australia”has
the meaning given in theBuilding Act1975,section 3.2“community organisation”means an
organisation formed to promote theinterests of a
particular community or community group.“ConstructionTrainingAustralia”meansNationalBuildingandConstructionIndustryTrainingCouncilLimited(tradingas1Building Act
1975, section 3 (Definitions)—“building certifier”means a person or
public sector entity accredited as a buildingcertifier by an
accrediting body.2Building Act 1975, section 3
(Definitions)—“Building Code of Australia”means
the edition, current at the relevant time, ofthe Building Code
of Australia (including the Queensland Appendix) publishedby
the body known as the Australian Building Codes Board and includes
theedition as amended from time to time by
amendments published by the board.

industry training advisorybody within the meaning of the ANTA
Act.3“ConstructionTrainingQueensland”meansConstructionIndustryTrainingCouncil(Queensland)Inc.(usingthebusinessnameConstructionTrainingQueensland),beinganindustrytrainingadvisory body recognised by the Training and
Employment Board.“designlicence”meansalicenceofaclassmentionedinschedule2,parts
26 to 29.“draft construction standards (level
4)”means—(a)the
document prepared by Construction Training Australia; and(b)designatedasconstructionstandardslevel4(thirddraft),(Sept
1997).“draft construction standards (level
5)”means—(a)the
document prepared by Construction Training Australia; and(b)designatedasconstructionstandardslevel5(thirddraft),(Sept
1997).“draft construction standards (level
6)”means—(a)the
document prepared by Construction Training Australia; and(b)designatedasconstructionstandardslevel6(thirddraft),(Sept
1997).“generalrepair”meansrepairsotherthanrepairscarriedoutinconnection with
the preparation of a certificate of maintenance or arecord of maintenance.“inspection”,forschedule2,parts58to66,meanstheprocessofexamining, measuring, testing or otherwise
comparing or evaluatingan item, unit or system against an
Australian Standard or a law of theCommonwealth or
the State that relates to the item, unit or system.“maintenance”,forschedule2,parts58to66,meansinspectionandtesting necessary to ensure that a fire
protection system and any other3AustralianNationalTrainingAuthorityAct1992(Cwlth),section4(1)(Interpretation)—“industry
training advisory body”means an organisation or body declared
by theMinisterial Council to be an industry
training advisory body for the purposes ofthe
Agreement.

safety measures continue to operate at their original
performancelevel and in accordance with any relevant
Australian Standards.“multiple dwelling”means a building
comprising 2 or more residentialunits.“national competency standards”means
a document—(a)designated as national competency
standards; and(b)endorsed by ANTA for the
Statement.“national register of assessors”means
the register of national buildingand construction
industry skills assessors administered by—(a)Construction Training Australia; and(b)for Queensland—Construction Training
Queensland.“occupational licence”means a licence
or registration for an occupationthat is—(a)issued to a person by an entity other
than the authority; and(b)required by the
person to carry out the occupation.“recognitioncertificate”meansarecognitioncertificateundertheTraining and Employment Act 2000,
section 182.4“registeredtrainingorganisation”seeTrainingandEmploymentAct2000,section 14.5“required
competency”,foraclassoflicence,meansthecompetency,assessed against
relevant national competency standards, to carry outthe
scope of work relevant to the class of licence.“requiredcompetency(generalbuilding)”meansthecompetency,assessed against
the draft construction standards (levels 4–6), to carryout
the scope of work relevant to a general building licence.4Training and Employment Act

practice;(g)work performed by the State or an
instrumentality or agency oftheState(asdistinctfromworkperformedfortheStateoraninstrumentalityoragencyoftheStatebyanindependentcontractor);(h)workperformedbyalocalgovernment(asdistinctfromworkperformed for a local government by an
independent contractor);(i)work performed by
a charitable or community organisation forits own use, if
the authority agrees that the work can reasonablybeexcludedfromthedefinition“buildingwork”,giventhequalifications and experience of
persons who will supervise thework;(j)theconstruction,extension,repairorreplacementofawaterreticulationsystem,seweragesystemorstormwaterdrain,outside the boundaries of private
property;(k)the construction, maintenance or
repair of a road under theLandAct 1994;(l)the construction,
maintenance or repair of a bridge (other than abridge on land in
private ownership);(m)the construction, maintenance or
repair of railway tracks, signalsorassociatedstructures(unlessthestructuresarebuildingsforresidential purposes, or are storage or
service facilities);(n)theconstruction,maintenanceorrepairofairportrunways,taxiways and aprons;(o)the
construction, maintenance or repair of harbours, wharfs andother
maritime structures (unless the structures are buildings forresidential purposes, or are storage or
service facilities);

fire detection system, alarm system or emergencywarning and
communication system for a building;(q)the
construction, maintenance or repair of a dam;(r)theconstruction,maintenanceorrepairofcommunicationsinstallationsperformedforapubliccompanyorotherpublicbody
engaged in radio or television broadcasting or in some otherform
of communications business or undertaking;(s)the
erection of scaffolding;(t)theinstallationofmanufacturingequipmentorequipmentforhoisting,conveyingortransportingmaterialsorproducts(includingprimaryproduce),butexcludingtheinstallationoffixed
structures providing shelter for the equipment;(u)construction work in mining;(v)hanging of curtains or blinds, or
laying of carpets or vinyl;(w)workconsistingofmonumentalmasonry,sculpture,ortheerection or construction of statues,
fountains or other works of art(other than work
affecting the structure of a building);(x)work
consisting of earthmoving and excavating;(y)work
performed personally by the owner of the land on which thework
is performed if—(i)the value of the work is less than $6
600; or(ii)the work is exempt or self-assessable
development under theStandard Building Regulation
1993;(z)certificationworkperformedbyabuildingcertifierundertheBuilding Act 1975in the certifier’s
professional practice;(za)servicesperformedbyaregisteredvaluerundertheValuersRegistration Act
1992in the valuer’s professional
practice;(zb)the laying of asphalt or
bitumen;

the presence of asbestosmaterialsundertheWorkplaceHealthandSafetyRegulation1997,
part 11, division 1;8(zd)aninspection,investigationorreportforassessmentofaninsurance claim;(ze)workofthetypeusuallyperformedbyalocksmith,whetherperformed by a
locksmith or another person.(2)The
authority’s agreement under subsection (1)(i) cannot be given
soas to exclude from the ambit of the
definition “building work” work thatwould otherwise be
residential construction work.(3)In
this section—“licensed electrical mechanic”meansapersonwhoholdsanelectricalmechanic licence
under theElectrical Safety Regulation 2002.3BLicensed builder—Act, s 4(1)A
person is a licensed builder under this regulation if the person is
theholder of a contractor’s licence for general
building or house building.4Classification as
farm buildingFor the definition“farm
building”in the Act, a building is of a kindclassified as a farm building if—(a)it is constructed on land used wholly
or primarily for agriculturalor pastoral
purposes; and(b)itisusedorintendedtobeusedforagriculturalorpastoralpurposes;
and(c)it has a completed value of not more
than $27 500; and(d)it is not a home.8WorkplaceHealthandSafetyRegulation1997,part11(Asbestos),division1(On-site management of asbestos

AuthorityRegulation 1992s 4B4AValue of domestic building workForthedefinition“majordomesticbuildingwork”intheAct,domesticbuildingworkofavalueexceeding$3300ismajordomesticbuilding work.4BClassification as residential construction
work(1)Forthedefinition“residentialconstructionwork”intheAct,building work is classified as residential
construction work if the buildingwork is—(a)relevant building work under
subsection (2), (3) or (4); and(b)carried out by a building contractor;
and(c)of a value of more than $3 300;
and(d)notexcludedfrombeingrelevantbuildingworkundersubsection (5) or
(6).(2)Building work is relevant building
work if it is—(a)the construction of a residence;
or(b)the construction of a roofed building,
other than a residence, onthesiteofaresidenceorproposedresidence,butonlyiftheroofedbuildingisforthepurposesofusingtheresidenceorproposed residence for residential
purposes.Example of roofed building for paragraph
(b)—A private garage, shed, carport,
toilet building or change room on the site of an existingor
proposed residence.(3)Building work is also relevant
building work if—(a)itisbuildingworkonaresidence,oronaroofedbuildingtowhich subsection (2)(b) applies;
and(b)the building work is—(i)the replacement, relocation or
extension of part or all of theresidence or
roofed building in a way affecting any roofs,ceilings, walls,
internal partitions, windows, doors, floors orfoundations;
or(ii)the construction, erection or
installation of part or all of theexternal fabric
of the residence or roofed building; or

or roofed building.(4)If building work that is relevant
building work under subsection (2)or (3) is carried
out under a contract, relevant building work is also—(a)allotherbuildingworkcarriedoutunderthecontractontheresidence or roofed building the
subject of the contract; and(b)if
the relevant building work is for a residence, building work
onanythingonthesiteoftheresidence,butonlyifthebuildingworkisforthepurposesofusingtheresidenceforresidentialpurposes;
and(c)if the relevant building work is for a
roofed building, buildingwork on the site of the residence or
proposed residence for whichthe roofed
building is to be used, but only if the building work isfor
the purposes of using the residence or proposed residence
forresidential purposes.(5)Building work is not relevant building work
if it is on, or on the siteof,abuildingorproposedbuildingthatisorformspartofanyofthefollowing—(a)a
multiple dwelling of more than 3 storeys;(b)ahostel,boardinghouse,guesthouse,lodginghouse,hotel,motel
or backpacker’s accommodation;(c)acorrectionalcentre,prison,reformatory,watch-houseorlockup;(d)a
hospital, nursing home or other health care building;(e)an orphanage or children’s
home;(f)a retirement village under theRetirement Villages Act 1999;(g)an educational
institution;(h)groupaccommodationforpersonswithaphysicalormentaldisability;(i)commercialorindustrialpremises,ifthebuildingorproposedbuilding—(i)also serves the commercial or
industrial purpose carried onat the commercial
or industrial premises; and(ii)is the only
residential unit in the premises.

caretaker’s flat on industrial premises constructed for a caretaker
responsible for thecare or security of the premises or goods on
the industrial premises.(6)Also, building
work is not relevant building work if it is carried outby a
building contractor for a person—(a)who
is the holder of an owner-builder permit covering the work;or(b)who should have
obtained an owner-builder permit to carry outthe work.(7)In this section—“residence”means
a building or part of a building designed to be used forresidentialpurposes,whetherornotitispartofcommercialorindustrial premises.4CApproval of management courses(1)The authority may approve a management
course for the purpose ofthedefinition“approvedmanagerialqualification”,paragraph(d)insection
3(1).(2)Theauthoritymayapproveacourseonlyifitissatisfiedanindividual successfully completing the course
would acquire managementskills similar to those acquired by an
individual successfully completinganother course or
the subjects mentioned in the definition.5Committees—Act, s 14(2)(1)A
committee appointed by the board or the Minister under section
14of the Act is to have a constitution
determined by the board.(2)A constitution
determined by the board under this section must—(a)assign a name to the committee;
and(b)provide for the membership of the
committee; and(c)state the purposes for which the
committee is established; and(d)provideforthewaymeetingsofthecommitteearetobeconvened and the frequency of meetings;
and

committee and who is to preside atits meetings;
and(f)provide that the committee is to reach
decisions by majority voteofthemembersvotingorinsomeotherwaysetoutintheconstitution; and(g)require the committee to report to the board
at intervals stated inthe constitution.6Classes of licence—Act, s 30(2)(1)Licences are divided into classes in
accordance with schedule 2.(2)A contractor’s
licence or supervisor’s licence may be issued for anyclass
of licence.7Requirements for contractor’s
licence—Act, s 31(1)Subject to subsection (2), an
individual applying for a contractor’slicence must have
the qualifications and experience set out in schedule 2for
the relevant class of licence.(2)For a
class of licence other than a class mentioned in schedule 2,parts
1, 7, 9, 10 and 58 to 66, an individual also has a qualification for
theclass if the individual has a combination of
any of the following that theauthority is
satisfied is at least the equivalent of the required
competencyfor the class—(a)successful completion of an
apprenticeship;(b)a recognition certificate;(c)a qualification or statement of
attainment issued by an approvedauthority for any
class of licence mentioned in schedule 2;(d)awrittenstatementissuedbyanapprovedauthoritythattheindividualhascompetencyassessedagainstapartofnationalcompetency standards relevant to work that
may be carried outunder the class of licence.

AuthorityRegulation 1992s98Requirements for supervisor’s
licence—Act, s 32An applicant for a supervisor’s licence must
have the same qualificationsandexperienceasarerequiredofanindividualwhoappliesforacontractor’s licence of the
corresponding class.9Application for a licence—Act, s
33(1)An application for a licence under the
Act—(a)must be in writing in a form approved
by the authority; and(b)must contain the
information indicated by the form; and(c)must
be accompanied by—(i)thedocumentaryevidenceoftheapplicant’sidentity,qualifications and experience required by the
authority; and(ii)iftheapplicationisforacontractor’slicence—thedocumentaryevidencerequiredbythefinancialrequirements
stated in the board’s policies; and(d)mustbeaccompaniedbyastatutorydeclarationverifyingtheinformationcontainedintheapplicationandthedocumentssupplied by the
applicant; and(e)must be accompanied by the application
fee and the annual feespecified in schedule 1.(1A)Subsection (1)(e) does not apply to an
application—(a)if—(i)the
applicant is a company; and(ii)theauthorityissatisfiedthecompany’ssoleobjectistoconduct training for persons to
undertake building work; or(b)if—(i)theapplicantismakinganapplicationforasupervisor’slicenceforthepurposeofbeingacompany’snominatedsupervisor; and(ii)thecompanyhasnothadanominatedsupervisorpreviously; and(iii)the
supervisor’s licence is not of a class corresponding to acontractor’s licence of class 1 or
2.

AuthorityRegulation 1992s 11(2)Anapplicantor,iftheapplicantisacompany,anofficerofthecompany must, at the request of the
authority—(a)attendaninterviewwithanofficeroftheauthoritytoanswerquestionsandprovideinformationrelevanttotheapplication;and(b)providetheauthoritywithanyfurtherevidenceitreasonablyrequires to
decide the application.(3)If the applicant
(or the officer) fails, without reasonable excuse, toattendanintervieworprovideevidencerequiredunderthissection,theauthority may reject the application on that
ground.11Renewal of licence—Act, ss 37 and
38(1)The authority must, in accordance with
the board’s policies, send toevery licensee
before the expiry day for the licensee’s licence—(a)a licence renewal notice; and(b)theforms(the“financial requirements forms”)theauthorityreasonably requires the licensee to complete
about the licensee’scontinuedsatisfactionoftherelevantfinancialrequirementsstated in the
board’s policies.(2)The licence renewal notice—(a)must state the date on which the
licence renewal falls due; and(b)must
state the annual licence fee and the time for payment.(c)muststatethetimebywhichthecompletedfinancialrequirements forms must be given to the
authority.(3)Thelicencefeeprescribedbyschedule1mustbepaidonorbefore 4.30 p.m.
on the last day of the month in which the licence is due toexpire
or at such earlier time as the renewal notice may require.(3A)However, the licence fee is not
required to be paid if the licensee isa company and the
authority is satisfied the company’s sole object is toconduct training for persons to undertake
building work.(4)For the purposes of section 38(2) of
the Act, the appropriate fee forterminating a
suspension imposed under that section is a fee equivalent tothe
licence fee prescribed by schedule 1 plus the application fee
prescribedby that schedule.

AuthorityRegulation 1992s 12(5)The authority may, for any reason it
considers appropriate, remit orreduce the fee
mentioned in subsection (4).(6)Thecompletedfinancialrequirementsformsmustbegiventotheauthority
by—(a)until 30 September 2000—4.30 p.m. on
the last day of the monthin which the licence expires;
and(b)from30September2000—4.30p.m.onthedaythelicenceexpires.11A Refund of
annual licence fee(1)The authority may refund the unexpired
part of the annual licence feepaid by a licensee
if—(a)the licensee surrenders the licence
before the expiry date for thelicence;
or(b)the licensee dies during the licence
period.(2)The unexpired part is the amount
worked out using the formula—-A----L-----F---1--×-2----W------M----where—“ALF”means
the annual licence fee paid by the licensee.“WM”means
the whole months before the expiry date for the licence.(3)For the purpose of subsection (2), a
whole month means a monthbeginningonthedayofthecalendarmonthonwhichthelicencewasissuedandendingonthedaybeforethecorrespondingdayofthenextcalendar month.Example of whole
month—For a licence issued on 7 March in a
year—a month beginning on 7 March and endingon 6
April.12Register—Act, s 39(2)(d)(1)The register must contain particulars
of—

construction work undertaken by eachlicensee who
holds a licence that authorises the licensee to carryout
residential construction work; and(b)thenumberofseparateprojectsinvolvingresidentialconstruction work
in relation to which the licensee has carriedout, or agreed to
carry out, building work as a licensee; and(c)if
the licensee is a company—the full name and business addressof
each secretary of the company.(2)If a
person mentioned in subsection (1)(c) does not have a
businessaddress,theregistermustinsteadcontainparticularsoftheperson’sresidential
address.13Owner-builder permits—Act, s 44(1)An application for an owner-builder
permit—(a)must be in a form approved by the
authority; and(b)must be accompanied by the fee
prescribed by schedule 1.(2)The authority
may, before granting an owner-builder permit, requiretheapplicanttoprovidesuchevidenceastheauthorityconsidersappropriate of the applicant’s identity and
ownership of the land on whichthe domestic
building work is to be carried out.(3)An
owner-builder permit permits the holder of the permit, subject
