Trade Measurement Administration Regulation 1991 Part 1 Preliminary [s 1] Trade Measurement Administration Regulation 1991 [as amended by all amendments that commenced on or before 1 July 2009] Part 1 Preliminary 1 Short title This regulation may be cited as the Trade Measurement Administration Regulation 1991 . 2 Commencement These regulations commence on the day appointed by proclamation under section 2(2) of the Act. 3 Repeal The Weights and Measures Regulations 1981 , as subsequently amended, are repealed. 4 Interpretation (1) In these regulations— balance means a beam-scale which has means for relieving all its knife edges and bearings. beam-scale means an equal-armed weighing instrument, the pans of which are below the beam. flow meter means an instrument for measuring liquid volume from the amount of liquid passing through the instrument. inspectors’ class 1 standard has the same meaning as in the National Measurement Regulation (Cwlth), section 80. Trade Measurement Administration Regulation 1991 Part 1 Preliminary [s 5] inspectors’ class 2 standard has the same meaning as in the National Measurement Regulation (Cwlth), section 80. inspectors’ class 3 standard has the same meaning as in the National Measurement Regulation (Cwlth), section 80. quality assurance certificate see section 6. quality assurance test see section 6. request test means a test on a measuring instrument, whether or not it is a trade measuring instrument, conducted by an inspector at the request of the owner, user, repairer, licensed certifier or person in possession of that instrument. State secondary standard has the same meaning as in the National Measurement Regulation (Cwlth), section 80. State tertiary standard has the same meaning as in the National Measurement Regulation (Cwlth), section 80. unclassified instrument means a weighing instrument which is not a class 1, 2, 3 or 4 instrument or a balance. weighbridge testing unit means a self-contained mobile device provided by the chief inspector for the purpose of testing weighbridges. (2) In these regulations, a reference to a class 1, 2, 3 or 4 instrument is a reference to a weighing instrument marked with any such class in accordance with the terms of a certificate of approval issued under the National Measurement (Patterns of Instruments) Regulations of the Commonwealth, as in force for the time being. 5 Fees and charges (1) The fees and charges payable for the purposes of the principal Act and the Act are the fees and charges specified in schedules 1, 2, 3 and 4 to these regulations. (1A) Despite subsection (1), no fee is payable under schedule 1 for a test for accuracy carried out— (a) on a measuring instrument after its repair by a servicing licensee; and Page 4 Reprint 2C effective 1 July 2009

(2) The expenses that may be charged for the purposes of the principal Act and the Act are the expenses specified in schedule 5, payable— (a) if the test is a request test carried out at a location other than the office of the inspector, for the total time taken from the time of the inspector’s departure from that office to the time of the inspector’s return to that office; or (b) if the test is a verification or re-verification test, for waiting time while adjustments are made to a measuring instrument before further testing by an inspector; or (c) if an inspector gives directions under section 16 of the principal Act for the re-verification of a measuring instrument and the instrument is unavailable or inaccessible or access to the instrument is, in the opinion of the inspector, unreasonably refused, for the total time taken by the inspector in attempting to re-verify the instrument. (3) If the owner of a measuring instrument is not in possession of the instrument, the person in possession of the instrument is to pay the relevant fee, charge or expenses. 6 Quality assurance tests and certificates (1) An inspector may perform quality assurance tests and issue quality assurance certificates. (2) A quality assurance test is a request test relating to measurement (other than a test to verify or re-verify an instrument under the Act or the National Measurement Act). (3) A quality assurance test may be done even if no quality assurance certificate is to be issued based on a result of the test. (4) A quality assurance certificate is a certificate based on a result of a test relating to measurement (other than a Reprint 2C effective 1 July 2009 Page 5

(5) A quality assurance certificate may be based on a result of any appropriate test, whether or not a quality assurance test. (6) For the purpose of fees— (a) a test for a certificate under section 15(4) of the principal Act is taken to be a quality assurance test; and (b) a certificate under that section is taken to be a quality assurance certificate.
