Act.3RepealTheWeights and Measures Regulations 1981, as
subsequentlyamended, are repealed.4Interpretation(1)In
these regulations—balancemeans a
beam-scale which has means for relieving allits knife edges
and bearings.beam-scalemeans an
equal-armed weighing instrument, thepans of which are
below the beam.flow metermeans an
instrument for measuring liquid volumefrom the amount
of liquid passing through the instrument.inspectors’

whetherornotitisatrademeasuringinstrument,conductedbyaninspector at the
request of the owner, user, repairer, licensedcertifier or
person in possession of that instrument.StatesecondarystandardhasthesamemeaningasintheNational
Measurement Regulation(Cwlth), section 80.StatetertiarystandardhasthesamemeaningasintheNational Measurement Regulation(Cwlth), section 80.unclassified
instrumentmeans a weighing instrument whichis
not a class 1, 2, 3 or 4 instrument or a balance.weighbridgetestingunitmeansaself-containedmobiledeviceprovidedbythechiefinspectorforthepurposeoftesting weighbridges.(2)Intheseregulations,areferencetoaclass1,2,3or4instrumentisareferencetoaweighinginstrumentmarkedwithanysuchclassinaccordancewiththetermsofacertificate of approval issued under
the National Measurement(Patterns of Instruments) Regulations
of the Commonwealth,as in force for the time being.5Fees and charges(1)The
fees and charges payable for the purposes of the principalActandtheActarethefeesandchargesspecifiedinschedules 1, 2, 3 and 4 to these
regulations.(1A)Despite subsection (1), no fee is
payable under schedule 1 fora test for
accuracy carried out—(a)on a measuring
instrument after its repair by a servicinglicensee;

certification.(2)TheexpensesthatmaybechargedforthepurposesoftheprincipalActandtheActaretheexpensesspecifiedinschedule 5, payable—(a)if
the test is a request test carried out at a location otherthan
the office of the inspector, for the total time takenfromthetimeoftheinspector’sdeparturefromthatoffice to the
time of the inspector’s return to that office;or(b)ifthetestisaverificationorre-verificationtest,forwaiting time while adjustments are
made to a measuringinstrument before further testing by an
inspector; or(c)if an inspector gives directions under
section 16 of theprincipalActforthere-verificationofameasuringinstrumentandtheinstrumentisunavailableorinaccessible or access to the instrument is,
in the opinionof the inspector, unreasonably refused, for
the total timetakenbytheinspectorinattemptingtore-verifytheinstrument.(3)If
the owner of a measuring instrument is not in possession ofthe
instrument, the person in possession of the instrument is topay
the relevant fee, charge or expenses.6Quality assurance tests and
certificates(1)An inspector may perform quality
assurance tests and issuequality assurance certificates.(2)Aqualityassurancetestisarequesttestrelatingtomeasurement(otherthanatesttoverifyorre-verifyaninstrument under the Act or the National
Measurement Act).(3)Aqualityassurancetestmaybedoneevenifnoqualityassurance
certificate is to be issued based on a result of thetest.(4)Aqualityassurancecertificateisacertificatebasedonaresultofatestrelatingtomeasurement(otherthanaReprint 2C

re-verification under the Actor the National
Measurement Act).(5)A quality assurance certificate may be
based on a result of anyappropriate test, whether or not a
quality assurance test.(6)For the purpose

taken to be a quality assurance test; and(b)a
