titleThis regulation may be cited as theAnimals Protection Regulation 1991.PART 2—LAYER HEN HOUSING2Definitions for pt 2In
this part—“domestic fowl”means a member
of the speciesGallus gallus domesticus.“floorarea”,ofalayercage,meanstheareaofthehorizontalplanemeasured between the vertical sections of
the back and front walls andthe vertical
sections of the side walls of the cage, regardless of the
eggand waste baffle, the drinking nipples and
water trough.“layerhen”meansafemaledomesticfowlreasonablyexpectedtobecapable of
laying eggs.3Layer hen housing—1 fowl in a
cage(1)This section applies if—(a)only 1 domestic fowl is kept in a
cage; and(b)the fowl is a layer hen.11The provisions of
this section are based on provisions of the 3rd edition of
theAustralian Model Code of Practice for the
Welfare of Animals—Domestic Poultry.
s44s5Animals Protection Regulation 1991(2)A person must not keep the layer bird
in a cage that has a floor arealess than 1 000
sq cm.Maximum penalty—20 penalty units.(3)This section does not apply to a layer
hen kept in a cage for transport.4Layer
hen housing—2 or more fowl in a cage(1)This
section applies if—(a)2 or more domestic fowl are kept in a
cage; and(b)at least 1 of the fowl is a layer
hen.2(2)A person must
not keep the fowl in a cage that has a floor area lessthan—(a)if 2
fowl are kept in the cage—1 350 sq cm; or(b)if3ormorefowlarekeptinthecage—anareacalculatedbyallowing—(i)450
sq cm for each fowl weighing less than 2.4 kg; and(ii)600 sq cm for
each fowl weighing 2.4 kg or more.Maximum
penalty—20 penalty units.(3)This section
does not apply to a layer hen kept in a cage for transport.PART
3—CIRCUS ANIMALS5Definitions for pt 3In
this part—“circus animal”means a
vertebrate animal kept or exhibited in a circus toentertain or educate the public.2The provisions of this section are
based on provisions of the 3rd edition of theAustralian Model
Code of Practice for the Welfare of Animals—Domestic
Poultry.
s65s6Animals Protection Regulation 1991“circus code”means the
Queensland Code of Practice for the Welfare ofAnimals in
Circuses published by the department.36Compliance with circus codeThe
owner of a circus animal must comply with the circus code to
theextentitisrelevanttotheacquisition,breeding,care,display,housing,training and
transport of the animal.Maximum penalty—20 penalty
units.3Copies of the circus code are
available for inspection or purchase at the department’soffices at 80 Ann Street,
Brisbane.
