areas of the park in a natural state, allowing thepublicopportunitiestoappreciateandenjoytherelativelyundisturbed
nature of those areas, and providing for limitedremoval of marine resources.9Entry and use(1)Subject to part 4 (Additional uses and
exemptions), a personmayenterorusetheconservationparkzoneforanyofthefollowing
purposes—(a)trolling for pelagic species;(b)linefishinginwhicheachpersonusesnomorethan2
hand-held rods or handlines, each with—(i)only
1 hook; or(ii)an artificial fly; or(iii)a lure;(c)spearfishing that is—(i)not for sale or trade; and(ii)notwithunderwaterbreathingapparatus(otherthan
a snorkel); and(iii)not with a
power-head;(d)limited collecting;(e)limited oyster gathering;(f)recreational or educational activities

applicant for permission to enter or use a zone must satisfythe
chief executive that no unacceptable environmental impactwill
occur as a result of the use of the area for the purpose forwhich
permission is sought.(2)In this
section—unacceptableenvironmentalimpactmeansanimpactthatmay
result in disturbance or alteration to the hydrology, waterquality,substrate,orthenaturalspeciescompositionorproductivity of communities.Part
3Designated area provisions11Designated areas(1)The
following areas are set aside for special management—(a)turtle monitoring special management
area;(b)Mon Repos special management
area;(c)turtle protection special management
area.(2)Theboundariesofthedesignatedareasaresetoutinschedule 2.(3)The
approximate locations of the designated areas are shownon
the designated areas map in schedule 4.12Objectives(1)Theobjectiveofsettingasidetheturtlemonitoringspecialmanagement area
for special management is to investigate anyeffects of
trawling on marine turtles during the turtle nestingseason.(2)TheobjectiveofsettingasidetheMonReposspecialmanagementareaistoprovideforforeshore,inshoreand

at Mon Repos to be specially managed for thepurposesofconservationofmarineturtlerookeries,appreciationbythepublicandfortheregulationofpublicaccess.(3)Theobjectiveofsettingasidetheturtleprotectionspecialmanagement area
is to provide for other areas of the marinepark to be
specially managed for the purposes of conservationofnaturalorculturalresources,undisturbedscientificresearch, appreciation by the public and
public safety.Part 4Additional uses
andexemptions13Access in special circumstances(1)In addition to the purposes specified
in part 2, a person mayenter or use a zone for the purpose
of—(a)saving a human life or avoiding the
risk of injury to ahuman being; or(b)locating or securing the safety of an
aircraft, vessel orstructure that is, or may be, endangered by
weather or bynavigational or operational hazards;
or(c)governmentreconnaissance,surveillance,orlawenforcement (including enforcement of
the Act); or(d)monitoring and management of the park
by, or with theapproval of, the chief executive; or(e)dealing with an emergency involving a
serious threat tothe environment.(2)The
chief executive may, for the following purposes, permit aperson to enter or use a zone and may give
such directions fortheentryanduseasarereasonablynecessaryfortheconservation,
protection and preservation of the park and anything contained
in the park—(a)removingavesselthatiswrecked,stranded,sunkorabandoned, except
a wreck protected under theHistoric

1976of the Commonwealth or a wrecklocated within a special management area
that has beendesignatedforthepurposeofspecialmanagementofthat wreck;(b)defenceoperations,includingtheuseofshipsandaircraft;(c)government geodetic, bathymetric or similar
surveys;(d)the construction, installation and
servicing of authorisednavigationalaidsandtheirancillarybuildingsandworks, including the operation of vessels
and aircraft forthese purposes.
