s1 3 Marine Parks ( Woongarra) Order 1991 Marine Parks (Woongarra) Order 1991 [reprinted as in force on 20 September 1993] s4 1 Short title This order in council may be cited as the Marine Parks (Woongarra) Order 1991 . 2 Establishment of marine park The area of tidal waters and tidal land described in the Schedule is set apart and declared as a marine park. 3 Constituents of marine park Under section 15 of the Act— (a) the subsoil beneath tidal land in the area, to a depth of 1000m below the surface; and (b) the airspace above the area, to a height of 915m above the surface; are taken to be in the marine park and, for the purposes of the Act, part of the area. 4 Naming of marine park The name “Woongarra Marine Park” is assigned to the marine park set apart and declared under section 2.

4 Marine Parks ( Woongarra) Order 1991 Schedule section 2 The area consists of the tidal waters and tidal land within the boundary that— (a) commences at the point of intersection of the parallel of latitude 24 º 45.6' south by the coastline at highest astronomical tide, in the vicinity of South Head; and (b) runs east along that parallel to its intersection by the coastal 3 n mile line; and (c) then generally south-easterly and southerly along that coastal 3 n mile line to its intersection by the parallel of latitude 24 º 55.5' south; and (d) then west along that parallel to its intersection by the coastline at highest astronomical tide, in the vicinity of Elliott Heads (north headland); and (e) then generally north-westerly and northerly along the coastline at highest astronomical tide (crossing the mouths of creeks and streams in accordance with the general trend of the coast at highest astronomical tide) to the point of commencement; and includes the tidal waters and tidal land of— (f) Palmer Creek; and (g) Rifle Range Creek; and (h) the unnamed inlet and its tributary streams which flow into the sea at the southern end of Mon Repos Beach at about latitude 24 º 48.1' south, longitude 152 º 26.7' east; but excludes— (i) Environmental Parks reserved and set apart under the Land Act 1962 ; and (j) alienated tidal land.
