title1.This regulation may be cited as
theVocational Education, Trainingand
Employment Regulation 1991.˙Commencement2.This
regulation commenced on 28 October 1991.˙Definitions3.Thedictionaryinschedule2definesparticularwordsusedinthisregulation.˙Meaning of “ACE course”4.An“ACE course”is an adult
community education course, offered ata State college,
that is not run for profit and for which a person completingthe
course does not receive an award.˙Meaning of “at cost”5.“Atcost”,foraservice,meanstheamount(notmorethanthereasonablecostofprovidingtheservice)thecollegedirectorconsidersreasonable.

“Nominal hours”means—(a)for
a government funded subject—the number of hours stated forthe
subject in an official syllabus; or(b)for
an ACE course—the number of hours stated for the course inan
official college publication.˙Meaning of “official college
publication”7. “Official college publication”of a
college means a publication, oradvertisement,
about the college, approved by the director and available
forpurchase or inspection at the college.Examples—•an
approved college diary or handbook•an
approved course information sheet or brochure.˙Meaning of “student services”8.
“Student services”means any of the following services
available toall students enrolled in a government funded
subject at a college—•student
counselling or job placement service•student activities coordination
service•student security service•library service•course information service•recreational facilities and activities
service•disability support service.˙Meaning of “tuition fee”9.
“Tuition fee”means—(a)for
a government funded subject—the fee payable as the
student’s

subject; or(b)for an ACE course—the fee for tuition

services and other services˙Fees
for State college services and other services10.(1)ThefeespayableundertheAct,otherthanfortheAustralianRecognition
Framework, are in schedule 1, parts 1 to 3.(2)Astudentmustpayatuitionfeeorstudentservicesfeewhenenrolling.(3)However,astudentmaynothavetopayatuitionfeeorstudentservices fee, or may be given time to pay the
fee, under division 2.1(4)A
fee for an ACE course is chargeable at an hourly rate only if
anofficial college publication states the fee
is chargeable at an hourly rate.˙Facilities fee for ACE courses11.(1)AstudentinanACEcoursemustpayafacilitiesfeeforthecourse.(2)The amount of the fee—(a)is worked out by dividing the cost of
running the course by thenumberofstudentsforthecoursestatedinanofficialcollegepublication;
and(b)is the amount stated in an official
college publication as payableby each student

cost of enrolment or tuition is not counted in working out
thefacilities fee.(4)If
the course is not an adult and community education course
undertheA New Tax System (Goods and Services
Tax) Act 1999(Cwlth), the costof running the
course may be increased to take account of GST payable forthe
supply of the course.†Division 2—Fee
exemptions, refunds and time to pay˙Government funded subjects for which there
are no tuition or studentservices fees and free tests12.Thereisnotuitionfeeorstudentservicesfeeforthefollowinggovernment funded
subjects or tests—(a)a subject for which the Commonwealth
or the State requires therebe no
fee;(b)a subject for tutors undertaken by
someone who has agreed totutor at a college free of
charge;(c)atest(otherthanforaspecialentryapprentice)todecideplacement in a
literacy or numeracy program;(d)a
learning support subject;(e)a subject
undertaken at a college as part of the student’s secondaryeducation.˙Government funded subjects for which there
are no tuition fees13.There is no tuition fee for an adult
literacy or numeracy programfunded by the
State.˙Replacement of non-CBT program with CBT
program14.(1)This section
applies if—

a program that is not a CBTprogram;
and(b)the subjects to complete the program
are no longer offered by thecollege;
and(c)the student enrols in a comparable CBT
subject simply to receivea result in the CBT subject.(2)There is no tuition or student
services fee for the comparable CBTsubject.˙Director may waive fees for
professional development of college staff15.A
director may waive payment of the tuition or student services
feeforasubjectapprovedbythedirectorandtakenbyastaffmemberasprofessional development.˙Industry placement hours—25% of fees
payable for nominal industryplacement
hours16.Only 25% of the tuition and student
services fee is payable for thenominal industry
placement hours for a subject.˙Fee
adjustment for certain transfers and cancellations of enrolment
inGovernment funded subjects17.(1)This section
applies if a student enrolled in a government fundedsubject at a college—(a)transfers the enrolment to substantially the
same subject at anothercollege; or(b)cancels the enrolment and enrols in another
subject at the samecollegenolaterthan2weeksafterthestartofthecancelledsubject.(2)Any tuition or student services fee
payable on the original or cancelledenrolment must be
applied to reduce the total amount of tuition and studentservices fees payable on the later
enrolment.

cancelled enrolment must be refunded.˙Fee
exemption on grounds of extreme financial hardship18.(1)The director may
exempt a student from a tuition fee or studentservices
fee.(2)However, the director may grant the
exemption only if the director issatisfied the
student is suffering extreme financial hardship.(3)The student must apply for the
exemption in the approved form whenenrolling.˙Tuition fee exemptions for government
funded subjects19.(1)The director may
exempt a student from 75% of the tuition fee fora
government funded subject if—(a)the
student has not completed year 12 and was or will be under
17at the end of February in the year in which
the subject is taken; or(b)for a subject
taken at a senior college—the student was or will beunder 18 at the end of February in the year
in which the subject istaken; or(c)the
student is an Aboriginal or Torres Strait Islander; or(d)the student—(i)holds a health care card or pensioner
concession card issuedunder Commonwealth law; or(ii)is—(A)thepartneroradependantofapersonwhoholdsahealth care card or pensioner concession
card; and(B)named on the card; or(iii)hasadocumentissuedinanofficialformunderCommonwealthlawconfirmingthatthestudent,thestudent’spartnerorthepersonofwhomthestudentisadependant is entitled to concessions
under a health care card

pensioner concession card.(2)The student must
apply for the exemption in the approved form whenenrolling.(3)Subsection (1)(d) does not apply if the
student obtained a refund offees for the
subject.(4)A student applying for exemption under
subsection (1)(d) must also,when applying,
produce—(a)the card or a copy of it certified to
be a true copy by a justice ofthe peace or
commissioner for declarations; or(b)the
document mentioned in subsection (1)(d)(iii).˙Half
fee exemption for ACE courses for students entitled toconcessions under Commonwealth law20.(1)This section
applies if—(a)a student holds a health care card
issued under Commonwealthlaw; or(b)a
student—(i)holdsapensionerconcessioncardissuedunderCommonwealth law; and(ii)is
entitled to the maximum rate of pension; or(c)a
student—(i)is the partner or a dependant of a
person who holds a healthcare card; and(ii)is
named on the card; or(d)a
student—(i)is the partner or a dependant of a
person who—(A)holds a pensioner concession card;
and(B)is entitled to the maximum rate of
pension; and(ii)is named on the
card.

Education, Training andEmployment Regulation 1991(2)This section also applies—(a)ifastudenthasadocumentissuedinanofficialformunderCommonwealthlawconfirmingthatthestudent,thestudent’spartnerorthepersonofwhomthestudentisadependantisentitled to concessions under a health care
card; or(b)if—(i)a
student has a document issued in an official form underCommonwealthlawconfirmingthatthestudent,thestudent’spartnerorthepersonofwhomthestudentisadependantisentitledtoconcessionsunderapensionerconcession card;
and(ii)the student, the
student’s partner or the person of whom thestudentisadependantisentitledtothemaximumrateofpension.(3)If
the tuition fee for an ACE course is chargeable at an hourly rate,
thestudent may apply to the director for
exemption from half of the tuition feefor the
course.(4)Thestudentmustwhenenrollingapplyfortheexemptionintheapproved form and
produce—(a)the card or a copy of it certified to
be a true copy by a justice ofthe peace or
commissioner for declarations; or(b)the
document mentioned in subsection (2).(5)In
this section—“maximum rate of pension”means the
maximum rate of pension payableundertheCommonwealthlawunderwhichapensionerconcessioncard or document
mentioned in this section is issued.˙Allowing time to pay fees for government
funded subjects21.(1)A student may
apply to the director for time to pay tuition fees orstudent services fees for a government funded
subject if the total amount oftuitionfeesorstudentservicesfeespayablewhenenrollingismorethan
$75.00.

form when enrolling.(3)If the director allows the student
time to pay the fees the director mayenter into a
written arrangement for payment of the fees.(4)The
fees must be paid as required under the arrangement.(5)Ifthestudentdoesnotpaythefeesforasubjectunderthearrangement the director may withhold
the student’s results for the subjectuntil the fees
are paid.(6)Subsection(5)isinadditiontoanyotherremedyavailabletothedirector.˙Refund if subject or course cancelled
by director22.If the director cancels a government
funded subject or ACE coursebeforeitstarts,thedirectormustrefundthefeespaidforthesubjectorcourse.˙Refund
if enrolment cancelled before subject or course starts23.(1)If a student
cancels enrolment in a government funded subject orACE
course before it starts, the director must refund the fees the
studentpaid for the subject or course after
deducting—(a)for an ACE course—the enrolment fee
for the course; or(b)foragovernmentfundedsubject—anadministrationchargeof$10.00 for all subjects cancelled at
the same time.(2)However, there is no refund for an ACE
course unless the enrolmentis cancelled no
later than 2 days before the course starts.(3)This
section does not apply if a tuition or student services fee
payableon the cancelled enrolment must be applied to
reduce fees payable on a laterenrolment.22See section 17(2)

starts24.(1)Ifanyofthefollowingthingshappenwhilethestudentisundertakingagovernmentfundedsubject,thestudentmayapplytothedirector for a refund of the fees for
the subject—(a)thestudentacceptsaplaceofferedthroughtheQueenslandTertiary
Admissions Centre;(b)the student suffers an illness or
injury preventing the student fromcompleting the
subject;(c)exceptional circumstances prevent the
student from completingthe subject.(2)The
student must apply in the approved form before the
assessmentfor the subject ends.(3)The
director may refund the fees after deducting an
administrationcharge of $10.00 for all subjects to which
the application relates.˙Refund if academic
exemption received25.(1)Ifastudenthasreceivedanacademicexemptionfromagovernment funded subject since enrolling in
it, the student may apply to thedirector for a
refund of fees for the subject.(2)The
student must apply in the approved form within 5 weeks after
thesubject starts.˙Refund
if re-evaluation successful26.The director
must refund the fee for re-evaluation of a result of agovernment funded subject to a student whose
re-evaluation is successful.˙Refused applications for fee exemptions,
refunds and time to pay27.(1)If the director
refuses an application for a fee exemption, refund ortime
to pay, the director must give the applicant written notice of the
reasonsfor refusal.(2)A
person who is refused an exemption, refund or time to pay
may,

given, apply to the director for areconsideration
of the refusal.(3)The refusal must be reconsidered by a
person more senior than theperson who
refused the original application.˙Delegation of director’s powers28.A director may delegate the director’s
powers under this regulation toa member of the
college’s staff.

4.“apprentice level test”means a test to
assess whether an apprentice hassuccessfullycompletedalevelforanapprenticementionedinanofficial
syllabus.“approved form”means a form
approved by the chief executive.“at cost”see
section 5.“BSSSS”meansBoardofSeniorSecondarySchoolStudiesundertheEducation (Senior Secondary School Studies)
Act 1988.“CBT”, of a subject,
means competency based training to meet industryspecified standards, under which a student
is assessed as competent ornot yet
competent in the subject.“certificate of competency”hasthemeaningassignedtoitundertheElectricity Act 1976;“college”means a State
college.“electricalapprentice”meansanapprenticeindenturedinanapprenticeshipcallinginwhichatradespersonperformselectricalwork.“electrical trainee”meansapersonemployedasatraineeortraineeparaprofessional.“electrical
work”has the meaning assigned to it under
theElectricity Act1976.

Regulation1989.“government funded”includes funded
or partly funded by a State or theCommonwealth.“highvoltage”hasthemeaningassignedtoitundertheElectricity Act1976.“industry placement”seeVocationalEducationandTraining(IndustryPlacement) Act 1992, section
8.“late enrolment”means enrolment
for a subject after the closing time forenrolment stated
in an official college publication.“learningsupportsubject”meansasubjectintendedtoincreaseastudent’s general ability to learn.“low
voltage”has the meaning assigned to it under
theElectricity Act 1976.“minor
repairs”includes—(a)the
renewal of secondary fuses; and(b)the
replacement of switches and similar accessories; and(c)the repair of portable electrical
appliances or flexible cord sets;but does not
include repairs to or in connection with—(d)lifts, hoists or conveyors for the carriage
of persons; or(e)x-ray or other medical equipment;
or(f)industrial heating equipment.“nominal hours”see section
6.“nominal industry placement hours”,
for a subject, means the number ofindustry
placement hours for the subject stated in an official
syllabus.“official college publication”see
section 7.“official syllabus”,forasubject,meansadocumentoutliningacourseaccredited by
the Accreditation Council or BSSSS.“paraprofessional”means a person
who—

in the workforce; and(b)possesses
qualifications at an associate diploma level; and(c)has appropriate experience for that
level of work.“programofstudy”means1ormoresubjectsidentifiedinanofficialcollege
publication as a program.“special entry apprentice”means a person who—(a)the
State Training Council allows to enter into an
apprenticeship;and(b)doesnothavetheminimumstandardofeducationfortheapprenticeship.“student”includes a person enrolling as a
student.“student services”see section
8.“subject”includes
module.“tradetest”meanatesttoassesswhetherapersonhasskillsandknowledge appropriate to a particular
trade.“tuition fee”see section
9.PART 2—DEFINITIONS FOR PART 4 OF THISREGULATION (PROVISIONS FOR AUSTRALIANRECOGNITION FRAMEWORK)“accreditation”means
accreditation in Queensland under the framework.“associatedhigherqualificationlevelproduct”meansaproductthatincludes a subset of competencies, which if
satisfactorily completed,leads to the associated lower
qualification.“Australian Recognition Framework”means the Australian RecognitionFramework developed under instructions from
the Australian National

Authority Ministerial Council.“complaint”meansacomplaintofnon-compliancemadeagainstaregistered training organisation or quality
endorsed organisation to theAccreditation
Council.“compliance”, for a
registered training organisation or an organisation withquality endorsed status, means compliance
with the requirements theorganisation must comply with under
the framework to obtain or retainits registration
or status.“compliance audit”means an audit
of compliance, carried out in or outsideQueensland or
Australia, that is—(a)initiated and managed by the
Accreditation Council; and(b)carried out on a
registered training organisation or an organisationwith
quality endorsed status.“expensesatcost”meanstravel,accommodation,communicationandother expenses reasonably incurred.“ISO”means
International Standards Organisation.“notification”means
notification to the Accreditation Council under theframework.“registration”means
registration in Queensland under the framework.“skill recognition
services”means skill recognition services
(assessmentonly) and issue of qualifications and
statements of attainment.“qualityendorsedstatus”meansqualityendorsedstatusgrantedinQueensland under the framework.“service fee”means a fee for
providing—(a)ongoing information about the
framework and developments in it;and(b)complianceauditsunderthisregulationforwhichnofeeischarged under
this schedule.“the framework”see section
