2003]PART 1—PRELIMINARY1Short
titleThis regulation may be cited as theMineral Resources Regulation 1990.2DefinitionsIn
this regulation—“average market price”, for a mineral,
means the average settlement pricefor the mineral
over a royalty period on—(a)for gold or
silver—the London Bullion Market; or(b)for
copper, lead or zinc—the London Metal Exchange.“designated
fossicking land”hasthemeaninggivenbytheFossickingAct 1994.“plan”, in relation to
a restricted area, means a plan held in the office of thedepartment.“reference
price”, for copper, gold, lead, silver or zinc—see
schedule 1,section 4.“reference price
1”—see schedule 1, section 4.“reference price 2”—see schedule 1,
section 4.“reference price 3”—see schedule 1,
section 4.“royalty base rate”, for copper,

registrar is not to record any actionor dealing for
which a fee is prescribed until payment of that fee is made.PART
2—MINING DISTRICTS8Mining districts(1)The
land included in each part of schedule 5 is a mining
district.(2)Each mining district is assigned the
name stated in the part heading.PART
3—PROSPECTING PERMITS9Conditions of
prospecting permitFor the purposes of section 25 of the Act
the prescribed conditions of aprospectingpermitarethattheholderoftheprospectingpermitandallpersons acting
under the authority of the permit—(a)aretouseexistingroadsortracksonoccupiedlandwherepracticable to
do so;(b)aretotakeeveryprecautiontoensurethereisnodispersalofpartheniumweedseedortheseedofanyotherdeclaredplantwithin the
meaning of theRural Lands Protection Act 1985as
aresult of activities carried on under the
authority of the permit;(c)aretogainaccesstooccupiedlandonlyatapointorpointsdesignated by a
mining registrar unless the holder has obtainedthe consent in
writing of the owner and has lodged that consentwith
the mining registrar;(d)aretorestrainanimalsinthecustodyofthatpersonorthosepersonsonoccupiedlandunlesstheholderhasobtainedtheconsent in writing of the owner and has
lodged that consent withthe mining registrar;

lodged that consent withthe mining registrar;(g)for unoccupied land—must ensure
rubbish and human waste isdisposed of in a safe and sanitary
way.10Register of prospecting permits(1)Aminingregistrarmustrecordthefollowingparticularsofeachapplicationforaprospectingpermitandeachprospectingpermitintheregister—(a)name of holder;(b)address for service of notices on the
holder;(c)number of the permit;(d)category of the permit;(e)date of application for the
permit;(f)dateofgrantofthepermitorrejectionofapplicationforthepermit;(g)date
of commencement of the permit;(h)date
of expiry, cancellation or surrender of the permit;(i)security required under section 26 of
the Act;(j)descriptionoflandcomprisedinthepermitandaccesstothatland;(k)any special conditions upon which the
permit is granted;(l)consents.(2)The
register may be searched only by the owner of the land
duringthe hours prescribed for the conduct of
business at the office of the miningregistrar on
payment of the prescribed fee.(3)The
register may be maintained manually, on computer disc or insuch
other form as may be adopted by direction from the chief
executive.

permitsThe amount of security a mining registrar
fixes for a district prospectingpermit must not
be less than $1 000.PART 4—MINING CLAIMS12Conditions of mining claimFor
the purposes of section 81 of the Act the prescribed conditions of
amining claim are that the holder and all
persons acting under the authorityof the mining
claim—(a)are to ensure there is no dispersal of
parthenium weed seed or theseed of any
other declared plant within the meaning of theRuralLands Protection Act 1985as a
result of mining activities or as aresult of access
to the area of the claim;(b)are to restrain
animals in the custody of that person on the landcomprised in the claim unless the area of
the claim is fenced insuch a manner as to contain those
animals;(c)are not to discharge a firearm on
occupied land unless the holderhas obtained the
consent in writing of the owner and has lodgedthat consent
with the mining registrar.13Register of
mining claims(1)Aminingregistrarmustrecordthefollowingparticularsofeachapplication for a

Regulation 199015Excavations near railway land(1)The holder of or applicant for a
mining claim is not to make anyexcavation within
a distance of 12 m in a horizontal direction or of 15 m inaverticaldirectionfromanyembankment,cutting,bridge,pier,culvert,drainorotherworkonarailwaylinepassingoverorneartothelandcomprisedintheminingclaimorapplicationwithouttheauthorityinwriting of the chief executive of Queensland
Rail.Maximum penalty—200 penalty units.(2)The request for the authority of the
chief executive of QueenslandRail is to be
made in the first instance to the chief executive.16Moving datum post after survey of
contiguous land(1)Where the land the subject of an
application for a mining claim isshown in the
application as being contiguous with other land which is thesubject of—(a)a
mining claim; or(b)a mining lease; or(c)an
application for a mining claim; or(d)an
application for a mining lease;and that other
land is not surveyed, then, within 14 days (or such longerperiodastheMinisterintheparticularcaseallows)aftertheminingregistrar has
notified the applicant for the mining claim in writing that asurveyofthatotherlandhasbeencompletedandthatallsurveymarksdefining the boundary of the other land have
been placed, the applicant forthe first
mentioned mining claim may adjust the marking out of the land
sothat the land applied for is still contiguous
with that other land as surveyedand may be
surveyed accordingly.(2)Subsection (1)
does not authorise the adjustment of the marking outofanylandsoastoincludelandwhichwasnotlandtowhichtheapplicant’sprospectingpermitappliedatthedateofapplicationforthemining claim, or the surveying of that
land.(3)When the marking out of the land
comprised in the application hasbeenadjustedorthelandhasbeensurveyed,thelandistobethelandmarked out and
applied for by the applicant pursuant to the provisions ofthe
Act.

Regulation 199017Instrument of mortgageAminingregistrarisnottorecordparticularsofamortgageoveramining claim unless 2 copies of the
executed instrument of mortgage arelodged with the
mining registrar in the approved form and accompanied bythe
prescribed fee.18Sale by mortgagee(1)When
a mortgagee exercises a power of sale contained or implied
ina mortgage over a mining claim the mortgagee
is to—(a)furnishtheminingregistrarwithsatisfactoryevidencethatthepower of sale has been properly exercised;
and(b)submit the assignment of the interest
pursuant to the exercise ofthe power of
sale in accordance with the provisions of section 96of
the Act; and(c)pay the prescribed assignment
fee.(2)An assignment by a mortgagee
exercising a power of sale under amortgage over a
mining claim is to be made in the approved form and is tobe
accompanied by—(a)a copy of the government gazette and
of a newspaper circulatedin the locality, containing the notice
of the mortgagee’s intentionto sell;
and(b)the certificate of grant of the mining
claim; and(c)the duplicate of the mortgage under
which the sale was made.19Rental payable on
a mining claimThe yearly rental payable on a mining claim
is prescribed in schedule 3.20Area
of mining claim landTheareaofaminingclaimoverspecifiedlandinaminingdistrictspecified in
schedule 6 must not be more than the area specified for the
landin schedule 6.

Regulation 199021Permitted equipment and prohibited
machinery on mining claims(1)Thefollowingequipmentmaybeusedforprospectingorhandmining on land in
a mining claim—(a)a pick, shovel, hammer, gad or
sieve;(b)powered machinery that is not
prohibited machinery.(2)Prohibitedmachinerymustnotbeusedforprospectingorhandmining on land in
a mining claim.(3)Prohibited machinery may only be used
to—(a)transport—(i)mineral bearing ore or wash; or(ii)equipment
(including machinery), materials or water, that isused
in connection with mining operations; or(b)build storage facilities for water that is
used in connection withmining operations; or(c)rehabilitate the surface area of land
in a mining claim.(4)In this section—“powered
machinery”—(a)meansamechanicaldevicepoweredbyair,electricity,gas,internal combustion, steam or water;
and(b)includes the following—(i)aclassifier,compressor,drier,drill(otherthanavehiclemounteddrill),elevator,feeder,filter,hoist,jack-pick,puddler,
pulsator, pump, separator, shaker, shute, trommel,vibrator, willoughby, winch and
windlass;(ii)forlandwithintheMareebaminingdistrict—aneductordredge that—(A)has
a maximum inlet nozzle diameter of 200 mm; and(B)is
used when water flows in the Palmer river, Mitchellriver or their tributaries;(iii)for land in
restricted area 1 in the Emerald mining district,restrictedarea25intheQuilpieminingdistrictorrestricted area 77 in the Winton mining
district—

diameter of25 cm used for exploration drilling;
and(B)a vehicle mounted drill with a maximum
diameter of1 m used for drilling access shafts.“prohibitedmachinery”meansanyofthefollowingpoweredmachinery—(a)abackhoe,bobcat,bucketexcavator,bulldozer,clamshell,continuousminer,dragline,dredge,end-loader,excavator,grader,loader,ripper,rooter,scarifier,scoop,scoopmobile,scraper, tractor
or traxcavator;(b)acart,crane,locomotive,monorail,motorvehicle(withorwithout a trailer) or ropeway.PART
5—EXPLORATION PERMITS23Conditions of
exploration permitFor the purposes of section 141 of the Act
the prescribed conditions ofan exploration
permit are that the holder of an exploration permit and allpersons acting under the authority of the
permit—(a)aretouseexistingroadsortracksonoccupiedlandwherepracticable to
do so;(b)aretotakeeveryprecautiontoensurethereisnodispersalofpartheniumweedseedortheseedofanyotherdeclaredplantwithin the
meaning of theRural Lands Protection Act 1985as
aresult of activities carried on under the
authority of the permit;(c)aretogainaccesstooccupiedlandonlyatapointorpointsdesignated by
the mining registrar unless the holder has obtainedthe
consent in writing of the owner and has lodged that consentwith
the mining registrar and forwarded a copy of that consent tothe
chief executive;(d)aretorestrainanimalsinthecustodyofthatpersonorthosepersonsonoccupiedlandunlesstheholderhasobtainedtheconsent in writing of the owner and has

and reductions;(k)renewals;(l)date
of expiry, cancellation or surrender of the permit;(m)annual rental;(n)security required pursuant to section 144 of
the Act;

subject to exploration permitFor the purposes
of section 127(4) of the Act, the area prescribed is—(a)in respect of coal—300 sub-blocks;
and(b)for all minerals other than coal—100
sub-blocks.26Application for exploration
permit(1)For the purposes of section 133(f) of
the Act the office prescribed forthe receipt of
applications for exploration permits is any office of a
miningregistrar.(2)Whereaminingregistrarrefusestoacceptthelodgmentofadocument as an application for an
exploration permit the mining registrar istoretainacopyofthedocumentandinformthepersonlodgingthedocumentthatthelodgmenthasnotbeenacceptedandofthereasonstherefor.27Numbering of application(1)The mining registrar is to allocate to
each application for the grant ofan exploration
permit the next available number by reference to the lastnumber allocated to an exploration permit or
application for an explorationpermitofthattyperecordedintheregistermaintainedbythechiefexecutive.(2)Thenumberallocatedtoanexplorationpermitistoincludeidentificationofthetypeofexplorationpermitbyreferencetocoalormineral other than coal or specified minerals
the subject of the permit by aconsistent method
approved by the chief executive.

DEVELOPMENT LICENCES29Conditions of mineral development
licenceFor the purposes of section 194 of the Act
the prescribed conditions of amineral
development licence are that the holder of the mineral
developmentlicence and all persons acting under the
authority of the licence—(a)aretouseexistingroadsortracksonoccupiedlandwherepracticable to
do so;(b)aretotakeeveryprecautiontoensurethereisnodispersalofpartheniumweedseedortheseedofanyotherdeclaredplantwithin the
meaning of theRural Lands Protection Act 1985as
aresult of activities carried on under the
authority of the licence;(c)are to gain
access to occupied land only by the access approvedby
the Minister;(d)aretorestrainanimalsinthecustodyofthatpersonorthosepersonsonoccupiedlandunlesstheholderhasobtainedtheconsent in writing of the owner and has
lodged that consent withthe mining registrar and forwarded a
copy of that consent to thechief
executive;(e)are not to discharge a firearm on
occupied land unless the holderhas obtained the
consent in writing of the owner and has lodgedthat consent
with the mining registrar and forwarded a copy ofthat
consent to the chief executive;(f)arenottolightopenfiresunlesstheholderhasobtainedtheconsent in writing of the owner and has

Regulation 199034Rental payable on mineral development
licence(1)In this section—“yearly rental
rate”for a mineral development licence means the
yearlyrental rate mentioned in schedule 3 for the
particular year the licenceis in force from
the day of its grant.(2)The yearly
rental rate payable under a mineral development licencefor
each hectare of land covered by the licence for the particular year
of thelicence is—(a)for
the first 1 000 ha—100% of the yearly rental rate; and(b)for the next 1 000 ha—40% of the
yearly rental rate; and(c)for the next 3
000 ha—25% of the yearly rental rate; and(d)for
the next 10 000 ha—5% of the yearly rental rate; and(e)for each additional hectare—1% of the
yearly rental rate.PART 7—MINING LEASES35Conditions of mining leaseFor
the purposes of section 276 of the Act the prescribed conditions of
amining lease are that the holder of the
mining lease and all persons actingunder the
authority of the lease—(a)aretotakeeveryprecautiontoensurethereisnodispersalofpartheniumweedseedortheseedofanyotherdeclaredplantwithin the
meaning of theRural Lands Protection Act 1985as
aresult of mining activities or as a result
of access to the area ofthe mining lease; and(b)are to restrain animals in the custody
of that person unless thearea of the lease is fenced in such a
manner as to contain thoseanimals; and(c)are
not to discharge a firearm on occupied land unless the holderhas
obtained the written consent of the owner and that consenthas

applications(1)The mining registrar may give to a
person a copy of a mining leaseapplication.(2)However, the mining registrar must not give
the person a copy of anystatement detailing the financial and
technical resources that accompaniedthe
application.38Request for registration of
execution(1)A request for registration of an
execution of an interest of a holder ofa mining lease is
to be made to the mining registrar in the approved formand
is to be accompanied by—(a)an office copy or
a certified copy of the execution evidencing theauthority to
seize and sell the interest; and(b)the
prescribed fee.(2)The assignment of the interest
executed by the person appointed tomake the seizure
is to be in the approved form and is to be accompanied bythe
prescribed assignment fee.39Excavations near
