s1 3 s2 Fire and Rescue Authority Regulation 1990 FIRE AND RESCUE AUTHORITY REGULATION 1990 [as amended by all amendments that commenced on or before 14 July 2000] ˙ Short title 1. This regulation may be cited as the Fire and Rescue Authority Regulation 1990 . ˙ Definitions 2. In this regulation— “community protection centre” includes ambulance centre, fire station, State Emergency Service headquarters, Air Sea Rescue station and Coast Guard centre. “level” , of a building, includes any basement or mezzanine level of the building. “licensed” , in relation to premises that are used other than as an oil or fuel depot, means premises for which a licence has been issued under the Liquor Act 1992 to sell liquor. “lot” means a lot included in a community titles scheme under the Body Corporate and Community Management Act 1997 . “outdoor storage area” includes an area used as a builder’s or contractor’s yard, a garden materials storage centre, a fenced area for parking or storage (other than for retail sale) of heavy equipment, materials, motor vehicles and boats. “premises” includes— (a) land; and (b) a building or structure in or on land; in a local government area but does not include— (c) a hotel; or
s3 4 s7 Fire and Rescue Authority Regulation 1990 (d) a motel; or (e) an office; or (f) a shop; or (g) a commercial recreation premises. “students” includes full-time and part-time students (other than external students). “tavern” means a premises in relation to which a general licence has been issued under the Liquor Act 1992 . ˙ Repeals 3.(1) The Fire Brigades (Financial Arrangements) Regulation 1970 and the Rural Fires Regulation 1987 are repealed. (2) Each regulation made— (a) under the Fire Brigades Act 1964 and amending the Fire Brigades (Financial Arrangements) Regulation 1970 ; (b) under the Rural Fires Act 1946 and amending the Rural Fires Regulation 1977 ; is repealed. ˙ Prescribed forms 4.(1) The forms to be used for the purposes of the Act are the forms approved by the commissioner. (2) A person may request the commissioner to give the person a document setting out a form approved under subsection (1). (3) The commissioner must comply promptly with a request under subsection (2). ˙ Administration fee—Act, s 117(4) 7. For section 117(4) of the Act, the administration fee for a financial year, to which a component local government is entitled, is to be calculated as follows—
s 10 5 s 11 Fire and Rescue Authority Regulation 1990 (a) if the number of prescribed properties for which it gives fire levy notices for the financial year is not more than 40 000—the amount worked out by multiplying the number of properties by $2.92; (b) if the number of prescribed properties for which it gives fire levy notices for the financial year is more than 40 000—the amount worked out using the following formula— $116 800 + (N - 40 000) x $2.45 where— “N” means the number of prescribed properties. ˙ Constitution of urban districts—Act, s 106 10.(1) A portion of the State shown on an urban district map is— (a) constituted an urban district for the purposes of the Act; and (b) assigned the name specified on the map. 1 (2) In this section— “urban district map” means a map mentioned in section 106(2) of the Act. ˙ Annual contributions of owners of prescribed properties—Act, s 108 11.(1) Each urban district mentioned in schedule 1 is assigned to the fire levy class opposite it in the schedule. (2) Each category of property mentioned in the 1st column of schedule 2 is assigned to the fire levy group specified. (3) The amount of the contribution to be paid by the owner of a prescribed property, for a financial year, is the amount specified in schedule 2 according to— (a) the fire levy group to which the category of property is assigned; 1 A copy of an urban district map may be inspected free of charge, during office hours, at the head office of the Queensland Fire Service and at other places the commissioner considers appropriate.

(4) If a category of property is assigned to more than 1 fire levy group, the contribution to be paid is the higher or highest of the contributions payable for the groups to which the category is assigned. ˙ Property not to be prescribed property—Act, s 105 11A. For section 105 of the Act, premises vested in the Queensland Housing Commission are prescribed not to be prescribed property if the premises are— (a) vacant land; or (b) a dwelling, including a single unit residence, a multi-unit residence or a lot used for residential purposes. ˙ Annual returns by component local governments—Act, s 109 12. For section 109 of the Act, the particulars prescribed are the number of properties in each fire levy class for each category of property in a fire levy group. ˙ Discount for pensioners—Act, s 110 13.(1) A pension payable under a law of the Commonwealth is declared to be a pension for section 110 of the Act. (2) For section 110(2) of the Act, it is declared that a pensioner, who is the owner of a prescribed property that is the principal place of residence of the pensioner, is to be granted a discount of 20% on the contributions payable under part 10 of the Act for the property. ˙ Payments by component local governments to authority—Act, s 118 14. For section 118 of the Act, the following are declared periods— (a) for a component local government mentioned in schedule 3—
s 15 7 s 15 Fire and Rescue Authority Regulation 1990 1 July to 31 October 1 November to 31 December 1 January to 31 March 1 April to 31 May 1 June to 30 June; (b) for a component local government mentioned in schedule 4— 1 July to 31 October 1 November to 31 March 1 April to 30 June. ˙ Repeal 15. The order in council made under the Act on 30 May 1991 and published in the gazette on 1 June 1991 at page 540–2 is repealed.
