under the Act are stated in schedule 1.6AReduced application fee for commercial tour
operatorpermits if equivalent fee paid under another
Act(1)This section applies to an application
for a commercial touroperator permit (aRAM
application) if—(a)the
commercial activity for which the permit is sought isto be
conducted in a recreation area and 1 or more of thefollowing—(i)aforestreservethatwas,immediatelybeforeitsdedication as a forest reserve, a
State forest undertheForestry Act 1959;(ii)a protected area under theNature Conservation Act1992;(iii)a State forest
under theForestry Act 1959; and(b)theapplicanthasalsomadeanapplicationforanauthority (however called) for
conducting the activity intheforestreserve,protectedareaorStateforest(arelated application); and(c)the chief executive is satisfied the
RAM application andrelated application can be considered
together.Example—A
person applies for a commercial tour operator permit for conducting
acommercial tour that is to be conducted in
the Fraser Island RecreationArea and the
Cooloola section of the Great Sandy National Park.The
day before the application was made, the person applied, under
theNatureConservationAct1992, for a commercial activity permit
forconducting the tour in the Cooloola section
of the Great Sandy NationalPark and the chief executive has not
started considering that applicationunder that
Act.(2)The chief executive may waive all or
part of the applicationfee payable under schedule 1 for the
RAM application.

subsection (2) only applies if the holder has paid anapplication fee (however called) for the
related application.(4)Also, if the application fee payable
for the RAM application ishigher than the application fee paid
for the related application,the chief
executive can only waive an amount equivalent to theapplication fee paid for the related
application.6BReduced permit fee for commercial tour
operator permitsif equivalent fee paid under another
Act(1)This section applies if—(a)the chief executive waives all or part
of the applicationfeepayableforanapplicationforacommercialtouroperator permit under section 6A; and(b)the holder of the permit has paid a
permit fee (howevercalled) for the authority mentioned in
section 6A(1)(b)(theequivalent
authority).(2)The chief
executive must also waive—(a)if the permit fee
paid for the equivalent authority is thesame or higher
than the permit fee stated in schedule 1for the
commercial tour operator permit—the permit feefor the
commercial tour operator permit; or(b)ifthepermitfeepaidfortheequivalentauthorityislowerthanthepermitfeestatedinschedule1forthecommercialtouroperatorpermit—theamountofthepermitfee,forthecommercialtouroperatorpermit,equivalenttothepermitfeepaidfortheequivalentauthority.6CReduced daily tour fee for commercial
tour operatorpermits if equivalent fee paid under another
Act(1)This section applies if—(a)theholderofacommercialtouroperatorpermitotherthanforfilmingorphotographyconductsthecommercial activity authorised under
the permit in therecreationareatowhichthepermitappliesand1ormore
of the following—

State forest undertheForestry Act 1959;(ii)a protected area under theNature Conservation Act1992;(iii)a State forest
under theForestry Act 1959; and(b)theactivityisconductedforthesameclientsintherecreation area
and the forest reserve, protected area orState forest
under an equivalent permit (however called);and(c)theholderhaspaidadailyfee(howevercalled)forconducting the activity under the
equivalent permit.(2)The daily tour fee payable under the
Act for conducting theactivityunderthecommercialtouroperatorpermitistheamount worked out
by deducting the amount of the daily feepaid for
conducting the activity under the equivalent permitfrom
the daily tour fee stated in schedule 1 for the commercialtour
operator permit.(3)Toremoveanydoubt,itisdeclaredthatadeductionundersubsection (2) may result in the daily tour
fee payable underthe Act being nil.Example—The holder of a commercial tour
operator permit conducts a commercialtour lasting more
than 3 hours for 10 clients in Bribie Island RecreationArea
and Glasshouse Mountains National Park and the holder has paid
adailyfeeof$25.50($2.55foreachclient)undertheNatureConservationAct1992forconducting the
tour in the nationalparkunder a commercial activity permit
under that Act.TheadditionaldailyfeepayableundertheActforconductingthecommercialtourintherecreationareaunderthecommercialtouroperator permit is nil, being the additional
daily fee stated in schedule 1for conducting
the tour ($2.55 for each client) reduced by $25.50, beingthedailyfeepaidundertheNatureConservationAct1992forconducting the
tour in Glasshouse Mountains National Park under acommercial activity permit under that
Act.(4)In this section—dailyfeedoesnotincludeafeepayableforcampingovernight.

board7Meetings of the boardThe
board may meet as often as is necessary to discharge itsfunctions under the Act.8Duties of secretaryThesecretaryshallrecordandkeeptheminutesofeverymeetingoftheboard,
issuenoticesforeachmeetingoftheboard and attend to correspondence of
the board.Part 3Permits,
approvals and otherauthoritiesDivision 1Permits9Application of div 1(1)This
division applies to a person if, under section 274of theAct, the board
grants 1 of the following kinds of permits to theperson—•a
camping permit•a commercial tour operator
permit•a temporary commercial tour operator
permit•a service permit.(2)However, only sections 12 to 15 apply to the
Inskip Peninsularecreation area.4Section 27 (Power of board to grant permits)

permits(1)Thissectionappliestoaservicepermitholder(theholder)when
the holder’s vehicle (thevehicle) is in a
recreation areaunder the permit.(2)Theholdermustattachthepermittotheleftsideofthevehicle’swindscreenor,ifthevehicledoesnothaveawindscreen, another prominent position
on the vehicle.Maximum penalty—20 penalty units.(3)The holder must always ensure the
permit is attached to thevehicle when it is in a recreation
area under the permit.Maximum penalty—20 penalty
units.(4)This section does not apply to an
aircraft.12Passengers carried by commercial tour
operatorA person who enters or traverses a
recreation area as part of atouroperatedbyacommercialtouroperatorunderacommercialtouroperatorpermitortemporarycommercialtour
operator permit shall for the purposes of this regulationbe
deemed to have been issued with a service permit.13Permit to camp(1)The
holder of a permit to camp shall attach or affix the permittotheperson’scampingstructuresoastobeclearlyandreadily visible at all times to an
authorised officer.Maximum penalty—20 penalty units.(2)A person who is the holder of a permit
to camp may, exceptwhereanendorsementonthepermitrestrictscampingtoaparticular site, camp—(a)on any part of a beach; or(b)in a developed camping area; or(c)in any part of a recreation area that
is designated as acamping area.

as part of a tour authorised under acommercial tour
operator permitApersonwhocampsinarecreationareaaspartofatouroperated by a
commercial tour operator under a commercialtour operator
permit or temporary commercial tour operatorpermit shall for
the purposes of this regulation be deemed tohave been issued
with a permit to camp.20Fresh permit
etc.Whereapermitoranidentifyingwindscreenlabelissuedunderthisregulationislost,mislaidorinadvertentlydestroyed the
holder of the permit or the label may apply tothe board in the
specified manner accompanied by the fee setforth in schedule
1, for a fresh permit or label and the board, ifit
sees fit, may thereupon issue a fresh permit or fresh label.21Record of persons carried etc.(1)The holder of a commercial tour
operator permit shall, withrespect to each tour authorised under
the permit, keep or causetobekeptinthespecifiedmanner,adailyrecordofthenumber of persons
conducted on the tour and the number ofpersons who will
camp in a recreation area as part of the tour.Maximum
penalty—20 penalty units.(2)The record shall
be completed prior to the commencement ofthe tour and it
shall be available at any time during the tour oratanyreasonabletimethereafterforinspectionbyanauthorised officer.Maximum penalty—20 penalty units.(3)The holder of a commercial tour
operator permit may apply totheboardforapprovalofamannerforthekeepingoftherecord required to be kept under
subsection (1).(4)The approval may be revoked or
cancelled at any time by theboardandnoticeoftherevocationorcancellationshallbegiven in writing by the board to the
holder of a commercialtour operator permit.(5)Everyholderofacommercialtouroperatorpermitshallwithin 35 days of
the end of the month during which a tour

the board the original ofthe record in the specified manner, of
the number of personsconducted on the tour and the number
of persons who campedin a recreation area as part of the
tour, accompanied by thefees set forth in schedule 1.Maximum penalty—20 penalty units.(6)Notwithstandingsubsection(5)wherethecommercialtouroperatoristheholderofatemporarycommercialtouroperator permit, the operator shall
prior to the commencementof the tour complete in the specified
manner a daily record ofthenumberofpersonstobeconductedonthetourandthenumber of persons who will camp in a
recreation area as partof the tour in accordance with the
itinerary and the operatorshallpriortothecommencementofthetourforwardthecompletedrecordtotheboardaccompaniedbythefeessetforth
in schedule 1.Maximum penalty—20 penalty units.(7)Acommercialtouroperatorpermitholdermustnotfailtolodge
a record or return, unless the person has a reasonableexcuse.Maximum
penalty—20 penalty units.(8)Acommercialtouroperatorpermitholdermustnotstateanythinginarecordorreturnthepersonknowsisfalseormisleading in a material particular.Maximum penalty—20 penalty units.(9)It is enough for a complaint for an
offence against subsection(8) to state that the record or return
was false, misleading orincomplete to the operator’s
knowledge.22Assignment or transfer of commercial
tour operatorpermit(1)A
commercial tour operator permit shall not be assigned ortransferredinwholeorinpart,exceptwiththeconsentinwriting of the board.(2)An application for the assignment or
transfer of a commercialtouroperatorpermitshallbemadetotheboardinthe

fee set forth in schedule1.(3)Anassignmentoratransferofacommercialtouroperatorpermitshallhavenoforceoreffectwhatsoeverunlessanduntil
the assignment or transfer is first approved by the board.Division 2Approvals and
other authorities22AExpiry of particular vehicle approvals
andexemption authorities(1)Thissectionappliestoavehicleapprovalorvehicleexemptionauthorityinforceimmediatelybeforethecommencement of this section
if—(a)theapprovalorauthoritydoesnotspecifyadayonwhich the
approval or authority expires; or(b)theboardhasgiventheholderoftheapprovalorauthority written notice that—(i)statestheapprovalorauthorityremainsinforce;and(ii)doesnotspecifyadayonwhichtheapprovalorauthority expires.(2)The
vehicle approval or vehicle exemption authority expires12
months after the commencement of this section.(3)In
this section—vehicleapprovalmeanswrittenapprovaloftheboardforaperson to enter or traverse a
recreation area in a vehicle.vehicle
exemption authoritymeans a certificate of exemption,exemptionauthority,exemptionlabel,approvaloranauthority, however called—(a)issued or granted under the Act, or
taken, under repealedsection68oftheAct,tohavebeenissuedorgrantedunder the Act;
and(b)under which a person is exempted from
a requirementunder the Act to have a permit or written
approval forentering or traversing a recreation area in
a vehicle.
