title1.ThisregulationmaybecitedastheEducation(SeniorSecondarySchool Studies)
Regulation 1989.˙Definitions2.In this regulation—“assessing school”means a school
at which senior secondary education isofferedandthestudentsareassessedforeitherorbothofthefollowing—(a)board subjects under procedures decided by
the board;(b)boardregisteredsubjectsforwhichworkprogramshavebeenapproved by the
board.“completion”, of year 12 by
a full-time student, means the student attendsschool in year
12 until and including—(a)if the first
Monday of the December student vacation in the yearis
not more than 9 days before Christmas day—the Friday of thefifth last week before the vacation starts;
or(b)if the first Monday of the December
student vacation is more than9 days before
Christmas day—the Friday of the fourth last weekbefore the vacation starts.“December student vacation”, in
a year, means the student vacation to beobserved in a
State school starting in December in the year, but notincludinganadditionalholiday,undertheEducation(General

achievement”,foraboardsubject,boardregisteredsubjectorstrand of a board registered subject,
means any of the following—•very
high achievement•high achievement•sound achievement•limited achievement•very
limited achievement.“principal”means the person
in charge of a school.“Vocational Education, Training and
Employment Commission”seeVocational
Education, Training and Employment Act 1991, section
6.†PART 3—AWARD OF CERTIFICATES,EXAMINATIONS, ACHIEVEMENT LIST˙Principal of assessing school to give
assessment results to board4.(1)The principal of
an assessing school must give the board the resultsof
assessments of the school’s students for—(a)board subjects if the assessments were made
under procedures1TheEducation(GeneralProvisions)Regulation1989,section17providesasfollows—‘Student vacations‘17.StudentvacationstobeobservedinaStateschoolshallbethosedaysasapprovedfromtimetotimebytheMinisterandpublishedoncalendarsintheEducation Office gazette.’.TheEducation(GeneralProvisions)Regulation1989,section18(b)providesforadditionalholidaysthatmustbeobservedinStateschoolsincluding‘holidaysgrantedbytheGovernor-General,theGovernor,thePremier,theMinisterforEducation, and other Ministers’.

board; and(b)board registered subjects if the work
programs were approved bythe board; and(c)recorded subjects.(2)The
results must be given to the board at the time, and in the
way,decided by the board.˙Senior
certificates to be awarded to students completing year 12 infull-time schooling5.(1)Theboardmustawardaseniorcertificatetoastudentwhocompletes year 12 in full-time schooling at
an assessing school.(2)However, the board must not award a
senior certificate to a student ifthe principal of
the assessing school attended by the student advises theboard
the student’s attendance has been insufficient to allow the student
tosubstantially cover the subjects enrolled
for, and to be assessed adequatelyon the subjects,
unless the board—(a)reviews the principal’s advice;
and(b)issatisfiedthestudenthassubstantiallycoveredthesubjectsenrolled for and
has been adequately assessed.(3)The
senior certificate must be based on the following
assessmentsgiven to the board under section 4—(a)for a board subject or board
registered subject—assessments ofthestudentbytheassessingschoolatwhichthestudentcompletes year
12;(b)for a recorded subject—assessments of
the student by the schoolthroughwhichthestudentundertakestheschoolingortheeducational institution responsible
for assessment of the subject.(4)For
each board subject or board registered subject, the certificate
muststate—(a)the
number of semester units studied by the student in years 11and
12; and(b)ifthesubjecthasvocationaleducationcomponents—the

and(c)the level of achievement reached by
the student in the subject; and(d)for
each board registered subject in which separate strands of
thesubjectareassessed—thelevelofachievementreachedbythestudent in each
strand.(5)For each recorded subject, the
certificate must state—(a)the name of the
subject; and(b)information about the assessment of
the student for the subject bytherelevantschoolorinstitution,thattheboarddecidesisnecessary.˙Senior
certificates may be awarded to students completing year 12other
than in full-time schooling6.(1)Theboardmayawardaseniorcertificatetoastudentwhocompletes senior secondary education other
than by full-time schooling.(2)Thecertificatemustbebasedonassessmentsbyeducationalinstitutions—(a)that
assess students for board subjects under procedures decidedby
the board; and(b)through which the student undertakes
the schooling.(3)For each board subject or board
registered subject, the certificate muststate—(a)the number of semester units studied
by the student; and(b)ifthesubjecthasvocationaleducationcomponents—thecomponents;
and(c)the level of achievement reached by
the student in the subject; and(d)for
each board registered subject in which separate strands of
thesubjectareassessed—thelevelofachievementreachedbythestudent in each
strand.(4)For each recorded subject, the
certificate must state—

name of the subject; and(b)information
about the assessment of the student for the subject bytherelevantschoolorinstitution,thattheboarddecidesisnecessary.˙Senior
certificates to be awarded to certain students completingexternal senior examinations7.(1)The board must
make an external examination available each yearfor
the following—(a)studentsundertakingseniorsecondaryeducationotherthanbyfull-time schooling;(b)studentsundertakingseniorsecondaryeducationbyfull-timeschoolingiftheboardissatisfiedthestudentmay,underaby-law,2be a
candidate for the examination.(2)The
board must award senior certificates to the students based
ontheir results in the examination.(3)Thecertificatemuststatethelevelofachievementreachedbyastudent in each
subject for which the student has been examined.˙Order of overall achievement
list8.(1)Theboardshallcompile,andmakeavailablefortheuseofappropriate authorities, an indicator
of comparative overall achievement ofstudents in board
subjects.(1A)The indicator
shall be determined in the manner specified from timeto
time by the board.2TheEducation(SeniorSecondarySchoolStudies)By-law1989,section5(1)provides that a student undertaking year 12
studies by full-time schooling may bea candidate at
the appropriate examination if the board is satisfied as
follows—‘(a)the student has transferred from 1
school to another and is unable at theother school to
complete previously commenced studies in any 1 or moresubjects; or(b)the
student for good and sufficient reason is unable to undertake the
studyof any 1 or more subjects at that
school.’.

subject to such conditions (if any) asit thinks fit and
subject to the payment of the prescribed fee.(3)For
the purposes of this regulation,“appropriate
authorities”shallincludetertiaryinstitutionsandtertiaryadmissionscentres,whetherinQueensland or elsewhere.†PART
4—MEMBERSHIP OF MODERATION ANDSUBJECT ADVISORY
COMMITTEES˙Moderation committee9.(1)The moderation
committee appointed in accordance with section 34of
the Act shall consist of the director of the board, the
chairpersons of 5State review panels (which 5 panels shall be
selected as representative of therange of subjects
or groups of subjects studied in Queensland secondaryschools)2chairpersonsofsubjectadvisorycommitteesandsuchotherpersons as are considered necessary by the
board.(2)Unlessotherwisedeterminedbytheboard,thedirectorshall,onappointment, be designated and shall be
chairperson of the committee.˙Subject advisory committee10.(1)A subject
advisory committee shall be appointed for each subjector
for each group of subjects in accordance with section 36 of the
Act.(2)Each committee shall consist
of—(a)1 nominee of the board who shall, on
appointment, be designatedand shall be chairperson; and(b)the chairperson of the State review
panel for the subject or one ofthe groups of
subjects as the case may be; and(c)6nomineesallofwhomshallbeleadingpractitionersoftherespectivesubjectorgroupsofsubjectsasthecasemaybe,

Secondary School Studies)Regulation 1989selectedfrompractisingteachersinQueenslandsecondaryschools, 4 of whom shall be nominated by the
chief executivefrom teachers in State secondary schools,
and the remaining 2shallbeapprovedbytheboardfromteachersinnon-Statesecondary
schools selected from persons whose names have beensubmitted to the board by non-State school
organisations; and(d)1personnominatedundersubsection(3)who,atthetimeofappointment, is a parent of—(i)astudentattendingyear11or12ataStateeducationalinstitution or
other school in Queensland; or(ii)apersonexpectedtoattendyear11or12ataStateeducational institution or other school in
Queensland duringthe term of appointment; or(iii)a person who
attended year 11 or 12 at a State educationalinstitution or
other school in Queensland and whose last dayof attendance
was not earlier than 2 years before the day ofappointment;
and(e)4representativesofinstitutionsofhighereducationtobenominated by the
Higher Education Forum; and(f)1personwhoisanofficerofthedepartmentinvolvedincurriculum research or development to
be nominated by the chiefexecutive; and(g)1nomineeofthelearnedsocietyorassociationofpersonsrecognisedbytheboardashavingexpertiseinthesubjectorgroupsofsubjectsforwhichasubjectadvisorycommitteeisappointed and whose nomination is approved
by the board;and(h)1 person nominated by an industry
association recognised by theboard as having
expertise in the subject or group of subjects forwhichthecommitteeisappointedandwhosenominationisapproved by the board; and(i)other persons appointed by the board
because the board considersthe persons have
expertise in the subject or group of subjects forwhich the committee is appointed or would
otherwise contributeto the committee’s work.

committees—(a)QueenslandCouncilofParentsandCitizens’AssociationsIncorporated;(b)FederationofParentsandFriendsAssociationsofCatholicSchools,
Queensland;(c)Independent Parents and Friends
Council of Queensland.(4)The meeting may
be by telephone, closed circuit television or anotherform
of communication.(5)Also,beforetheboardrecognisesanindustryassociationasmentioned in subsection (2)(h), the board
must consult with the VocationalEducation,
Training and Employment Commission.†PART
5—ADMINISTRATIVE PROVISIONSRELATING TO THE
BOARD AND COMMITTEES˙Quorum of the
board11.For the purpose of section 19 of the
Act, a quorum of members ofthe board
required to constitute a meeting of the board shall be one-half,
orifone-halfisnotawholenumber,thewholenumbernexthigherthanone-half of the
total number of members for the time being of the board.˙Quorum at committee meetings12.Thenumberofmembersofamoderationcommitteeorasubjectadvisorycommitteerequiredtoconstituteaquorumatameetingofthecommittee shall be one-half, or if
one-half is not a whole number, the wholenumber next
higher than one-half of the total number of members for thetime
being of the committee.

of appointment of committee members13.(1)Thetermofappointmentofmembersofthemoderationcommittee shall
be 4 years.(2)Thetermofappointmentofmembersofasubjectadvisorycommittee shall be 4 years.(3)However, the instrument appointing a
member of a subject advisorycommittee may
provide the member is appointed for a stated period of lessthan
4 years.˙Casual vacancies on committees14.(1)The board may,
upon the occurrence of a casual vacancy in themembership of the
moderation committee or a subject advisory committeeappoint a person to fill the vacancy.(2)However, the person appointed shall
have qualifications similar tothose of the
person’s predecessor and shall be appointed for the balance
ofthe term for which the person’s predecessor
was appointed.˙Manner of exercising power of a
committee15.(1)The moderation
committee and a subject advisory committee shallexercise a power or authority or perform a
duty or function by majority voteof their
respective members present and voting at the meeting at which
suchexercise or performance is to occur.(2)A member who abstains from voting
shall be deemed to have votedfor the
negative.(3)The chairperson of the moderation
committee or a subject advisorycommittee shall
have a deliberative vote and, in the event of an equality ofvotes, a casting vote.
