s1 3 s8 Dental By-law 1988 DENTAL BY-LAW 1988 [as amended by all amendments that commenced on or before 1 January 2002] PART 1—PRELIMINARY 1 Short title This by-law may be cited as the Dental By-law 1988 . 2 Commencement This by-law shall commence on 1 July 1988. 4 Definitions In this by-law— “annual fee” means annual licence fee or additional annual licence fee. “association” means an unincorporated association of persons. PART 2—THE BOARD 7 Notice of meetings of board The registrar shall give 7 days notice in writing to each member of the board, setting forth the place, date and time of each meeting and the business thereof. 8 Order of business of board meetings (1) The order of business at a meeting of the board shall be as follows—
s 9 4 s 11 Dental By-law 1988 (a) reading of minutes of meeting, convened for the purposes of this section, next preceding; (b) confirmation or otherwise of the minutes; (c) business arising out of minutes; (d) outward correspondence and consideration of inward correspondence; (e) financial matters; (f) restorations— (i) dentists; (ii) dental specialists; (g) registrations— (i) dentists; (ii) additional qualifications; (iii) dental specialists; (h) general business. 9 Special meetings of board (1) At the direction of the president or on the requisition, in writing of any 3 members, the registrar shall convene a special meeting of the board. (2) At such special meeting only the business stated in the direction or requisition shall be discussed. 10 Common seal of board The common seal of the board shall remain in the custody of the registrar and shall be affixed by the registrar to certificates of registration and such other documents as the board may direct. 11 Board’s funds (1) An amount payable to the board must be given to the registrar. (2) The registrar must—
s 12 5 s 12 Dental By-law 1988 (a) deposit the amount in an account kept by the board in accordance with the Statutory Bodies Financial Arrangements Act 1982 , section 31; 1 and (b) keep a record of all amounts deposited in, and payments made from, the account; and (c) for each board meeting, prepare a statement of all amounts received, and payments made, by the board during the statement period. (3) A payment may be made from the account only— (a) by a cheque signed by the registrar and a board member authorised by the board to sign cheques; or (b) in another way authorised by the board. (4) In this section— “statement period” , for a statement for a board meeting, means the period decided by the board at the previous board meeting. 12 Honorary treasurer (1) The board may appoint 1 of its members as the board’s honorary treasurer. (2) If an honorary treasurer is appointed, the honorary treasurer must— (a) at each board meeting, present the statement prepared by the registrar under section 11(2)(c); and (b) ensure the statement is reconciled with the statements for accounts kept by the board with a financial institution. 1 Statutory Bodies Financial Arrangements Act 1982 , section 31 (General banking powers for day-to-day operations)
s 13 6 s 15A Dental By-law 1988 PART 3—REGISTRATION 13 Register of dentists For the purposes of section 17(1)(a) of the Act, the prescribed particulars of dentists to be recorded in the register of dentists shall be as follows— (a) number of certificate of registration; (b) business address; (c) date of registration; (d) qualifications. 14 Register of dental specialists For the purposes of section 17(1)(b) of the Act, the prescribed particulars of dental specialists to be recorded in the register of dental specialists shall be as follows— (a) number of certificate of registration; (b) business address; (c) date of registration; (d) qualification by virtue of which registration is granted; (e) dental specialty. 15 Prescribed qualifications (1) For the purposes of section 18(1)(b) of the Act, the prescribed qualifications for registration as a dentist shall be the qualifications set out in schedule 1. (2) For the purposes of section 18(3)(a) of the Act, the prescribed qualifications for registration as a dental specialist shall be the qualifications set out in schedule 2. 15A Dental specialties For section 18(8) of the Act, the following are dental specialties:— dental public health
s 16 7 Dental By-law 1988 dento-maxillofacial radiology endodontics oral and maxillofacial surgery oral pathology orthodontics pedodontics periodontics prosthodontics. s 16 PART 4—ADVERTISING 16 Advertising (1) A dentist or dental specialist must not advertise himself or herself as qualified to practise dentistry, or the place where the practice takes place, unless the advertisement identifies the dentist or dental specialist by name. Maximum penalty—5 penalty units. (2) A dentist or dental specialist must not advertise himself or herself as qualified to practise dentistry, or the place where the practice takes place, if the advertisement— (a) is false, misleading or deceptive or likely to be misleading or deceptive; or (b) promotes the unnecessary, inappropriate or harmful use of dental services; or (c) is disparaging of other dentists or dental specialists, or of dental companies; or (d) states the dentist or dental specialist has any qualifications other than the qualifications recorded for the dentist or dental specialist on the register. Maximum penalty—5 penalty units.
s 16 8 s 16 Dental By-law 1988 (3) A dental company must not advertise itself as qualified to engage in dentistry, or the place where the practice takes place, unless the advertisement identifies the dental company by name. Maximum penalty—5 penalty units. (4) A dental company must not advertise itself as qualified to engage in dentistry, or the place where the practice takes place, if the advertisement— (a) is false, misleading or deceptive or likely to be misleading or deceptive; or (b) promotes the unnecessary, inappropriate or harmful use of dental services; or (c) is disparaging of other dental companies, or of dentists or dental specialists; or (d) states the dentists or dental specialists carrying out work for the dental company have any qualifications other than the qualifications recorded for the dentists or dental specialists on the register. Maximum penalty—5 penalty units. (5) An application for an approved name shall— (a) be made in the approved form; and (b) be accompanied by the prescribed fee. (6) If the board is of the opinion that— (a) any dentist or dental specialist is advertising himself or herself as qualified to practise dentistry or the place where the practice takes place in any manner or by any method contrary to this section; or (b) any dental company that provides dental services or the place where the practice takes place is being advertised in any manner or by any method contrary to this section; the board may give to the dentist, dental specialist, members of the partnership or association or secretary and directors of the dental company directions in writing to remove, alter, amend, or discontinue the advertisement in question and specify a time within which the dentist, dental specialist, members of the partnership or association or secretary or directors of the dental company shall comply.
s 17 9 s 19 Dental By-law 1988 (7) Despite subsections (2)(d) and (4)(d), the courtesy title ‘doctor’ may be used— (a) by a registered dentist, provided it is followed by the words ‘dentist’, ‘dental surgeon’ or ‘dental practitioner’; or (b) by a dental specialist, provided it is followed by the prescribed designation of the dental specialist’s specialty; or (c) by a dentist employed within the public dental services, in the dentist’s title, provided the title includes the word ‘dentist’ or ‘dental officer’. PART 5—MISCELLANEOUS 17 Duties of members and directors It shall be the duty of the secretary and directors of a dental company, to ensure that the provisions of this by-law with respect to that company are complied with or, as the case may be, are not contravened. 19 Breaches and penalties (1) A person who contravenes or fails to comply with any provision of this by-law commits a breach of this by-law. (2) A person who— (a) fails to do that which the person is directed to do; or (b) does that which the person is forbidden to do; by the board or a person acting under the authority of this by-law commits a breach of this by-law. (3) A person who, in a form or application required by or for the purposes of this by-law or lodged with or submitted to the board, makes or authorises the making of a statement that to the person’s knowledge is false or misleading in a material particular, or omits or authorises the omission of any matter or thing without which the form or application is to the person’s knowledge misleading in a material respect, commits a breach of this by-law.
s 25 10 s 27 Dental By-law 1988 (4) A person who commits a breach of this by-law is liable to a maximum penalty of 4 penalty units. PART 7—FEES 25 Fees The fees payable under the Act are in schedule 3. 26 When annual fees must be paid (1) A person who applies to be registered as a dentist or dental specialist in a year must pay the annual fee for the year with the registration fee. (2) If a person is registered as a dentist or dental specialist on or after 15 November in a year, the annual fee for the following year is waived. (3) A person who is already registered as a dentist or dental specialist on 15 November in a year (the “current year” ) must pay the annual fee for the following year on or before 31 December in the current year. 27 Fees for unsuccessful application to be refunded If an application under section 18(1) or (3) of the Act is refused, the board must repay to the applicant— (a) the fee paid by the applicant for registration; and (b) the annual licence fee paid by the applicant for the application.

(University of Adelaide); (b) B.S.Sc. (University of Melbourne); (c) B.D.S. (University of Sydney); (d) B.D.Sc. (University of Western Australia). 2. Qualifications awarded by universities in New Zealand— (a) B.D.S. (University of New Zealand); (b) B.D.S. (University of Otago). 3. Qualifications awarded by universities in the United Kingdom and the Republic of Ireland— (a) B.D.S. (University of Belfast); (b) B.D.S. (University of Birmingham); (c) B.D.S. (University of Bristol); (d) B.D.S. (University of Dundee); (e) B.D.S. (University of Durham); (f) B.D.S. (University of Edinburgh); (g) B.D.S. (University of Glasgow); (h) B.D.S. (National University of Ireland); (i) B.D.S. (University of Liverpool); (j) B.D.S. (University of London); (k) B.D.S. (University of Manchester); (l) B.D.S. (University of Newcastle upon Tyne);

13 Dental By-law 1988 SCHEDULE 2 QUALIFICATIONS FOR REGISTRATION AS A DENTAL SPECIALIST section 15(2) Each qualification set out below is to be obtained by course-work extending not less than 2 years of full-time study or an equivalent period of part-time study. Satisfactory documentary evidence of compliance with this condition is required to be produced at the time of application for registration as a dental specialist. 1. Qualifications awarded by universities in Australia— M.D.S. or M.D.Sc. (by course-work) from— (a) University of Adelaide; (b) University of Melbourne; (c) University of Queensland; (d) University of Sydney; (e) University of Western Australia. 2. Qualifications awarded by the Royal Australian College of Dental Surgeons— (a) FRACDSDOS.—FRACDSOMS.; (b) FRACDS D. Pros.—FRACDSPROS; (c) FRACDS D. Endo—FRACDSENDO. 3. Qualifications awarded by the Royal College of Surgeons of England, Edinburgh, Glasgow or Ireland— (a) F.D.S.R.C.S. (England, Edinburgh, Ireland) together with a certificate of accreditation in— (i) oral surgery and oral medicine; (ii) orthodontics;

(Glasgow) together with a certification of accreditation in— (i) oral surgery and oral medicine; (ii) orthodontics; (iii) restorative dentistry; awarded by the Royal College of Physicians and Surgeons; (c) Dip. Orth. R.C.S. (England) together with a certificate of accreditation in orthodontics awarded by the Royal College of Surgeons. 4. Qualifications awarded by the University of Witwatersrand, Johannesburg— (a) M. Dent. (Orthodontics); (b) M. Dent. (Prosthodontics); (c) M. Dent. (Maxillofacial and Oral Surgery); (d) M. Dent. (Periodontics and Oral Medicine); (e) M. Dent. (Oral Pathology); (f) Dip. Ortho.; (g) Dip. Pros.; (h) Dip. MFOS; (i) Dip. POM; (i) Dip. Oral Path. 5. Qualifications awarded by the University of London— M.Sc. (in children’s dentistry, conservative dentistry, prosthetic dentistry, orthodontics, periodontology, oral pathology, or dental public health) involving or followed by at least 2 years continuous full-time specialist training at registrar or equivalent level. 6. Qualifications awarded by the University of Otago, Dunedin—M.D.S. (1976 and subsequent years).

Degrees, diplomas or certificates awarded by institutions accredited by the Council on Dental Education of the American Dental Association to conduct an advanced level programme for the preparation of dental specialists involving at least 2 years full-time training or an equal amount of training on a part-time basis.
