By-law 1988DENTAL BY-LAW 1988[as amended by
all amendments that commenced on or before 1 January 2002]PART
1—PRELIMINARY1Short titleThis by-law may
be cited as theDental By-law 1988.2CommencementThis by-law
shall commence on 1 July 1988.4DefinitionsIn this
by-law—“annual fee”means annual
licence fee or additional annual licence fee.“association”means an
unincorporated association of persons.PART 2—THE
BOARD7Notice of meetings of boardThe
registrar shall give 7 days notice in writing to each member of
theboard,settingforththeplace,dateandtimeofeachmeetingandthebusiness
thereof.8Order of business of board
meetings(1)The order of business at a meeting of
the board shall be as follows—

preceding;(b)confirmation or otherwise of the
minutes;(c)business arising out of
minutes;(d)outwardcorrespondenceandconsiderationofinwardcorrespondence;(e)financial matters;(f)restorations—(i)dentists;(ii)dental specialists;(g)registrations—(i)dentists;(ii)additional qualifications;(iii)dental
specialists;(h)general business.9Special meetings of board(1)At the direction of the president or
on the requisition, in writing ofany 3 members,
the registrar shall convene a special meeting of the board.(2)At such special meeting only the
business stated in the direction orrequisition shall
be discussed.10Common seal of boardThecommonsealoftheboardshallremaininthecustodyoftheregistrar and
shall be affixed by the registrar to certificates of
registrationand such other documents as the board may
direct.11Board’s funds(1)An
amount payable to the board must be given to the registrar.(2)The registrar must—

1988(a)deposit the amount in an account kept
by the board in accordancewiththeStatutoryBodiesFinancialArrangementsAct1982,section 31;1and(b)keep a record of
all amounts deposited in, and payments madefrom, the
account; and(c)foreachboardmeeting,prepareastatementofallamountsreceived, and
payments made, by the board during the statementperiod.(3)A
payment may be made from the account only—(a)byachequesignedbytheregistrarandaboardmemberauthorised by the board to sign cheques;
or(b)in another way authorised by the
board.(4)In this section—“statement
period”, for a statement for a board meeting, means
the perioddecided by the board at the previous board
meeting.12Honorary treasurer(1)Theboardmayappoint1ofitsmembersastheboard’shonorarytreasurer.(2)If an honorary treasurer is appointed,
the honorary treasurer must—(a)ateachboardmeeting,presentthestatementpreparedbytheregistrar under
section 11(2)(c); and(b)ensurethestatementisreconciledwiththestatementsforaccounts kept by the board with a financial

1988PART 3—REGISTRATION13Register of dentistsFor the purposes
of section 17(1)(a) of the Act, the prescribed particularsof
dentists to be recorded in the register of dentists shall be as
follows—(a)number of certificate of
registration;(b)business address;(c)date
of registration;(d)qualifications.14Register of dental specialistsFor
the purposes of section 17(1)(b) of the Act, the prescribed
particularsof dental specialists to be recorded in the
register of dental specialists shallbe as
follows—(a)number of certificate of
registration;(b)business address;(c)date
of registration;(d)qualification by virtue of which
registration is granted;(e)dental
specialty.15Prescribed qualifications(1)Forthepurposesofsection18(1)(b)oftheAct,theprescribedqualifications
for registration as a dentist shall be the qualifications set
outin schedule 1.(2)Forthepurposesofsection18(3)(a)oftheAct,theprescribedqualificationsforregistrationasadentalspecialistshallbethequalifications
set out in schedule 2.15A Dental specialtiesFor
section 18(8) of the Act, the following are dental

dentist or dental specialist must not advertise himself or herself
asqualified to practise dentistry, or the place
where the practice takes place,unless the
advertisement identifies the dentist or dental specialist by
name.Maximum penalty—5 penalty units.(2)A dentist or dental specialist must
not advertise himself or herself asqualified to
practise dentistry, or the place where the practice takes place,
ifthe advertisement—(a)isfalse,misleadingordeceptiveorlikelytobemisleadingordeceptive; or(b)promotes the unnecessary, inappropriate or
harmful use of dentalservices; or(c)is
disparaging of other dentists or dental specialists, or of
dentalcompanies; or(d)states the dentist or dental specialist has
any qualifications otherthan the qualifications recorded for
the dentist or dental specialiston the
register.Maximum penalty—5 penalty units.

itself as qualified to engage indentistry,ortheplacewherethepracticetakesplace,iftheadvertisement—(a)isfalse,misleadingordeceptiveorlikelytobemisleadingordeceptive; or(b)promotes the unnecessary, inappropriate or
harmful use of dentalservices; or(c)is
disparaging of other dental companies, or of dentists or
dentalspecialists; or(d)states the dentists or dental specialists
carrying out work for thedentalcompanyhaveanyqualificationsotherthanthequalifications recorded for the dentists or
dental specialists on theregister.Maximum penalty—5
penalty units.(5)An application for an approved name
shall—(a)be made in the approved form;
and(b)be accompanied by the prescribed
fee.(6)If the board is of the opinion
that—(a)any dentist or dental specialist is
advertising himself or herself asqualifiedtopractisedentistryortheplacewherethepracticetakesplaceinanymannerorbyanymethodcontrarytothissection;
or(b)anydentalcompanythatprovidesdentalservicesortheplacewhere the
practice takes place is being advertised in any manneror
by any method contrary to this section;theboardmaygivetothedentist,dentalspecialist,membersofthepartnership or
association or secretary and directors of the dental companydirectionsinwritingtoremove,alter,amend,ordiscontinuetheadvertisementinquestionandspecifyatimewithinwhichthedentist,dental
specialist, members of the partnership or association or secretary
ordirectors of the dental company shall
comply.

1988(7)Despite subsections (2)(d) and (4)(d),
the courtesy title ‘doctor’ maybe used—(a)byaregistereddentist,provideditisfollowedbythewords‘dentist’,
‘dental surgeon’ or ‘dental practitioner’; or(b)by a
dental specialist, provided it is followed by the prescribeddesignation of the dental specialist’s
specialty; or(c)by a dentist employed within the
public dental services, in thedentist’stitle,providedthetitleincludestheword‘dentist’
or‘dental officer’.PART
5—MISCELLANEOUS17Duties of members and directorsIt
shall be the duty of the secretary and directors of a dental
company, toensure that the provisions of this by-law
with respect to that company arecomplied with or,
as the case may be, are not contravened.19Breaches and penalties(1)A
person who contravenes or fails to comply with any provision
ofthis by-law commits a breach of this
by-law.(2)A person who—(a)fails to do that which the person is
directed to do; or(b)does that which the person is
forbidden to do;by the board or a person acting under the
authority of this by-law commitsa breach of this
by-law.(3)Apersonwho,inaformorapplicationrequiredbyorforthepurposes of this by-law or lodged with
or submitted to the board, makes orauthorises the
making of a statement that to the person’s knowledge is
falseor misleading in a material particular, or
omits or authorises the omissionofanymatterorthingwithoutwhichtheformorapplicationistotheperson’s
knowledge misleading in a material respect, commits a breach
ofthis by-law.

units.PART 7—FEES25FeesThe fees payable
under the Act are in schedule 3.26When
annual fees must be paid(1)A person who
applies to be registered as a dentist or dental specialistin a
year must pay the annual fee for the year with the registration
fee.(2)If a person is registered as a dentist
or dental specialist on or after15 November in a
year, the annual fee for the following year is waived.(3)A person who is already registered as
a dentist or dental specialist on15 November in a
year (the“current year”) must pay the
annual fee forthe following year on or before 31 December
in the current year.27Fees for unsuccessful application to
be refundedIfanapplicationundersection18(1)or(3)ofthe
Actisrefused,theboard
must repay to the applicant—(a)the
fee paid by the applicant for registration; and(b)the
annual licence fee paid by the applicant for the
application.
