1—PRELIMINARY˙Short title1.This
regulation may be cited as theAdoption of
Children Regulation1988.˙Commencement2.This
regulation shall commence on 27 June 1988.˙Interpretation5.In
this regulation—“amendedbirthentry”meansanentryintheregistersreferredtoinparagraphs (a)
and (b) of the definition of “the registers”;“applicant”includes prospective adopter;“infertile”means—(a)aninabilitytoconceiveoraninabilitytocauseawomantoconceive except where such inability is due
to reasons within thecontrol of the person concerned;
or(b)possessing a genetically transmitted
disorder which is likely toplace at risk
the life of or result in the serious impairment of thehealth of a child; or(c)having a condition that there is the
likelihood of a child not beingcarried until it
can proceed in a living state from the body of itsmother; or(d)in
the case of a woman—having a condition which is likely
to

impair the woman’shealth if the woman were to become
pregnant;“the registers”means—(a)the Adopted Children Register;
and(b)the register kept by the
Registrar-General intituled ‘RECORD OFCHILDREN whose
Births have been registered in the State andwho have been
transferred under Deed of Adoption’; and(c)entries relating to adopted persons in the
registers of births keptunder the law of Queensland.˙Forms6.(1)TheprescribedformsforthepurposesoftheActaretheformsapproved by the chief executive.(2)Apersonmayrequestthechiefexecutivetogivethepersonadocument setting out an approved form.(3)The chief executive must promptly
comply with the request.†PART
2—APPLICATIONS, ELIGIBILITY,ASSESSMENT AND
CONSENTS˙Applications7.(1)A
person who seeks to become an adoptive parent and have theperson’s name entered in an appropriate
adoption list shall—(a)make an
application in the approved form; and(b)pay
the application fee specified in Part A of Schedule 2 for
theappropriate adoption list at the time of
making the application; and(c)pay
the assessment fee specified in Part A of Schedule 2 for theappropriateadoptionlistpriortothecommencementoftheassessment pursuant to section 13B of
the Act.
s85s8Adoption of Children Regulation 1988(2)Apersonwhopriortothecommencementofthisregulationhaslodged with the Director an application to be
authorised to adopt a childmadeinaccordancewiththerelevantlawbeforethecommencementofsection 6 of theAdoption of
Children Amendment Act 1983—(a)where the person’s name is included in
the adoption list kept bytheDirectorimmediatelybeforethecommencementofthatsection,otherthanapersonwhosenameistransferredtotheSpecialNeedsChildren’sAdoptionList,shallpaythefeespecifiedinPartBofSchedule2,priortothemakingoftheadoption order;(b)where the person’s name is not included in
the adoption list keptby the Director immediately before the
commencement of thatsection, shall pay the fees specified
in Part C of Schedule 2 for theappropriate
adoption list—(i)inrespectoftheassessmentfee—priortothecommencement of
the assessment pursuant to section 13Bof the Act;
and(ii)inrespectoftheorderfee—priortothemakingoftheadoption
order.(3)TheDirectormay,wheretheDirectorisoftheopinionthatthepayment of the fee specified in Parts A, B or
C of Schedule 2 would causehardship to the
person required to pay such fee, waive, wholly or partly,
thepayment thereof.˙Eligibility8.(1)Subject to section 13A of the Act, a person
shall be ineligible tohave the person’s name entered in an
adoption list unless in respect of theadoptionlistreferredtoincolumn1ofSchedule4thepersonhastheeligibility
specified in column 2 of Schedule 4.(2)Subject to section 13A of the Act, a person
shall be ineligible to havetheperson’snameremaininanadoptionlistunlessinrespectoftheadoption list referred to in column 1
of Schedule 5 the person retains theeligibility
specified in column 2 of Schedule 5.

Schedule 6 shall be matters to beregarded in the
making of an assessment under section 13B of the Act inrespect of persons whose names are entered in
an adoption list referred to incolumn 1 of
Schedule 6.˙Supporting information10.AnapplicanttobecomeanadoptiveparentshalllodgewiththeDirector—(a)such
of the undermentioned as requested by the Director—(i)full birth certificate of
applicant;(ii)deed poll or
other evidence of change of name of applicant;(iii)marriage certificate of applicant;(iv)certificate of
Australian citizenship of applicant;(v)a
certificate of decree nisi that has become absolute;(vi)custody, access
or guardianship order and any other ordersin relation to a
child to be adopted;(vii) medical report;(viii)a specialist medical practitioner’s
report stating the reasonfor infertility;(ix)references; and(b)such
other documentation and particulars to enable the Director
toproperly consider the application.˙Notification of change of
particulars11.A person who has made an application
to become an adoptive parentshall, until an
adoption order has been made or the application is otherwisedisposedof,forthwithadvisetheDirectorofachangeinanyofthecircumstances that might affect the
eligibility of such person.

applications12.(1)An applicant may
withdraw the applicant’s application to becomean adoptive
parent by notice in writing to the Director.(2)Upon
receipt of a notice pursuant to subsection (1), the Director
shallremove the name of the applicant from the
relevant adoption list and notifythe applicant of
such action.˙Removal of names from lists13.(1)For the purposes
of section 13B(8) of the Act, the prescribed timeis 2
years from the date on which an application is lodged with the
Director.(2)Where the Director has reasonable
cause to believe that an applicantdoes not intend
to proceed with an application to become an adoptive parenttheDirectormayremovethenameofthatapplicantfromtherelevantadoption
list.(3)Where the Director has removed the
name of an applicant from anadoptionlisttheDirectorshall,exceptwherethewhereaboutsoftheapplicant is unknown, notify the
applicant of that action.†PART
3—REGISTRATION OF ADOPTIONS˙Registration of Queensland orders14.The Registrar-General shall, in
respect of each memorandum of anadoption order
and each order made by the Supreme Court for the dischargeof an
adoption order—(a)register it by—(i)in
the case of a memorandum of an adoption order—(A)placing each order in sequence in the
Adopted ChildrenRegister;(B)numbering the orders in sequence;(C)completingandsigningColumn8oftheSchedule

adoptive parentand each adopted child;(ii)in
the case of an order by the Court discharging an adoptionorder made in respect of the child—placing
it in the registerwith the adoption order to which it
relates;(iii)in the case
of—(A)a memorandum of an adoption order
where there is, inrespectofthechild,apreviousregisteredadoptionorder; or(B)anorderbytheCourtdischarginganadoptionordermade
in respect of the child;crossreferencingsuchorderwiththepreviousregisteredadoption order
made in respect of the child;(b)if
it relates to a child whose birth is registered in
Queensland—(i)make a marginal note in the entry of
birth of the child in theregisters of births referring to the
adoption of the child or, asthe case may be,
that an adoption order in respect of the childhas been
discharged;(ii)make a note
against the child’s name in any index for theregisters of
births that the order has been made;(iii)where the birth has been entered in a
register of births keptby a district registrar—cause the
district registrar to make thenotespursuanttosubparagraphs(i)and(ii)inthedistrictregistrar’s
records;(c)in the case of an order for the
discharge of an adoption order—notmore than 21
days after receipt thereof, send to the Director acopy
of such order duly certified by the Registrar-General.˙Registration of orders (other than
Queensland)15.TheRegistrar-Generalshall,inrespectofanorderreferredtoinsection 57 of the
Act—(a)register it by—

approved form;(B)placing the compiled schedule, with
the memorandumorcopyofanadoptionorder,insequenceintheAdopted Children Register;(C)numbering the compiled schedule in
sequence;(D)completingandsigningcolumn8ofthecompiledschedule;(E)entering in an index the names of each
adoptive parentand each adopted child;(ii)in
the case of an order by the Court discharging an adoptionorder made in respect of the child—placing
it in the registerwith the adoption order to which it
relates;(iii)in the case
of—(A)an adoption order where there is, in
respect of the child,a previous registered adoption order;
or(B)anorderbytheCourtdischarginganadoptionordermade
in respect of the child;crossreferencingsuchorderwiththepreviousregisteredadoption order
made in respect of the child;(b)makeamarginalnoteintheentryofbirthofthechildintheregisters of births referring to the
adoption of the child or, as thecase may be,
that an adoption order in respect of the child hasbeen
discharged;(c)make a note against the child’s name
in any index for the registersof births that
the order has been made;(d)where the birth
has been entered in a register of births kept by adistrictregistrar,causethedistrictregistrartomakethenotespursuanttoparagraphs(b)and(c)inthedistrictregistrar’srecords.

registers16.No person other than—(a)the Director;(b)an
officer of the department engaged in giving effect to the
Act;(c)or any other person engaged in giving
effect to the Act;shall have access to the registers.˙Searches and copies17.(1)Any
person shall, upon application in writing and upon paymentof a
fee equal to the fee prescribed under theRegistration of
Births, Deathsand Marriages Act 1962as the fee
payable for the issue of a certified copyof or an extract
from any entry in a register kept under that Act or for asearch of any such register or the index
thereto, be entitled, at any timewhen the office
of the Registrar-General is open for the transaction of
publicbusiness—(a)toobtainfromtheRegistrar-GeneralcertifiedundertheRegistrar-General’s hand—(i)wheretheRegistrar-Generalregisteredanadoptionordermade
in another State, a Territory of the Commonwealth, ora
country outside the Commonwealth—(A)priortothe1August1965—acertificateintheapprovedformcontainingsuchinformationasisavailabletotheRegistrar-Generalinrelationtothatadoption, from
the adoption order;(B)inothercases—acertificateintheapprovedformcontainingsuchinformationasisavailabletotheRegistrar-General in relation to that
adoption, from theAdopted Children Register;(ii)whereapersonotherthanapersonthesubjectofanadoptionorderreferredtoinsubparagraph(i)hasbeenadopted—(A)beforethecommencementoftheseregulations,acertificate—

Children Regulation 1988(I)inthecaseofapersonwhoseparticularshavebeenenteredintheregisterkeptbytheRegistrar-Generalintituled‘RecordofChildrenwhose Births
have been registered in the State andwhohavebeentransferredunderDeedofAdoption’—in the approved form containing
suchinformation as is available to the
Registrar-Generalfrom such register; or(II)inthecaseofaperson,otherthanapersontowhomsubparagraph(I)applieswhohasbeenadoptedpriortothecommencementoftheAdoption of Children Act 1964—in
the approvedform containing such information as is
available totheRegistrar-GeneralfromthescheduletothecopyofanadoptionordercontainedintheAdopted Children Register; or(III) in the case of a person who has been
adopted onorafterthecommencementoftheAdoptionofChildrenAct1964—intheapprovedformcontaining such information as is available
to theRegistrar-Generalfromthescheduletothememorandumofanadoptionordercontainedinthe
Adopted Children Register;(B)afterthecommencementoftheseregulations,acertificateintheformofthescheduletothememorandum of an adoption
order;(b)tocausetheRegistrar-Generaltohaveasearchmadeoftheregisters or the
index thereto for such information as would bemade available
in a certificate pursuant to paragraph (a) in relationto
an entry therein; or(c)toobtainfromtheRegistrar-GeneralcertifiedundertheRegistrar-General’shand,anextractfromanyentryintheregistersintheformofan‘ExtractfromBirthEntry’formpursuant to the
regulations made under theRegistration of Births,Deaths and Marriages Act 1962.(2)The provisions
of section 22 of theRegistrationofBirths,Deaths

Children Regulation 1988andMarriagesAct1962shall,mutatismutandis,applytosearchesandcopies made pursuant to this section.(3)Subject to section 39C of the Act, no
person shall be entitled to searchor obtain a copy
of or extract from entries relating to adopted persons in
theregisters of births kept under the law of
Queensland, except upon an orderof the Supreme
Court.˙Correction of error18.(1)Where the Director or Registrar-General is
satisfied that—(a)an adoption order or copy thereof;
or(b)a memorandum of an adoption
order;containsanyerror,theDirectororRegistrar-Generalmaycorrectsuchdocument by—(c)inserting the correct particulars therein;
and(d)where applicable, ruling through the
erroneous particulars in suchmanner that such
particulars are still legible; and(e)initiallingthecorrectionandinsertingthedateonwhichthecorrection was made.(2)Whereacorrectionismadepursuanttosubsection(1),theRegistrar-General shall make, if
neccessary, in the margin in the entry ofbirth in the
registers of births, a suitable note of such correction.˙Sending of memoranda of orders to other
places19.For the purpose of section 56 of the
Act the Registrar-General shallsend the
memorandum in the approved form or copy of the dischargingorder
to the officer named in column 2 of Schedule 3 for the particular
StateorTerritoryoftheCommonwealthorcountrynamedincolumn1ofSchedule 3.

6—GENERAL˙Revocation of consents24.The prescribed address for the
purposes of section 22(2) of the Actshall be the
Department of Family Services and Aboriginal and IslanderAffairs, G.P.O. Box 806, Brisbane,
4001.˙Fees25.(1)The
fees set forth in Part D of Schedule 2 shall be the
prescribedfees with respect to the purposes and
circumstances respectively set out inSchedule
2.(2)The Director may waive, in whole or
part, payment by a person ofthe fee payable
by the person in relation to an application for identifyinginformation if payment of the fee would cause
hardship to the person.(3)Afeeisnotpayableinrelationtoanapplicationforidentifyinginformationifdisclosureoftheinformationisnotpermittedundersection 39B of the Act.˙General offence provision26. (1)A
person who contravenes or fails to comply with any provisionof
this regulation commits an offence against the regulation.(2)A person who fails to do that which
the person is directed to do by apersonactingundertheauthorityofthisregulationcommitsanoffenceagainst the
regulation.(3)A person who commits an offence
against this regulation is liable to apenalty of 20
penalty units or imprisonment for 3 months.
