IMPROVEMENT TRUSTREGULATION 1987[as amended by
all amendments that commenced on or before 17 February 1998]†PART 1—PRELIMINARY˙Short
title1.ThisregulationmaybecitedastheRiverImprovementTrustRegulation 1987.˙Interpretation4.In
this regulation—“chairperson”means
chairperson of the trust.“member”means member of
the trust.“minute book”means a book
kept for the purposes of section 5(4).“registerofimprovementnotices”meanstheregisterkeptforthepurposes of
section 7.“secretary”means secretary
of the trust.†PART 2—MEETINGS ETC. OF TRUST˙Meetings of the trust5.(1)The trust shall
meet at least once in every 3 months.(2)Special meetings of the trust—(a)shall be called by the chairperson
upon receipt of a request inwriting signed
by not fewer than 2 members;

be called by the chairperson at any time.(3)Except as is provided in subsection (3A),
the secretary shall cause tobe delivered a
notice of any meeting of the trust to each member not laterthan
3 clear days before that meeting.(3A)The
chairperson may direct the secretary to give shorter notice
inthecaseofaspecialmeetingwhereitisinthechairperson’sopinionnecessary.(4)The
secretary shall cause to be entered in a book to be kept for
thatpurpose the minutes of each meeting of the
trust, including the names of allmembers
present.(5)An entry in the minute book relating
to a meeting of the trust shall besigned by the
chairperson at the next meeting.(6)The
secretary shall cause a copy of the minutes of a meeting of
thetrust to be sent to the commissioner within 2
weeks of that meeting.˙Payments to
members6.(1)Subject to the
provisions of subsection (1A), the chairperson andmembers who—(a)attend a duly convened meeting of the trust;
or(b)take part in the inspection of works
carried on by the trust; or(c)take
part in any other necessary activity or journey having for
itsobject the furtherance of the business of
the trust;may be paid such fees therefor as are
determined by resolution at a meetingof the
trust.(1A)A fee for the
purposes of subsection (1) shall in no case exceed therelevant amount set forth in the
schedule.(2)In addition to the fees payable
pursuant to subsection (1) and subjectto the provisions
of subsection (2A), the chairperson and members may bereimbursed expenses actually and necessarily
incurred by them travelling tosuch meeting,
inspection or other business.(2A)Wherethechairpersonoramemberusesthechairperson’sormember’s own motor car for travelling to such
meeting, inspection or otherbusiness or in
making such inspection, travelling expenses shall be paid
for

travelled by the shortest practicableroute and at the
rate applicable under thePublic Service Management andEmployment Act 1988for the use by
public servants of their own motorcars.(3)Subject to the provisions of
subsection (4), the secretary shall be paidsuch reasonable
allowance as is determined by resolution of the trust havingregardtothetimeexpendedbythesecretaryintheperformanceofthesecretary’s duties under the
Act.(4)Theallowancepayabletothesecretaryistobenotmorethan$15
000.00 per annum.†PART 2A—RIVER IMPROVEMENT AREAS
ANDTRUSTS˙Burdekin Shire Rivers Improvement Area6AA.(1)TheHaughtonRiverimprovementareaisaddedtotheBurdekin Shire Rivers Improvement
Area.(2)In addition, any part of the local
government area of the Shire ofBurdekin not
included in the Burdekin Shire Rivers Improvement Area orHaughton River improvement area immediately
before the commencementis added to the Burdekin Shire Rivers
Improvement Area.(3)The assets and liabilities of the
Haughton River improvement trustare transferred
to the Burdekin Shire Rivers Improvement Trust.˙Cairns
river improvement area and trust6A.(1)The
Mulgrave Shire river improvement area, constituted undertheorderincouncilmadeon16September1972andpublishedinthegazetteatpage288,andtheMulgraveShireriverimprovementtrustconstituted for the area under the same order
in council are continued inexistence under
this regulation.(2)The area comprises the whole of the
local government area of CairnsCity
Council.

improvement area, constituted under the orderincouncilmadeon15August1959andpublishedinthegazetteatpage
2 309, and the Bremer river improvement trust constituted for the
areaunderthesameorderincouncilarecontinuedinexistenceunderthisregulation.(2)TheareacomprisesthewholeofthelocalgovernmentareaofIpswich City Council.(3)The name of the river improvement area
is changed to Ipswich riversimprovement
area.(4)The name of the trust for the river
improvement area is changed toIpswich rivers
improvement trust.˙Warwick Shire river improvement area
and trust6C.(1)The Rosenthal
Shire river improvement area and the RosenthalShire river
improvement trust, as continued in existence under section 6C
asthat section existed immediately before the
commencement, are continuedin existence
under this regulation.(2)TheGlengallanShireriverimprovementareaandtheCondamineriver
improvement area are added to the Rosenthal Shire river
improvementarea.(3)The name of the
Rosenthal Shire river improvement area is changedto
the Warwick Shire river improvement area.(4)The
name of the trust for the river improvement area is changed
toWarwick Shire river improvement trust.(5)The assets and liabilities of the
Glengallan Shire river improvementtrustandtheCondamineriverimprovementtrustaretransferredtotheWarwick Shire river improvement
trust.

continued in existence under thisregulation.(2)TheareacomprisesthewholeofthelocalgovernmentareaofWhitsunday Shire Council.(3)The name of the river improvement area
is changed to Whitsundayrivers improvement area.(4)The name of the trust for the river
improvement area is changed toWhitsunday rivers
improvement trust.†PART 3—GENERAL˙Improvement notices7.(1)Whenever the trust issues an improvement
notice for the purposesof section 11(1), (1A), (2) or (2A) of
the Act, the secretary shall give to thenotice a serial
number and shall record in a register of improvement noticesto be
kept for that purpose the required particulars of that
notice.(2)For the purposes of this regulation,
the required particulars are—(a)the
serial number; and(b)the name and address of the person to
whom it was issued; and(c)the date of the
notice; and(d)the form of the notice; and(e)thedescriptionofthelandinrespectofwhichthenoticewasissued; and(f)theparticularsoftheprohibition,directionsorrequirementsspecified in the
notice.(3)Theregisterofimprovementnoticesshallbeopentopublicinspection at any
reasonable time during office hours.

budget8.For the purposes of section 13(6) of
the Act, the prescribed date is31 August.˙Interference with pegs etc.9.(1)Apersonshallnotwithouttheauthorityofthetrustdestroy,mutilate, deface, remove or alter the
position of any peg, marker, sign orindicator fixed
or set up by the trust or any person acting under the
authorityof the trust.(2)A
person who commits an offence against this section is liable to
apenalty of 20 penalty units.
