BY-LAW1987[as amended by all amendments that
commenced on or before 1 March 2002]PART
1—PRELIMINARY1Short titleThisby-lawmaybecitedastheMedicalBoardofQueenslandBy-law
1987.5FeesThe fees payable
under the Act are in the schedule.5AWaiver of annual registration fees(2)Ifapersonisfirstregisteredasamedicalpractitioneronorafter1 July in a
registration year, the annual registration fee for the
followingregistration year is waived.(3)The board may also waive the annual
registration fee for a person fora registration
year if the person—(a)does not earn any income from the
practise of medicine; and(b)applies to the
board for a waiver of the fee before the registrationyear
starts; and(c)is at least 70 on the day of applying
for the waiver.(4)In this section—“registration
year”means a period of 12 months beginning on 1
October.

1987PART 2—CONDUCT OF BUSINESS OF BOARD6Notice of meetingThe registrar
shall complete and thereafter shall, in accordance with therequirements of section 11(9) of the Act,
deliver notice of any meeting oradjournedmeetingoftheboardotherthanaspecialmeetingandshallinclude in that
notice—(a)details of all motions or resolutions
intended to be proposed atthe meeting as given to the registrar
in writing at least 7 cleardays prior to
the date of the meeting; and(b)onlytotheextentwhichitispracticablesotodo,anyothermotions or
resolutions intended to be proposed at the meeting asgiven to the registrar in writing less than
7 clear days prior to thedate of the meeting.7General functions and duties of
registrar(1)Theregistrarshallactassecretarytotheboard,andshallbringbeforetheboardallmattersandthingsnecessarytoensurethattherequirements of the Act are complied
with.(2)The registrar shall write up the
minutes of all meetings of the board,conduct all
correspondence as directed by the board, keep a correct
recordin the proper books of all accounts,
receipts, payments, vouchers, reports,documents,papers,correspondenceandproceedingsconnectedwiththebusiness of the board, and generally do all
the clerical work of the boardand superintend
all business and affairs of the board, subject to the
board’sdirection.(3)The
registrar shall consult the president of the board with regard
toany business requiring urgent attention
between 1 meeting and the next.(4)Theregistrarshallberesponsibleforandshallcontrolthesafekeeping of all
receipts, papers, cheques, chequebooks, books, documentsand
property belonging to the board but the registrar shall make any
suchmaterial available to the board or any member
thereof for examination.8Board’s
funds(1)An amount payable to the board must be
given to the registrar.

section 31.19Honorary
treasurer(1)Wheretheboardappointsamemberoftheboardtobehonorarytreasurer the
registrar shall provide the honorary treasurer with an
accountof all moneys received.(1A)All
accounts of the board shall be paid by cheque and, subject
toinstructionsoftheboardtothecontrary,besignedbythepresidentorhonorary treasurer, and the registrar.(2)Thehonorarytreasurershall,inthemonthofJulyineachyear,present to the board an annual balance sheet
showing the exact financialposition of the
affairs of the board.PART 3—CUSTODY OF AND USE OF SEAL OF
BOARD10Custody and use of seal(1)The registrar shall have the custody
of the seal of the board, whichshall be used
only as hereinafter provided.(2)The
registrar shall cause the seal of the board to be affixed—(a)to certificates of registration;
and(b)toanyotherinstrumentsordocumentswheretheaffixingisauthorisedbyaresolutionpassedforthatpurposeandenteredupon the minutes

AS AN INTERN11Service as an intern(1)For the purposes of section 19(1)(d)
of the Act the aggregate amountof the period or
periods that a person shall serve as an intern shall be 12months which shall include—(a)a minimum of 22 weeks experience in
medicine; and(b)a minimum of 22 weeks experience in
surgery.(2)However,experienceinobstetricsshallconstituteexperienceineither medicine or surgery but shall not
exceed 8 weeks of the aggregateamount of 12
months.PART 5—ADVERTISING12Definitions for pt 5In this
part—“medical practitioner”includes a
medical company.13Prohibition on medical practitioners
advertising in certain waysA medical
practitioner must not advertise, or authorise another person
toadvertise,abouttheprofessionalservicesprovidedbythemedicalpractitioner if
the advertisement—

Queensland By-law 1987(a)isfalse,misleadingordeceptiveorlikelytobemisleadingordeceptive; or(b)unfavourablycomparestheprofessionalservicesprovidedbyanothermedicalpractitionerwiththeprofessionalservicesprovided by the medical practitioner;
or(c)containstestimonialsorotherendorsementsofthemedicalpractitioner;
or(d)is vulgar or sensational in a way that
would be likely to affectadversely the standing of the medical
profession.Maximum penalty—30 penalty units.14Advertising about area of
expertiseA medical practitioner must not advertise,
or authorise another person toadvertise,themedicalpractitionerashavingexpertiseinanareaofmedicineifthemedicalpractitionerdoesnothavetheappropriatequalifications,
training, skills or knowledge to practise in the area.Maximum penalty—30 penalty units.PART
6—MEDICAL CALL SERVICESDivision 1—Preliminary23Definitions for partIn
this part—“approvedarea”means,inrespectofamedicalcallservice,theareawithin which the
medical call service is to be conducted as describedin a
certificate of approval.“headquarters”means the
premises from which an approved medical callservice is
operated.“principal”means each
medical practitioner whose practice is serviced bya
medical call service established and conducted under a certificate
ofapproval.

feesIftheboardrefusesanapplicationforacertificateofapprovalorarenewal of the certificate, it may
refund to the applicant up to one-half ofthe application
fee.Division 2—Areas of service25Area of operationApersonshallnotestablish,conductorparticipateinamedicalcallservice except within an approved
area.26Approved areaThe board shall,
in respect of each medical call service, determine theapproved area having regard to—(a)the number of proposed principals;
and(b)the population and extent of the areas
serviced by the medicalpractices of the proposed principals;
and(c)such other matters as the board
considers relevant with respect tothe effective
and efficient operation of medical call services inQueensland.Division
3—Periods of operation27Hours of
operationExcept on public holidays, a person shall
not provide medical services inrespect of a
medical call service during the following hours—(a)weekdays other than Saturdays—8.00
a.m. to 6.00 p.m.;(b)Saturdays—8.00 a.m. to 12.00
midday.

participants28Obligations of medical directors and
employed medicalpractitioners(1)A
medical director shall—(a)ensure that
every medical practitioner employed in the medicalcall
service is a legally qualified medical practitioner; and(b)resideataplacewithintheapprovedareafromwhichthemedicaldirectorisabletosupervisethemedicalcallserviceadequately;
and(c)supervise the medical call service and
ensure that it is conductedin a proper and
lawful manner.(2)A medical practitioner employed in a
medical call service shall be oncallwithintheapprovedareaorattheheadquartersofthemedicalcallservice when rostered for duty.Division 5—Headquarters29Requirements for headquartersThe
headquarters of each medical call service shall—(a)be established in premises located
within the approved area; and(b)contain an area of rest for the medical
practitioner on duty; and(c)contain suitable
facilities for carrying out minor surgery.Division
6—Staffing, transport and support services30Requirements for certificates of
approvalA responsible person shall, when making
application for a certificate ofapproval, submit
to the board evidence that—(a)an
adequate number of medical practitioners will be employed;and(b)adequate
transport is available; and

or similar system of communication is availabletoensuretheeffectiveandefficientoperationoftheproposedmedical call service, at all times;
and(d)adequatesupportiveservices,includingadditionalmedicalpractitionersareavailabletoensuretheeffectiveandefficientoperation of the
proposed medical call service at all times.Division
7—Patients31Additional obligations of medical
directors(1)A medical director shall ensure that
the medical services provided bythe medical call
service are restricted to patients of the principals.(1A)However, medical
attention shall not be refused to a patient whohas no regular
medical practitioner or in case of emergency.(2)A
medical director shall ensure that—(a)anadequatereturnofclinicalinformationisprovidedtotheprincipals at the times required by
the principals;(b)adequate medical records are
kept;(c)arrangements are made for the proper
care of each patient by—(i)communicatingwiththeprincipalconcernedandpassingthecareofthepatientbacktothatprincipalinsufficienttimefortheprincipaltoarrangewhateverfurthercareisnecessary; or(ii)where necessary, passing the care of the
patient to anothermedicalpractitioner,includingaspecialistormedicalpractitioner in
a hospital;(d)arrangementsaremaintainedwiththeappropriatehospitalauthorities for the admission, accommodation
and medical careofpatientsofthemedicalcallserviceandthatallmedicalpractitionersemployedintheservicearefamiliarwithsucharrangements.

medical directorInrespectofamedicalcallservice,theresponsiblepersonandthemedical director
must ensure compliance with this part.40Cancellation and suspension of certificates
of approvalThefollowingcircumstancesareprescribedforthepurposeofsubsection 58(1)(c) of the Act—(a)if the certificate was issued or
renewed upon false or misleadingparticulars;(b)if
the medical call service in respect of which the certificate
wasissued or renewed—(i)ceases to have a medical director;(ii)ceases to be
provided with adequate headquarters;(iii)ceasestobeprovidedwithadequatestaff,transportandsupportive services.PART 7—BREACHES
OF BY–LAW41Offences(1)A
person who contravenes or fails to comply with a provision of
thisby-law commits a breach of this
by-law.(2)A person who fails to do that which
the person is directed to do ordoes that which
the person is forbidden to do by a person acting under theauthority of this by-law commits a breach of
this by-law.(3)A person who commits a breach of this
by-law shall be liable to amaximum penalty
of 30 penalty units.
