all amendments that commenced on or before 29 May 1996]†PART 1—PRELIMINARY˙Citation1.ThisregulationmaybecitedastheCoalIndustry(Control)Regulation
1987.˙Interpretation4.In
this regulation—“monthly return of coal sales”means the monthly return of coal
salesprescribed by an order issued by the board
pursuant to section 18(3)(d)of the
Act.“periodiccoalminingreturn”meanstheperiodiccoalminingreturnprescribed by an order issued by the board
pursuant to section 18(3)(d)of the Act and
to be completed in respect of a period of not greater than5
weeks.“persons engaged in mining operations”means all persons engaged inmining operations at a coal mine whether
such persons are employedby the owner or by any other
person.“secretary”means the person
holding the appointment of secretary to theboard pursuant
to the Act.˙Approved forms5.The
chief executive may approve forms for use under the
Act.

2—ADMINISTRATION OF THE BOARD˙Calling of meetings6.For
the purposes of section 11(2) of the Act, the prescribed manner
ofcallingmeetingsoftheboardshallbeanoticeinwritingsignedbythesecretary and
given to each member of the board.˙Official seal7.(1)Thesecretaryshallkeeptheofficialsealoftheboardinsafecustody.(2)The official seal shall not be used
except by the authority of the boardandeveryinstrumenttowhichthesealisaffixedshallbesignedby1
member of the board and countersigned by another member of the
boardin the presence of the secretary.†PART 3—FINANCE˙Calculation and payment of annual
contributions of mine owners10.(1)Themoneyspayablebytheownersofcoalminespursuanttosection50oftheActshallbepaidbyquarterlyinstalmentson30
September, 31 December, 31 March and 30 June in each year.(2)The amount of each quarterly
instalment payable by each owner shallbe determined by
the application of the following formula—AxCBwhere—“A”means the number of persons engaged in
the production of coal (otherthan coal
supplied or sold for export from the Commonwealth) at theowner’s coal mine.

number of persons engaged in the production of coal(other than coal supplied or sold for export
from the Commonwealth)at all coal mines in the State.“C”means one-fourth of the sum fixed by
the board and approved by theGovernor in
Council pursuant to section 50 of the Act.(3)For
the purposes of subsection (2), the number of persons engaged
inthe production of coal (other than coal
supplied or sold for export from theCommonwealth) at
each owner’s coal mine shall be calculated by the boardby
application of the following formula—DxFEGwhere—“D”means the total number of persons
engaged in mining operations at theowner’s coal
mine as shown on periodic coal mining returns requiredto
be lodged in the quarter by the owner.“E”means the total number of periodic coal
mining returns required to belodged in the
quarter by the owner.“F”means the total
number of tonnes of coal (other than coal supplied orsoldforexportfromtheCommonwealth)producedattheowner’scoal
mine and sold by the owner as shown on the monthly return ofcoal
sales required to be lodged in the quarter by the owner.“G”means the total number of tonnes of
coal produced at the owner’s coalmine and sold by
the owner as shown on the monthly return of coalsales required to be lodged in the quarter
by the owner.†PART 4—TRANSITIONAL˙Transitionally approved forms11.(1)This section
applies if—(a)immediatelybeforeitscommencement,therewasaprescribedform for a
matter; and

commencement, there is to be an approved form for thematter.(2)The
form that was the prescribed form for the matter immediatelybefore the commencement is taken to be the
approved form for the matteruntilthereisanapprovedformforthematterorthissectionexpires,whichever happens
first.˙Expiry of part12.This
part expires 3 months after it commences.
