s1 3 s5 Coal Industry (Control) Regulation 1987 COAL INDUSTRY (CONTROL) REGULATION 1987 [as amended by all amendments that commenced on or before 29 May 1996] † PART 1—PRELIMINARY ˙ Citation 1. This regulation may be cited as the Coal Industry (Control) Regulation 1987 . ˙ Interpretation 4. In this regulation— “monthly return of coal sales” means the monthly return of coal sales prescribed by an order issued by the board pursuant to section 18(3)(d) of the Act. “periodic coal mining return” means the periodic coal mining return prescribed by an order issued by the board pursuant to section 18(3)(d) of the Act and to be completed in respect of a period of not greater than 5 weeks. “persons engaged in mining operations” means all persons engaged in mining operations at a coal mine whether such persons are employed by the owner or by any other person. “secretary” means the person holding the appointment of secretary to the board pursuant to the Act. ˙ Approved forms 5. The chief executive may approve forms for use under the Act.

s 6 4 s 10 Coal Industry (Control) Regulation 1987 † PART 2—ADMINISTRATION OF THE BOARD ˙ Calling of meetings 6. For the purposes of section 11(2) of the Act, the prescribed manner of calling meetings of the board shall be a notice in writing signed by the secretary and given to each member of the board. ˙ Official seal 7.(1) The secretary shall keep the official seal of the board in safe custody. (2) The official seal shall not be used except by the authority of the board and every instrument to which the seal is affixed shall be signed by 1 member of the board and countersigned by another member of the board in the presence of the secretary. † PART 3—FINANCE ˙ Calculation and payment of annual contributions of mine owners 10.(1) The moneys payable by the owners of coal mines pursuant to section 50 of the Act shall be paid by quarterly instalments on 30 September, 31 December, 31 March and 30 June in each year. (2) The amount of each quarterly instalment payable by each owner shall be determined by the application of the following formula— Ax C B where— “A” means the number of persons engaged in the production of coal (other than coal supplied or sold for export from the Commonwealth) at the owner’s coal mine.

s 11 5 s 11 Coal Industry (Control) Regulation 1987 “B” means the total number of persons engaged in the production of coal (other than coal supplied or sold for export from the Commonwealth) at all coal mines in the State. “C” means one-fourth of the sum fixed by the board and approved by the Governor in Council pursuant to section 50 of the Act. (3) For the purposes of subsection (2), the number of persons engaged in the production of coal (other than coal supplied or sold for export from the Commonwealth) at each owner’s coal mine shall be calculated by the board by application of the following formula— Dx F EG where— “D” means the total number of persons engaged in mining operations at the owner’s coal mine as shown on periodic coal mining returns required to be lodged in the quarter by the owner. “E” means the total number of periodic coal mining returns required to be lodged in the quarter by the owner. “F” means the total number of tonnes of coal (other than coal supplied or sold for export from the Commonwealth) produced at the owner’s coal mine and sold by the owner as shown on the monthly return of coal sales required to be lodged in the quarter by the owner. “G” means the total number of tonnes of coal produced at the owner’s coal mine and sold by the owner as shown on the monthly return of coal sales required to be lodged in the quarter by the owner. † PART 4—TRANSITIONAL ˙ Transitionally approved forms 11.(1) This section applies if— (a) immediately before its commencement, there was a prescribed form for a matter; and

s 12 6 s 12 Coal Industry (Control) Regulation 1987 (b) on the commencement, there is to be an approved form for the matter. (2) The form that was the prescribed form for the matter immediately before the commencement is taken to be the approved form for the matter until there is an approved form for the matter or this section expires, whichever happens first. ˙ Expiry of part 12. This part expires 3 months after it commences.
