all amendments that commenced on or before 4 April 1996]˙Short title1.This
rule may be cited as theHospitals Foundations (Royal
BrisbaneHospital Research Foundation) Rule
1986.˙Definitions2.In these rules—“chairperson”means the
chairperson of the research committee.“foundation”means the Royal
Brisbane Hospital Research Foundation.“research objects
of the foundation”means the following objects of thefoundation—(a)to
seek to discover the nature, origins and causes of disease
andbodily afflictions by the application of all
or any of those branchesof science that are relevant to the
purpose and to make the bestuseofknowledgegainedforimprovementofthemeansofprevention or treatment of disease and
bodily afflictions;(b)toresearchorarrangeorpromoteresearch(includingsurveysrelevanttohealthserviceorhospitalfunctions)intoanddevelopmentofanybranchofmedicalscience,technologicalresearch,medicalinvestigationorothermatterconcerningthehealthorwellbeingofpeople,withaviewtogeneralimprovement in
health services;(c)to provide money grants or loans for
persons engaged in researchatpostgraduatelevelinmedicaloranyotherhealthscience(including
surveys relevant to any such science);

1986(d)to arrange for research and
development work in specific mattersrelated to the
health of people.˙Research Committee3.(1)Thereshallbeestablishedandfromtimetotimeconstitutedaresearch committee.(2)The
functions of the research committee shall be to furnish to
thechairperson information and advice with
respect to—(a)the conduct of all matters relevant to
the research objects of thefoundation;
and(b)the administration of the research
fund.(3)The research committee shall consist
of the following members—(a)the member of
the foundation to whom the foundation, pursuanttosection64oftheAct,hasdelegatedresponsibilityfortheconductofallactivitiesrelevanttotheresearchobjectsofthefoundation and the administration of
the research fund;(b)such other persons (being not more
than 10 in number) approvedby the Minister
as may be appointed from time to time by thefoundation,
provided always that there shall at all times be at least4
such other persons who shall be suitably qualified for
assessingactivities relevant to the research objects
of the foundation.(4)Members of the research committee
shall hold office for such periodas may be
determined by the foundation at the time of appointment.(5)However, the term of such appointment
may be extended from timeto time by the foundation.(6)The member referred to in subsection
(3)(a) shall be the chairpersonof the research
committee.(7)Nopersonsshallbeappointedtobeamemberoftheresearchcommittee pursuant to subsection (3)(b)
without the prior approval of theSecretary of the
Commonwealth Department of Health holding office undertheNational Health Act 1953(Cwlth).(8)The
chairperson shall preside at all meetings at which the
chairperson

1986is present but if the chairperson is absent
from any meeting, the memberspresent may
appoint a chairperson to preside at that meeting.(9)At all meetings of the research
committee, all members shall vote.(10)However, if a member refuses to vote, the
member’s vote shall becounted for the negative.(11)The chairperson
of each meeting shall have a deliberative vote and,in
the case of an equality of votes, shall also have a casting
vote.(12)Nobusinessshallbetransactedatanymeetingoftheresearchcommitteeunlessatleast4membersarepresentwhensuchbusinessistransacted.(13)The
research committee shall meet as often as it thinks necessary
toperform its functions but at least twice in
each half-year.(14)As soon as
practicable after each of its meetings, the chairpersonshall
furnish to the foundation a report in respect of the matters
resolved bythe research committee.(15)SubjecttothisruleandtheAct,theresearchcommitteeshallconductitsbusinessandproceedingsatmeetingsinsuchmannerasitdetermines from
time to time.˙Research4.The
chairperson shall ensure that all activities relevant to the
researchobjectsofthefoundationareconductedinaccordancewiththerecommendations of the research
committee.˙Research fund5.(1)Thefoundationshallinaccordancewithsection52oftheActestablish a trust fund to be called the
research fund for the purposes of theresearch objects
of the foundation and shall establish at a bank 1 or morebank
accounts in respect of the research fund.(2)Theresearchfundshallbeadministeredbythechairpersoninaccordance with the recommendations of the
research committee.(3)An amount received by the
foundation—

1986(a)for the research objects of the
foundation; or(b)as income from investment of amounts
in the research fund;must be paid into the research
fund.(4)However,thefoundationmaykeepanamountforpaymentofreasonable expenses the foundation has
incurred, or may be expected toincur, in
soliciting gifts for the foundation.(5)Moneys from time to time comprising the
research fund may, untilrequiredbythefoundationforthepurposetowhichthemoneysmaylawfully be applied in accordance with the
Act and this rule, be invested inaccordance with
section 51 of the Act.(6)Moneysfromtimetotimecomprisingtheresearchfundshallbeapplied to activities relevant to the
research objects of the foundation and inaccordance with
the recommendations of the research committee.˙Publication of research6.The
chairperson shall ensure that the results of all research
financedfromtheresearchfundshallbefreelyavailableandwhereverpossiblepublished in the scientific or medical
press.˙Winding-up of the research fund7.(1)If during any
period of 1 year no activities relevant to the researchobjectsofthefoundationarecarriedout,thefoundationmaywiththeapproval of the Minister, and shall if so
directed by the Minister, wind-upthe research
fund.(2)Ifuponthewinding-upoftheresearchfundthereremainsanymoneys after all the liabilities of the
research fund have been satisfied, thosemoneys shall not
be distributed among the members of the foundation butshall
be transferred to such body—(a)as
in the opinion of the Governor in Council has similar objects
tothose of the foundation; and

1986(b)ashasbeenapprovedbythecommissioneroftaxationforthepurposes of any of the subparagraphs
of section 78(1)(a) of theIncome Tax Assessment Act 1936.
