s1 3 s6 Pharmacy By-Law 1985 PHARMACY BY-LAW 1985 [as amended by all amendments that commenced on or before 14 December 2001] PART 1—PRELIMINARY 1 Short title This by-law may be cited as the Pharmacy By-law 1985 . 2 Fees The fees payable for the purposes of the Act are set out in the schedule. 4A Waiver of fees (1) If a person is registered as a pharmacist and the first period of registration is to start on or after 1 December in any year, the annual licence fee payable for the following year is waived. (2) If a pharmacist applies to the board within the period starting on 1 January and ending on 30 April in any year for waiver of the annual licence fee, and satisfies the board that he or she has attained the age of 70 years, the annual licence fee payable for that year is waived. PART 2—ADMINISTRATION 6 Meetings of board (1) The registrar shall give notice in writing to each member of the board not less than 3 days before an ordinary meeting setting forth the place, date and time of the meeting and the business thereof. (2) If at the expiration of half an hour after the time appointed for any meeting a quorum is not present, the chairperson or registrar shall postpone
s6 4 s6 Pharmacy By-Law 1985 the meeting and shall name a time and a day not being more than 2 weeks from the time and day of the meeting so postponed as shall seem to the chairperson or registrar most suitable. (3) The order of business at an ordinary meeting of the board shall be as follows— (a) reading of the minutes of the last meeting and unconfirmed minutes of special meetings; (b) confirmation or otherwise of such minutes; (c) business arising out of such minutes; (d) outward correspondence and consideration of inward correspondence; (e) finance— (i) financial statement; and (ii) production of statements for accounts kept by the board with a financial institution; and (iii) accounts for payment; and (iv) other matters of finance; (f) restorations; (g) registrations; (h) additional qualifications; (i) motions of which notice has been given in writing to the registrar; (j) general business. (4) A resolution passed or any act, matter or thing done or authorised by or at any meeting shall not be rescinded, amended, cancelled or revoked at a subsequent meeting unless prior notice of the intended rescission, amendment, cancellation or revocation has been given in the notice convening the meeting. (5) At the direction of the chairperson of the board or on the requisition in writing by 3 members of the board the registrar shall convene a special meeting of the board of which 3 clear days notice shall be given. (6) At a special meeting only the business stated in the direction or requisition shall be transacted.
s7 5 s8 Pharmacy By-Law 1985 7 The registrar (1) The registrar shall act as secretary to the board, and shall bring before the board all matters and things necessary to ensure that the requirements of the Pharmacy Act 1976 are complied with. (2) The registrar shall write up the minutes of all meetings of the board; conduct all correspondence; keep a correct record in the proper books of all accounts, receipts, payments, vouchers, reports, documents, papers, correspondence and proceedings connected with the business of the board; generally carry out all the clerical functions and duties of the board; and superintend all business and affairs under the board’s direction. (3) The registrar shall consult the chairperson or, in the chairperson’s absence, the deputy chairperson or, in the deputy chairperson’s absence other members of the board on any business requiring urgent attention between the various meetings. (4) The registrar shall be responsible for the safe keeping of all receipts, papers, cheques, cheque-books, books, documents and property belonging to the board which shall be under the registrar’s control, but which shall be available to the board or any member thereof. 8 Board’s funds (1) An amount payable to the board must be given to the registrar. (2) The registrar must— (a) deposit the amount in an account kept by the board in accordance with the Statutory Bodies Financial Arrangements Act 1982 , section 31; 1 and (b) for each board meeting, prepare a statement of all amounts received, and payments made, by the board during the statement period. (3) A payment may be made from the account only— (a) by a cheque signed by the registrar and a board member authorised by the board to sign cheques; or (b) in another way authorised by the board. 1 Statutory Bodies Financial Arrangements Act 1982 , section 31 (General banking powers for day-to-day operations)
s 8A 6 Pharmacy By-Law 1985 s 10 (4) In this section— “statement period” , for a statement for a board meeting, means the period— (a) starting on the first day of the month in which the previous board meeting was held; and (b) ending on the last day of the month immediately before the month in which the meeting is to be held. 8A Honorary treasurer (1) The board may appoint 1 of its members as the board’s honorary treasurer. (2) If an honorary treasurer is appointed, the treasurer must— (a) at each board meeting, present the statement prepared by the registrar under section 8(2)(b); and (b) ensure any payment made from the board’s account is in accordance with section 8(3). 9 Common seal (1) The common seal of the board in the name of the Pharmacy Board of Queensland shall be in such design as the board may determine. (2) The seal shall remain in the custody of the registrar and shall be affixed under the registrar’s signature to certificates of registration and to such other documents as the board may direct. PART 3—REGISTRATION 10 The register (1) The register shall contain the following particulars of each pharmacist recorded therein— (a) registration number; (b) full name;
s 11 7 s 12 Pharmacy By-Law 1985 (c) address of place of practice or home address; (d) date of registration; (e) initial qualifications; (f) additional qualifications. (2) The register shall be kept in alphabetical order of the names of the persons registered. 11 Records to be retained by registrar Where the name of a pharmacist has been removed from the register pursuant to the Act, the registrar shall retain a record of the prescribed particulars previously entered in the register relating to such pharmacist. 12 Registration An applicant for registration as a pharmacist shall with such application furnish to the board— (a) where qualifications have been obtained in Queensland— (i) the prescribed registration fee; and (ii) documentary evidence of the degree, diploma, or other qualification by virtue of which the applicant claims to be registered; and (iii) certificates in the approved forms; and (iv) such further particulars as the board may deem necessary for proper consideration of the application; or (b) where qualifications have been obtained outside Queensland at a university, college, institute or body prescribed in the Pharmacy (Qualification for Registration) Regulation 1982 , section 2, schedule— (i) the prescribed registration fee; (ii) either of the following documents— (A) certification that application has been made to the registration authority where the training was undertaken for a certificate of identity to be forwarded directly to the board;
s 13 8 s 13 Pharmacy By-Law 1985 (B) documentary evidence of the degree, diploma, certificate or other qualification by virtue of which the applicant claims to be registered and a certificate of good standing issued by a registration authority in a State or country referred to in the Pharmacy (Qualification for Registration) Regulation 1982 , section 2, schedule; (iii) such further particulars as the board may deem necessary for proper consideration of the application; or (c) where qualifications have been obtained from a university, college, institute or body other than prescribed in the Pharmacy (Qualification for Registration) Regulation 1982 , section 2, schedule— (i) the prescribed registration fee; (ii) documentary evidence of the degree, diploma, certificate or other qualification by virtue of which the applicant claims to be registered; and (iii) 2 character references in support of good fame and character; and (iv) a complete transcript of training issued by the university, college, institute or body at which the training was undertaken; and (v) certificates in the approved forms as may be required by the board; and (vi) such further particulars as the board may deem necessary for proper consideration of the application. 13 Additional qualifications An application by a pharmacist to the board for an additional qualification to be registered shall be in writing, signed by the pharmacist, and accompanied by— (a) certified documentary evidence that the pharmacist is the holder of the additional qualification; and (b) the prescribed registration fee.
s 14 9 s 14 Pharmacy By-Law 1985 14 Practical experience (1) In relation to an applicant for registration under the Act who for the purpose of section 19(1) of the Act relies upon holding a degree in pharmacy conferred by the University of Queensland, the practical experience prescribed pursuant to section 19(3) of the Act shall consist of either— (a) subject to subsection (2), experience— (i) in Queensland for a period totalling 48 weeks full-time employment under the supervision of a pharmacist upon such conditions as will give the applicant experience and training in the practice of pharmacy; or (ii) in 1 or more State or Territory of Australia other than in Queensland for a period totalling 48 weeks full-time employment under the supervision of a person in that State or Territory who is by the laws of that State or Territory of like character to the Act authorised to practise pharmacy upon such conditions as will give the applicant experience and training in the practice of pharmacy; or (iii) for a period totalling 48 weeks full-time employment comprised of service under the supervision of— (A) in relation to service within Queensland—a pharmacist; or (B) in relation to service other than in Queensland—a person in that State or Territory who is by the laws of that State or Territory of like character to the Act authorised to practise pharmacy, upon such conditions as will give the applicant experience and training in the practice of pharmacy; or (b) completion to the satisfaction of the board of such other course of study or training as the board may from time to time prescribe. (1A) The board may in its discretion reduce the period of training prescribed by subsection (1) by a period not exceeding 24 weeks where it is satisfied that the applicant in question, after obtaining a degree in pharmacy from the University of Queensland, has— (a) served as a member of the teaching staff of the Pharmacy Department of the University of Queensland in a capacity approved by the board for a period of at least 1 year; and
s 14 10 s 14 Pharmacy By-Law 1985 (b) successfully completed postgraduate study as approved by the board for which prior approval has been granted by the board. (2) There shall be excluded from the computation of the period of service by an applicant for the purposes of subsection (1)(a) any period, including recreation leave and sick leave, other than public holidays. (3) Without the consent of the board (which consent may be given at any time) the period of service referred to in subsection (1)(a) shall be completed within 3 years of the date of conferment of the degree by the University of Queensland. (4) Should the period of 48 weeks specified in subsection (1)(a) be broken no period shall be shorter than 4 consecutive weeks full-time employment, and 1 period shall be of at least 24 weeks full-time employment at the one training pharmacy. (5) During any period of training, the ratio of graduates at a training pharmacy shall not exceed 1 graduate per pharmacist. (6) An applicant seeking to satisfy the board of his or her completion of the prescribed practical experience shall— (a) if the applicant is relying upon completion of the period of service referred to in subsection (1)(a), supply to the board certificates in the approved forms; (b) if the applicant is the holder of a qualification from a university, college, institute or body other than the University of Queensland and is relying upon completion of such training or experience as may be required under the provisions of section 19(2) of the Act, supply to the board certificates in the approved forms; (c) in every case provide the board with such further information and material as the board may require. (7) Notwithstanding anything to the contrary herein contained the board may, at its discretion, exempt any person from compliance with this or the preceding section either wholly or partly or subject to such conditions as the board thinks proper.
s 15 11 s 15 Pharmacy By-Law 1985 PART 4—PRACTICE 15 Advertisement and display (1) A pharmacist shall not advertise in any manner which would tend to convey to the public that one pharmacist or pharmacy is superior in a professional sense to any other or create an invidious comparison with another pharmacist or pharmacy. (2) Advertising of professional services shall be restricted to the proprietor’s or manager’s name, the name of the pharmacy, the academic qualifications of the pharmacist, the designation of the pharmacist’s membership of professional institutes, the address of the pharmacy, the days and hours of service, telephone numbers and a factual statement of professional services offered which shall make no reference to charges or quality of services. (2A) Advertising of professional services in conjunction with advertising of a commercial nature is prohibited. (3) Pharmacists shall not advertise in a manner which is indecent, misleading, inappropriate, harmful or professionally unacceptable and shall ensure that their servants or agents do not advertise in any such manner. (4) The name of the proprietor, manager or nominee in the case of a partnership, shall be shown in any advertisement in respect of a pharmacy practice. (5) Hours of service shall be stated factually and in a prominent place clearly visible to the public at the entrance to the pharmacy premises. (6) Where a pharmacist in advertising the pharmacist’s practice uses such words as ‘night pharmacy’, ‘after hours pharmacy’, or other words of a similar meaning, the advertisement shall include the actual hours that the pharmacy is open for business. (7) A pharmacist shall not advertise in any manner in which the use of the name of another person or association of persons might be construed by the public to infer that such other person or association of persons has a pecuniary interest, control or direction in the conduct of such pharmacy unless such is the case. (8) Every advertisement published by or in the name of a person, firm or incorporated company which in any manner implies or suggests that such advertisement is justified by or based on the practice of a pharmacist shall
s 15 12 s 15 Pharmacy By-Law 1985 be deemed to be an advertisement by such pharmacist in the same manner as if it had been inserted by the pharmacist personally. (9) The advertising of mail order prescription services and mail order sales of scheduled drugs are prohibited unless otherwise approved by the board. (10) A pharmacist must not advertise a substance that is listed in schedules 3, 4 and 8 of the Standard within the meaning of the Poisons Regulation 1973 . (11) No advertisement shall either directly or indirectly promote the excessive, indiscriminate, deleterious or unnecessary use of therapeutic substances or substances for which a therapeutic claim is made. (12) A pharmacist shall not advertise in any manner which incorporates the name or identification in whole or in part of a person or organisation who or which conducts or controls a pharmacy or pharmacies in another place, unless that person or organisation is registered as a pharmacist in the © State of Queensland. (13) A pharmacist shall not advertise in any manner which incorporates the name or identification, in whole or in part, of a person or organisation, such as to give the impression that such person or organisation has any ownership, pecuniary interest, control or direction in the conduct of the pharmacy. (14) A pharmacist or, in the case of a deceased pharmacist, the administrator of the pharmacist’s estate, shall remove from the premises in which the practice of pharmacy has ceased to be carried on, all signs and other markings identifying the premises as a pharmacy, within thirty days of such cessation. (15) A pharmacist shall prominently and clearly display on the premises where the practice of pharmacy is conducted the word ‘pharmacist’, or ‘pharmacy’ or ‘chemist’ or ‘dispensary’ in addition to any other identifying mark and the lettering of such word or words shall be of at least equal size to the business name. (16) A pharmacist shall not give any statement or testimonial upon any therapeutic substance or substance for which a therapeutic claim is made to any proprietor, manufacturer, distributor or vendor for publication with the name or image of such pharmacist attached, other than by way of an acknowledgment in an article published in a scientific journal.
s 16 13 s 17A Pharmacy By-Law 1985 16 Direction to comply If the board is of the opinion that— (a) any pharmacist is advertising himself or herself as qualified to practise pharmacy; or (b) any pharmacist is advertising premises where a practice of pharmacy is conducted; in any manner or by any method contrary to any provision of this by-law, the board may give the pharmacist concerned directions in writing to remove, alter, amend or discontinue the advertisement in question and specify a time within which the pharmacist shall comply. PART 5—MISCELLANEOUS 17 Notice of exercise of powers under security document Where a bill of sale, bill of mortgage, bill of encumbrance or other document for the securing of monies advanced, in respect of a pharmacy practice or land on which the practice of pharmacy is conducted is given by a pharmacist, and the grantee, mortgagee or encumbrancee (as the case may be) pursuant to the relevant security document exercises, causes to be exercised, or gives notice of and intention to exercise any of the powers, rights or remedies to which it is entitled under the relevant security document, the pharmacist shall notify the board forthwith of such exercise, action or notice. 17A When annual licence fee must be paid (1) A person who is already registered as a pharmacist at the beginning of a year, or becomes registered in January of a year, must pay the annual licence fee for the year on or before 31 January in the year. (2) A person who is not registered as a pharmacist in January of a year, but applies to be registered in the year, must pay the annual licence fee for the year with the registration fee.
s 18 14 s 18 Pharmacy By-Law 1985 18 Offences (1) A pharmacist who— (a) contravenes or fails to comply with any provision of this by-law; (b) advertises or causes or permits to be advertised, directly or indirectly, any practice of pharmacy with which the pharmacist is associated contrary to any provision of this by-law; (c) fails to comply with any directions given by the board pursuant to section 16; commits an offence against this by-law. (2) A person who commits an offence against this by-law is liable to a maximum penalty of 4 penalty units.
