SUPERANNUATION REGULATION1970[as amended by
all amendments that commenced on or before 4 June 1996]˙Short title1.This
regulation may be cited as thePolice
Superannuation Regulation1970.˙Definition2.In
this regulation—“approved form”see section
13.˙Members of Queensland Police Service
who are not members of thepolice force for the Act3.A member of the Queensland Police
Service is not a member of thepolice force for
the purposes of the Act if the person—(a)is
appointed under thePolice Service Administration Act
1990asa staff member, police recruit or
special constable; and(b)was not a member
of the police force for the purposes of the Actimmediately
before the appointment.˙The conduct of the
business of the board4.(1)The board shall
meet in the second and fourth weeks of each monthfor
any business unless the board has previously determined that it
shall notmeet in any of these weeks.(2)Such determinations by the board may
be made from time to time.(3)The day, hour
and place of every meeting of the board shall be aspreviously determined by the board, or, in
default or in the case of a special

appoint.˙Special meetings of board5.(1)The manager
shall on requisition, in accordance with this section, ofany 2
members of the board convene a special meeting of the board.(2)The requisition shall be in writing,
state the objects of the meeting,andbesignedbytherequisitionists,andshallbedepositedwiththemanager.(3)Notice of the special meeting shall specify
the objects of the meetingas stated in the requisition.˙Notice of board meetings6.Where the time and place of any
meeting of the board is appointed bythe manager and
in every other case where notice of a meeting is given,notice of the meeting shall be given by the
manager to each member of theboard at least 3
days before the meeting.˙Failure to give
notice does not invalidate proceedings7.Theaccidentalomissiontogivenoticeofanymeetingto,orthenon-receipt of notice of any meeting by, any
member shall not invalidate theproceedings at
the meeting (including any adjournment thereof).˙Conduct of board business8.(1)Theboardshallcommencebusinessatthehourappointedforholdingthemeeting,orsosoonthereafterasasufficientnumberofmembers is present to form a
quorum.(2)If at the expiration of 15 minutes
after the hour appointed for theholdingofthemeetingaquorumisnotpresent,themeetingshallnotproceed on that day but stand adjourned
to such day, hour, and place as maybe fixed by the
members present, or, in default, by the manager, and thecircumstances, together with the names of the
members then present shallbe recorded in the minute
book.

Superannuation Regulation 1970˙Adjournment of board meetings9.(1)The board may
adjourn a meeting from time to time and from placeto
place, but no business shall be transacted at any adjourned meeting
otherthan the business left unfinished at the
meeting from which the adjournmenttook
place.(2)Without prejudice to anything in this
regulation contained, it shall notbe necessary to
give any notice of an adjournment or of the business to betransacted at an adjourned meeting.˙Confidentiality of board
business10.Alldeliberationsandbusinessoftheboardshallbestrictlyconfidential, and
any particulars relating thereto shall not be communicatedto
any person, but the board may—(a)consenttothecommunicationtoanypersonofanysuchparticulars;(b)authorise the manager to publish a report of
all or any part of theproceedings;as it thinks
fit.˙Calculation of benefits11.In order to ascertain the fortnightly
equivalent of the annual amountof benefits
payable, the following formula shall apply—divide the
amount of the total annual benefit by 26.09, and the amountso
obtained shall be taken to the next higher cent.˙Proof of incapacity12.Any
member retired from the police force by reason of incapacity
isto furnish to the board the following
notifications and certificates whilst heor she is in
receipt of incapacity benefit—(a)a
statement at the end of each calendar month indicating
whetheror not he or she engaged in any work during
the month;(b)a statement at the end of each
financial year giving details of any

1970s 14work engaged in during the previous 12
months;(c)amedicalreportfromagovernmentmedicalofficerorothermedical
practitioner approved by the board after the end of eachfinancial year.˙Proof
of entitlement to benefits13.The manager of
the board may from time to time require evidencethat
payments from the police superannuation fund are being properly
madeand for this purpose may require any person
in receipt of benefits from thepolice
superannuation fund to supply information in the approved
form.˙Approval of forms14.The
chief executive may approve forms for use under the Act.Approved forms14.(1)This
section applies if—(a)immediatelybeforeitscommencement,therewasaprescribedform for a
matter; and(b)onitscommencement,thereistobeanapprovedformforthematter or a form
may be approved for the matter.(2)Until there is an approved form for the
matter, the form that was theprescribedformforthematterimmediatelybeforethecommencementistaken
to be the approved form for the matter.(3)This
section expires 3 months after it commences.11Thisprovisionhasexpiredandisincludedinthisreprintforinformationalpurposes
only.It will be omitted in the next
reprint.This provision has not beenrenumbered under the Police Superannuation
Regulation 1970, section 16.
