matters(1)For the purpose of the administration
and enforcement of therepealed Acts in relation to
continuing matters, the repealedActs and the
legislation mentioned in part 5 continue to applyas if
this Act had not commenced.(2)Without limiting
subsection (1)—(a)achiefinspectoroftrademeasurementorastaffmember may be
employed under the repealed TMAA,section 5(1);
and(b)theemploymentofachiefinspectoroftrademeasurementorastaffmemberundertherepealedTMAA,section5(1),inforceimmediatelybeforethecommencement,continuesinforcefromthecommencement until it ends; and(c)thechiefinspectormayauthoriseapersontotakeproceedings for offences as mentioned
in the repealedTMAA, section 13(1); and(d)anauthorisationundertherepealedTMAA,section13(1), in force
immediately before the commencement,continues in

Transitional provisions[s 8](e)thechiefinspectormaydelegatethechiefinspector’spowers as
mentioned in the repealed TMAA, section 21;and(f)a delegation under the repealed TMAA,
section 21, inforce immediately before the commencement,
continuesin force from the commencement until it
ends.(3)In this section—staff
membermeans a person, other than a chief inspector
oftrade measurement, mentioned in the repealed
TMAA, section5(1).8Offences(1)This
section applies if a person is alleged to have committedanoffenceagainsteitheroftherepealedActsbeforethecommencement.(2)DespitetheCriminalCode,section11,proceedingsfortheoffence may be started or continued,
and the court may hearand decide the proceedings, as if this
Act had not commenced.9Infringement
notices(1)This section applies if—(a)a person is alleged to have committed
an infringementnotice offence before the commencement;
and(b)atthecommencement,aninfringementnoticefortheoffence had not
been served on the person.(2)Despite the
Criminal Code, section 11, an infringement noticefortheoffencemaybeservedonthepersonandtheStatePenalties Enforcement Act 1999applies as if this Act had notcommenced.(3)In
this section—infringement noticemeans an
infringement notice under theState Penalties

Regulation 1991.10Disciplinary
actions(1)This section applies if—(a)the licensing authority had served a
written notice on alicensee under the repealed TMA, section 57
before thecommencement; and(b)atthecommencement,thelicensingauthorityhadnottakendisciplinaryactionundertherepealedTMA,section 58 against the licensee.(2)The licensing authority may take
disciplinary action under therepealed TMA,
section 58 against the licensee as if this Acthad not
commenced.11Reviews(1)Subsection (2) applies if—(a)immediately before the commencement a
person couldhave applied to QCAT under the repealed TMA,
section59 for the review of a decision of the
licensing authority;and(b)thepersonhasnotmadetheapplicationbeforethecommencement.(2)The
person may apply to QCAT for the review, and QCATmay
review the decision under the repealed TMA, as if thisAct

person has applied to QCAT under the repealed TMA,section 59 before the commencement for the
review of adecision of the licensing authority;
and(b)thereviewhasnotbeenfinallydecidedbeforethecommencement.(4)QCAT
may review, or continue to review, the decision underthe
repealed TMA as if this Act had not commenced.12Seized measuring instruments and other
things(1)Thissectionappliesif,beforethecommencement,aninspector seized—(a)ameasuringinstrument,orrecordsconcerningameasuringinstrumentoritsuse,undertherepealedTMA, section
61(1); or(b)anarticleorotherthingundertherepealedTMA,section 62(2).(2)The
inspector may retain, return, or dispose of the instrument,records, article or other thing under the
repealed TMA as ifthis Act had not commenced.(3)Subsection (2) is subject to section
14(3).13Unpaid fees(1)Thissectionappliesif,immediatelybeforethecommencement,afeepayableundereitheroftherepealedActshasnotbeenpaidwithintheperiodprescribedundereither of the
repealed Acts for payment of the fee.(2)The
fee may be recovered by the State as a debt.(3)In
this section—feeincludes charge or expense.Page

Miscellaneous[s 14]14Disclosure of information about continuing
matters(1)Thissectionappliestoinformationobtainedbythechiefinspector about a continuing matter.(2)ThechiefinspectormaydisclosetheinformationtotheNationalMeasurementInstituteforthepurposeoftheadministration or
enforcement of the Commonwealth law.(3)Iftheinformationrelatestoaseizedthingmentionedinsection12,thechiefinspectormayallowtheNationalMeasurement
Institute to inspect the thing for the purpose ofthe
administration or enforcement of the Commonwealth law.(4)This section applies despite any other
Act.15Reference to a repealed ActAreferenceinanotherActordocumenttoeitheroftherepealedActsmay,ifthecontextpermits,betakenasareference to the Commonwealth
law.Part 4Miscellaneous16Transfer of registers and other
information(1)This section applies to—(a)theregisteroftheprescribedparticularsrelatingtolicences mentioned in theTrade Measurement Act 1990,section 47; and(b)informationobtainedbythechiefinspectorastheadministering authority or licensing
authority.(2)ThechiefinspectormaytransfertheregisterandtheinformationtotheNationalMeasurementInstituteforthepurposeoftheadministrationorenforcementoftheCommonwealth law.(3)This
