iconic values.(3)The declaration must be gazetted as
soon as practicable afterthe date of assent of this Act.6Minister’s power to declare additional
iconic places(1)The Minister may, by gazette notice,
declare (aniconic placedeclaration) a place to be
an iconic place if the place—(a)afterthechangeoverdayforanewlocalgovernmentareaundertheLocalGovernmentAct,chapter3,part1B, will be in the new local
government area; or(b)isinanewlocalgovernmentareaundertheLocalGovernment Act,
chapter 3, part 1B.(2)However,theMinistercannotmakeaniconicplacedeclaration after 30 June 2008.(3)Also,aniconicplacedeclarationmaybemadeonlyiftheMinister is
satisfied that—(a)the characteristics or qualities of
the place’s natural orbuiltenvironmentreflector
contributeinasubstantialway to
Queensland’s character; and(b)the place is
under pressure from population growth andnew development;
and(c)thereisademonstratedthreattothecharacteristicsorqualities; and(d)local
planning instruments for the place contribute in asubstantial way to the protection of the
characteristics orqualities; and(e)there
is substantial support by the local community inthe
place for the making of the declaration.(4)An
iconic place declaration must identify—(a)the

legislation.8Ministerial guidelines about gauging
local communitysupport for iconic place declaration(1)The Minister may, by gazette notice,
publish guidelines abouthowtheMinisterproposestoworkoutwhetherthereissubstantial support by a local
community in a proposed iconicplaceforthemakingofaniconicplacedeclarationfortheplace.(2)In
deciding whether to make an iconic place declaration forthe
place, the Minister may consider, but is not bound by, theguidelines.Division 2Publication of and access toinformation about iconic areas9Publication of declarations(1)As soon as practicable after making a
declaration the Ministermust—(a)give
a copy to—(i)each relevant local government;

(1) does not invalidate orotherwise affect the

values(1)Thelocalgovernmentmustprepareareport(theimpactreport)

subsection (2), the Ministermust have regard
to the impact report.16Treatment of
scheme proposal if Minister considers theiconic values are
affected(1)ThissectionappliesiftheMinisterconsiderstheschemeproposalwould,ifgiveneffectto,beinconsistentwithprotecting the place’s iconic values.(2)If the scheme proposal is for a
planning scheme, the Ministermust, under the
general scheme process or the structure planprocess, impose
conditions on the notification of the schemethattheMinisterconsidersarenecessarytopreservetheiconic values.(3)Iftheschemeproposalisforanamendment,theMinistermust, under the
general scheme process or the structure planprocess, notify
the local government that—(a)it may not
proceed with the amendment; or(b)itmaynotifytheproposalundertherelevantprocess,subject to conditions the Minister considers

publicnotification(1)This
section applies if, under the general scheme process orthe
structure plan process, a decision is made to proceed withthe
scheme proposal after public notification of the proposal.(2)WhengivingtheMinisteracopyoftheschemeproposalunderthegeneralschemeprocessorthestructureplanprocess, the local government must give the
Minister a copyof each properly made submission made to it
about the place’siconic values.(3)IftheMinisteris,underthegeneralschemeprocessorthestructureplanprocess,consideringwhetherornotStateinterests would be adversely affected by the
scheme proposal,theMinistermustalsoconsiderwhetherornottheschemeproposalwould,ifgiveneffectto,beinconsistentwithprotecting the place’s iconic values.(4)In making the consideration under
subsection (3), the Ministermust have regard
to each of the submissions.19Treatment of
scheme proposal if reconsideration is thatthe iconic values
are affected(1)Thissectionappliesif,undersection18,theMinisterconsiderstheschemeproposalwould,ifgiveneffectto,beinconsistent with
protecting the place’s iconic values.(2)If
the Minister advises the local government under the generalscheme process or the structure plan process
that it may adoptthe scheme proposal subject to conditions,
the Minister mustimpose conditions on the adoption of the
scheme proposal thattheMinisterconsidersarenecessarytopreservetheiconicvalues.(3)If the structure plan process applies
to the scheme proposal,the Minister may advise the local
government that it may notproceed further with the scheme
proposal.(4)Ifthereisaninconsistencybetweensubsection(3)andthePlanning Act, or
a guideline mentioned in section 145 of thatAct, subsection

made, the proposed TLPI—(i)would or may have
effect in an iconic place; and(ii)would
suspend or otherwise affect the operation ofaprotectedplanningprovisionrelatingtotheplace.21Report about impact on iconic
values(1)Thelocalgovernmentmustprepareareport(theimpactreport)
about the proposed TLPI evaluating its effect on theplace’s iconic values.(2)ThelocalgovernmentmustgivetheMinistertheimpactreport when,
under the TLPI process, it gives the Minister theproposed TLPI.22Ministerial consideration of effect on
iconic values(1)This section applies if, under the
TLPI process, the Minister isconsideringwhethertheproposedTLPIproposalshouldbemade.(2)The
Minister must also consider whether or not the proposedTLPI

considers theiconic values are affected(1)Thissectionappliesif,undersection22,theMinisterconsiderstheproposedTLPIwould,ifgiveneffectto,beinconsistent with
protecting the place’s iconic values.(2)The
Minister must, under the TLPI process—(a)if
the Minister is satisfied the proposed TLPI should bemade—imposeconditionsonthemakingoftheTLPIthat
the Minister considers are necessary to preserve theiconic values; or(b)iftheMinisterdoesnotconsidertheproposedTLPIshouldbemade—advisethelocalgovernmentthatitmay not proceed
with the proposed TLPI.Division 4Modifications to
scheme policyprocess24Application of div 4This division
applies if—(a)undertheschemepolicyprocess,alocalgovernmentformulatesaproposaltomakeoramendaplanningscheme policy

panel is to decide theapplication instead of the local

35]35Remuneration(1)A
member is to be paid the remuneration and allowances theGovernor in Council decides.(2)A member who is a public service
officer must not be paidremunerationiftheofficeractsasamemberduringtheofficer’s ordinary hours of duty as a public
service officer.(3)Howeverthememberisentitledtobepaidexpensesnecessarily incurred by the member in acting
as a member.36Disclosure of material personal
interests(1)This section applies if—(a)a member, has a material personal
interest in an issuebeingconsidered,orabouttobeconsidered,bythepanel; and(b)thematerialpersonalinterestcouldconflictwiththeproper performance of the member’s
functions relatingto the issue.(2)Themembermust,assoonaspracticable,disclosethematerial personal interest to all the
other members.(3)If a member has disclosed a material

a panel, and may hold the appointment orperformthefunctionsconcurrentlywithanyotherappointment the
officer holds in the public service.41Delegation of Minister’s functions under div
2(1)The Minister may delegate the
Minister’s functions under thisdivisiontothechiefexecutiveoranappropriatelyqualifiedpublic service officer.(2)In

places(1)This section applies if a master plan
application is made for adeclared master planned area and the
area is, or includes, aniconic place.(2)TheMinisteristakentobeaparticipatingagencyforassessing the application.(3)The Minister’s jurisdiction for the
application is the purposeof this Act.(4)In
assessing the application under the Planning Act, section173,theMinistermustconsidertheeffectoftheproposedmaster plan on
the place’s iconic values.(5)If the Minister
is satisfied an aspect of the proposed masterplanisinconsistentwithprotectingtheiconicvalues,theMinistermay,inmakingarecommendationunderthePlanningAct,section175,onlyrecommendoneofthefollowing to the
coordinating agency—(a)that stated conditions to remove the
inconsistency mustbe included in any approval of the proposed
master plan;(b)that the application be
refused.70Consideration of iconic values in
local governmentpolicy-making(1)This
section applies if—(a)a local government proposes to make or

71]71Regulation-making power(1)TheGovernorinCouncilmaymakeregulationsunderthisAct.(2)Withoutlimitingsection39(2),aregulationmayprovidefor—(a)theestablishment,maintenanceandoperationofaregisteroftheinterestsofmembersofpanelsandofpersonswho,undertheregulation,arerelatedtomembersofpanels,theobligationsofmembersofpanels and related persons in relation to
the register ofinterests and the consequences applying to a
failure tocomply with any obligation; and(b)the adoption of a code of conduct for
the members ofpanels, the obligations of members of panels
in relationto the code of conduct and the consequences
applying toa contravention of any obligation;
and(c)requirements for panel members to
record conflicts ofinterest (not including any conflict of
interest arising outof a material personal interest as mentioned
in section36)inissuesarisingintheperformanceofpanels’functions.(3)A regulation under subsection (2)(b)
need not state the termsof the code of conduct, but may state
ethics principles to beincluded in the code of
conduct.(4)A regulation may impose a penalty of
no more than 20 penaltyunits for contravention of a
regulation.72Review of Act(1)The
Minister must, within 3 years after the date of assent ofthis
Act, carry out a review of the operation and effectivenessof
this Act.(2)In carrying out the review, the
