arrangement(1)Acustomer sale
arrangementis an arrangement for the saleof
electricity by an electricity retailer to a person (therelevantcustomer),
but only if, for the sale—(a)theelectricityissuppliedforconsumptioninQueensland; and(b)the
supply of the electricity is measured by a meter.Example—a retail contract
under the Electricity Act for the sale of electricity by aspecialapprovalholdertoapersonforconsumptionatahouseinQueensland, the supply of which is measured
by a meter(2)However, acustomer sale
arrangementdoes not include anarrangementforthesaleofelectricityiftheelectricityisaccessed through a power card
arrangement.(3)There can be 2 or more customer sale
arrangements in placeeventhoughthereisonly1contractforthesaleoftheReprint 3A

supply is measured by a meter, there are 5 customer salearrangements.(4)IfanationalmeteringidentifierhasbeenissuedundertheNational Electricity Rules for the metering
installation for aparticularsupplyofelectricityforconsumptioninQueensland, there is only 1 customer sale
arrangement for thesupply that is measured by 1 or more meters
forming part ofthe installation.Example—If there is a contract for the sale of
electricity by an electricity retailer toa person for
consumption at a house, a national metering identifier hasbeen
issued for the metering installation for the supply of the
electricityand the supply is measured by 3 meters,
there is only 1 customer salearrangement for

unwritten arrangement or contract,and any of the

standard large customer retail contracts.11Meaning ofpower card
arrangement(1)Apower card
arrangementexists for premises in Queensland(thepower card
premisesfor the arrangement) if an
electricityretailer has the facility to sell
electricity for consumption atthe power card
premises using a card operated meter installed,and available for
operation, for the power card premises.(2)For
subsection (1), the following do not matter—(a)whether the power card premises are
occupied;(b)whether the power card premises are
connected for thesupply of electricity;(c)whether electricity is being consumed at the
power cardpremises;(d)whether the card operated meter is installed

receives an accountfromanelectricityretailerwhichshowsthecostofelectricitysupplied to each
flat as measured by a meter. There are 4 on-supplyarrangements (type 2).2A
person owns 10 self-contained apartments which are located in
1building and which are available for holiday
letting. The ownerreceives an account from an electricity
retailer which shows the costof electricity
supplied to each apartment as measured by a meter.There
are 10 on-supply arrangements (type 2).(2)For
subsection (1), the following do not matter—(a)whether electricity is consumed in the
separate areas;(b)whether all separate areas in the
building are included inthe group.17Person may have more than 1 role(1)A set of circumstances applying to a

this division—later financial yearmeans a financial
year starting on or after1 July 2004 and ending before 1 July

established as an amount(annual
levy) for each relevant financial year.(2)However, the levy is imposed under

jointly and severally liable forpayment of the
levy.27Consolidation arrangement does not
affect liability forlevy(1)Apersonmustpaythelevyforeachcustomersalearrangement for which the person is

the relevant customer for 2 or more customersale arrangements
and a single electricity account is issued forthe sale of

sale arrangement if—(a)anumberofcircumstancesmentionedindivision5apply
to the arrangement; and(b)ifallthecircumstancesareconsideredseparately,whether by
individual circumstance or individual set ofcircumstances,
the arrangement would be, on the basisof each separate
consideration, an exempt customer salearrangement.(2)Thearrangementistakentobeanexemptcustomersalearrangement.Example—Acustomersalearrangementwouldbeanexemptcustomersalearrangement if all electricity sold under
the arrangement is supplied to afarming shed and
to a pump used for irrigation.Division 5Particular exemptions31Exemption for later customer sale
arrangements forseparate area(1)Thissectionappliesifthereare2ormorecustomersalearrangements for the sale of electricity for
consumption onlyat the 1 separate area.(2)Eachofthearrangementsthatisalatercustomersalearrangement is an exempt customer sale

customer for thearrangementandatleast1ofthepersonsisapensioner (also
thepensioner); and(b)all electricity sold under the
arrangement is supplied topremisesthatarethepensioner’sprincipalplaceofresidence; and(c)anyotherpersonsharingthepremises,otherthanavisitor, is at
least 1 of the following—(i)the pensioner’s
spouse;(ii)apersonwhoiswhollydependentonthepensioner;(iii)another pensioner;(iv)a
social security beneficiary who does not pay rentfor
his or her occupation of the premises;(v)a
person who is a carer of the pensioner and whodoes not pay rent

stock or other purposesof primary production; or(b)a water or sewerage pump used for
domestic purposes.35Hot water system exemptionAcustomersalearrangementisanexemptcustomersalearrangementifallelectricitysoldunderthearrangementissupplied to a hot water system.36Public park facility exemptionAcustomersalearrangementisanexemptcustomersalearrangementifallelectricitysoldunderthearrangementissupplied to a public park facility.37Security lighting exemption(1)A customer sale arrangement
(therelevant arrangement) isan
exempt customer sale arrangement if—(a)allelectricitysoldundertherelevantarrangementissupplied to security lighting for premises;
and(b)there is at least 1 other electricity
sale arrangement forthe premises; and(c)the
relevant arrangement is not an exempt customer salearrangementunderthebuildingcommonaccountexemption(type1)orthebuildingcommonaccountexemption (type 2).(2)However, the relevant arrangement is not an

arrangement, or otherarrangements,issuppliedtosecuritylightingforthepremises;
and(b)the relevant arrangement is the first
of the electricity salearrangements to have commenced.37AExemption for equipment for medical
conditionAcustomersalearrangementisanexemptcustomersalearrangement if—(a)all
electricity sold under the arrangement is supplied toan
item of equipment; and(b)the equipment is
for the use of a person for a medicalcondition the
person has—(i)whether or not the equipment is used
only by theperson; and(ii)whetherornot,whenusedbytheperson,theequipment is used only for the medical
condition;and(c)the person has
written advice from a doctor to the effectof either of the
following—(i)because of the medical condition, the
person needsto use the equipment;(ii)because of the medical condition, the person
needsto have the equipment readily available for
use in amedical emergency; and(d)the
equipment is not in premises that are, or that are inthe
nature of, a hospital, an aged care hostel or a nursinghome.37BRetirement village common account

sold under the arrangement is supplied for1 or more of the
following—(i)common facilities for the retirement
village;(ii)1 or more on-supply arrangements;
and(c)there is anelectricitysale arrangement,
other than thecustomersalearrangement,foreachoccupiedaccommodationunitintheretirementvillagethatisaseparate domestic
area.Example—A
retirement village has 6 accommodation units. For each
occupiedaccommodation unit that is a separate
domestic area, there is a separatecustomersalearrangementforthesupplyofelectricitytoit.Additionally,theretirementvillageschemeoperatoristherelevantcustomer for a customer sale arrangement for
the supply of electricityfortheretirementvillage’scommonlighting.Thecustomersalearrangement for the lighting is an exempt
customer sale arrangement.37CBuilding common

by giving notice in theapprovedformtotherelevantelectricityretailerfortheon-supply
arrangement not later than 28 days after receipt ofthe
person’s notification.(4)Iftheon-supplyarrangementisanon-supplyarrangement(type1),andthepersonwhonotifiestheon-supplierundersubsection (2) is the occupier of the
separate area the subjectof the on-supply arrangement but is
not also the receiver forthe arrangement, the occupier must
advise the receiver of thenotification in any reasonable way as

relevant electricityretailerforeacharrangementareturncomplyingwithsubsection(3),andintheapprovedform,aboutallthearrangements.(2)If a
person becomes an on-supplier after the commencementofthissection,thepersonmust,within90daysafterbecominganon-supplier,givetotherelevantelectricityretailer for each
on-supply arrangement for which the personis the
on-supplier, a return complying with subsection (3), andin

under this Act for anyelectricitysalearrangementtowhichtheaccountrelates,before it is applied in payment of any other
amount payableunder the account.103Payment to commissioner of received levy
amounts(1)Anelectricityretailermustpaytothecommissioneralevyamount collected—(a)within1dayaftertheelectricityretailerreceivestheamount; or(b)within a later time approved by the
commissioner.(2)Theelectricityretailermustpaytheamounttothecommissionerwithoutanydeductionorset-offofanytype,including, in
particular, without any deduction or set-off forany
administration fee payable to the electricity retailer by
thecommissioner for the collection of the levy
amount.(3)Despite subsections (1) and
(2)—(a)if the electricity retailer is
authorised under division 8 topay a refund, the
electricity retailer may pay the refundout of levy
amounts collected; and(b)theelectricityretailermayset-off,fromtheamountpayable to the
commissioner—(i)if a cheque was used to pay a levy
amount and thecheque was later dishonoured—the amount of
thedishonoured cheque that relates to the levy
amountpaid; or(ii)if a
credit card was used to pay a levy amount andthe credit card

levy amount paid.(4)When an electricity retailer pays to
the commissioner a levyamount collected from an electricity
customer, the electricityretailer must give the commissioner a
return in the approvedform for the payment.(5)The return must include information
about any amount thathas not been included in the payment
because—(a)it has been used to pay a refund;
or(b)it has been set-off under subsection
(3)(b).(6)The refusal of the commissioner to
approve a later time undersubsection (1)(b) is a non-reviewable
decision.104Voluntary contributions(1)This section applies if—(a)a customer sale arrangement is an
exempt arrangementbecause of a pensioner exemption; and(b)thearrangementisbeingdealtwithbytherelevantelectricityretailerforthearrangementasanexemptarrangement;
and(c)therelevantcustomerforthearrangementvoluntarilypaystotheelectricityretaileranamount(voluntarycontribution)thatisadditionaltoanyamountthatispayablebythecustomerfortheelectricityaccountrelating to the arrangement.(2)To the extent the voluntary
contribution is not more than therelevant amount
in a financial year, the voluntary contributionistaken,forallpurposesofthisAct,tobealevyamountreceivedbyanelectricityretailerandpayabletothecommissioner.(3)In

amount(1)If an electricity retailer becomes
aware of a shortfall amountpayable by a person, the electricity
retailer must give writtennotice to the person of the shortfall
amount.(2)The commissioner may give written
notice to a person of ashortfall amount payable by a
person.(3)A written notice given under
subsection (1) may be includedin an electricity
account.(4)A person given a notice under
subsection (1) or (2) must paythe shortfall
amount to the person who gave the notice within14 days after the
person receives the notice.(5)A notice must not
be given under subsection (1) or (2) morethan 5 years
after the shortfall amount should have been paid.(6)The limitation in subsection (5) does
not apply if, in failing topay the shortfall amount, the
person—(a)acted fraudulently; or(b)knowinglymisledthecommissioneroranelectricityretailer;
or(c)otherwiseacteddeliberatelytoevadepaymentoftheamount.(7)A notice given under subsection (1) or
(2) must include adviceto the effect that the person has a
right of objection under thisActifthepersonclaimsthattheshortfallamountisanincorrect amount
or that no shortfall amount is payable.105ARequirement to pay shortfall amount for

replaced by the new arrangement, being dealt withby
the electricity retailer for the previous arrangement,forthepurposesofelectricityaccounts,asanexemptcustomer sale arrangement.(2)Iftheelectricityretailerforthenewarrangementbecomesawareofashortfallamountpayablebythecustomerinrelationtothepreviousarrangement,theelectricityretailermustgivewrittennoticetothecustomeroftheshortfallamount.(3)If a notice is given under subsection
(2), section 105(3) to (7)apply as if the notice was given under
section 105(1).(4)For subsection (1)(d), the supply of

claim in the approved form orbycomplyingwiththenotificationrequirementsunderthispart.(3)If
the electricity retailer is satisfied the electricity customer
isentitled to the refund amount, the
