force on 18 June 1997]An Act to rezone certain land in the
City of Ipswich, and for relatedpurposes˙Short title1.This
Act may be cited as theLocal Government (Springfield
Zoning)Act 1997.˙Definitions2.In
this Act—“council”means the
Council of the City of Ipswich.“development
control plan”means the Springfield development
controlplan, as approved by the order.1“order”meanstheIpswichCityCouncil(ApprovalinPartofaDevelopmentControlPlan)Order(No.6)1997publishedinthegazette on 24
January 1997 at page 205.“PlanningAct”meanstheLocalGovernment(PlanningandEnvironment) Act 1990.“planning scheme”means the
planning scheme that, under the PlanningAct and because
of theLocalGovernment(Brisbane,Esk,Ipswich,Logan and
Moreton) Regulation 1994, is the planning scheme of the1A copy of the development control plan
may be inspected at the head office ofthe Department of
Local Government and Planning or at the public office of theIpswich City Council.

City of Ipswich.“Springfield land”means the land
to which the development control planapplies.˙Zoning of Springfield land3.The Springfield land is included in
the particular development zone oftheplanningschemeandistakentohavebeenincludedonandfrom24 January
1997.˙Effect of zoning under s 34.(1)Section 3 amends
the planning scheme.(2)Thecouncilandthedepartmentmaydoanythingnecessaryorconvenient to be done to carry out or
give effect to this Act.Example for subsection (2)—TheparticulardevelopmentzoningoftheSpringfieldlandmaybenotedontheplanning scheme’s
maps.˙Subsequent change of zoning5.This Act does not prevent an action to
change, under the Planning Act,the zoning of the
Springfield land or part of the Springfield land.˙Act does not limit other lawful
purposes6.This Act does not limit the purposes
for which the Springfield landmay be lawfully
used apart from this Act.˙No rights to
compensation7.CompensationisnotpayablebytheStateorthecouncilmerelybecause of—

enactment or operation of this Act; or(b)anything done to carry out or give effect to
this Act.˙Preservation of existing use rights and
approvals8.(1)Eachapproval,consent,permission,authorityorpermitteduseunderthePlanningActinrespectoftheSpringfieldlandinforceimmediately
before 24 January 1997, continues to have force and effectdespite the commencement of the order and
this Act, and takes effect as ifthe order and
this Act had not commenced.(2)If an
application of any kind was duly made under the Planning ActbutnotfinallydealtwithbeforethecommencementofthisAct,theapplicationmustbedealtwithasifneithertheordernorthisActhadcommenced.(3)If
the application is approved, the application takes effect as if
neitherthe order nor this Act had commenced.(4)Anapproval,consent,permission,orauthorityunderthedevelopment control plan in respect of
the Springfield land for the use ofpremises as a
service station, in combination with a specified use within
themeaning of section 8.42of
the Planning Act, is a lawful use of premisesdespite section
8.4 of that Act.˙Application of Acts Interpretation Act
1954, s 20A9.ThisActisalawtowhichtheActsInterpretationAct1954,section 20A3applies.˙Regulation-making power10.The
Governor in Council may make regulations under this Act.2Section 8.4 (Combined use of premises
for service station and shop)3Section 20A (Repeal does not end saving,
