titleThis Act may be cited as theDisability Services Act 1992.2CommencementThis Act
commences on a day to be fixed by proclamation.3Purposes of ActThe purposes of
the Act are—(a)to affirm the principle that people
with disabilities havethe same rights as other members of
society; and(b)tosetouttheobjectivestobepromotedinthedevelopmentandimplementationofprogramsandservicesforpeoplewithdisabilitiesbypublicsectorunits,byserviceprovidersorservicedevelopersreceivingfundingunderthisActandbyotherbodies;and(c)toestablishafundingmechanismsothatservicesareprovided to, and services are
developed for, people withdisabilitiesinawaythatassiststhemachievetheirmaximum potential as members of society;
and(d)toencourageinnovativeprogramsandservicesforpeople with disabilities.

the Crown in right of the State and, so far asthe legislative
power of the Parliament permits, the Crown inall its other
capacities.Part 2Basic
concepts5Disabilities covered by this
Act(1)This Act applies to a person with a
disability—(a)thatisattributabletoanintellectual,psychiatric,cognitive,
neurological, sensory or physical impairmentor a combination
of impairments; and(b)that results in—(i)a
substantial reduction of the person’s capacity forcommunication,socialinteraction,learningormobility; and(ii)the
person needing support.(2)The disability
must be permanent or likely to be permanent.(3)The
disability may be, or may not be, of a chronic episodicnature.6Meaning ofserviceprovider(1)Aserviceprovideris—(a)a natural person
who provides services to people withdisabilities
(whether or not the service provider and thepeople with
disabilities are related); or(b)anorganisationthatprovidesservicestopeoplewithdisabilities, including—(i)a
public sector unit; and(ii)a local
government; and(iii)an institution
that provides tertiary education; and

incorporated)that is not a public sector unit, local
government orinstitution that provides tertiary
education.(2)The service provider may provide the
services—(a)specifically to people with
disabilities; or(b)generally to people in the community,
including peoplewith disabilities.(3)Theserviceprovidermayprovidetheserviceswiththeintention of making a profit.7Meaning ofservicedeveloperAservicedeveloperis a
person who—(a)researchestheprovisionofservicesforpeoplewithdisabilities; or(b)investigatestheneedforservicesforpeoplewithdisabilities; or(c)examines the outcomes of providing services
to peoplewith disabilities; or(d)plansfortheprovisionofservicesforpeoplewithdisabilities; or(e)developsproposalsfortheprovisionofservicesforpeople with disabilities; or(f)initiates services for people with
disabilities; or(g)develops or implements training
programs for—(i)the families of, and other persons who
provide carefor or assistance to, people with
disabilities; or(ii)other service providers.8Meaning ofgrantee(1)Agranteeisapersonwhoisgrantedfinancialassistanceunder
part 5.(2)A reference in part 6 to a grantee
includes, in the case of anunincorporatedbody,thememberormemberswhoagreed,

disabilities have the samehuman rights as others(1)People with disabilities have the same
basic human rights asothermembersofsocietyandshouldbeempoweredtoexercise their rights.(2)People with disabilities have the right
to—(a)respect for their human worth and
dignity as individuals;and(b)realisetheirindividualcapacitiesforphysical,social,emotional and intellectual development;
and(c)services that support their attaining
a reasonable qualityof life in a way that supports their family
unit and theirfull participation in society; and(d)participateactivelyinthedecisionsthataffecttheirlives,includingthedevelopmentofdisabilitypolicies,programs and services; and(e)anynecessarysupport,andaccesstoinformation,toenable them to participate in decisions that
affect theirlives; and(f)receiveservicesinawaythatresultsintheminimumrestriction of
their rights and opportunities; and(g)pursue any grievance in relation to services
without fearof the services being discontinued or
recrimination fromservice providers; and(h)adequatesupporttoenablepursuitofgrievancesinrelation to services.

Services Act 1992(3)This section applies regardless of the
age of the person withthedisabilityortheorigin,nature,typeordegreeofthedisability.(4)Services,andtheinformationnecessarytosupportaright,shouldbeprovidedinawaythatisappropriatetakingintoaccount the disability and the
person’s cultural background.(5)Subsection (2) does not limit subsection
(1).Part 4Objectives for
the developmentand implementation ofprograms and
services forpeople with disabilities10Objectives in part to be promoted by service
developersand service providersThispartsetsouttheobjectivestobepromotedbyservicedevelopersandserviceprovidersinthedevelopmentandimplementationofprogramsandservicesforpeoplewithdisabilities.11Focus
on the development of the individualPrograms and
services should be designed and implementedsothattheirfocusisondevelopingtheindividualandonenhancing the individual’s opportunity
to establish a qualitylife.12Focus
on a lifestyle the same as other people andappropriate for
agePrograms and services should be designed and
implementedto ensure that the conditions of everyday
life of people withdisabilities are—

to, the conditions ofeveryday life valued by the general
community; and(b)appropriate to their chronological
age.13Coordination of, and integration of,
services with generalservices(1)Services should be designed and implemented
as part of localcoordinatedservicesystemsandintegratedwithservicesgenerally
available to members of the community, whereverpossible.(2)Public sector units should develop,
plan and deliver disabilityprograms and services in a coordinated
way.14Services to be tailored to meet
individual needs andgoalsServices should
be tailored to meet the individual needs andgoals of people
with disabilities.15People with disabilities experiencing
additionaldisadvantagesPrograms and
services should be designed and implementedtomeettheneedsofpeoplewithdisabilitieswhomayexperience additional
disadvantages—(a)because they are Aborigines or Torres
Strait Islanders;or(b)because of their
sex, ethnic origin or location.16Promotion of competency, positive image
andself-esteemPrograms and
services should be designed and implementedto—(a)promote recognition of the competence
of people withdisabilities; and(b)promote a positive image of people with
disabilities; and(c)enhance the self-esteem of people with
disabilities.

implementedto promote the inclusion of people with
disabilities in the lifeof the local community.18No single organisation to exercise
control over life ofperson with disabilityPrograms and
services should be designed and implementedto ensure that no
single organisation that is a service providerexercisescontroloverallormostaspectsofthelifeofaperson with a disability.19Certain service providers to make
information available(1)Organisations
that are service providers should make availableinformationthatallowsthequalityoftheirservicestobejudged.(2)The information should be available to
the people using theservices, their advocates, any person who
provides financialassistance for the services and the
community generally.20Access to advocacy supportServices should be designed and implemented
to ensure thatpeoplewithdisabilitieshaveaccesstoanynecessaryindependentadvocacysupportsothattheycanparticipateadequatelyindecision-makingabouttheservicestheyreceive.21Raising and resolving grievancesPrograms and services should be designed and
implementedtoensurethatappropriatewaysexistforpeoplewithdisabilitiesandtheiradvocatestoraisegrievancesaboutservices and have
them resolved.22Participation in planning etc. of
services(1)Servicesshouldbedesignedandimplementedtoprovidepeople with
disabilities with, and encourage them to make use

receive.(2)Programsandservicesprovidedtopeoplewithdisabilitiesshould provide
opportunities for consultation in relation to thedevelopment of major policy and program
changes.23Respect for privacy and
confidentialityPrograms and services should be designed and
implementedto respect the rights of people with
disabilities to privacy andconfidentiality.24Consideration etc. for others involved with
people withdisabilitiesPrograms and
services should be designed and implementedto—(a)considertheimplicationsforthefamilies,carersandadvocates of people with disabilities;
and(b)recognisethedemandsonthefamiliesofpeoplewithdisabilities; and(c)take
into account the implications for, and demands on,the
families of people with disabilities.Part 5Grant
of financial assistance25Persons eligible
to apply for fundingThefollowingpersonsareeligibletoapplyforagrantoffinancial assistance—(a)people with disabilities;(b)service providers;(c)service developers.

financial assistanceThe Minister may approve grants of financial
assistance onlyif the Minister is satisfied that—(a)the principles set out in part 3 will
be promoted by thegrant; and(b)theprogramsandservicesfundedbythegrantwillpromote the objectives set out in part
4.27Agreement about conditions to which
financialassistance is subject(1)Apersonisnottobepaidmoneyunderagrantunlesstheperson has agreed, in writing, with
the conditions on whichthe grant is made.(2)The
agreement may deal with a matter that is dealt with underpart
6.(3)Ifthegranteeisanunincorporatedbody,amemberormembers of the organisation (specified by
the Minister) mustagree,inwriting,withthe
conditionsonwhichthegrantismade.(4)Ifthegranteeisaserviceprovider,theagreementmustsetout—(a)the
objectives of the service provider; and(b)the
outcomes to be achieved by the people receiving theservices; and(c)the
rights of the people receiving the services.28Minister’s powers not limited by agreement
etc.(1)The Minister’s powers under this part
are not limited by—(a)the inclusion of a matter in an
agreement under section27; or(b)a
power of the chief executive of the department underpart
6.(2)The Minister may review, amend or
repeal any decision underpart 6 of the chief executive of the
department.

part 5—(a)is not being complied with; or(b)has not been complied with;thechiefexecutivemayexercise1ormoreofthepowersunder this
part.30Chief executive may request grantee to
provideexplanation(1)The
chief executive may request the grantee to explain to thechief
executive why—(a)further payments under the grant
should be made; and(b)amounts paid under the grant should
not be refunded.(2)The request must be in writing and
allow 21 days after the dayof its receipt before the grantee must
provide the explanation.31Chief executive
may suspend further paymentsIf the
grantee—(a)does not provide an explanation to the
chief executivebefore 21 days after the receipt of the
request; or(b)fails to satisfy the chief executive
that the conditions ofthegrantarebeingcompliedwithandhavebeencomplied with;the chief
executive may suspend further payments under thegrant.

etc. of booksand records and examine them etc.(1)The chief executive may request the
grantee to produce to thechief executive any books or records
kept in relation to moneyreceived under the grant.(2)The chief executive may examine and
make copies of, or takeextracts from, the books and records
relating to the receipt andspending of the money.33Chief executive may request
auditor-general to auditbooks etc.(1)The
chief executive may request the auditor-general to auditthe
accounts of the grantee.(2)Incarryingouttheaudit,theauditor-generalhasallthepowersconferredontheauditor-generalbytheFinancialAdministrationandAuditAct1977in respect of an audit ofthat
type and the provisions of that Act apply in respect of theaudit
and to all persons concerned with it.Part 7Miscellaneous34Delegation by Minister of powers under
ActThe Minister may delegate the Minister’s
powers under thisAct to an officer of the department.35Delegation by chief executiveThe
chief executive of the department may delegate any of thefollowing powers to an officer of the
department—(a)the chief executive’s powers under
part 6;(b)a power delegated to the chief
executive under section34.
