Staff[s 6](3)The
fact that the deputy chief inspector of trade measurementhas
exercised any function of the chief inspector is, until thecontrary is proved, sufficient evidence of
the absence of thechief inspector or a vacancy in the office
of chief inspector.6Authority to exercise functions of an
inspector(1)Authoritytoexercisethefunctionsofaninspectormaybegiven by the chief inspector to a
person who, under the law ofanotherStateorofaTerritorythatcorrespondstotheprincipal Act, has functions similar
to those of an inspectorunder the principal Act.(2)A person authorised under subsection
(1) has the functions ofan inspector for the time and purposes
specified by the chiefinspector when giving the
authority.7Control of inspectorsAperson(otherthanthechiefinspector)whoexercisesthefunctions of an inspector is, in the
exercise of the functions,subject to the direction and control
of the chief inspector.8Inspectors’
certificates of authority(1)Either the
Minister or the chief inspector is to issue to eachinspector a certificate of authority in the
approved form.(2)The Minister is to issue to the chief
inspector a certificate ofauthority in the form determined by
the Minister.9Functions of chief inspector under
CommonwealthregulationsThe chief
inspector, with the approval of the Minister—(a)mayholdanappointmentmadeundertheNationalMeasurement
Regulations of the Commonwealth; and(b)may
exercise any functions conferred on the holder ofthe

and charges10Fees and charges may be
prescribed(1)Regulationsmaybemadeforandwithrespecttotheimposition,
collection and recovery of fees and charges for thepurposes of the principal Act and this Act
including—(a)application fees; and(b)licence fees; and(c)feespayablefortheissueofamendedlicencesorcertificatesandfortheissueofduplicatelicencesorcertificates; and(ca)feespayableforprovidingweighbridgesuitabilitystatementsorduplicatesofweighbridgesuitabilitystatements;
and(d)chargesfortheverification,re-verificationorcertification of measuring instruments;
and(e)charges for the examination of public
weighbridges forsuitability; and(f)chargespayablewhereaninspectorkeepsanappointment to examine or test a
measuring instrumentbutisunabletocarryouttheexaminationortestingbecausethemeasuringinstrumentisunavailableorinaccessible or access to it is unreasonably
refused; and(g)charges to reimburse costs incurred in
connection withthe examination and testing of a measuring
instrumentunder the principal Act; and(h)charges payable by a person where the
use of specifiedlabour or equipment provided by the chief
inspector isnecessaryfortheexerciseofthefunctionsofaninspector; and(i)chargespayablefortheusebyapersonofspecifiedequipment

Proceedings for offences[s 11](2)Theregulationsmayprovideforachargeundersubsection(1)(d) to (i) to
be calculated on a time basis.(3)The
regulations may provide for the fee payable under section52
(Periodic licence fee) of the principal Act for a licence tobe a
specified amount or an amount calculated in a specifiedmanner.(4)For
this section, it does not matter whether the fee prescribedfor a
public weighbridge licence and a weighbridge suitabilitystatement is a combined fee for the same
period.11Recovery of unpaid fees and
chargesA fee or charge payable under the
regulations is recoverableas a debt due to the Crown.Part
4Proceedings for offences12Time
for instituting proceedings for offenceProceedings for
an offence under the principal Act or this Actmaybecommencedwithin12monthsaftertheoffenceiscommitted or within 12 months after the
offence comes to theknowledge of the complainant, whichever
period is the later toexpire.13Summary proceedings(1)Proceedings for offences under the principal
Act or this Actare to be taken in a summary manner under
theJustices Act1886uponthecomplaintofthechiefinspector,orotherperson authorised
in that behalf by the chief inspector.(2)Anavermentinthecomplaintthatthecomplainantisdulyauthorisedtolaythecomplaintissufficientproofofsuchauthorisation in

General[s 15]15Double jeopardy(1)If an
act or omission is both an offence under the principal ActandanoffenceunderalawoftheCommonwealth,orofanother State, or of a Territory, a
person who—(a)is convicted of the offence under that
law; or(b)is found by a court to have committed
the offence underthat law but is not convicted;is
not liable to be proceeded against for the offence under theprincipal Act.(2)InproceedingsundertheprincipalAct,acertificatethatcomplieswithsubsection(3)inrelationtoaconvictionorfinding of a court is conclusive evidence of
the conviction orfinding unless it is proved—(a)that the conviction was quashed or set
aside; or(b)that the finding was set aside or
reversed.(3)A certificate complies with this
subsection if it is signed bythe registrar or
other proper officer of the court that directedthe conviction or
made the finding and is to the effect—(a)that
a named person was, on a stated date, convicted bythat
court of a specified offence; or(b)thatanamedpersonchargedwithaspecifiedoffencewas,onastateddate,foundbythatcourttohavecommitted the
offence but was not convicted.Part 6General19Search warrants(1)Aninspectormayapplytoastipendiarymagistratefortheissue of a search
warrant in respect of any premises or partthereof.Page

General[s 19](2)If a
stipendiary magistrate to whom application for a searchwarrantundersubsection(1)ismadeissatisfiedthattheinspector suspects on reasonable
grounds that—(a)in the premises or part to which the
application relatesan offence against the principal Act is
being or has beencommitted; or(b)in
the premises or part to which the application relatesthereisanythingwithrespecttowhichanoffenceagainsttheprincipalActisbeingorhasbeencommitted, or
with respect to which the inspector mayexerciseafunctionconferredontheinspectorbytheprincipal
Act;the stipendiary magistrate may, subject to
subsection (5), issuea search warrant directed to the
inspector to enter the premisesor part specified
in the warrant for the purpose of exercisingtherein the
powers conferred on an inspector by the principalAct.(3)A search warrant
remains in force for the period of 1 monthfromthedateofitsissueandislawfulauthorityfortheinspector to whom
it is directed—(a)toenterthepremisesorpartspecifiedinthesearchwarrant using
such force as is reasonably necessary forthe purpose;
and(b)to exercise therein the powers
conferred on an inspectorby the principal Act.(4)Aninspectorexecutingasearchwarrantistoproducethewarrant for inspection by the occupier
of the premises or partconcerned, if requested by the
occupier so to do.(5)A stipendiary magistrate is not to
issue a search warrant undersubsection (1)
unless—(a)the application therefor is made on
oath or affirmationandsetsoutthegroundsonwhichtheinspector’ssuspicion is
based; and(b)thestipendiarymagistratehasbeenfurnished(bytheinspector or

grounds as the stipendiary magistraterequires,suchinformationbeinggivenonoathoraffirmation;
and(c)thestipendiarymagistrateissatisfiedthattheissueofthe
search warrant is justified.(6)A
stipendiary magistrate who issues a search warrant undersubsection(1)istocausetobemade(onthewarrantorotherwise)arecordofthemattersoffactonwhichthestipendiarymagistratehasreliedtojustifytheissueofthewarrant.(7)Any
justice is authorised to administer any oath or affirmationnecessaryformakinganapplicationforasearchwarrantunderthissectionorforfurnishinganyinformationorstatement for the purposes of this
section.21DelegationThe chief
inspector may delegate the chief inspector’s powersunder
the principal Act or this Act.22Secrecy(1)A
person is not to, without the prior approval of the Ministeror
the chief inspector, produce in any court or provide to anyperson any document, or disclose to any
court or person anyinformation,thathascomeintothefirstmentionedperson’spossessionortothatperson’sknowledgeintheexerciseofthatperson’sfunctionsunderaprescribedActunlessthatperson—(a)does
so for the purposes of a prescribed Act; or(b)is
required to do so by order of any court or judge orotherwise by law.(2)A
person who fails to comply with subsection (1) commits anoffence.Maximum

each of the following Actsis a prescribed Act—(a)this Act;(b)principal Act;(c)repealed Act.23Penalties etc. payable to consolidated
fundAllpenalties,costs,fees,chargesandexpensesrecoveredunderthisActaretobepaidintoandbecomepartoftheconsolidated fund
of this State.23AApproval of formsThe chief
executive may approve forms for use under this Act.24Regulations(1)TheGovernorinCouncilmaymakeregulationsunderthisAct.(2)A
regulation may impose a penalty not exceeding 30 penaltyunits
