1997]†PART 1—PRELIMINARY†Article 1—Articles of governing
scheme˙Short title1.ThisdocumentistheArticlesoftheGovernmentOfficers’Superannuation Scheme.†Article 2—Interpretation˙Definitions2.In
these articles—“authorised leave”, of a member,
means leave from the member’s dutiesof employment
that is—(a)approved by the member’s employer;
or(b)authorised by—(i)a
law of the State; or(ii)an agreement
certified, or an award made, by the IndustrialRelations
Commission.“commencement date”means the date
on which the scheme commencespursuant to
section 17 of the Act.“disablement”meansanymentalorbodilyinjury,illness,diseaseorinfirmity.
s26s2Articles of the Government Officers’Superannuation Scheme“employer”means the Crown or other body which pays the
salary of amember.“employer
contributions”means contributions made to the fund
pursuantto article 5 and, where applicable, article
7.“member”means a person
who—(a)isapprovedtobeamemberoftheschemeundertheSuperannuation(GovernmentandOtherEmployees)Notice1996; and(b)hasnotreceivedtheperson’sfullentitlement,orhadthemember’saccumulatedcontributionsofthepersontransferred,under these
articles.“memberwithunclaimedbenefits”meansapersonmentionedinsection 26A(1) of the Act.“member’s accumulated employer
contributions”means in respect of amemberasataparticulardate,anamountequaltothatmember’semployer contributions to the scheme made
pursuant to articles 5 and7togetherwithinterestaccruedwithrespecttheretolessanyadministrative fees and charges and any
insurance premiums paid inrelation to the member.“member’s accumulated personal
contributions”means in respect of amemberasataparticulardate,anamountequaltothatmember’spersonal contributions to the scheme made
pursuant to article 6 and,where applicable, article 7 together
with interest accrued less (whereapplicable) any
administrative fees and charges.“preservationcashingcondition”meansaneventmentionedinsection 17(a) to (g).“preserved amount”, of a member,
means—(a)an amount received by the board for
the member under article 5;or(b)themember’saccumulatedpersonalcontributionsthat,on30June1994,wererequiredtobepreservedundertheOccupationalSuperannuationStandardsRegulations1987

member only if a preservationcashing
condition has been complied with.“salary”, in
relation to a member—(a)who is a member
of the police service, has the meaning given bythePolice Superannuation Act 1974,
section 4; and(b)whoisnotamembertowhichparagraph(a)applies,hasthemeaninggivenbytheStateServiceSuperannuationAct1972,section 4, except that the Governor in
Council may determine thatany sums paid by way of fees or
allowances be included as partof the
salary.“scheme”means the scheme
for the provision of superannuation benefitsas provided for
by these articles.“superannuationsystem”hasthemeaninggiventoitbytheSuperannuationIndustry(Supervision)Regulations1994(Cwlth),regulation
5.01.2“total and permanent
disablement”means disablement of a degree thatin
the opinion of the board after obtaining the advice of not less
than2 medical practitioners, the member is
unlikely ever to be able to workagaininajobforwhichthememberisreasonablyqualifiedbyeducation training or

person becomes a member of the scheme on and from the date
onwhichtheemployercommencestomakecontributionstothefundonbehalf of that member pursuant to article 5
and shall be entitled to benefitsunder the scheme
pursuant to articles 9, 10 (where applicable) and 11.†Article 5—Employer
contributions˙Definitions7.In
this article—“base year”means—(a)foranemployerwhowasanemployerforthewholeofthefinancial year
starting on 1 July 1991—that financial year; or(b)for
an employer who was not an employer for the whole of thefinancial year starting on 1 July 1991—the
first financial year inwhich the employer is an employer for
the whole of the year.“prescribed percentage”means—(a)foramemberwhoisacontributorunderthePoliceSuperannuation
Act 1974,theState Service Superannuation
Act1972oranotherschemetheMinisterdecidesisaschemetowhich this article applies—3%;
or(c)for another member—6%.˙Payment of contributions8.(1)Theemployerofamemberwhohasnotattainedtheageof65
years shall pay to the board on each pay day on and from the day
that is

in July 1988 for and on behalf of a member employed by itanamountequaltotheprescribedpercentageofthesalarypaidtotheemployee on each
pay day.(2)However,wherecontributionshavenotbeenpaidinrespectofaperson employed by an employer because
the basis on which that person isemployed is such
that the employer is of the opinion that such person is notamemberundertheschemeandatsometimeduringthecourseofafinancialyearsuchpersonbecomesamemberbecauseoftheSuperannuation(GovernmentandOtherEmployees)Notice1996,section 4(3)(b), then the employer shall pay
to the board an amount equal tothe prescribed
percentage of the salary paid to the member in the precedingperiod of 12 months.(3)Subsections (1) and (2) apply subject to
section 12A.˙Contributions while member is on
workers’ compensation9.(1)Thissectionapplieswhileamemberisreceivingcompensationunder theWorkCoverQueenslandAct1996instead of
salary paid by anemployer.(2)The
employer must pay to the board, on the member’s behalf, theamount payable under section 8 as if the
member had been engaged in themember’s normal
work.˙Discretionary contributions10.(1)Theboardmay,initsabsolutediscretion,receivefromanyemployer,forandonbehalfofamemberintheemploymentoftheemployer who has not attained the age
of 65 years, amounts in addition tothose referred to
in sections 8 and 9.(2)Subsection (1) applies subject to
section 12A.˙Method of payment11.Allpaymentstobemadetotheboardbyanemployerundertheterms of these articles must be made by
such method as the board fromtime to time
directs.

contributions12.(1)The board may in
its absolute discretion accept from any memberpersonal
contributions paid by the member by such methods as the
boardmay from time to time approve.(2)Subsection (1) applies subject to
article 6A.†Article 6A—Acceptance of
contributions˙Acceptance of contributions—member
under 6512A.The board may
accept contributions for a member who is under65 years only in
the following circumstances—(a)while the member—(i)regularly works at least 10 hours a week for
an employerand receives a regular salary for the
employment; or(ii)receives a
yearly salary from an employer that equals, or isat
least, 50% of the tax-free threshold for taxation purposesunder theIncome Tax
Assessment Act 1936(Cwlth); or(iii)receives a salary of at least $450 a
month;(b)for up to 2 years after the member
ceases to regularly work atleast 10 hours a
week for an employer;(c)for up to 7
consecutive years while the member—(i)isonauthorisedleavetoraisechildren,ofwhomthemember is a parent, or for whom the member
has assumedthe responsibility of a parent; and(ii)has a statutory
or contractual right to resume employment atthe end of the
authorised leave.

or over12B.(1)Theboardmayacceptcontributionsforamemberwhois65 years or over only if the
member—(a)was at least 60 years on 1 July 1990;
and(b)is under 70 years when the
contribution is made.(2)This section
expires on 30 June 2000.†Article
7—Transfer from other funds˙Board
may accept transfer of contributions from other funds13.(1)The board may in
its absolute discretion receive from some othersuperannuation,pensionorlikeschemeorfundorfromthetrusteesoradministrators or other controlling body
thereof any moneys in respect of amember’s interest
in that other scheme or fund or from a life assuranceofficeorfromapreviousemployerofthatmemberorfromsuchothersource approved
by the board.(2)All moneys received by the board on
behalf of that member shall bedeemed to be
personal contributions or employer contributions to the
fund,as the case may be, made on behalf of that
member and shall be dealt withby the board in
accordance with articles 9 and 11.†Article 8—Member’s account and
interest˙Member’s account14.(1)The
board shall maintain a separate account in the name of eachmember to which shall be credited—(a)contributionsmadebytheemployerofthememberorcontributions received pursuant to
section 13; and(b)personal contributions received
pursuant to section 12; and(c)the
proceeds of any insurance claim received under article 10,subarticle 1; and

from which shall be debited—(e)any
benefit paid to or in relation to the member; and(f)anyadministrativefeesandcharges(includingaprovisionforincome tax); and(g)any
insurance premiums required to be paid under article 10 forthe
member.(2)Anamountofadministrativefeesandchargesdebitedfromanaccountforaperiodmustnotbemorethantheinterestcreditedtotheaccount for the
period for—(a)members with unclaimed benefits;
and(b)members with an account balance of
less than $1 000.(3)For subsection (2), administrative
fees and charges do not include aprovision for
income tax.˙Interest15.The
board shall from time to time—(a)declare the interest rate which it intends
to pay to the members;and(b)credit the account of each member with
interest at the rate fixedby and in the manner determined by the
board.†PART 3—BENEFITS AND PAYMENTS†Article 9—Benefits˙Application16.The
benefits of the scheme shall be as provided in this
article.

for payment of benefits17.Subject to the
provisions of article 11 the board shall pay the amountstandingtothecreditofthemember’saccountascertainedpursuanttosection 14 upon being satisfied of the
occurrence of any 1 of the followingevents—(a)permanent retirement from the
workforce after having attained theage of 55
years;(b)attainmentoftheageof55yearsifpriortothemember’sattainment of
that age the member has already permanently retiredfrom
the workforce for a reason other than paragraph (c);(c)retirement on the grounds of total and
permanent disablement,before attaining the age of 55
years;(d)the permanent departure of the member
from Australia;(e)death of the member;(g)the member—(i)turns 70 years; and(ii)is
not employed for at least 30 hours a week.˙Persons entitled to payment of
benefits18.A benefit payable pursuant to the
provisions of this article shall bepaid to the
member, or if the member is dead, to the member’s estate or
tosuch person or corporation as the board after
the receipt of an application forthe payment
thereof in its sole discretion may determine.˙Application to be made for benefits19.A member or the person or corporation
claiming to be entitled to thebenefit of a
deceased member shall make application to the board for thepaymentofthebenefitinsuchmannerandproducesuchevidenceofentitlement to payment of the benefit as the
board in its sole discretion maydetermine.

Government Officers’Superannuation Scheme˙Transfer of benefits20.Where applicable the balance of a member’s
accumulated employercontributions shall be transferred to
the State service superannuation schemeorthepolicesuperannuationschemeasprescribedbytheState ServiceSuperannuation
Act 1972and thePolice
Superannuation Act 1974.˙Assignment of benefits21.Benefits payable from the fund are not
capable of being assigned,charged, taken in execution, attached
or of passing by operation of law, andany moneys
payable from the fund on the death of a member are not
liabletobeappliedormadeavailableinpaymentofthemember’sdebtsorliabilities.†Article 10—Death and disablement
insurance†Subarticle 1—Insurance against death
or total and permanentdisablement˙Definitions22.In
this subarticle—“insurance terms”means the terms
decided under section 22C.“insured member”means a member
insured under this subarticle.˙Provision of insurance22A.(1)The
board must provide insurance against the death, or total andpermanent disablement, of each person
who—(a)becomes a member on or after 1 July
1995; or(b)was, on 30 June 1995, being provided
insurance under a grouplife assurance policy entered into by
the board; or(c)becomes an insured member under
section 22B.

Officers’Superannuation Schemes 22C(2)However,theboardisnotrequiredtoprovidetheinsurancetoaperson who, under the insurance terms,
ceases to be an insured member.(3)The
board may enter into a group life assurance policy to
providesome or all of the insurance.˙Admission of other members22B.(1)This section
applies to a member who—(a)became a member
before 1 July 1995; and(b)wasnot,on30June1995,beingprovidedinsuranceunderagroup life assurance policy entered
into by the board.(2)The board may, on application by the
member under the insuranceterms, admit the member as an insured
member.˙Insurance terms22C.(1)Theboardmustdecidethetermsonwhichtheinsuranceisprovided.(2)Thetermsmay,forexample,includetermsaboutthefollowingmatters—(a)requirements, including medical
requirements, for eligibility to—(i)become an insured member under section 22B;
or(ii)increase the
level of insurance cover provided to an insuredmember;(b)benefits;(c)the
disclosure of relevant information to the board for the board
todecide—(i)an
issue about the payment of a benefit; or(ii)a
member’s eligibility to become an insured member or toincreasethelevelofinsurancecoverprovidedtothemember; or(iii)another issue relating to the proper conduct
of the insurance

cover.˙Premiums23.Subject to its agreeing otherwise with an
insured member, the boardmaydeductpremiumsforthemember’sinsurancefromthemember’saccount.†Subarticle 2—Insurance against total

insurance23A.Theboardmayalsoenterintoagrouplifeassurancepolicytoprovide insurance to members against
total and temporary disablement.†Subarticle 3—Members ineligible for
insurance˙Ineligible members24.AmemberwhoisamemberoftheStateservicesuperannuationschemeorthepolicesuperannuationschemeasprescribedbytheStateService
Superannuation Act 1972and thePolice
Superannuation Act 1974shall not be eligible for death or
total and permanent disablement or totaland temporary
disablement insurance.

11—Preservation and outward portability˙Preservation and portability on ceasing to be
member25.(1)In circumstances
other than those where a member has been paidbenefits as
provided in article 9 and the member ceases to be a member
thenthe amount then standing to the credit of the
member’s account ascertainedpursuant to
section 14 shall be—(a)retained in the
fund; or(b)iftheamountisapreservedamount,transferredwithinthesuperannuation system.(2)Shouldthemembersoelectinwritingtheprovisionsofsubsection(1)shallnotapplyinrespectofthemember’saccumulatedemployer
contributions where—(a)thememberleavestheemploymentoftheemployerincircumstances other than provided in section
17; and(b)thememberdoesnotresumeemploymentwithanyotheremployer
contributing to the fund within 3 months of the date ofcessation of the aforesaid employment;
and(c)the member’s accumulated employer
contributions do not exceedthe amount of
$500.(3)Should the member so elect in writing
subject to the provisions ofthesearticles,theboardshallpaytothememberhisorhermember’saccumulatedemployercontributionsand,whereapplicable,hisorhermember’s
accumulated personal contributions.(4)Shouldthemembersoelectinwriting,theprovisionsofsubsection (1) shall not apply to his or her
member’s accumulated personalcontributions
that are not preserved amounts.

member26.(1)Amembermaywithdrawallorpartoftheamountinthemember’s account ascertained under
section 14 that was received by theboard under
section 13(1).(2)The amount mentioned in subsection (1)
does not include an amountthat the board has undertaken to pay to
the member only if a preservationcashing condition
has been complied with.†Article
12—General powers of the board˙Board’s powers29.In
addition to the powers and discretions conferred upon it by
lawand to the powers and discretions conferred
upon it by the Act and otherprovisions of
these articles, the board shall have power to do all acts
andthings as and when and in the manner it
considers in its discretion necessaryorexpedientorconvenientfororinconnectionwiththemanagement,operation,
control and administration of the scheme and for the exercise
andperformance of its powers, functions and
duties under the scheme and inparticular
without derogating from the generality of the foregoing, it
shallhave the following powers exercisable in its
discretion—(a)to deduct any taxes or duties and
administrative fees and chargesfrom any benefit
payable to or in respect of a former member andto pay only the
residual amount in respect of the said benefit;(b)toprepare,sanctionandissueformsforanynoticeorotherdocumentwhatsoeverforthepurposesoftheschemeandtorequire any document to be submitted
to the employer or to theboard to be made—(i)in
the form (if any) issued by the board or in a form to thelike
effect; and(ii)inaccordancewithsuchdirectionsasarespecifiedintheform;(c)to
make determinations or to adopt procedures not inconsistentwith
the provisions of these articles and the Act in relation to
the

periods of time and other matters as appropriateto
facilitate the management, operation, control and
administrationof the scheme.
