1988.2DefinitionsIn this
Act—applicationforregistrationmeansanapplicationforregistration as a teacher.applicationforrestorationmeansanapplicationforrestoration of a person’s name to the
register.approved form, for a matter,
means the form approved undersection 78A for
the matter.boardmeans the Board
of Teacher Registration.charge,inrelationtoachargemadeoutsideQueensland,means any
allegation of an offence made in a way that is thesame
as, or substantially the same as, a charge under the lawof
the State.

of inquiry appointedby the board under section 51(1)(b)1to conduct an inquiry.compulsoryschoolageseetheEducation(GeneralProvisions) Act 1989, section

history, of a person, means all the
following—(a)everyconvictionofthepersonforanoffence,inQueenslandorelsewhere,atanytimeandwhetherbefore or after
the commencement of this Act as passedor any amendment
of this Act;(b)every charge made against the person
for an offence, inQueenslandorelsewhere,atanytimeandwhetherbefore or after
the commencement of this Act as passedor any amendment
of this Act and whatever the outcomeof the

director of the office.foreign regulatory authoritymeans—(a)an
interstate regulatory authority; or(b)an
entity established under a law applying in a foreigncountry,otherthanNewZealand,havingfunctionssimilar to the board’s functions under this

secondary educationand who are above compulsory school

of Teacher RegistrationDivision 1Establishment,
functions andpowers of the board3Establishment and membership of board(1)The Board of Teacher Registration is
established.(2)The board consists of the following
persons—(a)1 nominee of the Minister;(b)3 nominees of the chief executive, of
whom at least 2must be practising teachers;(c)2representativesofentitiesemployingteachersotherthan
in State schools, 1 of whom is to be nominated bythe
Queensland Catholic Education Commission and theotherbytheAssociationofIndependentSchoolsofQueensland Inc.;(d)1nomineeoftheQueenslandTeachers’Union,whomust
be a practising teacher in a State school;(e)1nomineeoftheQueenslandIndependentEducationUnion
of Employees, who must be a practising teacherin a non-State
school;(f)1nomineeoftheStatePublicServicesFederation,Queensland, who
must be a registered teacher;(g)2representativesofinstitutionsofhighereducation,who
must be practising teacher educators, nominated bythe
Higher Education Forum;(h)1representativeofcommunitygroupsinvolvedineducation, who is nominated under subsection
(3) and,

of registered teachers—(i)whosenamesaresubmittedasaresultofanelectioninvolvingregisteredteachersthatisheldunder
a by-law; and(ii)who,whenappointedasboardmembers,areregistered teachers;(j)1 other nominee of the Minister if the
Minister considersan additional representative is
desirable.(3)The Minister must arrange for a person
to hold a meeting ofrepresentatives of the following entities,
including a meetingbyelectronicmeans,todecideanomineeforsubsection (2)(h)—(a)IndependentParentsandFriendsCouncilofQueensland;(b)Parents and Friends Association,
Queensland;(c)QueenslandCouncilofParentsandCitizens’Associations
Incorporated.(4)TheGovernorinCouncilmustappointthemembersoftheboard.(5)The
director may not be appointed as a member.(6)In
this section—non-Stateschoolmeansaschoolthatisprovisionallyaccredited, or
accredited, under theEducation (Accreditationof
Non-State Schools) Act 2001.4Chairperson and deputy chairperson(1)The member of the board mentioned in
section 3(2)(a) is thechairperson of the board.(2)The board members must appoint a
member (other than thechairperson) as the deputy chairperson
of the board.

appointment of the deputy chairperson may be for a timedecidedbytheboardbutnotforlongerthanthedeputychairperson’s term of appointment as a
member.5Functions and powers of the
board(1)The functions of the Board of Teacher
Registration shall be—(a)to be responsible
to the Minister for the registration ofpersons entitled
to be registered as teachers under thisAct;(b)tokeepteacherregistrationinQueenslandundercontinuousreviewandtomakereportsandrecommendations to the Minister
thereon;(c)toconferandcollaboratewithemployingauthorities,teachereducationinstitutions,theteachingprofession,teacherorganisationsandthegeneralcommunityinrelationtostandardsofcoursesofteachereducationacceptable for the purpose of teacher
registration and toadvise the Minister accordingly;(d)to appoint such committees as it
thinks fit to assist andadvise it in the performance of its
functions;(e)toundertakerelevantreviewandresearchprojectsascommissioned and funded by the
Minister from time totime;(f)to
undertake, with the approval of the Minister first hadand
obtained, review and research projects using fundsraisedbytheboardbyitsregistrationandassessmentfunctionsorfundsprovidedbysourcesotherthantheMinister, or fees
and charges collected under this Act;(g)to
make recommendations to the Minister with respecttospecialprojectsnotinconsistentwithitsotherfunctions,andspecialprojectfundingrequiredtoundertake such projects;(h)to furnish to the Minister as soon as
practicable, but notlater than 4 months from 31 December in each
year, areport of its work and activities during the
year.

1988s6(2)The board may
exercise all powers necessary or convenientforperformingitsfunctions,includingthefollowingpowers—(a)to impose and collect fees for
registration in respect ofpersonseligibletoberegisteredasteachersinQueensland and assessment fees from persons
seekingto establish such eligibility, such fees
being subject tothe approval of the Governor in
Council;(b)to produce materials in the
performance of its functions;(c)to
enter into, with the approval of the Minister first hadandobtained,anagreementwithanypersonfortheleasing of premises as accommodation
for the board.(3)For material produced by it, the board
may—(a)charge for advertising in the
material; or(b)sellthematerialorenterintoanagreementwithanentity to sell the material.5APrimary considerations of board in
registration ofteachersInperformingitsfunctionsrelatingtotheregistrationofpersons as teachers, the welfare and best
interests of childrenare to be primary considerations of
the board.6By-law and rule-making power(1)The board may make by-laws under this
Act.(2)Without limiting subsection (1), the
board may make a by-lawabout—(a)teacher registration—(i)the
registration of persons as teachers; and(ii)the
cancellation of provisional registration; and(iii)the
inspection of the Register of Teachers and thefees to be paid
by a person inspecting the register;and

authorisation of persons to employ as teacherspersons who are
not registered teachers; and(v)the
furnishing by principals of reports and returnsinrespectofpersonsemployedasteachersinschools; and(vi)thefeestobepaidbyapersonapplyingtotheboard to be
registered as a teacher, for the retentionoftheperson’snameintheregisterorfortherestoration of the person’s name to the
register;(b)committees of inquiry—(i)the quorum of a committee;(ii)majority and minority findings of a
committee;(iii)thepracticesandproceduresofacommitteegenerally;(c)the procedures for and rules governing
the conduct ofthe election of registered teachers in
Queensland for thepurposes of section 3;11(d)suchothermattersasbythisActarerequiredorpermittedtobeprescribedorasarenecessaryorconvenientforthecarryingintoeffectoftheseveralprovisions,
objects and purposes of this Act.(3)Aby-lawmayauthorisetheboardtomakerulesforthecarrying into effect of all or any of
the provisions and objectsof the by-laws.(4)All
rules made pursuant to any by-law by the board shall be offull
force and effect on and from the day on which they arepromulgated in accordance with the by-law
under which theyare made or on and from such later date as
may be specified inthe rule, and the production of a copy of
any such rule verifiedbytheboardissufficientevidenceofthemakingandauthenticity of the same in all courts
and before all personsacting judicially.(5)A
by-law has no effect unless approved by the Governor inCouncil.11Section 3 (Establishment and membership of

public interest(1)TheMinistermaygivetheboardawrittendirectioniftheMinister is
satisfied it is necessary to give the direction in thepublic interest.(2)Without limiting subsection (1), a direction
may be that theboard must comply with—(a)a
policy, standard or other instrument of a public sectorunit;
or(b)anotherdocument,including,forexample,anotherpolicy, standard or instrument.(3)The board must comply with the
direction.(4)Intheboard’sannualreportforafinancialyear,undertheFinancial Administration and Audit Act
1977, the board mustinclude copies of
all directions given to it during the financialyear.Division 2Administrative
provisions relatingto the board8Failure to nominateWhere a vacancy
on the board arises from the expiration of amember’s term of
appointment or because of a casual vacancyontheboard,andtheperson,bodyorgrouprequiredasprescribedbythisActinrelationtothemembershipoftheboard to nominate a person to be a
member of the board to fillthevacancyfailstonominatesuchpersonatleast14daysprior to the date appointed for the
filling of the vacancy, theMinister may nominate the person in
lieu of the person, bodyor group and thereupon the person
shall be taken to have beennominated by the person, body or group
in question.9Members’ term of appointment(1)The member appointed as the
chairperson of the board holdsofficefortheterm,notlongerthan4years,statedinthemember’s
appointment.

following persons are not qualified to be, or cease to bequalified to be, board members—(a)anundischargedbankruptorapersonwhotakesadvantage of the
laws in force for the time being aboutbankrupt or
insolvent debtors;(b)apersonwhohasbeenconvictedofanindictableoffence, unless
the Minister considers the circumstancesoftheoffencedonotwarrantdisqualificationfromoffice.11Vacation of office of members of the
boardA member of the board shall be taken to have
vacated office assuch member if—(a)the
member dies;(b)thememberdeclinestoactortofurtheractassuchmember;(c)thememberresignsofficeassuchmemberinwritingdelivered to the
chairperson of the board;(d)the member is
absent, without leave of the board firsthad and obtained,
from 3 consecutive ordinary meetingsof the board of
which meetings a notice—(i)has been served
personally upon the member; or(ii)hasbeensentbyprepaidpostletteraddressedtothe member at the member’s place of
business orplace of residence lastknown to the
chairperson ofthe board;(e)the
member ceases to be qualified to be a member of theboard;(f)the
member is removed from office as such member bythe Governor in
Council.

appointment(1)Where a vacancy in the membership of
the board occurs ontheexpirationofamember’stermofappointment,theMinister must, by written notice, appoint a
date on or beforewhich a person is to be appointed to fill
such vacancy.(2)Theappointmentofapersontofillsuchvacancyshallbemade,
as prescribed by this Act in relation to the membershipof
the board, on or before the date so appointed.(3)Subsection(1)doesnotapplyinthecaseofavacancyoccurringinthemembershipoftheboardinrespectofamember nominated by the
Minister.(4)Where a vacancy occurs in respect of a
member nominated bythe Minister, the Minister shall, or, in the
case of a memberappointedpursuanttosection3(2)(j),12may,nominateaperson to fill such vacancy.13Removal of member(1)TheGovernorinCouncilmayatanytimebeforetheexpiration of the period for which a member
of the board wasappointed remove such member from his or her
membershipby written notice to the member.(2)A person removed from the board ceases
to be a member—(a)ifadateisstatedinthenoticeasthedateittakeseffect—from the

abstains from voting is taken to have votedfor the

must disclose thenature of the interest to a meeting of the
board or committee.(3)Unlesstheboardorcommitteeotherwisedirects,theinterested person must not—(a)be present when the board or committee
considers theissue; or(b)take
part in a decision of the board or committee aboutthe
issue.(4)The interested person must not be
present when the board orcommitteeisconsideringwhethertogiveadirectionundersubsection (3).(5)If
there is another person who must, under subsection (2), alsodisclose an interest in the issue, the other
person must not—(a)be present when the board or committee
is consideringwhether to give a direction under subsection
(3); or(b)takepartinmakingthedecisionaboutgivingthedirection.(6)If,becauseofthissection,amemberoftheboardoracommittee is not present at a board or
committee meeting forconsideringordecidinganissue,orforconsideringordeciding whether to give a direction under
subsection (3), buttherewouldbeaquorumifthememberwerepresent,theremainingmemberspresentareaquorumoftheboardorcommitteeforconsideringordecidingtheissueatthemeeting.(7)Adisclosureundersubsection(2)mustberecordedintheboard’s or

is—(a)if the number of members of the board

budget of the board shall be of no force or effect until it
isadopted by the board and approved by the
Minister.(3)Upon approval by the Minister, the
budget shall be bindingupon the board.(4)If
the general fund of the board contains a surplus or shows adeficit at the end of a year, the board
shall take such surplus ordeficitintoaccountinthepreparationofitsbudgetforthenext succeeding year.26Observance of budget(1)Subjecttothissection,theboardshallconfineitsdisbursements from its general fund
throughout a year withinthetotalamountcontainedinitsbudgetforthatyearasapproved under section 25.(2)If,duringanyyear,itappearstotheboardthatanextraordinary circumstance has arisen
which requires that theboard make a disbursement from its
general fund in that yearthat was not provided for in the
budget (as approved) for thatyear, the board
shall, before making such disbursement—(a)by
resolution, approve that such disbursement be made;and(b)obtain approval
of the Minister for an amendment to thebudget so that
the budget as amended and approved willnot then be
exceeded in total by the disbursement.(3)If,inanyyear,theboardmakesfromitsgeneralfundadisbursementwhichwasnotprovidedforinthebudget(asapproved) of the board for that year, all
the members of theboard who voted for such disbursement shall
be jointly andseverallyliabletorepaytotheboardtheamountofsuch

improper way thatshows the applicant is unfit to be

for restoration if theboard is satisfied, on reasonable
grounds, that the applicant—(a)wasregisteredbuttheregistrationwascancelledorsuspended because the person did not apply,
in the wayprescribedunderaby-law,fortheretentionoftheperson’s name in the register;
and(b)has paid the fees prescribed under a
by-law.(4)This section has effect subject to

person about whom theinformation is received; and(b)only relevant information is used in

good characterfor the purpose of being, or continuing to
be, registeredasateacher,basedontheinformation,aremadeconsistently.(3)The
board must give a copy of the guidelines, on request, to aperson seeking to be, or continue to be,

board.(3)The notice must include the
following—(a)the name of the employing authority
and, if the name ofthe authority is different to the name of
the school, thename of the school;(b)the
name of the relevant teacher;

relevant teacher; or(b)receivingnoticefromtherelevantteacheroftheteacher’s resignation.(4A)An employing authority for a school
that gives a notice undersubsection(2)isnotliable,civilly,criminallyorunderanadministrativeprocess,fordisclosinginformationcontainedin
the notice.(4B)Without limiting subsection
(4A)—(a)in a proceeding for defamation, the
employing authorityhasadefenceofabsoluteprivilegeforpublishingthedisclosed information; and(b)if the employing authority would
otherwise be requiredtomaintainconfidentialityaboutthedisclosedinformationunderanAct,oath,ruleoflaworpractice—the employing authority does
not contravenethe requirement by disclosing the
information.(5)In this section—employing
authority, for a school, means the person or
entityresponsible for the appointment of teachers
to the educationalstaff of the school.relevantteacher,inrelationtoanemployingauthority,means—(a)apersonwhoisapractisingteacherattheschoolforwhich
the employing authority is responsible; or

its production,beevidenceand,intheabsenceofevidencetothecontrary,conclusiveevidenceofthematterscontainedtherein;(c)acertificatepurportingtobesignedbytheexecutiveofficer or director certifying that at a

empoweredbythisActtoapproveandtheconditions(ifany)specified in such approval shall, upon
its production, beevidence and, in the absence of evidence to
the contrary,conclusiveevidenceofthematterscontainedinthecertificate;(d)astatement,inacomplaintcommencingthatproceeding, of the date on which the
matter of complaintcametotheknowledgeofthecomplainantshallbeevidence and, in the absence of
evidence to the contrary,conclusive evidence of its
content;(e)proof shall not be required of the
authority of any personto prosecute an offence against this
Act or to take anyproceedingonbehalfoftheboardunlessevidenceisgiven
to the contrary;(f)proofshallnotberequiredoftheappointmentoftheexecutiveofficerordirectororofanyotherofficerappointed for the
effectual administration of this Act orof the signature
