agent if the person, inthe course of a business, sells or
arranges for the sale of oradvertises that
he or she is willing to sell or arrange for thesale of—(a)rights to travel; or(b)rights to travel and
accommodation.(2)A person does not carry on business as
a travel agent—(a)by reason only of anything done in the
course of his orher employment; or(b)by
reason only of selling, or arranging for the sale of,rights to travel in a vehicle owned by him
or her; or(c)by reason only of selling, or
arranging for the sale of,rights to accommodation at a place
owned by him or her.(3)For the purposes
of this section, a person is the owner of avehicle or place
of accommodation if the person has lawfulpossession of
the vehicle or place of accommodation.10Changes to Act’s applicationAregulationmayexemptapersonortransactionfromtheapplication of this Act or a stated
provision of this Act.11Administration of
ActThe commissioner is responsible, subject to

Restriction on carrying on business as travel agent[s
12]Restriction on carrying onbusiness as travel agent12Travel agents to be licensed(1)A person shall not—(a)carryonbusinessasatravelagentotherwisethaninaccordance with the authority
conferred on the personby a licence; or(b)carry on business as a travel agent in
partnership with aperson who is not a licensee.Maximum penalty—1000 penalty units.(2)An unlicensed person shall not hold
himself or herself out as atravel
agent.Maximum penalty—1000 penalty units.(3)Where a person is convicted of an
offence against subsection(1), the court by which the conviction
is recorded shall orderthe person to pay to the Crown an
amount estimated by thecourt to be the amount of the profit
that has accrued to thepersonoranyotherpersonwithwhomthepersonhasabusinessorpersonalassociationinconsequenceofthecommission of the offence.(4)Any amount recovered by the Crown in
pursuance of an orderunder subsection (3) shall be paid
into the compensation fund.(5)Noactionliesfortherecoveryofanyfee,commissionorother reward for any service done or
performed in the courseof carrying on business as a travel
agent by a person (otherthan an exempted person) who does not
hold a licence.13Injunction upon application by
commissionerUpon application by the commissioner that a
person who isnot an exempted person and is not a licensee
has carried onbusiness as a travel agent, the Supreme
Court may issue aninjunctionrestrainingthatpersonfromcarryingontheCurrent as at 1 November 2013Page

exempted person or alicensee.Part 3LicencesDivision 1Issue of licences14Application for a licence(1)An application for a licence
shall—(a)be made to the commissioner;
and(b)be in the approved form; and(c)be accompanied by—(i)the
application fee prescribed under a regulation;and(ii)if, before or
when the application is made, the chiefexecutiverequiresthepaymentofcostsundersection 15B(1)—the amount of the costs
requiredto be paid.(2)An
applicant for a licence shall furnish to the commissionerthe
prescribed information and such other information as thecommissioner may require.(3)Whereanapplicationismadeforalicence,theapplicantshall—(a)causetheapplicationtobeadvertisedasprescribedunder a
regulation; and(b)cause a copy of the advertisement to
be served on thecommissioner.(4)Thecommissionershallcauseacopyofanapplicationreceivedtobeservedonthecommissionerofthepoliceservice.Page

commissioner may require information sought under thissectiontobegiven,verballyonoathorinwritingbydeclaration under theOaths Act
1867, as the case may be, andforthatpurposethecommissioneroranyjusticemayadminister an oath or take a
declaration.(6)Arequirementmentionedinsubsection(1)(c)(ii)issufficiently made of the applicant if it is
made generally ofapplicantsintheapprovedformornotifiedonthedepartment’s web site.15Investigation of application(1)Thecommissionermaymakesuchinquiriesasthecommissioner considers necessary in
respect of an applicationfor a licence.(2)Thecommissionerofthepoliceservicemayinvestigateanapplication for a licence.15AInvestigation of applicants(1)The commissioner may make
investigations about a person tohelp the
commissioner decide whether the person—(a)is a
fit and proper person for the grant of an applicationfor
registration, or renewal of registration; or(b)continues to be a fit and proper
person.(2)Withoutlimitingsubsection(1)orsection15,thecommissioner may ask the commissioner
of the police servicefor a report about the criminal
history of the person.(3)Ifthecriminalhistoryofthepersonincludesaconvictionrecorded against
the person, the commissioner’s report mustbe
written.15BCosts of criminal history
report(1)The commissioner may require a person
mentioned in section15A(1) to pay the reasonable, but no
more than actual, costsof obtaining a report under section

amount paid under the requirement if—(a)the
commissioner refuses the application without askingfor
the report; or(b)thepersonwithdrawstheapplicationbeforethecommissioner asks for the
report.15CConfidentiality of criminal
history(1)ApublicserviceemployeeperformingfunctionsunderthisAct
must not, directly or indirectly, disclose to anyone else areportaboutaperson’scriminalhistory,orinformationcontained in the
report, given under section 15A.Maximum
penalty—100 penalty units.(2)However, the
person does not contravene subsection (1) if—(a)disclosure of the report or information to
someone elseisauthorisedbythecommissionertotheextentnecessary to
perform a function under or in relation tothis Act;
or(b)the disclosure is otherwise required
or permitted by law.(3)Thecommissionermustdestroyawrittenreportaboutaperson’s criminal history as soon as
practicable after it is nolonger needed for the purpose for
which it was requested.16Objection to
application(1)Any person (including the commissioner
of the police service)may, within 10 days from the date on
which the applicationforalicencewaslastadvertisedpursuanttosection14(3),lodge with the commissioner for
consumeraffairsawrittenobjectiontotheapplicationsettingoutthegroundsoftheobjection.(2)Thecommissionerforconsumeraffairsmay,ontheapplicationofaninterestedperson,andsubjecttosuchconditions as
the commissioner thinks fit, extend the periodfor lodging

Licences[s 17](3)Subjecttosubsection(4),thecommissionerforconsumeraffairsshallservetheapplicantforalicenceandthecommissionerofthepoliceservicewithacopyofeachobjection lodged
under subsection (1).(4)Where the
commissioner of the police service has lodged anobjection, a copy thereof need not be served
on him or her.17Applicant may make submission upon
objectionsUponreceiptofacopyofanobjectiontohisorherapplication for a licence, the
applicant may within 7 days ofreceiptofthecopylodgewiththecommissionerhisorhersubmissions in
writing upon that objection.18Determination of application(1)Upon the expiration of—(a)10daysfromthedateonwhichtheapplicationforalicence is last advertised pursuant to
section 14(3); or(b)where an objection to the application
is duly lodged 7daysaftertheapplicantisservedwithacopyoftheobjection;whicheveristhelater,thecommissionershallapprovetheapplication if the commissioner is
satisfied—(c)that—(i)where the applicant is a natural
person—(A)the applicant is of or over the age of
18 yearsand holds the prescribed qualifications;
and(B)the applicant is likely to carry on a
businessas a travel agent honestly and fairly;
and(C)theapplicantisotherwiseafitandproperperson to hold a licence; or(ii)where the
applicant is a corporation—every personwho is an
officer of the corporation or who, in theopinionofthecommissioner,isinapositiontoCurrent as at 1 November 2013Page

affairs of thecorporation—(A)is
of or over the age of 18 years and holds theprescribed
qualifications; and(B)islikelytocarryonthebusinessofthecorporationorexercisethatcontrolorinfluence honestly and fairly; and(C)is otherwise a fit and proper person
to be anofficer of that corporation or to exercise
thatcontrol or influence in respect of the
businessof a travel agent; and(d)thattheapplicanthasmadesuitablearrangementstofulfil the obligations that may arise under
this Act; and(e)that the trustees under the trust deed
have certified—(i)that the applicant is eligible for
membership of thecompensationschemeestablishedbythetrustdeed; and(ii)that the
applicant will be admitted as a member ofthe compensation
scheme on being licensed; and(f)that
the applicant is not disqualified under this Act or acorresponding law from holding a licence
under this Actorthecorrespondinglaworbeinginvolvedinthedirection,
management or conduct of the business of atravel
agent.(2)For the purposes of subsection (1)(e),
where the applicationformembershipofthecompensationschememadebyanapplicant for a licence at least 3
calendar months before theappointed day has not been determined
at the appointed day,thetrusteesunderthetrustdeedshallbedeemedtohavecertifiedasrequiredinsubsection(1)(e)inrespectoftheapplicant until the application is
determined.(3)Ifthe
commissionerrefuses toapproveanapplicationforalicence, the commissioner must refund
to the applicant any feefor the licence accompanying the

Licences[s 19](4)Wherethecommissionerapprovesanapplicationforalicence,thecommissionershallnotifytheapplicantaccordingly but
shall only issue the licence if the prescribedfee for the
licence is or has been paid to the commissioner.(5)Thecommissionermayrefrainfromdetermininganapplication for a licence until—(a)a natural person to whom the
application relates; and(b)the directors
and officers of a corporation to which theapplication
relates;or such of them as the commissioner
specifies or refers to, hasorhaveappearedpersonallybeforethecommissionerandsatisfiedthecommissionerastoanymatterrelevanttotheapplication.(6)Where, before the appointed day, a licence
is issued, it shallnot take effect until the appointed
day.19Duration of licence(1)A licence shall, subject to this Act,
remain in force until—(a)the licence is
surrendered or cancelled; or(b)thelicenseediesor,inthecaseofacorporation,iswound-up or dissolved.(2)Alicenseemust,notlaterthanthedayprescribedunderaregulation for this section—(a)paytothecommissionertheannuallicencefeeprescribedunderaregulationandlodgewiththecommissioner an annual return in the
approved form; or(b)paytothecommissionerthetrienniallicencefeeprescribedunderaregulationandlodgewiththecommissioner a triennial return in the
approved form.(3)Wherealicenseefailstopaythelicencefeeorlodgethereturninaccordancewithsubsection(2),thecommissionermay, by notice
in writing to the licensee, require the licenseetomakegoodthedefaultand,inaddition,topaytothecommissioner the amount prescribed as a

of the notice, thelicence shall, by force of this subsection,
be suspended untilthe licensee complies with the
notice.(5)Thecommissionershallcausenoticeofasuspensionundersubsection(4)(beingnoticeintheapprovedform)tobepublished in a newspaper circulating
throughout the State.(6)Where a licence
has been suspended by virtue of subsection(4) for a
continuous period of 6 months, the licence shall, byforce of this subsection, be
cancelled.(7)Alicenseemay,withtheconsentofthecommissioner,surrender the
licence.20Conditions of licence(1)A licence is subject to—(a)a condition that each place at which
the licensee carriesonbusinessasatravelagentmustcomplywiththeprescribed requirements; and(b)a condition that the licensee shall,
at all times during thecurrencyofthelicence,beaparticipantinthecompensation scheme; and(c)any prescribed conditions; and(d)anyconditionsimposedbythecommissionerongranting the licence.(2)Thecommissionermay,bynoticeinwritinggiventoalicensee, impose
or revoke a condition of the licence or varysuch a condition
or impose a further condition.(3)Alicenseeshallnotcontraveneorfailtocomplywithacondition of his or her

Licences[s 21]21Licence not transferableSave where
otherwise expressly provided in this Act, a licenceshall not be transferable.22Duplicate licenceIf the
commissioner is satisfied that a licence has been lost ordestroyed,thecommissionermay,uponpaymentoftheprescribed fee,
issue a duplicate licence which shall have thesame effect as
the original licence.23Register of
licences(1)For the purposes of this Act, the
commissioner shall keep aregisteroflicencesthat,withoutlimitingtheoperationofsubsection(2),includestheaddressesoftheprincipalandother places at which each licensee is
authorised to carry onbusinessasatravelagentandthenameandaddresslastnotified to the commissioner of the person
in charge at each ofthose places in compliance with
section 34(1).(2)Subject to this Act, the register
shall contain the particularsprescribed under
a regulation and shall be kept in such formand manner as
the commissioner thinks fit.(3)The
register shall be made available at all reasonable times forinspection by any person at the office of
the commissioner.(4)The commissioner may, on the
application of a person, issuetothepersonacertificatestatingwhetherornotapersonspecifiedinthecertificateisorwas,onadateorduringaperiod specified in the certificate, a
licensee.(5)The commissioner may charge the
prescribed fee (if any) forthe issue of a

proceedings24Notice to show cause(1)Where, at any time, the commissioner
is of the opinion thatthere are reasonable grounds for
believing that—(a)a licence has been improperly obtained
or, at the time alicence was granted, there were grounds for
refusing togrant it; or(b)a
licensee has been convicted of an offence against thisAct;
or(c)a licensee has failed to comply with
this Act, a conditionorrestrictiontowhichthelicenceissubjectorarequirementundersection25(1)(b)applicabletothelicensee; or(d)a
licensee has been found guilty of an offence involvingfraudordishonestypunishableonconvictionbyimprisonment for 3 months or more; or(e)a licensee does not have, or is not
likely to continue tohave, sufficient financial resources
to enable the licenseeto continue to carry on business as a
travel agent; or(f)the business to which a licence
relates is being carriedon in a dishonest or unfair manner;
or(g)ifapersonwerenotalicensee—thecommissionerwould refuse an
application by him or her for a licence;or(h)a licensee has, for a period of 1
month or more, ceasedto carry on the business to which the
licence relates; or(i)aperson(otherthanthelicensee)involvedinthedirection,managementorconductofabusinesstowhich the licence relates is not a fit and
proper person tobe so involved; or(j)alicenseehasbeenrefusedalicenceunderacorresponding Act; orPage

licensee has been the subject of action that, under acorrespondingAct,hadaneffectsimilartotheeffectunder this Act
of action under section 25(1)(a), (b), (c),(d) or (g);
or(l)a licensee is not, for any other
reason, a fit and properperson to continue to hold a
licence;thecommissionermay,bynoticeinwritingservedonthelicensee,calluponthelicenseetoshowcause,withinsuchperiod,beingnotlessthan14days,asisspecifiedinthenotice, why the licensee should not,
for such of the reasonsreferredtoinparagraphs(a)to(l)asarespecifiedinthenotice, be dealt with in accordance
with section 25(1).(2)Anoticemaynotbeservedonalicenseeforthereasonspecified in
subsection (1)(i) unless—(a)the notice
specifies the reasons why it is considered thatthepersoninvolvedinthedirection,managementorconduct of the business to which the licence
relates isnot a fit and proper person to be so
involved; and(b)anoticeinwritingisalsoservedonthepersonsoinvolved calling on the person to show
cause, within thesame period as is specified in the notice
served on thelicensee,whythepersonshouldnot,forreasonsspecified in the
notice (being the same as those specifiedunder paragraph
(a)) be disqualified in accordance withsection
25(2).(3)Anoticemaynotbeservedonalicenseeforthereasonspecifiedinsubsection(1)(l)unlessthenoticespecifiesthereasons why it is considered that the
licensee is not a fit andproper person to continue to hold a
licence.(4)A licensee on whom a notice under
subsection (1) has beenserved,apersonwithwhomthelicenseecarrieson,inpartnership, the
business to which the licence relates or, wherethelicenseeisacorporation,anofficerofthecorporationmay,withintheperiodspecifiedinthenotice,makesubmissions, in
writing, with respect to the matters to whichthe notice

subsection (2)(b) has beenserved may, within the period
specified in the notice, makesubmissions, in
writing, with respect to the matter to whichthe notice
relates.(6)In order to determine—(a)whether or not to serve a notice under
subsection (1); or(b)whether or not to take action under
section 25;thecommissionermaymakesuchinvestigationsasthecommissioner thinks fit.(7)Thecommissionerofthepoliceserviceshall,ifthecommissionerforconsumeraffairssorequests,makesuchinvestigations
for the purposes of subsection (6) in respect ofmatters specified by the commissioner for
consumer affairs asthe commissioner of the police service
considers necessary tofulfiltherequestandshall,assoonaspracticableaftercompletingtheinvestigation,makeareportontheinvestigation to the commissioner for
consumer affairs.(8)The commissioner may suspend a licence
for any 1 or more ofthe following periods—(a)aperiodofnotmorethan14dayspendingadeterminationastowhetherornotanoticeshouldbeserved on the licensee under subsection
(1);(b)where such a notice is so served—the
period specifiedunder subsection (1) in the notice;(c)pending a determination as to whether
or not action is tobe taken under section 25, a period of not
more than 14days.25Determination of disciplinary measures by
thecommissioner(1)If,aftercompliancewithsection24,thecommissionerissatisfied that any matter referred to in
section 24(1) has beenestablished in relation to a licence,
a licensee or the businesscarried on pursuant to a licence, the
commissioner may do any1 or more of the following—Page

Licences[s 25](a)reprimand the licensee;(b)require the licensee to comply within a
specified timewith a requirement specified by the
commissioner;(c)suspendthelicenceforaperiodnotexceeding12months;(d)imposeaconditionorrestrictiontowhichthelicenceshall be
subject;(e)disqualifythelicensee(or,ifthelicencehasbeensurrendered,theformerlicensee)inaccordancewithsubsection (2);(f)whereanoticewasservedonapersonundersection24(2)(b)—disqualifythepersoninaccordancewithsubsection (2);(g)except where the commissioner acts in
accordance withparagraph (a), (b), (c) or (d)—cancel the
licence.(2)A person is disqualified in accordance
with this subsection ifeitherorbothofthefollowingdisqualificationsisorareimposed—(a)a disqualification from holding a
licence;(b)a disqualification from being involved
in the direction,management or conduct of business as a
travel agent;either permanently or for such period as is
specified by thecommissioner when imposing the
disqualification.(3)Where, under subsection (1)(b), the
commissioner requires alicenseetocomplywitharequirementspecifiedbythecommissioner,
the licensee shall comply with the requirementwithinthetimespecifiedbythecommissionerunderthatparagraph.Maximum
penalty—20 penalty units.(4)Where the
commissioner disqualifies a licensee in accordancewith
subsection (2), the commissioner shall cancel the licence.(5)If the commissioner suspends or
cancels a licence under thissection,thesuspensionorcancellationtakeseffectonandCurrent as at 1 November 2013Page

licensee under section 26(2).(5A)Subsection (5) applies subject to any
decision by QCAT on anapplicationmadeundersection26(4)forareviewofthedecision to suspend or cancel the

licensee29Death of licensee(1)Where a licensee dies, a person who is, or
who is named as, orwhointendstoapplytobecome,alegalpersonalrepresentative of the deceased licensee may,

section 18(1)(c)(ii)(B) or (C) or a licenceunder a

required under section 27.(3)The termination
takes effect, subject to any decision by QCATon a review of
the decision, on the day stated in the QCATinformation

38]38Compensation fund(1)IfalreadyestablishedandadministeredpriortothecommencementofthisAct,thecompensationfundshallcontinue to be
administered by trustees appointed for the timebeing under the
trust deed.(2)There shall be paid into the
compensation fund—(a)the contributions required to be paid
in accordance withthis part; and(b)any
amounts required to be paid into the compensationfundinaccordancewiththetrustdeedandanycorresponding
law.(3)There shall be paid out of the
compensation fund—(a)anyamountofcompensationtowhichapersonisentitled in accordance with this part;
and(b)any amounts required to be paid out of
the compensationfundinaccordancewiththetrustdeedandanycorresponding
law.39Licensees required to pay
contributions(1)Everylicenseeshallpayintothecompensationfundsuchcontribution as
may be required by the regulations.(2)Ifalicenseefailstopayacontribution,withinthetimeallowed for
payment by the regulations, the licence shall, byvirtue of this subsection, be suspended
until the contributionis paid.(3)Forthepurposesofsubsection(1),theCrowninrightofQueensland shall be deemed to be a
licensee.40Persons entitled to
compensation(1)Subject to the trust deed, a person
who has suffered loss inconsequence of—(a)thedishonestyornegligenceofapersoncarryingonbusiness as a travel agent; orPage

business as a travel agent; or(c)the
failure on the part of a person carrying on businessasatravelagenttocarryoutcontractualobligationsproperly;is
entitled to compensation.(2)A person who is
entitled to compensation under subsection (1)may make a claim
for compensation in accordance with thetrust
deed.41Claims(1)A
claim for compensation shall be determined by the trusteesin
accordance with the trust deed.(2)Subject to the trust deed, where the amount
standing to thecreditofthecompensationfundisinsufficienttomeetallvalidclaimsforcompensation,thetrusteesshallapportionthat amount
between the claimants in such proportions as thetrustees think just.(3)ThetrusteesmustgivetheclaimantaQCATinformationnotice for the
trustees’ decision on the claim.42Compensation scheme trustees to have certain
rights bysubrogation and otherwise(1)In this section—unlistedpersonmeansaperson(otherthananexemptedperson or a
licensee) who carries on business as a travel agentunder a name or names that is or are not
included in a list inforce under subsection (2).(2)Thecommissionershallassoonaspracticableafterthecommencementofthissectionandfromtimetotimethereafter,
publish in the gazette a list in which is specified—(a)thenameornamesunderwhicheachlicenseeatthetime of preparation of the list was

act or omission by apersoncarryingonbusinessasatravelagent,thecompensation scheme trustees are
subrogated to the rights ofthe claimant in
relation to the act or omission.(4)Wheretherightsconferredbysubsection(3)onthecompensationschemetrusteesareexercisableagainstacorporation,thoserightsareenforceablejointlyagainstthecorporation and the persons who were its
directors at the timeof the act or omission and severally
against the corporationand each of those directors.(5)Where it is proved that an act or
omission by a corporationoccurred without the knowledge or
consent of a director of thecorporation,rightsarenotenforceableasprovidedbysubsection(4)againstthedirectorinrelationtotheactoromission.(6)Where an act or omission referred to in
subsection (3) was theactoromissionofapersonwho,atthetimeoftheactoromission, was an unlisted person, any
other person who, inthecourseofcarryingonabusiness,providedtheunlistedperson with
goods or services in relation to which the act oromission occurred shall, for the purposes of
subsections (3) to(5) but in relation only to the act or
omission in so far as itinvolved those goods or services, be
deemed to have, at thetimeoftheactoromission,carriedonbusinessasatravelagent in
partnership with the unlisted person.(7)Apersonwho,inthecourseofcarryingonabusiness,providesanunlistedpersonwithgoodsorservicesfordisposal in a manner that would constitute
the carrying on bytheunlistedpersonofbusinessasatravelagentshallbedeemed to have aided, abetted, counselled
and procured thecarryingonbytheunlistedpersonofbusinessasatravelagent.Page

occupier is not required to consent; and(b)the
purpose of the entry; and(c)the occupier
gives the officer consent to enter the placeand exercise
powers under section 45D; and(d)the
time and date the consent was given.(5)If
the occupier signs a consent acknowledgment, the officermust
promptly give a copy to the occupier.45JEvidence of consent(1)Subsection (2) applies if—(a)anissuearisesinacourtproceedingwhethertheoccupierofaplaceconsentedtoanauthorisedofficerentering the place under section 45(1)(a);
and(b)a consent acknowledgment is not
produced in evidencefor the entry; and(c)it
is not proved the occupier consented to the entry.(2)The court may presume the occupier did

not divulge or communicate information that isor was acquired
by the person by reason of being, or havingbeen,employedorengagedin,orinconnectionwith,theadministration of this Act

law; or(e)for the purposes of legal
proceedings.Maximum penalty—20 penalty units.47InvestigationsThe commissioner
of the police service shall, at the request ofthe commissioner
for consumer affairs cause a police officertoinvestigateandreportuponanymatterrelevanttothedetermination
of—(a)any application or other matter before
the commissionerfor consumer affairs; or(b)anymatterthatmightconstitutepropercausefordisciplinary action under this Act.48Report on operation of ActThedepartment’sannualreportforafinancialyearmustinclude a report
on the operation of this Act during the year.49Service of documents(1)Any
notice or document required or authorised by this Act tobe
given to or served on any person shall be deemed to havebeen
duly served if it has been—(a)served on the person personally; or(b)postedbymeansofregisteredpostaddressedtotheperson at the person’s last known
address, or, in the caseof a licensee, the person’s address

cancelledWhere a licence is suspended or cancelled
under this Act, thelicenseeorformerlicenseeshall,atthedirectionofthecommissioner return the licence to the
commissioner.Maximum penalty—20 penalty units.53Offences generallyApersonwhocontravenesorfailstocomplywithanyprovision of this Act commits an
offence against this Act andif a specific
penalty is not otherwise provided is liable to apenalty of 10 penalty units.54Proceedings for offences(1)An offence against this Act may be
prosecuted in a summaryway under theJustices Act
1886upon the complaint of—(a)the
commissioner; or(b)an inspector; or(c)anyotherpersonauthorisedinthatbehalfeithergenerally or in
the particular case by the Minister.(2)AprosecutionforanoffenceagainstthisActmaybecommenced
within—(a)1yearfromthetimewhenthematterofcomplaintarose; or(b)6 months after the matter of complaint
was brought tothe knowledge of the complainant;whichever is the later to occur.(3)An authority to prosecute purporting
to have been signed bythe Minister is evidence of that
authority without proof of thesignature of the

otherwise expressly provided by this Act, all feesandallpenaltiesrecoveredandcostsincurredinrespectofproceedingsunderthisActshallbepayabletotheconsolidated fund.56EvidenceEach of the
following applies in a proceeding for the purposesof
this Act—(a)it shall not be necessary to prove the
appointment of thecommissioneror,aninspector,authorisedofficerorpolice officer;(b)a
signature purporting to be that of the commissioner oran
inspector shall be taken to be the signature it purportsto
be until the contrary is proved;(c)adocumentpurportingtobesignedbythecommissioner to the effect that a
person named thereinwas or was not, on a day or during a
period so specified,theholderofalicencesospecifiedshalluponitsproductioninthatproceedingbeevidenceand,intheabsence of
evidence to the contrary, conclusive evidenceof the matters
contained in the document;(d)adocumentpurportingtobesignedbythecommissioner to the effect that a
person named thereinwas, on a day or during a period so
specified, authorisedfor the purposes of section 45 shall
upon its productioninthatproceedingbeevidenceand,intheabsenceofevidencetothecontrary,conclusiveevidenceofthematters
contained in the document;(e)anavermentinacomplaintofthedateonwhichthecommission of an offence against this Act
came to theknowledge of the complainant shall be
evidence and, intheabsenceofevidencetothecontrary,conclusiveevidence of that

executive may approve forms for use under this Act.57Regulation-making power(1)TheGovernorinCouncilmaymakeregulationsunderthisAct.(2)Aregulationmaybemadefororaboutthefollowingmatters—(a)prescribing a code of practice to be
observed by personswho carry on business as travel
agents;(b)providing for differing categories of
licence that may begranted in respect of the different types of
the businessoftravelagentsspecifiedintheregulationsandprescribingthequalificationforholdersoflicencesofthose differing categories;(c)prescribing, or providing for the
calculation of, fees forthe purposes of this Act;(e)prescribing the records to be kept by
licensees and themanner in which the records must be
kept;(f)requiringperiodicauditstobemadeoftheaccountsrequiredbythisActtobekeptandprovidefortheappointment of auditors;(g)regulatingtheformandcontentofadvertisementsconcerning the
services offered by persons carrying onbusiness as
travel agents;(h)providingforthefurnishingofreturnstoenablecalculation of
contributions to the compensation fund;(i)prescribing penalties not exceeding 20
penalty units forcontravention of, or noncompliance with any
regulation.(3)Aregulationmadeundersubsection(2)(a)mayreferto,orincorporate,inwholeorinpart,andwithorwithoutmodification, a
code of practice for the time being, or fromtime to time,
