arrangements by the StatepursuanttotheprovisionsoftheCommonwealthandStatesFinancial
Agreement Act 1927for the raising of certain sums ofmoney
by way of loan by the State, and for other purposes1Short titleThis Act may be
cited as theGovernment Loan Act 1986.2InterpretationIn this
Act—financialagreementmeanstheagreementbetweentheCommonwealth and the States as
approved and ratified by theCommonwealth and
States Financial Agreement Act 1927.governmentstockmeansanyformofgovernmentstockorsecuritiesexceptinscribedstock,andincludesdebentures(including
registered debentures and instalment debentures),Treasury bills and bonds (including

Government Loan Act 1986[s 3]3Act to be read as one with the
Commonwealth and StatesFinancial Agreement Act 1927This
Act shall be read and construed with and subject to theprovisionsoftheCommonwealthandStatesFinancialAgreementAct1927andnothinginthisActshallderogatefrom
the provisions of the financial agreement.4Authority of State to make arrangements to
raise a loanof $480000000(1)The
Governor in Council is hereby authorised and empoweredto
make arrangements in accordance with and in the mannerprovided in the financial agreement for the
raising by way ofloan for the public service of the State of
sums of money notexceedinginthewholethesumof$480000000forexpenditureuponpublicworksandserviceswhichmayhereafterbeapprovedbyParliamenttobedefrayedoutofmoneys standing to the credit of the
loan fund.(2)The authority to raise a sum in
respect of which arrangementsfor the raising
thereof are hereby authorised shall include theauthoritytoraiseadditionalsumsasmaybenecessarytoactually produce to the Treasury that sum
after providing forallchargesandexpensesconnectedwiththeraisingofthewhole or part thereof.5Loans secured upon the consolidated
fund(1)Forthepurposeofraisingthewholeorpartofthesumsreferredtoinsection4(1)theGovernorinCouncilmaysubjecttosection4(1)causegovernmentstockorinscribedstock to be
issued or created and delivered or sold.(2)All
stock so issued or created and delivered or sold—(a)shall be secured upon the consolidated
fund; and(b)shallbearinterestataratefixedbytheGovernorinCouncil according as necessity
demands; and(c)shall be repayable at a date or dates

StateThe Governor in Council may for the purpose
of raising thewhole or part of the sums referred to in
section 4(1) authorisethesaleofgovernmentstockorinscribedstockoutsidetheState, and may appoint an agent to negotiate
the sale and toenter into and execute a contract
therefor.7When government stock deemed fully
issuedGovernment stock purporting to be issued
under the authorityof this Act, if signed by the Governor and
countersigned bythe Treasurer, or if the issue purports to
have been made in aplace outside the State, signed as
prescribed by the Governorin Council, shall be deemed to have
been duly issued, and theholder thereof shall not be bound to
inquire whether the issuewas in fact duly authorised.8How sums borrowed to be accounted
forSums borrowed under the authority of this
Act shall be paid totheTreasurer,andshallbeplacedbytheTreasurertothecredit of the loan fund.9Temporary advancesThe Governor in
Council may, pending the final disposal ofanygovernmentstockorinscribedstockissuedorcreatedundertheauthorityofthisAct,obtaintemporaryadvancesfromacorporation,financialinstitutionorothersourceforsuch period and on such terms as to
interest or otherwise asthe Governor in Council thinks
fit.10Application of the Government Loans
Redemption andConversion Act 1923TheprovisionsoftheGovernmentLoansRedemptionandConversion Act 1923shall apply to

contributions to be a chargeupon consolidated
fundAll interest on sums borrowed under the
authority of this Act,and all contributions payable to the
sinking fund in respect ofthose sums and all sums of money
necessary for the purchaseof government stock issued and sold
under the conditions insection12shallbeachargeuponandpayableoutoftheconsolidated
fund which is hereby appropriated accordingly.12Special provision as to stock(1)Governmentstockorinscribedstockissuedorcreatedanddelivered or sold under the authority of
this Act may, if theGovernor in Council so directs, and
subject to the provisionsoftheCommonwealthandStatesFinancialAgreementAct1927, be issued or
created and delivered or sold subject to theconditionthataproportionoftheprincipalmoneysrepresenting that stock shall be redeemed at
stated intervalsduringtheperiodofthecurrencyofthatstock,ortoaconditionthatacertainamountshallbesetapartatfixedperiods for the
purpose of purchasing that stock at a price andonthetermsandconditionsastheGovernorinCouncilconsiders
desirable.(2)Moneyssosetapartmaybepayabletoanyfinancialinstitution or
