1—PRELIMINARY˙Short title1.This
Act may be cited as theOccupational Therapists Act
1979.˙Definitions4.In this Act—“approved
form”see section 37A.1“board”means the
Occupational Therapists Board constituted under thisAct.“fee”includes
tax.“occupationaltherapist”meansapersonregisteredasanoccupationaltherapist under
this Act and whose name, at the material time, remainson
the register.“register”means the
register of occupational therapists kept under this Act.“registrar”means the
registrar of the board.1Section 37A
(Approval of forms)
s54s7Occupational Therapists Act 1979†PART 2—ADMINISTRATION˙Administration of Act5.ThisActshallbeadministeredbytheMinisterand,subjecttotheMinister, by the board.˙Constitution of board6.(1)ThereistobeaboardtobecalledtheOccupationalTherapistsBoard of
Queensland which shall have and may exercise and discharge
thepowers, authorities, duties and functions
conferred and imposed upon it byor under this
Act.(2)The board shall be a body corporate
with perpetual succession and acommon seal and,
subject to this Act, shall be capable in law of suing andbeingsued,ofcompoundingorprovinginanycourtofcompetentjurisdiction all
debts or sums of money due to it, and of acquiring, holding,alienating, and otherwise dealing with
property and of doing and sufferingall such acts and
things as bodies corporate may in law do and suffer.(3)All courts and persons acting
judicially shall take judicial notice of thecommon seal of
the board and, until the contrary is proved shall presumethat
it was duly affixed to any document on which it appears.˙Members of board7.(1)The
board shall consist of 9 members appointed by the Governor
inCouncil.(2)The
members of the board shall consist of—(a)4
persons nominated by the Minister of whom at least 2 shall
beoccupational therapists; and(b)3occupationaltherapistsacceptabletoandnominatedbytheMinister from a panel or panels of
names submitted by 1 or moreassociationsacceptedbytheMinisterasrepresentativeofoccupational therapists; and(c)1personrepresentingusersoftheservicesofoccupationaltherapists;
and

Supreme Court.(3)Submissionofapanelreferredtoinsubsection(1A)(b)shallbemadewithinthetimeandinthemannerprescribedor,wherenotprescribed, as determined by the Minister, as
the case may be, or in theevent that insufficient names of
occupational therapists acceptable to theMinister are
submitted, the Governor in Council may appoint as a memberof
the board any person who is qualified as prescribed to be nominated
as iftheperson’snamehadbeendulysubmittedbytheassociationorassociations entitled to make the
submission.(4)A person may hold office as a member
of the board in addition toany position the
person holds in the public service.˙Chairperson and deputy chairperson of
board8.(1)Ineveryappointmentofthewholenumberofmembersoftheboard the Governor in Council shall
appoint members to be respectively thechairperson and
deputy chairperson of the board.(2)Whenavacancyoccursintheofficeofchairpersonordeputychairpersonoftheboard,theGovernorinCouncilmayappointanothermember of the board to the vacant
office.(3)The chairperson shall preside at every
meeting of the board at whichthechairpersonattendsandinthechairperson’sabsencethedeputychairperson shall
so preside.(4)Where both the chairperson and deputy
chairperson are absent from ameeting,anothermemberoftheboardchosenforthepurposebythemajority of the members present and
voting shall preside.(5)The deputy
chairperson or other member who presides at a meetingof
the board in place of the chairperson has and may exercise all the
powersand authorities of the chairperson while he
or she so presides.(6)Save where the by-laws disentitle him
or her to vote on the matter inissue, the
chairperson, deputy chairperson or other member presiding at
ameeting of the board is entitled to a
deliberative vote on any matter beforethemeetingand,intheeventofanequaldivisionofvotesthereon,isentitled to a second or casting
vote.

appointment of a member of the board is to be for a term of3
years.(2)Amemberoftheboardshallbeeligibleforreappointmentifthemember is qualified as prescribed to be
nominated therefor.(3)Theofficeofamemberoftheboardshallbecomevacantifthemember—(a)dies; or(b)becomesbankruptorcompoundswithhisorhercreditors,orotherwise takes advantage of the laws in
force for the time beingrelating to bankruptcy; or(c)isabsentwithoutpriorleavegrantedbytheboardfrom3 consecutive
ordinary meetings of the board of which due noticehas
been given to the member; or(d)resigns office by signed notice delivered to
the Minister; or(e)is convicted of an indictable offence;
or(f)isremovedfromofficebytheGovernorinCouncilbynotification published in the gazette on the
grounds of mental orphysical incapacity to perform duties
as a member or of conductwhichintheopinionoftheGovernorinCouncil,showsthemember to be unfit to be a member of
the board.(4)Attendance of a member of the board at
the time and place appointedfor an ordinary
meeting of the board shall be deemed to constitute presenceat a
meeting notwithstanding that by reason that a quorum is not present
nomeeting is then and there actually held, and
the registrar shall enter in theminute book the
names of all members who so attend.(5)Aresignationasmemberoftheboardshallbeofnoeffectuntilnotice in writing thereof is received by the
Minister or until the operativedate specified in
the notice, whichever is the later.˙Casual
vacancies10.When a vacancy occurs in the office of
a member of the board duringthe term of
office of the members then constituting the board, the

appoint another person as amember, to hold
office for the balance of his or her predecessor’s term ofoffice as a member.˙Meetings of board11.(1)Theboardshallmeetasoftenasisnecessaryforthedueadministration of
this Act, at such times and places as it thinks fit, and
shallconduct its business in such manner as may be
prescribed or, where or tothe extent not prescribed, as it
determines from time to time.(2)A
quorum at any meeting of the board shall be 5 members entitled
tovote on the business before the meeting who
at a duly convened meetingshall be competent to transact any
business of the board and may exerciseand perform all
the powers, authorities, duties and functions of the board.(2A)Thedecisionofamajorityofthemembersatameetingoftheboard at which a quorum is present
shall be the decision of the board.(2B)If a
member present at a meeting and entitled to vote abstains
fromvoting the member is taken to have cast a
vote for the negative.(3)Aproceedingordecisionoftheboardshallnotbeinvalidatedormade
ineffectual by reason only that—(a)thewholenumberofmembershadnotbeenappointedatthetime; or(b)any member was not entitled to take
part in the proceeding ordecision; or(c)there is a defect in the appointment of any
member.˙Committees12.(1)The
board may select persons to form an advisory committee oradvisory committees to advise the board on
any matter within the scope ofthe board’s
functions referred to the committee or to a particular
committeeby the board.(2)A
person may be a member of such a committee whether or not
theperson is a member of the board.

committees13.Membersoftheboardandmembersofacommitteeformedpursuant to section 12 shall be entitled to
such fees and allowances as areapproved by the
Governor in Council.˙Members of board
etc. not affected by restrictive employmentprovisions14.A provision of any enactment requiring
the holder of an office todevote the whole of his or her time to
the duties of the office or prohibitingthe holder from
engaging in employment outside the duties of the officeshall
not operate to hinder holding that office and also an appointment
asmember, chairperson or deputy chairperson of
the board or of any advisorycommittee, or the
acceptance and retention of remuneration payable to amember of the board under this Act.˙Registrar and other officers employed
under Public Service Act15.The registrar
and other officers of the board are to be employed underthePublic Service Act 1996.˙Funds of
board16.(1)All moneys
received by or on behalf of the board shall be paidinto
and form part of the funds of the board.(2)Expenses of and incidental to the
administration of this Act shall bepaid by the board
from its funds.(2A)Subsection (2)
does not affect the liability, prescribed by any otherAct,
the board to pay from its funds the salaries of the registrar and
theofficers appointed for the effectual
administration of this Act.(3)The board shall
enter or cause to be entered in such books, accountsand
records required by the Auditor-General to be kept for the purpose
atrue account of all sums of money received
and paid under this Act.

Financial Arrangements Act 1982.†PART 3—REGISTRATION OF
OCCUPATIONALTHERAPISTS˙The
register17.(1)Theboardshallcausetheregistrartokeepinsuchformasitthinksfitaregister(the“registerofoccupationaltherapists”)ofthenames and other
prescribed particulars of persons who are entitled to be andwho
remain registered under this Act as occupational therapists.(2)The register shall at all reasonable
times be open to inspection at theoffice of the
registrar by any person on payment of the prescribed fee.(3)The registrar shall cause to be
published—(a)by30Juneineachyearthe‘listofoccupationaltherapists,Queensland’
certified by the registrar as correct to 1 May in thatyear;(b)fromtimetotime,astheregistrarthinksdesirable,asupplementary list indicating all
alterations, additions, revisionsand removals
made in the register during the period indicated insuch
supplementary list and certified by the registrar to a dateindicated in that list.˙Qualification for registration18.(1)Subject to this
section, a person shall be entitled to be registered asan
occupational therapist if the person applies to the board in the
approvedform, pays the prescribed fee for
registration and satisfies the board that the

therapy and that—(a)thepersonistheholderofadegree,diplomaorcertificateconferred after
due examination by an educational institution in aState or Territory which institution is duly
recognised in the Stateor Territory in which it is situated
and by the board as competentto confer the
same and which degree, diploma or certificate isrecognisedbytheboardand,whereconferredoutsideQueensland,bytheoccupationaltherapistsboardorotherregistrationauthorityintheStateorTerritoryinwhichitisconferred as entitling the person to
practise occupational therapyin that State or
Territory; or(b)thepersonhaspassedthrougharegularcourseofstudyinaneducational institution in any country
and has received after dueexaminationfromauniversity,collegeorotherbodyinthatcountry a
degree, diploma or certificate which—(i)isapprovedbytheboardasequaltoorhigherthanaqualification conferred after due
examination by a universityinQueenslandwhichqualificationisonereferredtoinparagraph (a); and(ii)isrecognisedbytheboardasqualifyingtheapplicanttopractise occupational therapy in that
country; or(c)the person has—(i)passed through a regular course of study in
an educationalinstitutioninanycountryandhasreceivedafterdueexamination from a university, college
or other body in thatcountry a degree, diploma or
certificate which is recognisedbytheboardasqualifyingtheapplicanttopractiseoccupational
therapy in that country; and(ii)undergone such additional educational
training which mayinclude the undertaking and passing of
examinations relativetothepracticeofoccupationaltherapyasintheboard’sopinionisnecessarytoqualifythepersontopracticeoccupational
therapy in Queensland.(1A)Theboardmay,whereitthinksfit,appointacommitteeof

Therapists Act 1979assessorscomposedofmedicalpractitioners(whetherornottheyaremembersoftheboard)andmayrequireanapplicantforregistrationtoappear before the committee of assessors who
shall determine the medicalfitness to
practise occupational therapy of an applicant and the board shall
beboundbyacertificateissuedbythecommitteeofassessorsastothemedical fitness
to practise occupational therapy of the applicant.(2)ApersonwhoappliesforregistrationunderthisActashavingaqualification prescribed by subsection (1)(b)
or (c) shall not be entitled to beso registered
unless—(a)thepersonsatisfiestheboardthatthepersonhasasoundunderstanding of
the English language and possesses sufficientknowledgeofandsufficientskillintheexpressionofthatlanguage, both
written and oral; and(b)thepersonsatisfiestheboardthatthepersonhasanadequateknowledgeoftheconditionsgoverningthepracticeofoccupational therapy in Australia;
and(c)if the board requires it—the person
has undertaken and passed—(i)apreliminaryexamination,conductedintheEnglishlanguage as may be approved by the board;
and(ii)a written
examination relevant to the conditions governingthepracticeofoccupationaltherapyinAustraliaandrecognised by the board.(3)Forthepurposesofsubsection(2)(c),theboardmayappointexaminerswhomayincludeinanycertificatebythemtotheboardaconditionthatsuchcertificateisgivensubjecttotheexamineebeingrequired to
undertake a period of supervised practice in occupational
therapyin Queensland.(4)Where a conditional certificate is issued
pursuant to subsection (3) theboard may require
the applicant for registration to undertake a period, as itdetermines, of supervised practice in
occupational therapy in Queensland asapproved by the
board.˙Conditional registration19.(1)When a person
has applied to the board for registration under the

Therapists Act 1979provisions of section 18(1)(b) or (c) and the
board has required the personto undertake a
period of supervised practice pursuant to section 18(4), theboard
may grant the person a certificate in the approved form of
conditionalregistration.(2)Thepracticeofoccupationaltherapybyapersonwhohasbeengranted a certificate of conditional
registration under this section shall belimitedtosupervisedpracticebut,subjecttothissubsectionandtheconditions contained in the
certificate, the person shall be deemed to beregistered as an
occupational therapist for as long as the certificate
remainsvalid.(3)Ifthepersonshallfailtocarryoutanyofsuchconditionstothesatisfaction of the board, the board
may direct the registrar to cancel thecertificateandthatpersonshallthereuponceasetobedeemedtoberegistered as an occupational therapist
under this Act and the cancellationshall be deemed
to be a refusal by the board of that person’s application tobe
registered as an occupational therapist.˙Registration for a limited period20.(1)Subject to this
Act, a person who makes application to the boardin
that behalf in the approved form and who satisfies the board that
theperson is of good fame and character and that
the person is the holder of adegree,diplomaorcertificateinoccupationaltherapy(ineachcaserecognised by the board and obtained after
due examination) conferred byan institution
recognised in the State or Territory or other country wherein
itis situated and by the board as authorised to
confer such degree, diploma orcertificate and
that the person has come to Queensland—(a)at
the request of a teaching institution, any State authority or
anyassociationrecognisedbytheboardasrepresentativeofoccupationaltherapistsforthepurposeofteaching,lecturing,giving clinical
demonstrations or engaging in research work; or(b)to
undertake postgraduate study in occupational therapy;shallbeentitledtoregistrationasanoccupationaltherapistatalltimesduring the period the person is so
engaged.(2)A person registered under this section
shall notify the board forthwithupon ceasing to
engage in the duties or study mentioned in subsection
(1)

to remove that person’s namefrom the
register.(3)The board may at any time by notice in
writing call upon a personregisteredunderthissectiontoshowcauseataplace,dateandtimespecified by the
board in such notice why the person’s name should not beerased from the register.(4)If
such cause be not shown to the board’s satisfaction as requested
bythe board, the board may direct the registrar
to remove that person’s namefrom the
register.˙Provisional registration21.(1)When a person
has applied to the board in the approved form tobe
registered as an occupational therapist and has paid the prescribed
fee forregistration,thechairperson,or(intheabsenceofthechairperson)amember of the board authorised generally in
that behalf by the board, uponbeing satisfied
that such person is entitled to be registered as an
occupationaltherapist, may grant to such person a
certificate in the approved form ofprovisional
registration as an occupational therapist.(2)Apersonwhohasbeengrantedacertificateofprovisionalregistration as
an occupational therapist shall be deemed to be registeredunder
this Act as an occupational therapist and this Act shall apply to
andwith respect to that person
accordingly—(a)until the date stated in such
certificate; or(b)until such later date as may be fixed
by the board;which stated date or later date (if any)
fixed by the board shall not in anycase be later
than 6 months from the granting of such certificate.(2A)However, the
board may at any time before the date so stated orfixed, cancel such certificate and such
person shall thereupon cease to bedeemed to be
registered as an occupational therapist under this Act, andsuchcancellationshall,forthepurposeofthisAct,bedeemedtobearefusal by the
board of the application by that person to be registered as
anoccupational therapist.(3)If a
person to whom a certificate of provisional registration has
beengranted becomes registered as an occupational
therapist while that certificate

shall, unless otherwise decided bythe board, date
from the granting of that certificate.˙Certificate of registration22.(1)Every
occupational therapist shall be entitled to obtain from theregistraracertificateoftheoccupationaltherapist’sregistrationintheapproved form.(2)On
application made to the board at any time and on payment of
theprescribed fee, the board may issue to any
occupational therapist a duplicateor certified copy
of the occupational therapist’s certificate of registration.˙Annual licence fee23.(1)Every occupational therapist shall pay to
the board a prescribedannual licence fee.(1A)The
annual licence fee shall be paid to the board within the period
ineachyearcommencingon1Januarytoandconcludingon30Aprilor,whereanotherperiodisprescribedinrespectthereof(theboardbeingherebythereuntoauthorised)withinthatotherperiodineachyearassoprescribed.(1B)An
occupational therapist shall at the time of the payment of
theannual licence fee furnish the board with
particulars of the occupationaltherapist’s
address for entry in the register.(2)If
an occupational therapist fails to pay the annual licence fee
withintheperiodasprovidedinsubsection(1),theregistrarshallthereuponremove the
occupational therapist’s name from the register.(3)Ifthenameofanypersonhasbeenremovedfromtheregisterpursuant to
subsection (2) or section 24(1)(a) the board shall, subject to
thisAct,uponapplicationbythatpersondirecttheregistrartorestoretheperson’s name to the register upon payment of
the annual licence fee andsuch restoration fee as may be
prescribed.˙Removal of name from register24.The board may instruct the registrar
to remove from the register the

Therapists Act 1979name of an occupational therapist—(a)whoappliesinwritingtohavehisorhernameremovedtherefrom;(b)whose name has at any time been ordered to
be erased absolutelyor for a limited period from a
register of occupational therapistsmaintained under
that or any other name by any other registrationauthorityandwhosenameatthematerialtimehasnotbeenrestored to that
register.˙Correction of register26.(1)The registrar
shall from time to time strike from the register thenamesofalloccupationaltherapistswhohavediedandmakesuchalterations and amendments to the register as
the board directs so that theregistershallbeanaccuraterecordofthenames,addressesandqualifications of occupational
therapists.(2)An occupational therapist shall notify
the board of any change ofname, address or other prescribed
particulars and furnish particulars of suchchange within 21
days after the occurrence of the change.˙Board
to give notice of refusal of application27.(1)If
the board refuses an application by a person for registration
asan occupational therapist, the registrar must
within 14 days of the refusalhappening, give
written notice of the refusal to the person.(2)The
notice must state—(a)the reasons for the board’s decision
to refuse the application; and(b)thatthepersonmayappealagainstthedecisiontotheDistrictCourt;
and(c)how to appeal.˙Appeals28.(1)Apersonaggrievedbyarefusalbytheboardoftheperson’sapplication for registration as an
occupational therapist may appeal against

Therapists Act 1979therefusaltoajudgeoftheDistrictCourtatBrisbanewhoshallhavejurisdictiontohearanddeterminethesameandwhosedecisionthereonshall be final
and be given effect to by the board.(2)An
appeal shall be by way of re-hearing, and shall be instituted
within30 days after notification of the refusal or
order to the person aggrieved, andno later, by
filing a notice of appeal in the registry of the District Court
atBrisbaneandbycomplyingwithanyrulesofcourtmadewithrespectthereto.(3)Theappellantshallserveacopyofthenoticeofappealontheregistrar of the board not later than 7
days after the notice is filed in theregistry of the
District Court.(5)The proceeding on appeal under this
section shall be deemed to be aproceeding before
a District Court.(6)If the judge hearing an appeal under
this section is of the opinion thatthe appeal
involves a question of special knowledge and skill, the judge
mayappoint 1 or more assessors who in the
judge’s opinion possess the specialqualificationsnecessaryfortheparticularcasetoassistthejudgeinthejudge’s determination.(6A)An assessor
shall be paid such fees and expenses as the Governorin
Council shall from time to time determine.(6B)An
assessor may advise the judge on any matter but all questions
oflaw and fact shall be determined by the judge
who shall place such weight(if any) as the
judge thinks fit, on the advice.(7)Where upon an appeal a District Court orders
a penalty to be paid byan appellant it shall order the penalty
to be paid to the board and, for thepurposes of its
enforcement, the order shall be deemed to be an order madeby
the board.†PART 4—MISCELLANEOUS˙Prohibited practices29.(1)A person who is
not an occupational therapist shall not—

occupation therapist, work therapist, functionaltherapist,ergotherapist,activitiestherapist,activitytherapist,rehabilitation
therapist, or hold himself or herself out as being oneof
the above, or assume, take, or use any name, initials, word,title, addition, symbol or description
which, having regard to thecircumstances in
which it is assumed, taken or used, indicates oris
capable of being understood to indicate or is calculated to
leadpersons to infer that the person is an
occupational therapist or isqualified to
practise occupational therapy;(b)without the written consent of the board,
advertise—(i)thatthepersonisskilledinthepracticeofoccupationaltherapy;(ii)that the person
is willing to practise occupational therapy;(iii)thatthepersoniscompetenttoteachthepracticeofoccupational therapy;(iv)thatthepersoniswillingtoinstructinthepracticeofoccupational therapy.Maximum
penalty—10 penalty units.(2)In subsection
(1)(b)—“advertise”includes
advertise—(a)by publishing a statement or claim in
any newspaper, magazine,periodical, circular, pamphlet,
handbill, notice or other document;and(b)by communicating a statement or claim
by means of a broadcasttransmission, television transmission,
or cinematograph; and(c)in any other
prescribed manner.˙Offences with relation to badges31.(1)A person who is
not an occupational therapist shall not use orwear any badge
issued by the board.(2)A person whose name has been removed
from the register shall notwhile the
person’s name remains so removed use or wear any badge
issued

Act shall not wear any badgeissued by the
board other than the badge issued to such person by the
board.(4)A person shall not use or wear any
colourable imitation of any badgeissued by the
board.˙Penalty for fraudulent practices32.(1)A person shall
not—(a)make or cause to be made any
falsification in the register or inany writing
relating to the register or any false statement relatingto
the register; or(b)utteranyfalse,forgedorcounterfeitcertificateorwritingpertaining to
the person’s qualification to practise occupationaltherapy; or(c)procureorattempttoprocureregistrationunderthisActforhimself,herselforanotherpersonbymakingorproducing,orcausing to be made or produce, any false or
fraudulent statement,declaration or representation, either
verbal or in writing; or(d)falselypersonateorrepresenthimselforherselfasbeingtheperson referred to in any certificate or
writing presented to theboard or in any certificate granted
under this Act; or(e)fraudulently or by false
representation obtain any certificate ofregistration
under this Act; or(f)forge, alter or counterfeit any
certificate of registration under thisAct; or(g)utter any forged, altered or
counterfeit certificate of registrationunder this Act
knowing the same to have been forged, altered orto
be counterfeit; or(h)falsely advertise or hold himself or
herself out as having obtaineda certificate of
registration under or as being registered under thisAct,

imprisonment.(2)The name of any person who procures
registration under this Act by

Therapists Act 1979anymeanswhichcontravenethissectionshall,uponthepersonbeingconvicted in respect of that contravention,
be removed from the register.(3)Theprovisionsofthissectionshallbeinadditiontoandnotinsubstitution for or in derogation of the
provisions of the Criminal Code orany other
Act.(4)However, a person shall not be liable
to be convicted both under thisAct and under the
Criminal Code or any other Act in respect of the sameact.˙General
penalty33.(1)A person who
contravenes or fails to comply with any provisionof
this Act commits an offence against this Act and, save where a
specificpenalty is otherwise provided, is liable to a
penalty of 20 penalty units.(2)All
penalties recovered in respect of an offence against this Act
shallbe paid to the board.˙Proceedings generally34.(1)An
offence against this Act may be prosecuted in a summary wayunder
theJustices Act 1886upon the
complaint of the registrar, or a personauthorised by the
board in that behalf.(2)A prosecution
for an offence against this Act may be commencedwithin 1 year from the time when the matter
of complaint arose or within6monthsafterthematterofcomplaintcomestotheknowledgeofthecomplainant
whichever is the period later to expire.(3)Without prejudice to any other right or
remedy available to the boardwith respect
thereto all fees payable to the board under this Act and allpenalties and costs ordered by the board to
be paid to it under this Act maybe recovered in a
summary way under theJustices Act 1886or as a
debtdue and owing to the board by action in any
court of competent jurisdiction.˙Evidentiary provisions35.In
any proceeding for the purposes of this Act—(a)a
certificate purporting to be signed by the registrar certifying
the

Therapists Act 1979stateofanypartoftheregisteratadateorduringaperiodspecifiedinthecertificateorcertifyingthatapersonnamedtherein was not at a date or during a period
specified therein anoccupational therapist shall, upon its
production, be admissible asevidenceand,intheabsenceofevidencetothecontrary,conclusive
evidence of the matters contained in the certificate;(b)every part of the register, and an
extract of any part of the registerpurporting to be
certified as correct by the registrar shall, upon itsproduction,beadmissibleasevidenceand,intheabsenceofevidencetothecontrary,conclusiveevidenceofthematterscontained therein;(c)a
statement in a complaint commencing the proceeding of the
dateon which the matter of complaint came to the
knowledge of thecomplainant shall be evidence and, in the
absence of evidence tothe contrary, conclusive evidence of
its content;(d)proofshallnotberequiredoftheauthorityofanypersontoprosecute an offence against this Act
or to take any proceeding onbehalf of the
board unless evidence is given to the contrary;(e)proof shall not be required of the
appointment of the registrar orof any other
officer appointed for the effectual administration ofthis
Act or of the signature of the registrar.˙Statutory declarations36.For
the purposes of this Act, the board may—(a)demand and accept a declaration under
theOaths Act 1867fromany
person for the purposes of this Act;(b)requireanapplicanttoverifybywayofdeclarationundertheOathsAct1967(the taking of
which being hereby authorised)information
furnished to the board in respect of the application forregistration.˙By-law
making power37.(1)The board may
make by-laws under this Act.(2)A
by-law may be made for or about—

the registrar and other officersappointed for
the effectual administration of this Act;(b)the
register and the manner of its keeping;(c)themakingofapplicationstotheboard,andtheeffectoffurnishing false particulars therein;(d)the conduct of meetings of the board,
the entitlement of membersoftheboardtovoteuponbusinessbeforeameeting,andtheconduct of proceedings before the
board;(e)the common seal of the board, and the
attesting of documents byor on behalf of the board;(f)the manner and method in which an
occupational therapist mayadvertise himself or herself as
qualified to practise occupationaltherapy and the
place where that practice takes place;(g)thepurposesforwhichfeesarepayableunderthisAct,theamounts of fees, the persons who are
liable to pay fees, whenfees are payable, the waiver of fees
and the recovery of unpaidamounts of fees;(ga)the
allowances payable under this Act and the purposes for whichthey
are payable;(i)the penalties to be imposed for
breaches of the by-laws but so thatno such penalty
shall exceed 10 penalty units;(j)regulating and controlling the use by
occupational therapists oftitles, letters or words indicating or
describing their qualifications;(ja)prescribing titles, letters or words that
shall or may be used toindicate or describe that any person
is an occupational therapist ortoindicateordescribeanyparticularoccupationaltherapyqualification;(jb)prohibiting the use by occupational
therapists, in relation to theirqualifications
as occupational therapists or the practice by them ofoccupational therapy, of any titles, letters
or words, other thanthose prescribed for such use or
prohibiting any prescribed titles,lettersorwordsfrombeingsousedand,inrelationtooccupational therapy qualifications, either
generally or except toindicate or describe a particular
qualification;

38(k)regulating,controllingandprohibitingcanvassingorsolicitingwork or business
by, for or on behalf of occupational therapists;(l)prescribing the kind of badge to be
issued and regulating the issuethereof.(3)A by-law must be approved by the
Governor in Council.2˙Approval of forms37A.The
board may approve forms for use under this Act.˙Regulation making power37B.The
Governor in Council may make regulations under this Act.˙Power of board to make by-laws about
fees38.For the removal of doubt, it is
