titleThis Act may be cited as theNambour Library Act 1973.2InterpretationIn this
Act—boardmeanstheLibraryBoard,thebodycorporateconstituted underLibraries and
Archives Act 1988.councilmeans the Council
of the Shire of Maroochy, a bodycorporate
constituted under theLocal Government Act 1993.principalActmeanstheSchoolsofArts(WindingUpandTransfer) Act
1960.3Vesting of
property in council(1)The land specified in schedule 1 shall
continue to vest in thecouncilforanestateinfeesimplesubjectonlytotheprovisions of this Act.(2)All
property (other than land), that by virtue of section 3 ofthe
principal Act is vested in the council, shall continue to
vestin the council subject only to the
provisions of this Act.

purposesThe council shall use the land specified in
schedule 2 in thestead of the land specified in schedule 1 in
the provision, as afunction of local government, of a public
library of a standardapproved by the board and in the
maintenance of the library tothe satisfaction
of the board and for that purpose shall erectand maintain upon
that land such buildings as are necessaryandshallastheoccasionrequiresalter,extend,demolish,reconstruct and
repair the buildings at any time on that land.5Use
of land and buildings not required for librarypurposes(1)Where at any time any part of the land
specified in schedule 2oranypartofabuildingthereonisnotrequiredfortheprovision of a
public library in accordance with section 4, thecouncil may, with the consent of the board
and the approval ofthe Governor in Council given by order in
council, use thatpart of the land or building for any other
purpose connectedwith a function of local government.(2)Any moneys received by the council as
rental for the use ofany part of the land or a building as
prescribed by subsection(1) shall be paid into the library
fund of the council.6Termination of trustsOnandfromthepassingofthisAct,thelandspecifiedinschedule 1 and all other property vested in
the council by theprincipalActandbythisActshallbeabsolutelyfreedanddischarged from the trusts upon and
subject to which that landand other property were so vested, and
on and from that datethecouncilmayusethatlandandotherpropertyforanypurpose connected with a function of
local government.7Ratification of past dealing with
landIt is hereby declared that the excision of
the land specified inschedule 3 from land vested in the
council by virtue of section3 of the
principal Act and the use of the land so specified forpurposes other than the provision of a
public library do notconstituteandshallbedeemednevertohaveconstituted
