titleThis Act may be cited as theCrown Employees Act 1958.2Meaning of termsIn this
Act—Crown,withoutlimitingthegeneralityofthemeaningthereof, includes
any commission, commissioner, corporation,board,
instrumentality or person representing the Crown.service, in relation to
the Crown, means employment in anycapacity
in—(a)the public service under and within
the meaning of thePublic Service Act 1996; or(b)the police service under and within
the meaning of thePolice Service Administration Act
1990; or(c)QueenslandRailunderandwithinthemeaningoftheTransport Infrastructure Act
1994; or(d)any other office,
position or place under the Crown.3Reappointment to service under the
Crown(1)Subject to this Act, upon application
in writing made in thatbehalf,anduponbeingsatisfiedthattheapplicantresignedfromanypermanentserviceundertheCrowninordertobecome a candidate for election as a senator
or member of theHouseofRepresentativesoftheParliamentoftheCommonwealth or as a member of the
Legislative Assembly

defeated candidate attheelectioninquestion,andthattheapplicantmadetheapplication
within 3 months after the return of the writ for thatelection,theGovernorinCouncilorauthorityorpersonhavingpowertoappointtotheserviceinquestionmayreappoint the applicant permanently to that
service.(2)ThereappointmentmaybetotheserviceundertheCrownfrom which the
person resigned as mentioned in subsection(1) or to any
other service under the Crown having the same ora
lower classification level, rank or grade.(3)ApersontowhomthisActappliesmaybereappointeddespite the
person’s age.(4)However, if the person is mentally or
physically incapable ofperformingthedutiesofanyserviceundertheCrown,theperson must not be reappointed.4Continuity of service(1)ThecontinuityoftheemploymentinanyserviceundertheCrownofapersontowhomthisActapplieswhoisreappointed to that service pursuant
to an application made bythe person as prescribed by this Act,
shall be deemed to be notbroken by that person having so
resigned from that service buttheperiodduringwhichthecontinuityoftheperson’semploymentinthatservicewasinterruptedbytheperson’sresignationtherefromshallnotbetakenintoaccountincalculatingtheaggregateofthecontinuousemploymentinthat service had by the person.Superannuation etc.(2)Where, consequent upon resigning from any
service under theCrown,otherthanthepoliceserviceunderandwithinthemeaningofthePoliceServiceAdministrationAct1990,aperson to whom this Act applies has received
a refund of orpaymentonaccountofcontributionsrequiredbylawtobemadebythepersontoanysuperannuationorotherbenefitfund
and so made the person may upon reappointment to thatservice—(a)repay
into the fund in question the amount so refundedor
paid to the person, and pay thereinto the amount of

not resignedfrom the service in question, would have
been payableby the person in respect of the period
during which thecontinuityoftheperson’semploymentinthatservicewasinterruptedbytheperson’sresignationtherefrom,together with interest on both those amounts
at the rateper centum per annum fixed by the person or
authoritycontrolling the fund in question; or(b)if the person may lawfully contribute
to that fund uponthebasisoftheperson’sagewhensoreappointed—contribute thereto upon that
basis on andfrom the date of such reappointment.(3)The authority or person controlling
the fund in question mayallow the person to make repayment and
payment as specifiedin subsection (2)(a) by periodical
instalments of such amountand payable respectively at such
intervals as it may determine,and may require
the person to pay interest at a rate fixed by itupon
the unpaid balance thereof.5InterpretationTotheextentnecessarytogiveoperationandeffecttothisAct—(a)thePublic Service Act 1996;
and(b)thePolice Service
Administration Act 1990; and(c)theTransport Infrastructure Act
1994; andevery other Act,
shall be read subject to this Act.
