1921[as amended by all amendments that commenced
on or before 25 March 19942]An
Act to constitute Anzac Day a national holiday˙Short
title1.This Act may be cited as theAnzac Day Act 19213–8.˙Anzac Day to be a
national holiday2.In commemoration of the part taken by
Queensland troops in the GreatWar, and in
memory of those who gave their lives for the Empire, 25
Aprilineachyear(beingtheanniversaryofthefirstlandingofEnglish,Australian, and
New Zealand troops on Gallipoli) shall be known as ‘AnzacDay’,
and shall be observed throughout Queensland as a holiday.˙Interpretation3.In
this Act—“Chief Industrial Inspector”means the Chief Industrial Inspector
withinthe meaning of theIndustrial
Relations Act 1990;“inspector”meansanindustrialinspectorwithinthemeaningoftheIndustrial Relations Act 1990;“place of public amusement”means a place within the meaning of
theTrading Hours Act 1990used or intended
to be used—(a)as a theatre, dance hall or music
hall; or(b)for a circus, or cinematograph
exhibition; or(c)for any sporting entertainment;
or(d)foranypublicamusementorentertainmentofwhatever

charge is, or is to be, made for admission thereto, andincludes any part thereof;“racingvenue”,“racemeeting”,“trottingmeeting”,“greyhoundmeeting”,“bookmaker”,“TotalisatorBoard”and“totalisator”have the same
respective meanings as are assigned to each of thoseterms by theRacing and
Betting Act 1980.˙Anzac Day to be a
public holiday4.(1)In this section
each of the terms“factory”,“shop”,“independentretail
shop”,and“exemptshop”has the meaning
assigned to it in theTrading Hours Act 1990.(3)Theprovisionsofthissectionrequiringemployeestobegivenaholiday on Anzac Day do not apply to
the employment on Anzac Day—(a)inafactoryorshop—ofapersonsolelyemployedinsafeguarding the factory or shop;(b)ataracingvenueatwhicharacemeeting,trottingmeetingorgreyhound meeting is lawfully held—of
any person;(ba)at an office or
agency of the Totalisator Board—of any person;(c)on
licensed premises under and within the meaning of theLiquorAct 1992—of
any person;(d)in or on any place of public amusement
within the meaning ofsection 5 which is being lawfully used
as such—of any personsolely employed for the purposes of
such use;(da)of any person in
an independent retail shop;(db) of any
person in an exempt shop;(e)in a shop
specified in the Schedule, Part 1—of any person;(f)in a calling specified in the
Schedule, Part 2—of a person solelyengaged in and
for the purposes of carrying on that calling.(4)Subject to subsections (2) and (3) of this
section, every employee in afactory or in a
shop shall be given a whole holiday on Anzac Day.(5)A regulation may from time to time
amend the Schedule by deleting

shop or factory for the time being specified therein or byadding thereto any other shop or factory, or
by deleting from Part 2 anycalling for the
time being specified therein or by adding thereto any othercalling.(6)The
Schedule as so amended shall become and be for the time
beingthe Schedule.˙Powers
of inspector6.An inspector may—(a)enter any place (other than premises used
exclusively as a privatedwelling house) at which or in which
the inspector has reason tobelieve a person
is contravening or failing to comply with any ofthe
provisions of this Act and at or in that place conduct suchinvestigation as the inspector considers
necessary for the purposesof this Act;(b)in
conducting an investigation referred to in paragraph (a)—(i)question any person with respect to
matters under this Actand require the person questioned to
truthfully answer thequestions put to the person;(ii)call to his or
her aid any police officer where the inspectorhas reason to
believe the inspector will be obstructed in theexercise of
powers under this Act.˙Obstructing an
inspector7.A person shall not—(a)assault, threaten, obstruct, abuse,
insult or intimidate an inspectorwho is
exercising powers under this Act, or attempt so to do;(b)fail to answer or give a false or
misleading answer to any questionput to the
person by an inspector exercising powers under thisAct.
6Anzac Day Act 1921˙Offences against Act8.(1)A
person who contravenes or fails to comply with any provision
ofsections 4 and 7 commits an offence against
this Act and upon conviction,is liable—(a)in the case of a natural person—to a
penalty not exceeding $2 000;or(b)inthecaseofabodycorporate—toapenaltynotexceeding$10 000.(2)AprosecutionforanoffenceagainstthisActshallbebywayofsummary proceedings under theJustices Act 1886on the complaint
of theMinister, the Chief Industrial Inspector or
any other inspector authorised bythe Chief
Industrial Inspector either generally or in a particular
case.(3)Whereapersoncommitsanoffenceagainstanyprovisionofsection 4 then, without derogating from
section 7 of the Criminal Code, theoccupier of the
factory, shop or place of public amusement in respect ofwhichtheoffenceiscommittedshallbedeemedtohavecommittedtheoffence and, notwithstanding section 23
of the Criminal Code or any otherrule or law or
practice, to be criminally responsible for the act or
omissionconcernedthereinandmaybechargedwiththeoffenceandpunishedaccordingly.(3A)Itisimmaterialthattheoffencewascommittedwithouttheauthority of or contrary to the
instructions of the occupier but it shall be adefence for the
occupier to prove that the offence was committed withoutthe
occupier’s consent or connivance and that the occupier exercised
duediligence to prevent the commission of the
offence.(3B)Subsections (3)
and (3A) apply so as not to prejudice any liabilityimposed under this Act upon any person by
whom any offence against thisAct is actually
committed.(3C)For the purposes
of subsections (3) and (3A)—“occupier”has
the meaning assigned to it in theFactories and
Shops Act1960.(4)Where a body corporate commits an
offence against this Act then,withoutderogatingfromsection7oftheCriminalCode,eachofthefollowingpersonsshallbedeemedtohavecommittedtheoffenceand,notwithstanding section 23 of the Criminal
Code or any other rule of law or

and punished accordingly—(a)thepersonwhoatthetimetheoffenceiscommittedwasthechairpersonofdirectors,managingdirectororothergoverningofficerbywhatevernamecalledorothermemberofthegoverning body
thereof by whatever name called; and(b)every person who at the time the offence is
committed managesoractsortakespartinthemanagement,administrationorgovernment of the business in Queensland
thereof.(5)Subsection(4)appliessoasnottolimitoraffectinanywaytheliability of a body corporate to be proceeded
against and punished for anoffence against
this Act committed by it.(6)It is a defence
to a charge for an offence against this Act broughtagainstapersonspecifiedinsubsection(4)(a)or(b)toprovethattheoffence was committed without that
person’s consent or connivance andthat the person
exercised due diligence to prevent the commission of theoffence.˙Evidentiary provisions9.In
any proceeding for the purposes of this Act—(a)it
shall not be necessary to prove the appointment of the
Ministeror any inspector to do any act or take any
proceeding;(b)asignaturepurportingtobethatoftheMinister,theChiefIndustrial
Inspector or any other inspector shall be taken to be thesignature it purports to be until the
contrary is proved;(c)the allegation or averment in any
complaint that the person namedtherein is, or
was at the time set out, the occupier of a factory,shop
or place of public amusement shall be evidence of the mattersoallegedoraverred,and,intheabsenceofevidencetothecontrary, shall be conclusive evidence
of that matter.˙Anzac Day Trust10.(1)For
the purposes of this Act a Trust is constituted under the
nameof ‘The Anzac Day Trust’.
8Anzac Day Act 1921(2)The
Trust shall be a body corporate with perpetual succession and
acommon seal, and shall be capable of suing
and being sued in its corporatename, and of
doing and permitting all acts and things required by this Act
tobe done by the Trust or which are necessary
or convenient to be done by theTrust for the
purpose of carrying out its functions under this Act.(3)The Trust shall consist of 4 trustees
(including the chairperson) eachof whom shall,
subject to subsection (4), be appointed by the Governor inCouncil by notification published in the
Gazette.(4)Of the 4 trustees—(a)1
shall be a person nominated by the Minister and the person
shallbe the chairperson;(b)1
shall be a person nominated by the Minister after
consultationwith the President of the Returned Services
League of AustraliaQueenslandBranchfromapanelof3namessubmittedtotheMinister by such
League;(c)1 shall be a person nominated by the
Minister from a panel of3namessubmittedtotheMinisterbytherepresentativesofLegacy Clubs in Queensland;(d)1 shall be a person nominated by the
Minister from a panel of3namessubmittedtotheMinisterbythoseorganisationsorassociationsofex-servicemenorex-servicewomenwhichareregisteredascharitiesunderandwithinthemeaningoftheCollectionsAct1966orwhichareincorporatedundertheAssociations Incorporation Act
1981.(5)Subject to
subsection (7) every trustee, including the chairperson—(a)shall be eligible for reappointment;
and(b)shall hold office for the term for
which the trustee is appointed orreappointed but
no such appointment or reappointment shall befor a term
exceeding 3 years.(6)IfatanytimetheLeaguementionedinsubsection(4)(b),ortherepresentativesofLegacyClubs,ortheorganisationsorassociationsmentionedinsubsection(4)(d)failsorfail,within30daysafterbeingthereunto called
upon in writing by the Minister, to nominate a panel of 3namesfornominationtherefrombytheMinisterofapersonforappointment as a trustee, the Minister
may nominate for the appointment in

trustee.(7)The office of a trustee, including the
chairperson, shall become vacantif the
trustee—(a)diesorbecomesapatientwithinthemeaningoftheMentalHealth Act
1974; or(b)becomes bankrupt or compounds with the
trustee’s creditors, orotherwise takes advantage of the laws
in force for the time beingrelating to
bankruptcy; or(c)is absent without leave granted by the
Trust from 3 consecutiveordinary meetings of the Trust of
which due notice has been givento the trustee;
or(d)resigns office by signed written
notice delivered to the Ministerand the
resignation is accepted by the Minister; or(e)is
convicted of an indictable offence; or(f)isremovedfromofficebytheGovernorinCouncilformisbehaviourorincompetencebynotificationpublishedintheGazette.(7A)However, the
attendance of the chairperson or any other member ofthe
Trust at the time and place appointed for an ordinary meeting shall
bedeemed to constitute presence at an ordinary
meeting notwithstanding thatby reason that no
quorum is present no meeting is actually held on that day,and
the secretary shall enter in the minute book the name of the
chairpersonor any other member who so attends.(8)Threetrustees,1ofwhomshallbethechairperson,shallformaquorum.(9)TheTrustshallmeetatsuchtimesandplacesandconductitsbusiness in such manner as it may from time
to time determine.(10)When,bydeath,resignationorotherwisehowsoever,avacancyoccurs in the
office of a trustee, including the chairperson, the Governor
inCouncilmay,subjecttosubsections(4)and(6),appointbynotificationpublished in the
Gazette, a person to be a Trustee (and, in the case of thechairperson, the chairperson) for the
remainder of the term of the trustee’spredecessor in
the office in question.
10Anzac Day Act 1921(11)The
Minister may appoint an officer of the department
administeredby the Minister to be the secretary to the
Trust, and such officer may holdsuchappointmentinadditiontotheofficetheofficerholdsinthedepartment.(12)The
Trust may, in respect of the Fund, accept any gift (whether
bywill or inter vivos) of any property, of
whatsoever kind and wheresoeversituate, and
whether in possession, reversion or remainder, and may sell
andconvertintomoneyanypropertyvestedinitwhichdoesnotconsistofmoney.˙Functions of the Trust11.(1)Applications for payment from the Anzac Day
Trust Fund of anysum for a purpose specified in section 12(3)
shall be made to the Trust.(2)The Trust shall
consider every such application and having regard tothe
circumstances thereof, to the amount for the time being standing to
thecredit of the Fund and to all pending
applications for payments from theFund made to the
Trust, may refuse the application or may determine thatthe
sum applied for or a lesser sum be paid from the Fund.˙The Anzac Day Trust Fund12.(1)The Trust shall
establish in a bank a trust fund called ‘The AnzacDay
Trust Fund’, in this Act referred to as“the Fund”.(2)There shall be
paid into the Fund—(a)inthefinancialyearcommencedon1July1964,fromtheConsolidated Fund (which is hereby
appropriated accordingly), asumequaltoonethree-hundredthpartoftheaggregateoftheannualfeespaidfortheirrespectivelicensesbylicensedvictuallers in
respect of the financial year commenced on 1 July1963; and(b)subjecttoappropriationbyParliament,fromtheConsolidatedFund in each
financial year, beginning with the financial year tocommence on 1 July 1965, a sum equal to one
three-hundredthpart of the aggregate of the annual fees
paid for their respectivelicenses by licensed victuallers in
respect of the next precedingfinancial year;
and
11Anzac Day Act 1921(c)subjecttoappropriationbyParliament,fromtheConsolidatedFund, the
following amounts certified by the Commissioner ofStamp Duties to be—(i)an
amount equal to 5% of the aggregate of investments madeontotalisatorsoperatedataracingvenueandbytheTotalisator
Board on Anzac Day; and(ii)an amount equal
to 1.3% of the aggregate of all bets made bya bookmaker at a
racing venue on Anzac Day; and(d)by
the Commissioner of Stamp Duties from the unpaid fractionsaccount kept by the Commissioner, an amount
certified by theCommissioner to be 0.7% of the aggregate of
all bets made by abookmaker at a racing venue on Anzac Day;
and(e)moneys contributed to the Fund by any
person whomsoever.(2A)In this
subsection—“AnzacDay”means,inrespectofanyyearinwhichanotherdayisappointed
pursuant to theHolidaysAct1983to be kept as a
publicholiday instead of Anzac Day, the day so
appointed.(3)ThecostsincurredbytheTrustinrespectoftheexerciseofitsfunctionsunderthisActshallbepaidoutoftheFundand,subjecttopayment thereof, the moneys standing to
the credit of the Fund shall bedistributed in
making payments approved by the Trust—(a)for
the purposes of—(i)the preservation, alteration and
improvement of homes;(ii)theacquisitionoflandfortheerectionandconstructionthereon of
homes;(iii)the erection and
construction of homes on land acquired forthat purpose or
otherwise held;(iv)the acquisition
of land and homes erected thereon, for agedex-servicemen
and ex-servicewomen and their maintenancein such homes
and of the welfare of widows and children ofdeceasedex-servicemenandwidowersandchildrenofdeceased ex-servicewomen; and(b)among institutions, organisations and
associations the object, or

objects, of which is the financial assistance and relief, orthe
amelioration of conditions, of persons—(i)who
were members of the Naval, Military or Air Forces ofHer
Majesty or of the Commonwealth; or(ii)now
resident in the State who were members of any Naval,MilitaryorAirForcesofanyforeignpoweralliedorassociated with Her Majesty or with the
Commonwealth;during any war in which Her Majesty or the
Commonwealth wasor is engaged, or during any warlike
operations which the Trustconsiders to have had or have the
general attributes of a war inwhich Her
Majesty or the Commonwealth was or is engaged, orof
the dependants of any such persons.(4)Nothinginthissectionshallentitle,orbedeemedtoentitle,anytrustee to any remuneration, allowance or
expenses in respect of the exerciseby the trustee of
the trustee’s functions and duties under this Act.˙Investment powers13.(1)TheTrustmayinvestmoneysheldintheFundwhicharenotimmediately
required for the purposes for which the Trust is constituteduntil
such time as such moneys are required—(a)insecuritiesissuedorguaranteedbytheGovernmentoftheCommonwealth or of a State or
Territory of the Commonwealth;(b)withorondepositwithabankorinsecuritiesissuedorguaranteed by a bank;(c)insuchothersecurities,investmentsorotherfinancialarrangementsasmayberecommendedbytheTreasurerandapproved by the Governor in Council;providedthatnosuchinvestmentshallhaveatermofinexcessof12
months except with the Treasurer’s approval first had and
obtained.(2)Everysecurity,safecustodyacknowledgmentorotherdocumentevidencing title issued in respect of an
investment shall be held by the Trust.(3)Any
approval in accordance with subsection (1) may be granted—(a)inrespectofaspecificsecurity,investmentorotherfinancial
13Anzac Day Act 1921arrangement,allsecurities,investmentsorotherfinancialarrangementsofaspecifickindorclass,orallsecurities,investments and
other financial arrangements;(b)for
a specific period or without limit of time.˙Regulations14.The
Governor in Council may make regulations for the purposes ofthis
Act.

shop that is an office under theTrading Hours
Act 1990in which—(a)theusualactivitiesconductedincludethelettingofaccommodation; and(b)on
Anzac Day, the only activities conducted are—(i)the
letting of accommodation; and(ii)activities related to the letting of
accommodation.PART 22.Printing, publishing and distributing
newspapers.3.The manufacture, distribution or
supply of gas or electric light or poweror water
supply.4.Any necessarily continuous process of
manufacture or mining.5.Essential
