3 Anzac Day Act 1921 ANZAC DAY ACT 1921 [as amended by all amendments that commenced on or before 25 March 1994 2 ] An Act to constitute Anzac Day a national holiday ˙ Short title 1. This Act may be cited as the Anzac Day Act 1921 3–8 . ˙ Anzac Day to be a national holiday 2. In commemoration of the part taken by Queensland troops in the Great War, and in memory of those who gave their lives for the Empire, 25 April in each year (being the anniversary of the first landing of English, Australian, and New Zealand troops on Gallipoli) shall be known as ‘Anzac Day’, and shall be observed throughout Queensland as a holiday. ˙ Interpretation 3. In this Act— “Chief Industrial Inspector” means the Chief Industrial Inspector within the meaning of the Industrial Relations Act 1990 ; “inspector” means an industrial inspector within the meaning of the Industrial Relations Act 1990 ; “place of public amusement” means a place within the meaning of the Trading Hours Act 1990 used or intended to be used— (a) as a theatre, dance hall or music hall; or (b) for a circus, or cinematograph exhibition; or (c) for any sporting entertainment; or (d) for any public amusement or entertainment of whatever
4 Anzac Day Act 1921 description; whether or not a charge is, or is to be, made for admission thereto, and includes any part thereof; “racing venue” , “race meeting” , “trotting meeting” , “greyhound meeting” , “bookmaker” , “Totalisator Board” and “totalisator” have the same respective meanings as are assigned to each of those terms by the Racing and Betting Act 1980 . ˙ Anzac Day to be a public holiday 4.(1) In this section each of the terms “factory” , “shop” , “independent retail shop” , and “exempt shop” has the meaning assigned to it in the Trading Hours Act 1990 . (3) The provisions of this section requiring employees to be given a holiday on Anzac Day do not apply to the employment on Anzac Day— (a) in a factory or shop—of a person solely employed in safeguarding the factory or shop; (b) at a racing venue at which a race meeting, trotting meeting or greyhound meeting is lawfully held—of any person; (ba) at an office or agency of the Totalisator Board—of any person; (c) on licensed premises under and within the meaning of the Liquor Act 1992 —of any person; (d) in or on any place of public amusement within the meaning of section 5 which is being lawfully used as such—of any person solely employed for the purposes of such use; (da) of any person in an independent retail shop; (db) of any person in an exempt shop; (e) in a shop specified in the Schedule, Part 1—of any person; (f) in a calling specified in the Schedule, Part 2—of a person solely engaged in and for the purposes of carrying on that calling. (4) Subject to subsections (2) and (3) of this section, every employee in a factory or in a shop shall be given a whole holiday on Anzac Day. (5) A regulation may from time to time amend the Schedule by deleting
5 Anzac Day Act 1921 from Part 1 any shop or factory for the time being specified therein or by adding thereto any other shop or factory, or by deleting from Part 2 any calling for the time being specified therein or by adding thereto any other calling. (6) The Schedule as so amended shall become and be for the time being the Schedule. ˙ Powers of inspector 6. An inspector may— (a) enter any place (other than premises used exclusively as a private dwelling house) at which or in which the inspector has reason to believe a person is contravening or failing to comply with any of the provisions of this Act and at or in that place conduct such investigation as the inspector considers necessary for the purposes of this Act; (b) in conducting an investigation referred to in paragraph (a)— (i) question any person with respect to matters under this Act and require the person questioned to truthfully answer the questions put to the person; (ii) call to his or her aid any police officer where the inspector has reason to believe the inspector will be obstructed in the exercise of powers under this Act. ˙ Obstructing an inspector 7. A person shall not— (a) assault, threaten, obstruct, abuse, insult or intimidate an inspector who is exercising powers under this Act, or attempt so to do; (b) fail to answer or give a false or misleading answer to any question put to the person by an inspector exercising powers under this Act.
6 Anzac Day Act 1921 ˙ Offences against Act 8.(1) A person who contravenes or fails to comply with any provision of sections 4 and 7 commits an offence against this Act and upon conviction, is liable— (a) in the case of a natural person—to a penalty not exceeding $2 000; or (b) in the case of a body corporate—to a penalty not exceeding $10 000. (2) A prosecution for an offence against this Act shall be by way of summary proceedings under the Justices Act 1886 on the complaint of the Minister, the Chief Industrial Inspector or any other inspector authorised by the Chief Industrial Inspector either generally or in a particular case. (3) Where a person commits an offence against any provision of section 4 then, without derogating from section 7 of the Criminal Code, the occupier of the factory, shop or place of public amusement in respect of which the offence is committed shall be deemed to have committed the offence and, notwithstanding section 23 of the Criminal Code or any other rule or law or practice, to be criminally responsible for the act or omission concerned therein and may be charged with the offence and punished accordingly. (3A) It is immaterial that the offence was committed without the authority of or contrary to the instructions of the occupier but it shall be a defence for the occupier to prove that the offence was committed without the occupier’s consent or connivance and that the occupier exercised due diligence to prevent the commission of the offence. (3B) Subsections (3) and (3A) apply so as not to prejudice any liability imposed under this Act upon any person by whom any offence against this Act is actually committed. (3C) For the purposes of subsections (3) and (3A)— “occupier” has the meaning assigned to it in the Factories and Shops Act 1960 . (4) Where a body corporate commits an offence against this Act then, without derogating from section 7 of the Criminal Code, each of the following persons shall be deemed to have committed the offence and, notwithstanding section 23 of the Criminal Code or any other rule of law or
7 Anzac Day Act 1921 practice, to be criminally responsible for the act or omission concerned therein and may be charged with the offence and punished accordingly— (a) the person who at the time the offence is committed was the chairperson of directors, managing director or other governing officer by whatever name called or other member of the governing body thereof by whatever name called; and (b) every person who at the time the offence is committed manages or acts or takes part in the management, administration or government of the business in Queensland thereof. (5) Subsection (4) applies so as not to limit or affect in any way the liability of a body corporate to be proceeded against and punished for an offence against this Act committed by it. (6) It is a defence to a charge for an offence against this Act brought against a person specified in subsection (4)(a) or (b) to prove that the offence was committed without that person’s consent or connivance and that the person exercised due diligence to prevent the commission of the offence. ˙ Evidentiary provisions 9. In any proceeding for the purposes of this Act— (a) it shall not be necessary to prove the appointment of the Minister or any inspector to do any act or take any proceeding; (b) a signature purporting to be that of the Minister, the Chief Industrial Inspector or any other inspector shall be taken to be the signature it purports to be until the contrary is proved; (c) the allegation or averment in any complaint that the person named therein is, or was at the time set out, the occupier of a factory, shop or place of public amusement shall be evidence of the matter so alleged or averred, and, in the absence of evidence to the contrary, shall be conclusive evidence of that matter. ˙ Anzac Day Trust 10.(1) For the purposes of this Act a Trust is constituted under the name of ‘The Anzac Day Trust’.
8 Anzac Day Act 1921 (2) The Trust shall be a body corporate with perpetual succession and a common seal, and shall be capable of suing and being sued in its corporate name, and of doing and permitting all acts and things required by this Act to be done by the Trust or which are necessary or convenient to be done by the Trust for the purpose of carrying out its functions under this Act. (3) The Trust shall consist of 4 trustees (including the chairperson) each of whom shall, subject to subsection (4), be appointed by the Governor in Council by notification published in the Gazette. (4) Of the 4 trustees— (a) 1 shall be a person nominated by the Minister and the person shall be the chairperson; (b) 1 shall be a person nominated by the Minister after consultation with the President of the Returned Services League of Australia Queensland Branch from a panel of 3 names submitted to the Minister by such League; (c) 1 shall be a person nominated by the Minister from a panel of 3 names submitted to the Minister by the representatives of Legacy Clubs in Queensland; (d) 1 shall be a person nominated by the Minister from a panel of 3 names submitted to the Minister by those organisations or associations of ex-servicemen or ex-servicewomen which are registered as charities under and within the meaning of the Collections Act 1966 or which are incorporated under the Associations Incorporation Act 1981 . (5) Subject to subsection (7) every trustee, including the chairperson— (a) shall be eligible for reappointment; and (b) shall hold office for the term for which the trustee is appointed or reappointed but no such appointment or reappointment shall be for a term exceeding 3 years. (6) If at any time the League mentioned in subsection (4)(b), or the representatives of Legacy Clubs, or the organisations or associations mentioned in subsection (4)(d) fails or fail, within 30 days after being thereunto called upon in writing by the Minister, to nominate a panel of 3 names for nomination therefrom by the Minister of a person for appointment as a trustee, the Minister may nominate for the appointment in
9 Anzac Day Act 1921 question such person as the Minister deems fit and such person may be appointed a trustee. (7) The office of a trustee, including the chairperson, shall become vacant if the trustee— (a) dies or becomes a patient within the meaning of the Mental Health Act 1974 ; or (b) becomes bankrupt or compounds with the trustee’s creditors, or otherwise takes advantage of the laws in force for the time being relating to bankruptcy; or (c) is absent without leave granted by the Trust from 3 consecutive ordinary meetings of the Trust of which due notice has been given to the trustee; or (d) resigns office by signed written notice delivered to the Minister and the resignation is accepted by the Minister; or (e) is convicted of an indictable offence; or (f) is removed from office by the Governor in Council for misbehaviour or incompetence by notification published in the Gazette. (7A) However, the attendance of the chairperson or any other member of the Trust at the time and place appointed for an ordinary meeting shall be deemed to constitute presence at an ordinary meeting notwithstanding that by reason that no quorum is present no meeting is actually held on that day, and the secretary shall enter in the minute book the name of the chairperson or any other member who so attends. (8) Three trustees, 1 of whom shall be the chairperson, shall form a quorum. (9) The Trust shall meet at such times and places and conduct its business in such manner as it may from time to time determine. (10) When, by death, resignation or otherwise howsoever, a vacancy occurs in the office of a trustee, including the chairperson, the Governor in Council may, subject to subsections (4) and (6), appoint by notification published in the Gazette, a person to be a Trustee (and, in the case of the chairperson, the chairperson) for the remainder of the term of the trustee’s predecessor in the office in question.
10 Anzac Day Act 1921 (11) The Minister may appoint an officer of the department administered by the Minister to be the secretary to the Trust, and such officer may hold such appointment in addition to the office the officer holds in the department. (12) The Trust may, in respect of the Fund, accept any gift (whether by will or inter vivos) of any property, of whatsoever kind and wheresoever situate, and whether in possession, reversion or remainder, and may sell and convert into money any property vested in it which does not consist of money. ˙ Functions of the Trust 11.(1) Applications for payment from the Anzac Day Trust Fund of any sum for a purpose specified in section 12(3) shall be made to the Trust. (2) The Trust shall consider every such application and having regard to the circumstances thereof, to the amount for the time being standing to the credit of the Fund and to all pending applications for payments from the Fund made to the Trust, may refuse the application or may determine that the sum applied for or a lesser sum be paid from the Fund. ˙ The Anzac Day Trust Fund 12.(1) The Trust shall establish in a bank a trust fund called ‘The Anzac Day Trust Fund’, in this Act referred to as “the Fund” . (2) There shall be paid into the Fund— (a) in the financial year commenced on 1 July 1964, from the Consolidated Fund (which is hereby appropriated accordingly), a sum equal to one three-hundredth part of the aggregate of the annual fees paid for their respective licenses by licensed victuallers in respect of the financial year commenced on 1 July 1963; and (b) subject to appropriation by Parliament, from the Consolidated Fund in each financial year, beginning with the financial year to commence on 1 July 1965, a sum equal to one three-hundredth part of the aggregate of the annual fees paid for their respective licenses by licensed victuallers in respect of the next preceding financial year; and
11 Anzac Day Act 1921 (c) subject to appropriation by Parliament, from the Consolidated Fund, the following amounts certified by the Commissioner of Stamp Duties to be— (i) an amount equal to 5% of the aggregate of investments made on totalisators operated at a racing venue and by the Totalisator Board on Anzac Day; and (ii) an amount equal to 1.3% of the aggregate of all bets made by a bookmaker at a racing venue on Anzac Day; and (d) by the Commissioner of Stamp Duties from the unpaid fractions account kept by the Commissioner, an amount certified by the Commissioner to be 0.7% of the aggregate of all bets made by a bookmaker at a racing venue on Anzac Day; and (e) moneys contributed to the Fund by any person whomsoever. (2A) In this subsection— “Anzac Day” means, in respect of any year in which another day is appointed pursuant to the Holidays Act 1983 to be kept as a public holiday instead of Anzac Day, the day so appointed. (3) The costs incurred by the Trust in respect of the exercise of its functions under this Act shall be paid out of the Fund and, subject to payment thereof, the moneys standing to the credit of the Fund shall be distributed in making payments approved by the Trust— (a) for the purposes of— (i) the preservation, alteration and improvement of homes; (ii) the acquisition of land for the erection and construction thereon of homes; (iii) the erection and construction of homes on land acquired for that purpose or otherwise held; (iv) the acquisition of land and homes erected thereon, for aged ex-servicemen and ex-servicewomen and their maintenance in such homes and of the welfare of widows and children of deceased ex-servicemen and widowers and children of deceased ex-servicewomen; and (b) among institutions, organisations and associations the object, or
12 Anzac Day Act 1921 1 of the objects, of which is the financial assistance and relief, or the amelioration of conditions, of persons— (i) who were members of the Naval, Military or Air Forces of Her Majesty or of the Commonwealth; or (ii) now resident in the State who were members of any Naval, Military or Air Forces of any foreign power allied or associated with Her Majesty or with the Commonwealth; during any war in which Her Majesty or the Commonwealth was or is engaged, or during any warlike operations which the Trust considers to have had or have the general attributes of a war in which Her Majesty or the Commonwealth was or is engaged, or of the dependants of any such persons. (4) Nothing in this section shall entitle, or be deemed to entitle, any trustee to any remuneration, allowance or expenses in respect of the exercise by the trustee of the trustee’s functions and duties under this Act. ˙ Investment powers 13.(1) The Trust may invest moneys held in the Fund which are not immediately required for the purposes for which the Trust is constituted until such time as such moneys are required— (a) in securities issued or guaranteed by the Government of the Commonwealth or of a State or Territory of the Commonwealth; (b) with or on deposit with a bank or in securities issued or guaranteed by a bank; (c) in such other securities, investments or other financial arrangements as may be recommended by the Treasurer and approved by the Governor in Council; provided that no such investment shall have a term of in excess of 12 months except with the Treasurer’s approval first had and obtained. (2) Every security, safe custody acknowledgment or other document evidencing title issued in respect of an investment shall be held by the Trust. (3) Any approval in accordance with subsection (1) may be granted— (a) in respect of a specific security, investment or other financial
13 Anzac Day Act 1921 arrangement, all securities, investments or other financial arrangements of a specific kind or class, or all securities, investments and other financial arrangements; (b) for a specific period or without limit of time. ˙ Regulations 14. The Governor in Council may make regulations for the purposes of this Act.
14 Anzac Day Act 1921 S ¡ CHEDULE PART 1 section 3 1. A shop that is an office under the Trading Hours Act 1990 in which— (a) the usual activities conducted include the letting of accommodation; and (b) on Anzac Day, the only activities conducted are— (i) the letting of accommodation; and (ii) activities related to the letting of accommodation. PART 2 2. Printing, publishing and distributing newspapers. 3. The manufacture, distribution or supply of gas or electric light or power or water supply. 4. Any necessarily continuous process of manufacture or mining. 5. Essential services. 6. Milk supply. 7. Bread manufacturing and the preparation of food in restaurants, cafes, pastry-cook and hot takeaway food kitchens.
