1Short title

This regulation may be cited as the Plumbing and Drainage Amendment Regulation 2024.

Division 5 Particular provisions for transitional treatment plant approvals

32Purposes of division

The purposes of this division are—
(a)to enable a person who held an existing treatment plant approval on 31 December 2023 to apply, by 1 July 2024, for a treatment plant approval that remains in force until 31 December 2024; and
(b)to provide for the application to be decided on the basis of compliance with the previous Queensland Plumbing and Wastewater Code rather than the criteria under section 19.

33Definitions for division

In this division—
existing treatment plant approval means a treatment plant approval mentioned in section 169 of the Act.
previous Queensland Plumbing and Wastewater Code means the document called ‘Queensland Plumbing and Wastewater Code’—
(a)published by the department on 26 October 2017; and
(b)available on the department’s website.
transitional treatment plant approval see section 35(2).

34Approval of previous Queensland Plumbing and Wastewater Code—Act, s 7

(1)For section 7(2) of the Act, the previous Queensland Plumbing and Wastewater Code is approved only in relation to work for a transitional treatment plant approval.
(2)This section applies despite section 8.
(3)For subsection (1), a reference in the previous Queensland Plumbing and Wastewater Code to a provision or matter in the repealed Act or repealed Standard Plumbing and Drainage Regulation 2003 is taken to be a reference to the corresponding provision or matter in the Act or this regulation.
(4)In this section—
corresponding provision, for a provision of the repealed Act or repealed Standard Plumbing and Drainage Regulation 2003, means a provision of the Act or this regulation that is substantially the same as the provision of the repealed Act or repealed Standard Plumbing and Drainage Regulation 2003.

35Application for and deciding transitional treatment plant approvals

(1)This section applies in relation to a person who was, on 31 December 2023, the holder of an existing treatment plant approval.
(2)The person may apply under this section for a treatment plant approval (a transitional treatment plant approval).
(3)The application must be—
(a)made in the approved form before 1 July 2024; and
(b)for a treatment plant that was, on 31 December 2023, the subject of the existing treatment plant approval held by the applicant.
(4)Subject to subsections (5) to (7), division 1 applies to the application as if the application were an application for a treatment plant approval under that division.
(5)Section 16(3) does not apply in relation to the application.
(6)Section 19 does not apply for deciding the application.
(7)The chief executive may decide to approve the application if satisfied a treatment plant of the type the subject of the application will comply with the previous Queensland Plumbing and Wastewater Code as approved under section 34.

35ADuration of transitional treatment plant approvals

(1)A transitional treatment plant approval remains in force until 31 December 2024.
(2)This section applies despite section 23.

35BExpiry of division

This division expires on 1 January 2025.
