1Short title

This regulation may be cited as the Transport Operations (Marine Safety) (Riverston Bay Marine Zone) Amendment Regulation 2024.

2Commencement

This regulation commences on 1 July 2024.

3Regulation amended

This regulation amends the Transport Operations (Marine Safety) Regulation 2016.

4Amendment of sch 5 (Marine zones)

Schedule 5—
insert—

Part 3 Riverston Bay

1Marine zone

(1)The area of Riverston Bay is a marine zone.
(2)The area of Riverston Bay is the area within the following boundary—
starting at latitude 24º 04.363' south, longitude 151º 17.988' east on the western shore of the mouth of the bay
then generally south-easterly to latitude 24º 04.457' south, longitude 151º 18.127' east on the eastern shore of the mouth of the bay
then along the shore of the bay to the starting point.

2Requirement for marine zone

The requirement for the marine zone is that a ship powered by an engine must not be operated in the marine zone.

3Exceptions from requirement for marine zone

The requirement in section 2 does not apply to the operation of a ship by an employee of the Gladstone Area Water Board who is—
(a)a shipping inspector performing a function under section 153 of the Act; or
(b)carrying out a water activity under the Water Act 2000 relating to the board’s main function as a water authority under section 569 of that Act; or
(c)carrying out an activity under an authority issued to the board under the Fisheries Act 1994, section 49 for the following purposes—
(i)broodstock collection;
(ii)education;
(iii)fish stocking.

5Amendment of sch 9 (Dictionary)

Schedule 9, definition government entity, ‘Public Service Act 2008, section 24’—
omit, insert—

Public Sector Act 2022, section 276
