to inform child about obtaining legal advice</heading><subclause id="sec.4-ssec.1" guid="_e68e6586-17e1-457f-b3ea-9d6fe4ab1b54" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a convenor of a conference.</txt></block></subclause><subclause id="sec.4-ssec.2" provision.type="other"><no>(1)</no><block><txt break.before="0">If, under <legref jurisd="QLD" type="subordleg" refid="sec.151" target.doc.id="UNKNOWN" check="invalid">section&#160;151</legref><legref jurisd="QLD" type="subordleg" refid="sec.151-ssec.1" target.doc.id="UNKNOWN" check="invalid">(1)</legref> of the <legref jurisd="QLD" type="subordleg" target.doc.id="UNKNOWN" check="invalid">Act</legref>, a court orders the chief executive to give to the court a pre-sentence report concerning a child, the report must include all of the following information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_154ac049-ee56-44ae-a0af-be729c2f7ba9" provision.type="other"><no>(a)</no><block><txt break.before="0">the child’s full name, address, date of birth and occupation;</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_aeb49edc-e1f4-4c14-82c0-cca6baf15293" provision.type="other"><no>(b)</no><block><txt break.before="0">the source of the information on which the report is based;</txt></block></li><li id="sec.6-ssec.1-para1.c" guid="_1cc575f7-9ade-4cd1-baf1-473021e57237" provision.type="other"><no>(c)</no><block><txt break.before="0">the circumstances of the offence to which the report relates;</txt></block></li><li id="sec.6-ssec.1-para1.d" guid="_29f0288a-c920-49cd-907e-a8491cd527a2" provision.type="other"><no>(d)</no><block><txt break.before="0">the child’s placement between the start of the proceeding and the date of the report;</txt></block></li><li id="sec.6-ssec.1-para1.e" guid="_d11dd881-42f9-4227-a89d-6b050850ef90" provision.type="other"><no>(e)</no><block><txt break.before="0">details of all community based orders or detention orders made against or for the child;</txt></block></li><li id="sec.6-ssec.1-para1.f" guid="_f8bf644e-5f42-495a-bf0d-3b734af47509" provision.type="other"><no>(f)</no><block><txt break.before="0">if the chief executive is aware of a corresponding order made against or for the child—details of the corresponding order;</txt></block></li><li id="sec.6-ssec.1-para1.g" guid="_91ef74e3-661e-4df3-9b67-2f3e4be063e4" provision.type="other"><no>(g)</no><block><txt break.before="0">an assessment of factors the chief executive considers may have contributed to the child committing the offence;</txt></block></li><li id="sec.6-ssec.1-para1.h" guid="_0089ecfa-08d3-4dc3-9607-80ee3c93dee5" provision.type="other"><no>(h)</no><block><txt break.before="0">the child’s attitude to the offence and to the victim of the offence;</txt></block></li><li id="sec.6-ssec.1-para1.i" guid="_e307a5bf-2af4-44c9-8ff9-92dc4cf80dbd" provision.type="other"><no>(i)</no><block><txt break.before="0">if the chief executive is aware of any consequences that have happened to the child as a result of the act or omission that constitutes the offence—details of the consequences;</txt><note id="sec.6-ssec.1-para1.i-note" guid="_08754787-d963-459a-8795-1ff7953ef397" type="example"><heading id="sec.6-ssec.1-para1.i-note-he" guid="_ab05be05-40e3-4240-8b40-95daa21baa09">Example—</heading><block><txt break.before="1">The child may have been disciplined by his or her parents or by a member of the child’s community.</txt></block></note></block></li><li id="sec.6-ssec.1-para1.j" guid="_27c582f8-9abb-42ba-9c2d-4fd44875cc8e" provision.type="other"><no>(j)</no><block><txt break.before="0">information about sentencing options.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_ff208bf7-1658-4065-87b9-1ef056ea6143" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-ssec.2-def.correspondingorder_" guid="_720fb73d-ebad-4ab0-9ecb-f0c86955ebe4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-ssec.2-def.correspondingorder" guid="_0a8e9858-0a27-43b2-bc2a-d758e6d724a2" type="definition">corresponding order</defterm> means an order made by a court in another State that is substantially similar in nature to a community based order or a detention order.</txt></definition></deflist></block></subclause></clause><clause id="sec.7" guid="_8619306c-cadf-407f-bb50-65c44a64d8ff" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_979fdcd8-056c-4e67-8842-43c89a7d9b87">Contents of further material for pre-sentence report</heading><subclause id="sec.7-ssec.1" guid="_c5517459-1846-4a19-9095-ca002df3bc06" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, under <legref jurisd="QLD" type="subordleg" refid="sec.151" target.doc.id="UNKNOWN" check="invalid">section&#160;151</legref><legref jurisd="QLD" type="subordleg" refid="sec.151-ssec.9" target.doc.id="UNKNOWN" check="invalid">(9)</legref> of the <legref jurisd="QLD" type="subordleg" target.doc.id="UNKNOWN" check="invalid">Act</legref>, the chief executive gives a court further material to be considered with another report prepared for another sentencing of a child that happens on the same day.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_751a1582-1e92-4510-8689-61bf7c221bd5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The further material must, for the offence for which it is given, include the information mentioned in <intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">section&#160;6</intref> that is relevant to the offence and not included in the other report.</txt></block></subclause></clause></division><division id="pt.3-div.2" guid="_00d93a1c-947a-4d2b-829f-3351fea0ab79" affected.by.uncommenced="0"><no>Division 2</no><heading id="pt.3-div.2-he" guid="_2a9eef26-7f38-4aed-a320-47ab0a98ac6e">Community based orders</heading><clause id="sec.8" guid="_5a0c813a-7604-4b00-ad86-a25320269558" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_ea0a7ccc-4b61-4928-94df-360bfa025106">Reporting requirements for community based order</heading><subclause id="sec.8-ssec.1" guid="_dc2a0575-5620-4bae-a12d-1582ff484bb9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a child against or for whom a community based order is made.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_6ca904ea-8d23-4673-89f7-e2510ffd4b75" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the child can not comply with a reasonable direction of the chief executive given in relation to the order because of illness, injury or other circumstance beyond the child’s control, the child must as soon as practicable inform the chief executive of the illness, injury or other circumstance.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_bc930041-510c-43c9-9771-eb48607a03de" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive may ask the child to give the chief executive—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-para1.a" guid="_1fe100fc-3539-4e6c-8c1b-4e068a6900c5" provision.type="other"><no>(a)</no><block><txt break.before="0">a medical certificate that states the nature of the illness or injury; or</txt></block></li><li id="sec.8-ssec.3-para1.b" guid="_e9a0896b-b03b-4463-8162-a4f1d9a30195" provision.type="other"><no>(b)</no><block><txt break.before="0">documentary or other evidence of the reason for the child’s noncompliance with the reasonable direction.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.4" guid="_b5a030e3-a0fb-4f25-a2a3-168818f50bca" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The child must comply with the request.</txt></block></subclause><subclause id="sec.8-ssec.5" guid="_d3bf69fa-1620-4612-b37a-743cd8fe0419" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the child is injured while performing community service or another activity under the community based order the child must report the circumstances of the injury to the chief executive as soon as practicable.</txt></block></subclause><subclause id="sec.8-ssec.6" guid="_a72cf265-5051-4a0b-9fe3-98e17d1f0a35" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Also, if the person who is supervising the child’s community service or other activity is aware of the circumstances of the injury, the person must report the circumstances to the chief executive as soon as practicable.</txt></block></subclause><subclause id="sec.8-ssec.7" guid="_09df80f4-af17-44ed-82cb-36447a06e092" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The chief executive must, as soon as practicable after the community based order is made, inform the child about the child’s obligations under this section.</txt></block></subclause></clause><clause id="sec.9" guid="_bc2f5bac-29e2-4766-b27a-1046808dad86" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_60675249-4132-4a87-90ee-69a859c9b977">Limits on chief executive’s directions about community based order</heading><subclause id="sec.9-ssec.1" guid="_144bc1f0-d735-4c4d-bc83-ad396b9cb0d6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive must not direct a child to perform community service, or another activity under a community based order, that is dangerous, unsafe or likely to harm the child’s health.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_d17f921f-2ba8-46ea-bd48-1fbff9d8a9ca" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, in giving directions to a child in relation to the child’s performance of another activity under a community based order, the chief executive must avoid, if practicable, conflicts with the religious and cultural beliefs and practices of the child or the child’s parent.</txt><note id="sec.9-ssec.2-note" guid="_29a26a65-bd9f-458e-be4e-9db2ca991751" type="example"><heading id="sec.9-ssec.2-note-he" guid="_9463049f-8c64-4269-8e5e-72a846e61e89">Note—</heading><block><txt break.before="1">For directions about community service, see <intref check="invalid">section&#160;197</intref> (Obligation of chief executive) of the <legref jurisd="QLD" type="subordleg" target.doc.id="UNKNOWN" check="invalid">Act</legref>.</txt></block></note></block></subclause><subclause id="sec.9-ssec.3" guid="_708e70dd-d1ac-4782-b308-b1ddd634300e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For <intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">subsection&#160;(1)</intref>, the chief executive must have regard to the child’s age, maturity, physical capacity and intellectual capacity.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_5f84951e-7c57-492f-9dfb-8c400cd519ee" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the child is 15 years or older, the chief executive must not direct the child to perform community service for more than—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.4-para1.a" guid="_71ea5442-6b5a-4333-86ec-0e1ca900a354" provision.type="other"><no>(a)</no><block><txt break.before="0">if the child is attending school or another educational institution on a full-time basis, the following hours in a week—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.4-para1.a-para2.i" guid="_6b75dbe9-3876-4c93-a0ac-75c4ba8d7fdc" provision.type="other"><no>(i)</no><block><txt break.before="0">during vacations of the school or educational institution—30 hours;</txt></block></li><li id="sec.9-ssec.4-para1.a-para2.ii" guid="_ee477a68-8926-4809-968e-5820fd9e7230" provision.type="other"><no>(ii)</no><block><txt break.before="0">at other times—8 hours; or</txt></block></li></list></block></li><li id="sec.9-ssec.4-para1.b" guid="_e3651e83-135f-4621-bf2b-c08c2a3fc0eb" provision.type="other"><no>(b)</no><block><txt break.before="0">if the child is in full-time employment—8 hours a week; or</txt></block></li><li id="sec.9-ssec.4-para1.c" guid="_1a2a14a6-5a73-4e5b-8eb0-8256eec5c3ca" provision.type="other"><no>(c)</no><block><txt break.before="0">otherwise—30 hours a week.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.5" guid="_74f00373-0768-40e5-bbb6-067524fb6253" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the child is under 15 years, the chief executive must not direct the child to perform community service for more than the following hours in a week—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.5-para1.a" guid="_a8b8543e-6449-4a3d-9f5c-a532a938dedc" provision.type="other"><no>(a)</no><block><txt provision.type="other"><no>(f)</no><block><txt break.before="0">if, while on remand for a charge of an offence or after arrest by a police officer under the <legref jurisd="QLD" type="act" target.doc.id="act-2000-005" target.version.series="13728c9a-0e6c-41c2-8090-97af5880885b" check="valid"><name emphasis="yes">Police Powers and Responsibilities Act 2000</name></legref>, <legref jurisd="QLD" type="act" refid="sec.200" target.doc.id="act-2000-005" target.version.series="13728c9a-0e6c-41c2-8090-97af5880885b" check="valid" target.guid="_defa95b0-3078-4710-8977-a42cf86137d8">section&#160;200</legref><legref jurisd="QLD" type="act" refid="sec.200-ssec.3" target.doc.id="act-2000-005" target.version.series="13728c9a-0e6c-41c2-8090-97af5880885b" check="invalid">(3)</legref>, the child is detained—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.f-para2.i" guid="_1635a578-0143-4869-8089-9af708786522" provision.type="other"><no>(i)</no><block><txt break.before="0">to appear before a specified court on a specified day—the day and place of the child’s next appearance before the court; or</txt></block></li><li id="sec.13-ssec.1-para1.f-para2.ii" guid="_f8bfc361-f149-4a2a-94cd-ff8907135579" provision.type="other"><no>(ii)</no><block><txt break.before="0">to appear before a specified court at the next sittings of the court—the day the next sittings start and the place where the child is to appear;</txt></block></li></list></block></li><li id="sec.13-ssec.1-para1.g" guid="_6b66bbb7-caad-43df-9cd2-0a2f3d73c8a6" provision.type="other"><no>(g)</no><block><txt break.before="0">if the child is detained under the sentence of a court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.g-para2.i" guid="_fcd7d46f-4958-4785-8b41-0cb4fa262348" provision.type="other"><no>(i)</no><block><txt break.before="0">the nature of the offence; and</txt></block></li><li id="sec.13-ssec.1-para1.g-para2.ii" guid="_520158d9-5234-48b6-b790-6b797167a98a" provision.type="other"><no>(ii)</no><block><txt break.before="0">the day of the sentence; and</txt></block></li><li id="sec.13-ssec.1-para1.g-para2.iii" guid="_bcd45682-1842-4258-8b16-fdb89fb2bffd" provision.type="other"><no>(iii)</no><block><txt break.before="0">the period of the sentence;</txt></block></li></list></block></li><li id="sec.13-ssec.1-para1.h" guid="_31317b78-315f-479c-865f-ba16ac372d61" provision.type="other"><no>(h)</no><block><txt break.before="0">if, when the child is being admitted, the child makes a complaint about the child’s treatment while detained as mentioned in paragraph (f) or (g)—details of the complaint;</txt></block></li><li id="sec.13-ssec.1-para1.i" guid="_20b4b103-a46c-45d9-be6a-51d797b7f862" provision.type="other"><no>(i)</no><block><txt break.before="0">information about the apparent state of the child’s health, including, for example, information about any medical condition affecting the child that is available to the chief executive at the time of the child’s admission;</txt></block></li><li id="sec.13-ssec.1-para1.j" guid="_d894d79c-3e8f-4743-bbdc-af46faf37981" provision.type="other"><no>(j)</no><block><txt break.before="0">a description of the child’s physical appearance.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.2" check="invalid">(1)</legref> of the <legref jurisd="QLD" type="subordleg" target.doc.id="UNKNOWN" check="invalid">Act</legref> is explained to a child who is admitted to a detention centre, the chief executive must, if reasonably practicable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-para1.a" guid="_fa1ad6f2-4816-419e-950a-11de504101f5" provision.type="other"><no>(a)</no><block><txt break.before="0">for an Aboriginal or Torres Strait Islander child—have an Aboriginal or Torres Strait Islander detention centre employee orally explain the information to the child; and</txt></block></li><li id="sec.14-para1.b" guid="_462787ef-2448-4d67-a4d8-e2a0196aef6f" provision.type="other"><no>(b)</no><block><txt break.before="0">for a child who has difficulty understanding English—have an interpreter or other person able to communicate with the child orally explain the information to the provision.type="other"><no>(5)</no><block><txt break.before="0">The chief executive may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.5-para1.a" guid="_23202371-06c6-414a-9e7b-6a5d2623004c" provision.type="other"><no>(a)</no><block><txt break.before="0">keep the property in safe custody while the child is detained in the centre; or</txt></block></li><li id="sec.15-ssec.5-para1.b" guid="_b573ae9c-4d51-4329-8a44-9efe5db62eb8" provision.type="other"><no>(b)</no><block><txt break.before="0">allow the child to keep it for the child’s use; or</txt></block></li><li id="sec.15-ssec.5-para1.c" guid="_58c50186-3134-46cb-a737-f74586560806" provision.type="other"><no>(c)</no><block><txt break.before="0">if the chief executive considers the property is perishable—destroy it; or</txt></block></li><li id="sec.15-ssec.5-para1.d" guid="_c73e440c-b9da-4443-b0f9-e8cfcef0ff5e" provision.type="other"><no>(d)</no><block><txt break.before="0">if the chief executive considers the property is unhygienic or dangerous and poses an immediate risk to the health or safety of a person in the detention centre—destroy it; or</txt></block></li><li id="sec.15-ssec.5-para1.e" guid="_1b34e65a-2151-4846-b013-270b197d9949" provision.type="other"><no>(e)</no><block><txt break.before="0">if the chief executive considers the property is unhygienic or dangerous but does not pose an immediate risk to the health or safety of a person in the detention centre—destroy the property unless it would be reasonable to take steps to beliefs.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.17-ssec.4" guid="_d11bc461-6cf4-4770-a074-bd0f62801dc6" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The chief executive must not use, as a way of disciplining a child—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.4-para1.a" guid="_758d1ad5-7155-4b29-8208-48520bd690c8" provision.type="other"><no>(a)</no><block><txt break.before="0">corporal punishment; or</txt></block></li><li id="sec.17-ssec.4-para1.b" guid="_b96b44a9-c13b-413a-a9bd-4d5a172544f7" provision.type="other"><no>(b)</no><block><txt break.before="0">physical contact; or</txt></block></li><li id="sec.17-ssec.4-para1.c" guid="_338d0938-b7a3-4c2d-90b3-2b946a1fb35a" provision.type="other"><no>(c)</no><block><txt break.before="0">an act that involves humiliation, physical abuse, emotional abuse or sustained verbal abuse; or</txt></block></li><li id="sec.17-ssec.4-para1.d" guid="_c68dc8de-be4d-4abd-aeff-1109a90ed1a1" provision.type="other"><no>(d)</no><block><txt break.before="0">deprivation of sleep, food or visitors; or</txt></block></li><li id="sec.17-ssec.4-para1.e" guid="_ddb65990-3452-429e-99ea-ebf9fa7a29dd" provision.type="other"><no>(e)</no><block><txt break.before="0">withholding letters or other mail sent to or from the child; or</txt></block></li><li id="sec.17-ssec.4-para1.f" guid="_d11445ae-3a39-4f6c-afa6-70cc3b406f2e" provision.type="other"><no>(f)</no><block><txt break.before="0">withholding access to a telephone or other means of communication; or</txt></block></li><li id="sec.17-ssec.4-para1.g" guid="_0d42d032-de24-49f5-8052-c9f806173042" provision.type="other"><no>(g)</no><block><txt break.before="0">exclusion from cultural, educational or vocational programs; or</txt></block></li><li id="sec.17-ssec.4-para1.h" guid="_a2052671-49e2-4e20-9640-c828eec90adc" provision.type="other"><no>(h)</no><block><txt break.before="0">medication or deprivation of medication.</txt></block></li></list></block></subclause><subclause id="sec.17-ssec.5" guid="_d924ce5c-b1c1-4d7f-87cd-e26791b4fded" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A detention centre employee may use reasonable force to protect a child, or other persons or property in the centre, from the consequences of a child’s misbehaviour.</txt></block></subclause><subclause id="sec.17-ssec.6" guid="_58219425-4e20-4ad0-ae83-da9f6ffdf206" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">However, a detention centre employee may use the force only if the employee reasonably believes the child, person or property can not be protected in another way.</txt></block></subclause><subclause id="sec.17-ssec.7" guid="_31a7e649-2e3c-4640-876d-df64e229b01c" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">If a detention centre employee uses force under <intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">subsection&#160;(5)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.7-para1.a" guid="_1cc0123b-bad5-4c40-a9fb-f3eb6e8af6d6" provision.type="other"><no>(a)</no><block><txt break.before="0">the detention centre employee must not use more force than is reasonably necessary; and</txt></block></li><li id="sec.17-ssec.7-para1.b" guid="_b25eabd7-d399-4c17-8c6b-bb5d3f926fff" provision.type="other"><no>(b)</no><block><txt break.before="0">the chief executive must ensure details about the use of the force are chief executive may approve types of restraints (<defterm id="def.approvedrestraints" guid="_413855a4-4acf-41bf-9748-1aed95582480" type="definition">approved restraints</defterm>) a staff member may use to restrain a child in the chief executive’s custody.</txt></block></clause><clause id="sec.20" guid="_b8b118e8-1007-493d-b81f-c94920f057f7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_0a1d5c6e-83fa-4754-b60b-361593f51c40">Use of approved restraints</heading><subclause id="sec.20-ssec.1" guid="_cd94c6cf-7890-43d7-9cb7-b2a7ec84e1a2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive may authorise a staff member to use approved restraints to restrain a child in the chief executive’s custody.</txt></block></subclause><subclause id="sec.20-ssec.2" guid="_cac267eb-5b61-4b8e-a770-97323112f0e7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The staff member may use approved restraints to restrain the child only if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.2-para1.a" guid="_2d4cc5f6-a21b-4a1d-96c7-ca3f3f405a70" provision.type="other"><no>(a)</no><block><txt break.before="0">the child is outside a detention centre, or about to leave a detention centre, under escort by a staff member; or</txt></block></li><li id="sec.20-ssec.2-para1.b" guid="_316a1b22-9203-4e7e-bf5e-be761e8c5388" provision.type="other"><no>(b)</no><block><txt break.before="0">the child is in a detention centre and the chief executive considers, on reasonable grounds, that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.2-para1.b-para2.i" guid="_04a2664d-1035-4103-91e5-326e85ff83bb" provision.type="other"><no>(i)</no><block><txt break.before="0">it is reasonably likely that the child will attempt to escape; or</txt></block></li><li id="sec.20-ssec.2-para1.b-para2.ii" guid="_585cf4a0-3fbc-4288-9655-0355c9c41907" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child could seriously harm himself, herself or someone else; or</txt></block></li><li id="sec.20-ssec.2-para1.b-para2.iii" guid="_661e767a-9f55-446e-b115-e8bf0313341e" provision.type="other"><no>(iii)</no><block><txt break.before="0">the child could seriously disrupt order and security at the detention centre.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.20-ssec.3" guid="_9d7e2ac7-cfc9-436f-8e49-31d6ef981d9f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, a staff member must not use approved restraints under <intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">subsection&#160;(2)</intref><intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">(b)</intref> unless the chief executive considers on reasonable grounds there is no other way to stop the child—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.3-para1.a" guid="_3a281fbd-6af5-4193-b447-f3e09b53a95a" provision.type="other"><no>(a)</no><block><txt break.before="0">attempting to escape; or</txt></block></li><li id="sec.20-ssec.3-para1.b" guid="_fb3b4848-dfd9-493f-9430-3242714da180" provision.type="other"><no>(b)</no><block><txt break.before="0">seriously harming himself, herself or someone else; or</txt></block></li><li id="sec.20-ssec.3-para1.c" guid="_94482a5e-5ee9-4a0d-b0d5-3091e1d18625" provision.type="other"><no>(c)</no><block><txt break.before="0">seriously disrupting order and security at the detention centre.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.4" guid="_a799770c-4e39-43f2-bac8-392effcaf498" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If approved restraints are used on a child, the chief executive must ensure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.4-para1.a" guid="_a5464caf-6723-4d37-b54f-f9315b7eeca0" provision.type="other"><no>(a)</no><block><txt break.before="0">all reasonable steps are taken to use the restraints in a way that respects the child’s dignity; and</txt></block></li><li id="sec.20-ssec.4-para1.b" guid="_d9670d53-37c4-4ec3-bcfd-bd8526e6b5f5" provision.type="other"><no>(b)</no><block><txt break.before="0">the restraints are used for no longer than is reasonably necessary in the circumstances.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.5" guid="_e41435a9-a193-4211-b355-82e3b2d423b4" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0"><intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">Subsection&#160;(2)</intref><intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">(a)</intref> does not require the use of restraints on a child if the chief executive considers that, in all the circumstances, the child is not likely to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.5-para1.a" guid="_c4269e81-023a-432b-80a0-2566a98fa54c" provision.type="other"><no>(a)</no><block><txt break.before="0">attempt to escape; or</txt></block></li><li id="sec.20-ssec.5-para1.b" guid="_cf5f7d1b-0f7c-4c71-a3b9-5046fae4e882" provision.type="other"><no>(b)</no><block><txt break.before="0">seriously harm himself, herself or someone else; or</txt></block></li><li id="sec.20-ssec.5-para1.c" guid="_cad11aa1-dd24-4dc0-a438-e5e9de096e4a" provision.type="other"><no>(c)</no><block><txt break.before="0">seriously disrupt order and security at the centre.</txt></block></li></list><note id="sec.20-ssec.5-note" guid="_5b085b43-df25-4aa2-a391-a767fd838dfb" type="example"><heading id="sec.20-ssec.5-note-he" guid="_5287f17c-b1e8-4831-9f11-1402f24f2430">Example—</heading><block><txt break.before="1">Restraints may not be used on a child who is attending a funeral, or otherwise on leave of absence, because the chief executive considers the child is not likely to attempt to escape.</txt></block></note></block></subclause></clause><clause id="sec.21" guid="_f7a717c0-31ed-49a7-9057-784ded990316" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_f829ab51-9287-4343-990c-4eb2da28235f">Record about approved restraints</heading><block><txt break.before="1">The chief executive must keep a record containing the following information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-para1.a" guid="_8f87b90b-c186-4934-808a-886e480f6853" provision.type="other"><no>(a)</no><block><txt break.before="0">particulars of approved restraints;</txt></block></li><li id="sec.21-para1.b" guid="_184d8a65-a023-4cee-b9a9-32647e22788f" provision.type="other"><no>(b)</no><block><txt break.before="0">the following particulars about the use of approved restraints on a child—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-para1.b-para2.i" guid="_72a037ae-a752-4709-9acb-1ad8379c332e" provision.type="other"><no>(i)</no><block><txt break.before="0">the child’s name;</txt></block></li><li id="sec.21-para1.b-para2.ii" guid="_decf1699-7538-4d1e-bdee-ddde27cc9120" provision.type="other"><no>(ii)</no><block><txt break.before="0">the day on which the restraints were used;</txt></block></li><li id="sec.21-para1.b-para2.iii" guid="_8ce04422-ffbc-43a4-8df5-6727e2c7433c" provision.type="other"><no>(iii)</no><block><txt break.before="0">Subject to <intref refid="cd-status-he" target.guid="_bfd78292-564f-43ca-a70a-c98d6621e260" check="valid">section&#160;26</intref>, a search of a child under this subdivision must not involve the removal of all or part of the child’s clothes.</txt></block></subclause><subclause id="sec.25-ssec.2" guid="_7e7e64de-6426-4d70-87b9-edd64e2f01d2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, if the search involves touching the child, the search must be conducted by a detention centre employee of the same sex as the child.</txt></block></subclause><subclause id="sec.25-ssec.3" guid="_c7792377-206b-4ed2-ac20-a9be3fa7a252" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt guid="_9cacdf36-d107-41c5-a7d3-bf757533369a" provision.type="other"><no>(a)</no><block><txt break.before="0">inform the child that a search is to be conducted; and</txt></block></li><li id="sec.25-ssec.3-para1.b" guid="_8d7b3445-98d7-45f6-83da-45b3bc6404c7" provision.type="other"><no>(b)</no><block><txt break.before="0">ask for the child’s cooperation.</txt></block></li></list></block></subclause><subclause id="sec.25-ssec.4" guid="_1bd12902-4456-434f-bc2a-5539dc781aca" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The detention centre employee may use reasonable force to carry out the search.</txt></block></subclause><subclause id="sec.25-ssec.5" guid="_7671e898-a10b-4f57-8e25-29f32f7b298f" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, the detention centre employee may use the force only if the employee reasonably believes the search can not be carried out in another way.</txt></block></subclause></clause><clause id="sec.26" guid="_e06d21ac-6380-4f65-84d2-dbbfcf88a53d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>26</no><heading id="sec.26-he" guid="_31de2b25-fa98-4482-b7cd-092c0bfaf5dc">Search involving removal of clothes</heading><subclause id="sec.26-ssec.1" guid="_aa4df766-3b1e-4fdd-8c16-2b0494542aaa" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the chief executive considers, on reasonable grounds, that it is necessary for the security of detention centre employees or children in the detention centre, the chief executive may order the child who is to be, or is being, searched to partly or completely undress.</txt></block></subclause><subclause id="sec.26-ssec.2" guid="_3b1783bc-c6b0-4434-a7d5-fb3ecabab7c2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must not order a child to partly or completely undress in the presence of a person of the opposite sex to the child.</txt></block></subclause><subclause id="sec.26-ssec.3" guid="_cf68928e-eeaa-44a1-9920-0f383a433117" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If reasonably practicable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.3-para1.a" guid="_18938354-48aa-4839-823b-1124282d8904" provision.type="other"><no>(a)</no><block><txt break.before="0">a detention centre employee conducting the search must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.3-para1.a-para2.i" guid="_64d67748-f368-4fff-ac5b-4eadc3316291" provision.type="other"><no>(i)</no><block><txt break.before="0">tell the child he or she will be required to remove clothing during the search; and</txt></block></li><li id="sec.26-ssec.3-para1.a-para2.ii" guid="_ccfcae06-a6bc-4ad1-ba22-f88ffee7aa8d" provision.type="other"><no>(ii)</no><block><txt break.before="0">tell the child why it is necessary to remove the clothing; and</txt></block></li><li id="sec.26-ssec.3-para1.a-para2.iii" guid="_e38ce09e-5cab-4a18-a77a-805380795b86" provision.type="other"><no>(iii)</no><block><txt break.before="0">ask for the child’s cooperation; and</txt></block></li></list></block></li><li id="sec.26-ssec.3-para1.b" guid="_eda3c902-864c-4bf0-8013-ccc1187cb5a8" provision.type="other"><no>(b)</no><block><txt break.before="0">the child must be given the opportunity to remain partly clothed during the search, for example, by allowing the child to dress his or her upper body before being required to remove items of clothing from the lower part of the body.</txt></block></li></list></block></subclause><subclause id="sec.26-ssec.4" guid="_ac2ecd43-fa9f-461c-8d18-063c23e5cc56" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The search must be conducted in a way providing reasonable privacy for the child.</txt><note id="sec.26-ssec.4-note" guid="_d4c94c83-a13d-427b-a1e4-d4b39ad0a2dd" type="example"><heading id="sec.26-ssec.4-note-he" guid="_3b0c04f2-4aa0-49ce-9bb3-c84cdcb03df5">Example—</heading><block><txt break.before="1">Reasonable privacy may be provided by conducting the search in a way that ensures, as far as reasonably practicable, the child being searched can not be seen by anyone of the opposite sex and by anyone who does not need to be present.</txt></block></note></block></subclause><subclause id="sec.26-ssec.5" guid="_290c7757-65aa-4bc7-b9a4-b5d28e094bc5" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Also, the search must be conducted as quickly as reasonably practicable and the child searched must be allowed to dress as soon as the search is finished.</txt></block></subclause><subclause id="sec.26-ssec.6" guid="_a87fc097-8764-46c2-8229-f8215d11821f" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The child must comply with an order made or direction given for the purpose of the search.</txt></block></subclause><subclause id="sec.26-ssec.7" guid="_0a676cd1-c81a-46ba-b0ca-a7a5a9e59612" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">A detention centre employee may use reasonable force to obtain compliance with the order.</txt></block></subclause><subclause id="sec.26-ssec.8" search</heading><subclause id="sec.27-ssec.1" guid="_4d8f6b0a-1a58-4857-a212-c7f1c3f891b7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive may authorise a medical practitioner to conduct a body search of a child detained in a detention centre.</txt></block></subclause><subclause id="sec.27-ssec.2" guid="_2d5312c7-d932-479b-9cc9-2e340d2c8bfd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If reasonably practicable, the medical practitioner must be of the same sex as the child.</txt></block></subclause><subclause id="sec.27-ssec.3" guid="_47e609c2-d5a7-477f-94cf-31585e7f6f64" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive may authorise the search only if the chief executive considers, on reasonable grounds, that the child is in guid="_ac26c969-fc89-4460-81ac-8c37b0be66bd" provision.type="other"><no>(b)</no><block><txt break.before="0">endanger, or be used to endanger, the child or another provision.type="other"><no>(4)</no><block><txt break.before="0">If reasonably practicable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.4-para1.a" guid="_40aa4243-da18-4274-9b1b-18b6b5b1cfbe" provision.type="other"><no>(a)</no><block><txt break.before="0">the medical practitioner conducting the search must, before conducting the search—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.4-para1.a-para2.i" guid="_9231a1f9-b9e3-464a-a0de-a2eaaf65581e" provision.type="other"><no>(i)</no><block><txt break.before="0">tell the child he or she will be required to remove clothing during the search; and</txt></block></li><li id="sec.27-ssec.4-para1.a-para2.ii" guid="_5029de95-1460-44d5-be6e-3a7a617704fa" provision.type="other"><no>(ii)</no><block><txt break.before="0">tell the child why it is necessary to remove the clothing; and</txt></block></li><li id="sec.27-ssec.4-para1.a-para2.iii" guid="_025767e2-8d0f-4393-9dd2-e383aad42188" provision.type="other"><no>(iii)</no><block><txt break.before="0">ask for the child’s cooperation; and</txt></block></li></list></block></li><li id="sec.27-ssec.4-para1.b" guid="_2549226b-b36b-4f0f-b012-3a92bbe3464e" provision.type="other"><no>(b)</no><block><txt break.before="0">the child must be given the opportunity to remain partly clothed during the search, for example, by allowing the child to dress his or her upper body before being required to remove items of clothing from the lower part of the body.</txt></block></li></list></block></subclause><subclause id="sec.27-ssec.5" guid="_76da3c88-1f9d-44a6-9238-6c53c30c0a6e" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The search must be conducted in a way providing reasonable privacy for the child.</txt><note id="sec.27-ssec.5-note" break.before="0">is declared by the chief executive by written notice to be a restricted or prohibited article; or</txt></block></li><li id="sec.29-ssec.1-para1.b" centre; or</txt></block></li><li id="sec.29-ssec.1-para1.b-para2.ii" guid="_580102af-6e4e-4ce4-868b-6a1ac2ee4fee" provision.type="other"><no>(ii)</no><block><txt break.before="0">endangers, or may be used to endanger, the child or someone else;</txt></block></li></list></block></li></list></block><block><txt break.before="1">the person may take possession of the article.</txt></block></subclause><subclause id="sec.29-ssec.2" guid="_0dc9ede1-267d-4fdc-8beb-7289ee7c6da6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The person must give the article to the chief executive.</txt></block></subclause><subclause id="sec.29-ssec.3" guid="_9b5a7059-fa7a-46b8-96d6-a4604e3f09b2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive may—</txt><list number.type="manual" unnumbered.indent="0"><li or</txt></block></li><li id="sec.29-ssec.3-para1.c" guid="_b1147b3d-223d-481c-b8a9-051178ffaf07" provision.type="other"><no>(c)</no><block><txt break.before="0">if the article belongs to another person—return it to the other person; or</txt></block></li><li id="sec.29-ssec.3-para1.d" guid="_cb0d05bb-e222-4876-8ac4-bdb943500eb1" provision.type="other"><no>(d)</no><block><txt the right to make and receive telephone calls at all reasonable times.</txt></block></subclause><subclause id="sec.30-ssec.2" guid="_79169214-6e66-4681-96ad-183067b64e74" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The child has the right to speak to another person during a telephone call outside the hearing of any other person.</txt></block></subclause><subclause id="sec.30-ssec.3" guid="_99dd7fbd-2837-420d-9de6-4881212c7a9c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, if the chief executive considers, on reasonable grounds, that the telephone conversation may disclose information that is, or is likely to be, detrimental to the good order and management of the centre, the chief executive may require a detention centre employee at the centre to listen to the conversation and terminate it on reasonable grounds.</txt></block></subclause><subclause id="sec.30-ssec.4" guid="_a14d7b16-6d71-4af8-935c-f8bc4cac61f8" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may examine correspondence between the child and another person if the chief executive reasonably believes the correspondence may disclose information, or contain property, that is, or is likely to be, detrimental to the good order and management of the centre.</txt></block></subclause><subclause provision.type="other"><no>(ii)</no><block><txt break.before="0">allow the child to keep it for the child’s use; or</txt></block></li><li id="sec.32-ssec.2-para1.b-para2.iii" guid="_3a34c249-bea9-4332-8cae-1b8b01ee3170" provision.type="other"><no>(iii)</no><block><txt break.before="0">if the chief executive considers the property is perishable—destroy it; or</txt></block></li><li id="sec.32-ssec.2-para1.b-para2.iv" guid="_18794788-2a68-4771-9278-a64e1f042c15" provision.type="other"><no>(iv)</no><block><txt break.before="0">if the chief executive considers the property is unhygienic or dangerous and poses an immediate risk to the health or safety of a person in the detention centre—destroy it; or</txt></block></li><li id="sec.32-ssec.2-para1.b-para2.v" guid="_8083e72d-fbef-4045-8d45-4bc48c625a27" provision.type="other"><no>(v)</no><block><txt break.before="0">if the chief executive considers the property is unhygienic or dangerous but does not pose an immediate risk to the health or safety of a person in the detention centre—destroy the property unless it would be reasonable to take steps to make the provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must ensure that, if a child needs medical treatment or other health services, the child is asked whether he or she type="definition">prescribed period</defterm>), representations to show why the property should not be destroyed;</txt></block></li><li id="sec.39-ssec.2-para1.d" guid="_c689d6f9-8242-43d2-8085-e90832e78c18" provision.type="other"><no>(d)</no><block><txt break.before="0">that the child may consult a lawyer, community visitor (child) or child advocacy officer
