Expired on 30 June 2018 (see s 16).Major Events (Gold Coast Commonwealth Games) Regulation 2017Part 1Preliminary1Short titleThis regulation may be cited as the Major Events (Gold Coast Commonwealth Games) Regulation 2017.2DefinitionsThe dictionary in schedule 9 defines particular words used in this regulation.Part 2Commonwealth Games3Commonwealth Games is a major event—Act, s 12For section 12(1) of the Act, the event known as the Commonwealth Games to be held in 2018 is a major event.4Major event organiser for Commonwealth Games—Act, s 12For section 12(2)(a) of the Act, the Gold Coast 2018 Commonwealth Games Corporation established under the Commonwealth Games Arrangements Act 2011 is the major event organiser for the Commonwealth Games.5Major event period for Commonwealth Games—Act, s 12For section 12(2)(c) of the Act, the major event period for the Commonwealth Games is the period between 24 December 2017 and 30 April 2018.6Application of Act provisions to Commonwealth Games generally—Act, ss 12 and 17For sections 12(2)(d)(i) and 17(b) of the Act—(a)section 22(1)(b) of the Act applies to the Commonwealth Games from 24 December 2017 to 19 April 2018; and(b)section 31(1)(b) of the Act applies to the Commonwealth Games from 24 December 2017 to 15 April 2018; and(c)sections 37 and 38 of the Act apply to the Commonwealth Games for the major event period; and(d)section 39 of the Act applies to the Commonwealth Games from 17 March 2018 to 18 April 2018.
7Major event areas for Commonwealth Games—Act, s 12(1)For section 12(2)(b) of the Act, each of the areas stated in schedule 1, column 1 is a major event area for the Commonwealth Games.(2)For section 12(2)(d)(ii) of the Act— (a)the provisions of the Act stated in schedule 1, column 2 apply to the major event area stated opposite in schedule 1, column 1; and(b)the provisions of the Act stated in schedule 1, column 2 for a major event area apply to the major event area for the period stated opposite in schedule 1, column 3.
Part 3Works for Commonwealth Games8Carrying out works for Commonwealth Games—Act, s 16For section 16(2) of the Act, the major event organiser may enter onto public land to carry out works in a major event area stated in schedule 2, column 1 during the period stated opposite in schedule 2, column 2.9Assessing building work(1)This section applies to a building certifier engaged to assess building work for the Commonwealth Games for the purpose of giving a compliance certificate for section 78(3) of the Act.(2)Before giving a compliance certificate for the building work, the building certifier must—(a)consult the Queensland Fire and Emergency Service about a special fire service or any work involving a fire-related alternative solution for the building work; and(b)if the building work is for a building or structure that is proposed to have a special fire service or involves a fire-related alternative solution—obtain and consider a report from the Queensland Fire and Emergency Service on the suitability of the proposed special fire service or fire-related alternative solution.
(3)In this section—building certifier see the Building Act 1975, section 8.building work see the Building Act 1975, section 5.fire-related alternative solution means an alternative solution as defined under the Building Act 1975, schedule 2 for performance requirements relating to fire safety.performance requirements see the Building Act 1975, schedule 2.special fire service see the Building Act 1975, schedule 2.Part 4Matters prescribed for part 5 of the Act10Displaying posters prohibited in major event area—Act, s 20(1)For section 20(6)(h) of the Act, a person must not display a poster on a property inside a major event area for the Commonwealth Games, including on the outside of a building or structure on the property.(2)Subsection (1) does not apply to a poster displayed by a person inside a major event area if the poster—(a)was displayed before the period stated for the major event area in schedule 1, column 3; and(b)was displayed in the course of the person’s ordinary activities.
11Major event lanes—Act, s 38(1)For section 38(2) of the Act, a marked lane of a road identified as a proposed major event lane in the Commonwealth Games traffic and transport management plan is declared to be a major event lane for the Commonwealth Games for the period stated for the lane in the plan.(2)For section 38(3) of the Act, the major event lanes are shown on the maps in schedule 8.(3)In this section—Commonwealth Games traffic and transport management plan means the traffic and transport management plan approved by the chief executive (transport) on 29 August 2017 for the Commonwealth Games.12Vehicles permitted to use major event lanes—Act, s 39(1)For section 39(2)(b)(ii) of the Act, the following types of vehicles are prescribed for the Commonwealth Games—(a)a bus being used to provide a general route service in the integrated mass transit area under an integrated mass transit service contract under the Transport Operations (Passenger Transport) Act 1994;(b)a vehicle under escort by a police or emergency vehicle;(c)any other vehicle, if the vehicle drives in the major event lane for a distance of no more than 100m and it is necessary for the driver of the vehicle to drive in the major event lane—
(i)to enter or leave a road; or(ii)to enter a part of a road of 1 kind from a part of a road of another kind (for example, moving to or from a service road, the shoulder of a road or an emergency stopping lane); or(iii)to overtake a vehicle that is—(A)turning right, or making a U-turn from the centre of a road; and(B)giving a right change of direction signal; or
(iv)to enter a marked lane, or a part of a road where there is room for a line of traffic, other than animals, bicycles, motorbikes or motorised wheelchairs, from the side of the road; or(v)to avoid an obstruction.
(2)In this section—general route service see the Transport Operations (Passenger Transport) Act 1994, schedule 3.integrated mass transit area see the Transport Operations (Passenger Transport) Act 1994, section 62AAA(1).integrated mass transit service contract see the Transport Operations (Passenger Transport) Act 1994, section 62AAC(1).marked lane see the Queensland Road Rules, schedule 5.obstruction see the Queensland Road Rules, schedule 5.13Major event lane signs—Act, sch 1(1)For schedule 1 of the Act, definition major event lane sign, the following signs are prescribed—(a)if the sign is to be installed on a narrow median strip and is for indicating that a lane on a road to the left of the sign is a major event lane—the sign shown in schedule 3, item 1;(b)if the sign is to be installed on a narrow median strip and is for indicating that a lane on a road to the right of the sign is a major event lane—the sign shown in schedule 3, item 2;(c)if the sign is to be installed on a narrow median strip, is for indicating that a lane on a road is a major event lane and the chief executive (transport) is satisfied it is not necessary to use a sign mentioned in paragraph (a) or (b)—the sign shown in schedule 3, item 3;(d)if the sign is to be installed other than on a narrow median strip and is for indicating that a lane on a road is a major event lane—the sign shown in schedule 3, item 4;(e)if the sign is for indicating the end of a major event lane—(i)the sign shown in schedule 3, item 5; or(ii)a sign that is made up of the signs shown in schedule 3, items 4 and 6, arranged in the way shown as an example use in schedule 3, item 7.
(2)In this section—narrow median strip means a median strip that the chief executive (transport) is satisfied is a narrow median strip.Part 5Authorised persons for Commonwealth Games14Persons who may be appointed as authorised persons—Act, s 56For section 56(1)(d) of the Act, the following persons are prescribed for the Commonwealth Games—(a)an advertisement contractor;(b)a brand protection contractor;(c)a security contractor (screening);(d)a security contractor (supervisor);(e)a traffic controller.
15Limitations on powers—Act, s 57(1)This section limits, for section 57(2) of the Act, the powers of particular authorised persons for the Commonwealth Games.(2)An authorised person must not exercise a power under section 16(3) or 28(2) of the Act, unless the person is—(a)an employee of the major event organiser; or(b)a police officer; or(c)a security contractor (supervisor); or(d)a traffic controller; or(e)a transport officer.
(3)An authorised person must not exercise a power under section 18(5)(a) or (b) of the Act, unless the person is—(a)an employee of the major event organiser; or(b)a police officer; or(c)a security contractor (screening); or(d)a security contractor (supervisor); or(e)a transport officer (counter-terrorism).
(4)An authorised person must not exercise a power under section 18(5)(c) to (f) or 25 of the Act, unless the person is—(a)an employee of the major event organiser; or(b)a police officer; or(c)a security contractor (supervisor); or(d)a transport officer (counter-terrorism).
(5)An authorised person must not exercise a power under section 24 or 26(2) of the Act, unless the person is—(a)an employee of the major event organiser; or(b)a police officer; or(c)a security contractor (supervisor); or(d)a traffic controller; or(e)a transport officer (counter-terrorism).
(6)However, a traffic controller may exercise a power under section 26(2) of the Act only in relation to a person mentioned in section 26(1)(d) of the Act.(7)An authorised person must not exercise a power under section 30(2) or 32(3) of the Act, unless the person is—(a)a brand protection contractor; or(b)an employee of the major event organiser; or(c)a police officer; or(d)a security contractor (supervisor).
(8)An authorised person must not exercise a power under the following sections of the Act, unless the person is a police officer—(a)section 30(4);(b)section 32(5);(c)section 39(4) to (6) and (8);(d)section 63.
(9)An authorised person must not exercise a power under section 33(4) of the Act, unless the person is—(a)an advertisement contractor; or(b)a brand protection contractor; or(c)an employee of the major event organiser; or(d)a police officer.

Schedule 9Dictionarysection 2advertisement contractor means a person who is engaged by the major event organiser to cover or remove an advertisement under section 33(4) of the Act.brand protection contractor means a person who is an employee or contractor of— (a)Minter Ellison–Gold Coast ABN 69 399 090 230; or (b)the trustee for the Varsity Services Trust ABN 33 506 539 618.
security contractor (screening) means a security provider who has been trained by the major event organiser in security screening.security contractor (supervisor) means a security provider who has been trained by the major event organiser in security supervision.security provider means a person who is authorised to carry out the functions of a security provider under the Security Providers Act 1993.traffic controller means a person who— (a)holds an appointment as an accredited person with the function of a traffic controller under the Transport Operations (Road Use Management—Accreditation and Other Provisions) Regulation 2015; and (b)is engaged, for the Commonwealth Games, to carry out the functions of a traffic controller under section 51 of that regulation.
