target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" target.guid="_6a0f5660-a5e3-4aca-bdb6-6363be24df7f" check="valid">ss&#160;30</legref> and <legref jurisd="QLD" type="act" refid="sec.36B" check="invalid">(i)</intref> and <intref refid="sec.36B" check="invalid">36B</intref><intref refid="sec.36B-ssec.1" check="invalid">(1)</intref><intref refid="sec.36B-ssec.1-para1.b" check="invalid">(b)</intref> and <legref jurisd="QLD" type="act" check="invalid">(c)</legref> of the <legref jurisd="QLD" type="act" check="invalid">Act</legref>, each of the following institutes is prescribed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-para1.a" guid="_bd940f08-b8b0-4a52-95e2-5426271f91ab" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the Australian Property Institute;</txt></block></li><li id="sec.2-para1.b" guid="_2dd9be8b-dc70-4e0f-84c9-5d5e245f7f9e" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the Property Institute of New Zealand;</txt></block></li><li id="sec.2-para1.c" guid="_afc88e8f-c4ba-4967-afc3-c5a90674224a" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the Royal Institution of Chartered Surveyors;</txt></block></li><li id="sec.2-para1.d" guid="_efbc0487-d2f4-4fac-8be9-7d2537b853a2" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the Singapore Institute of Surveyors and Valuers.</txt></block></li></list></block></clause><clause id="sec.3" guid="_c8a9044b-3b6e-46bc-8066-feffedc32131" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_cf95bbb3-e7c9-4947-8f11-583fc1639430">CPD for registered valuers—<legref jurisd="QLD" type="act" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" check="valid">Act</legref>, <legref jurisd="QLD" type="act" refid="sec.36B" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" target.guid="_1bcae052-40f6-4c52-9724-86195806ced6" check="valid">s&#160;36B</legref></heading><subclause id="sec.3-ssec.1" guid="_bf093ce0-a34f-4826-a9f6-288cd70cbe5c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <intref refid="sec.36B" check="invalid">section&#160;36B</intref><intref refid="sec.36B-ssec.1" check="invalid">(1)</intref><legref jurisd="QLD" type="act" check="invalid">(a)</legref> of the <legref jurisd="QLD" type="act" check="invalid">Act</legref>, the CPD prescribed is that, for each CPD period, a registered valuer spends at least 10 hours in total on—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.a" guid="_aa903b2a-4644-4e94-a420-35696266ad5a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the board gives the valuer a CPD notice before the start of the CPD period—CPD activities that satisfy the requirements stated in the notice; or</txt></block></li><li id="sec.3-ssec.1-para1.b" guid="_e578fe03-5838-4db3-aff4-87603169dd58" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">otherwise—any 1 or more CPD activities.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.2" guid="_5395066f-deef-478a-944b-5d0837b98775" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-ssec.2-def.CPDactivity_" guid="_7236ae2f-9e89-4127-9db9-0d3b32b39915" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.2-def.CPDactivity" guid="_ef917add-4da1-415e-82c6-731e6ced91f5" type="definition">CPD activity</defterm> means any of the following activities—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-def.CPDactivity-para1.a" guid="_276c0394-3379-46f8-a381-699877bb820a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">attending seminars, conferences, workshops, field days or addresses about property matters that are conducted by the board, professional organisations, industry bodies or employers;</txt></block></li><li id="sec.3-ssec.2-def.CPDactivity-para1.b" guid="_d8928188-81ae-4e82-ad40-60964b3539c5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">preparing and presenting papers about property matters;</txt></block></li><li id="sec.3-ssec.2-def.CPDactivity-para1.c" guid="_c57c8ec8-be94-4316-9853-2852225c3abb" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">writing and circulating or publishing articles about property matters;</txt></block></li><li id="sec.3-ssec.2-def.CPDactivity-para1.d" guid="_e979f744-1f4c-447e-9e63-ffcd9226503d" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">undertaking formal education about property matters;</txt></block></li><li id="sec.3-ssec.2-def.CPDactivity-para1.e" guid="_d9f20788-4711-4448-9b54-0785aceaa3bd" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">undertaking informal education about property matters by perusing appropriate journals or similar documents.</txt></block></li></list></definition><definition id="sec.3-ssec.2-def.CPDnotice_" guid="_d64f612b-b328-47d6-831f-06c5906c970d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.2-def.CPDnotice" guid="_ea63a588-142f-455d-a25e-ced442dda364" type="definition">CPD notice</defterm>, in relation to a CPD period, means a written notice that— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-def.CPDnotice-para1.a" guid="_fa7c1e8e-ea45-404e-a937-b1b81272f23b" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">states the minimum number of hours a registered valuer must spend on 1 or more stated CPD activities during the CPD period; but</txt></block></li><li id="sec.3-ssec.2-def.CPDnotice-para1.b" guid="_520717a0-a140-46a7-9b7b-844b23d1fc65" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">does not require a registered valuer to spend more than 10 hours in total on CPD activities during the CPD period.</txt></block></li></list></definition><definition id="sec.3-ssec.2-def.CPDperiod_" guid="_00fa887c-82a0-4c35-a6ba-1db24181b0c7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.2-def.CPDperiod" guid="_5f8fadb9-7e4a-44b9-b4d3-fdcce732fd49" type="definition">CPD period</defterm> means a period—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-def.CPDperiod-para1.a" guid="_189c79ca-c253-45eb-abe9-2d06f2ab5a00" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">starting on 1 May; and </txt></block></li><li id="sec.3-ssec.2-def.CPDperiod-para1.b" guid="_bf8177df-aa7a-46af-9855-540c25bac19b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">ending on the next 30 April.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.4" guid="_0a3fdffd-3ab5-4044-be44-8d0c3f8fce3f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_a0bb1ca0-c962-42b0-ae85-724909ba42ec">CPD for specialist retail valuers—<legref jurisd="QLD" type="act" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" check="valid">Act</legref>, <legref jurisd="QLD" type="act" refid="sec.42FA" target.doc.id="act-1992-002" target.version.series="d93563db-5378-4a20-8b8d-10c4cf45fe6d" target.guid="_f0533cd8-5feb-42d3-bb7d-0958b70a20d1" check="valid">s&#160;42FA</legref></heading><subclause id="sec.4-ssec.1" guid="_dab74851-28b0-4e1e-a394-695e4f8eba15" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <intref refid="sec.42FA" check="invalid">section&#160;42FA</intref><legref jurisd="QLD" type="act" check="invalid">(b)</legref> of the <legref jurisd="QLD" type="act" check="invalid">Act</legref>, the CPD prescribed is that, for each CPD period, a specialist retail valuer spends at least 5 hours in total on—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.1-para1.a" guid="_398c1c12-8fb1-4e7c-9b8e-ce317c6e1b69" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the board gives the valuer a CPD notice before the start of the CPD period—CPD activities that satisfy the requirements stated in the notice; or</txt></block></li><li id="sec.4-ssec.1-para1.b" guid="_8320c6f9-4c4a-4228-a25c-3c9c8ddecd53" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">otherwise—any 1 or more CPD activities.</txt></block></li></list></block></subclause><subclause id="sec.4-ssec.2" guid="_ac03ec33-cace-4f54-b4ce-d8b72a98b2eb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.4-ssec.2-def.CPDactivity_" guid="_cdc67134-b5d4-48c9-bad3-4eb3ba2c2e3c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-ssec.2-def.CPDactivity" guid="_1e04b664-446e-4801-b8e8-25b581a0841a" type="definition">CPD activity</defterm> means any of the following activities—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.2-def.CPDactivity-para1.a" guid="_94956e70-c193-4611-9724-73b636a39519" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">attending seminars, conferences, workshops, field days or addresses about retail rental valuation that are conducted by the board, professional organisations, industry bodies or employers;</txt></block></li><li id="sec.4-ssec.2-def.CPDactivity-para1.b" guid="_3d96e05a-20db-4c86-96e8-66e726f525e0" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">preparing and presenting papers about retail rental valuation;</txt></block></li><li id="sec.4-ssec.2-def.CPDactivity-para1.c" guid="_3fee8831-decc-4726-835a-f25e1eece4b8" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">writing and circulating or publishing articles about retail rental valuation;</txt></block></li><li id="sec.4-ssec.2-def.CPDactivity-para1.d" guid="_56fb7bc2-bc76-430c-b37f-969fcf606918" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">undertaking formal education about retail rental valuation;</txt></block></li><li id="sec.4-ssec.2-def.CPDactivity-para1.e" guid="_c86722b3-37d5-4ee0-a65e-042a2bce3504" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">undertaking informal education about retail rental valuation by perusing appropriate journals or similar documents.</txt></block></li></list></definition><definition id="sec.4-ssec.2-def.CPDnotice_" guid="_311d2dba-0460-4270-89c5-be2e2e759998" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-ssec.2-def.CPDnotice" guid="_b837a78d-61cf-4938-a154-5bac9739f2f6" type="definition">CPD notice</defterm>, in relation to a CPD period, means a written notice that— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.2-def.CPDnotice-para1.a" guid="_61419295-8f47-451d-8e76-e7e5a39b513e" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">states the minimum number of hours a specialist retail valuer must spend on 1 or more stated CPD activities during the CPD period; but</txt></block></li><li id="sec.4-ssec.2-def.CPDnotice-para1.b" guid="_f71e528b-5ed5-4ff8-a021-6cc45ffb22ee" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">does not require a specialist retail valuer to spend more than 5 hours in total on CPD activities during the CPD period.</txt></block></li></list></definition><definition affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_8de0d71d-ba94-4d4e-960f-44b49a6c6827">Code of professional conduct</heading><subclause id="sec.5-ssec.1" guid="_3dd74512-f417-4bad-a9b6-8b991c4fe4ba" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref jurisd="QLD" type="act" check="invalid">section&#160;66</legref><legref jurisd="QLD" type="act" check="invalid">(2)</legref> of the <legref jurisd="QLD" type="act" check="invalid">Act</legref>, the code of professional conduct for valuers consists of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_adfcebb5-a8c3-4ccd-b212-028f7a8a3299" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the provisions of <intref refid="sch.1" target.guid="_5076f828-6d87-4dc2-900e-d7fe72b94a5f" check="valid">schedule&#160;1</intref>; board approves a document for inclusion in the code—the approved document.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_2d1509d1-65c0-40cb-b51e-64c88ebad39a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">To the extent of any inconsistency between a provision of <intref refid="sch.1" target.guid="_5076f828-6d87-4dc2-900e-d7fe72b94a5f" check="valid">schedule&#160;1</intref> and a document mentioned in <intref refid="sec.5-ssec.1" target.guid="_3dd74512-f417-4bad-a9b6-8b991c4fe4ba" check="valid">subsection&#160;(1)</intref><intref refid="sec.5-ssec.1-para1.b" target.guid="_8f17a713-4ffb-4420-833d-b6ef3705d9e3" check="valid">(b)</intref>, the provision of <intref refid="sch.1" target.guid="_5076f828-6d87-4dc2-900e-d7fe72b94a5f" check="valid">schedule&#160;1</intref> prevails.</txt></block></subclause><subclause id="sec.5-ssec.3" guid="_8c4e8c16-3ad9-48ac-b147-56bf6b992b31" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the board approves a document for inclusion in the code, the board must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_b30d1f0a-cca0-4a42-8b8d-60b8ffc70431" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">publish the document on the board’s website; and</txt></block></li><li id="sec.5-ssec.3-para1.b" guid="_2abb1a44-3575-480e-a498-e178e72e145a" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">keep copies of the document available for inspection, at the board’s office, by members of the public during business hours; and</txt></block></li><li id="sec.5-ssec.3-para1.c" guid="_c1378927-338d-4744-ad36-aa9f74faf7ee" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">give each registered valuer a written notice stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.c-para2.i" guid="_db0dbec0-8d9b-42dc-bff9-9ed1e9cc0ca6" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">that the board has approved the document for inclusion in the code; and</txt></block></li><li id="sec.5-ssec.3-para1.c-para2.ii" guid="_cab62914-b264-4072-83ca-2f11c3a748d9" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the version number or other identifying information for the document; and</txt></block></li><li id="sec.5-ssec.3-para1.c-para2.iii" guid="_75df358e-4de6-4898-9162-66877972a2e2" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the day on which the document takes effect as part of the code.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-ssec.4" guid="_276c32cb-bc47-4959-982a-b8e46d0aba0e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For <intref refid="sec.5-ssec.3" target.guid="_8c4e8c16-3ad9-48ac-b147-56bf6b992b31" check="valid">subsection&#160;(3)</intref><intref refid="sec.5-ssec.3-para1.c" target.guid="_c1378927-338d-4744-ad36-aa9f74faf7ee" check="valid">(c)</intref><intref refid="sec.5-ssec.3-para1.c-para2.iii"
