1992</name></legref>.</txt></block></clause><clause id="sec.2" guid="_3ed83400-feeb-4465-b792-94475937a4ea" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_75ffb511-282f-41c2-981e-00b913ba9589">Commencement</heading><block><txt break.before="1">This Act commences on a day to be fixed by proclamation.</txt></block></clause><clause id="sec.3" guid="_c4dc8846-28b8-4907-849b-59db6e14cd55" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_14df8503-2360-47da-83c1-f2d864dcaa9b">Purpose</heading><block><txt break.before="1">The purpose of this Act is to enable the enactment of uniform legislation relating to the recognition of regulatory standards adopted in Australia regarding goods and occupations.</txt></block></clause><clause id="sec.4" guid="_2c404913-6296-4d5d-9a6a-af48c41404d4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_7941e903-37c4-4ee1-8f1d-58b95429be7c">Interpretation</heading><block><txt break.before="1">In this Act—</txt><deflist><definition id="sec.4-def.theCommonwealthAct_" guid="_509c73ff-d9ae-47e2-8b25-e2ce40399aee" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.theCommonwealthAct" guid="_dbd1a78c-cc53-46f2-8a8c-8f439b4134a4" type="definition">the Commonwealth Act</defterm> means the <legref jurisd="QLD" type="act" target.doc.id="act-0000-000" check="invalid">Act</legref> of the Parliament of the Commonwealth, enacted as referred to in <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">section&#160;5</intref><intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">(1)</intref><intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">(a)</intref>, and as amended and in force from time to time.</txt></definition></deflist></block></clause><clause id="sec.5" guid="_a89b682f-4281-40cf-9889-42d1b8a8385d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_ee50616e-1137-4494-bee5-17444624cd47">Enactment of uniform mutual recognition legislation</heading><subclause id="sec.5-ssec.1" guid="_5b4ebfd8-1f63-44bd-8704-8e85223489f6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The following matters, to the extent to which they are not otherwise included in the legislative powers of the Parliament of the Commonwealth, are referred to the Parliament of the Commonwealth for a period commencing on the day on which this Act commences and ending on the day fixed under <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(4)</intref> as the day on which the reference under this Act terminates, but not longer, namely, the matters to which the Schedule relates but only to the extent of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_959dadde-fa0f-42a6-ac4a-ad77b18e57f3" provision.type="other"><no>(a)</no><block><txt break.before="0">the enactment of an Act in the terms, or substantially in the terms, set out in the Schedule; and</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_5796341f-c169-45e5-9055-4cc628fce75d" provision.type="other"><no>(b)</no><block><txt break.before="0">the amendment of that Act, but only in terms which are approved by the designated person for each of the then participating jurisdictions.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_f813d4d3-917f-44bd-a954-549e5d728584" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For the purposes of this section, a <defterm id="sec.5-def.participatingjurisdiction" guid="_191655b7-c78e-440c-93de-26339b4a4755" type="definition">participating jurisdiction</defterm> is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_025d121a-07ac-4502-aea7-35f3c5c1c89e" provision.type="other"><no>(a)</no><block><txt break.before="0">a State for which there is in force an Act of its Parliament that refers to the Parliament of the Commonwealth the matters mentioned in <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(1)</intref>, or that adopts the Commonwealth Act, under <legref jurisd="QLD" type="act" check="invalid">section&#160;51</legref><legref jurisd="QLD" type="act" check="invalid">(xxxvii)</legref> of the Commonwealth Constitution; or</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_e23639f2-3703-4600-b732-cf2fa35a494e" provision.type="other"><no>(b)</no><block><txt break.before="0">a Territory (being the Australian Capital Territory or the Northern Territory) for which there is in force an Act of its legislature that requests the Parliament of the Commonwealth to enact the Commonwealth Act or that enables the Commonwealth Act to apply in relation to it.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_1325be22-76c1-46aa-a095-c4e8bb97dd8a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For the purposes of this section, the designated person for a State is the Governor, for the Australian Capital Territory is the Chief Minister and for the Northern Territory is the Administrator.</txt></block></subclause><subclause id="sec.5-ssec.4" guid="_132f316c-1b78-4079-8297-2fea935b3f22" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Governor may, at any time, fix by proclamation a day as the day on which the reference under this Act terminates.</txt></block></subclause><subclause id="sec.5-ssec.5" guid="_5b652658-ca90-4147-bad2-a1a0d28aeb91" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The day so fixed must be no earlier than the end of the period of 5 years commencing on the date of commencement of the Commonwealth Act.</txt></block></subclause><subclause id="sec.5-ssec.6" guid="_81062794-8a00-452e-a620-71bcea36d265" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If some provisions of the Commonwealth Act commence before others, the reference in <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(5)</intref> to the date of commencement of that Act is taken to be a reference to the commencement of the first provision or provisions to commence.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;5</b> amd <legref of amendments</heading><block><txt break.before="1">For the purposes of <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">section&#160;5</intref><intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">(1)</intref><intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">(b)</intref>, the Governor may, by proclamation, approve the terms of amendments of the Commonwealth Act.</txt></block></clause><clause id="sec.7" guid="_e64bf3c7-cf6f-45e1-9fa2-0f7a337360a0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_7853fb08-ce84-4ea0-9aec-ac2bae6575ad">Regulations for temporary exemptions for goods</heading><block><txt break.before="1">Without limiting any other power to make regulations under any other Act, the Governor in Council may make regulations for the purposes mentioned in <legref jurisd="QLD" type="act" check="invalid">section&#160;15</legref> of the Commonwealth enact legislation authorised by the Parliaments of States under <legref jurisd="QLD" type="act" check="invalid">paragraph&#160;(xxxvii)</legref> of <legref jurisd="QLD" type="act" check="invalid">section&#160;51</legref> of the Commonwealth Constitution, and requested by the legislatures of the Australian Capital Territory and the Northern Territory, for the purpose of promoting the goal of freedom of movement of goods and service providers in a national market in Australia.</txt></block></clause><clause id="sch-sec.4" guid="_d391e197-aaad-490b-9728-5ebed705b488" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sch-sec.4-he" guid="_b37080d8-8ad1-458d-9795-8c06d1b33d02">Interpretation</heading><subclause id="sch-sec.4-ssec.1" guid="_32d9455b-a781-4b0c-97c0-e1fa410d7da3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">In this Act, unless the contrary intention appears—</txt><deflist><definition id="sch-sec.4-ssec.1-def.conditions_" guid="_8385f97f-1c33-490a-a29b-3778c154f16f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.conditions" guid="_cebf2c38-be27-46de-8b5e-0709ee7d755c" type="definition">conditions</defterm>, when used in relation to occupations, means conditions, limitations or restrictions;</txt></definition><definition id="sch-sec.4-ssec.1-def.deemedregistration_" guid="_fead976a-571b-40c7-9341-741b4abf0eee" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.deemedregistration" guid="_4fc4a376-5fe9-4034-8252-dcef6448725c" type="definition">deemed registration</defterm> means deemed registration as defined in <intref refid="sch-sec.25" target.guid="_347abeb3-2c18-4d19-b28a-dda98b8ad4f2" check="valid">section&#160;25</intref>;</txt></definition><definition id="sch-sec.4-ssec.1-def.equivalent_" guid="_c815cf1a-aa1b-4432-b0d2-485fe2b56fd0" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.equivalent" guid="_a6a33987-d562-4961-80d7-b8c8f2a520f6" type="definition">equivalent</defterm>, when used in relation to occupations, has a meaning affected by <intref refid="sch-sec.4-ssec.1-def.equivalent_-div.4" check="invalid">Division&#160;4</intref> of <intref refid="sch-pt.3" target.guid="_aeaf91e7-f920-4e5c-af14-af929553ad68" check="valid">Part&#160;3</intref>;</txt></definition><definition id="sch-sec.4-ssec.1-def.goods_" guid="_3f5a3d73-de1d-4a4a-a6eb-8d77e02ec0b6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.goods" guid="_47d5f66d-279a-4396-afda-fb70b8890f4c" type="definition">goods</defterm> means goods of any kind, and includes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.4-ssec.1-def.goods-para1.a" guid="_1076ff95-d936-40d6-9340-58cae9e3b4c5" provision.type="other"><no>(a)</no><block><txt break.before="0">animals; or</txt></block></li><li id="sch-sec.4-ssec.1-def.goods-para1.b" guid="_01d532e4-7664-49eb-9cf3-431d0f243dcc" provision.type="other"><no>(b)</no><block><txt break.before="0">a package containing goods; or</txt></block></li><li id="sch-sec.4-ssec.1-def.goods-para1.c" guid="_73408367-daf2-4042-b6e8-9ccc0850c700" provision.type="other"><no>(c)</no><block><txt break.before="0">a label attached to goods;</txt></block></li></list></definition><definition id="sch-sec.4-ssec.1-def.grant_" guid="_e34e6fdb-9c1e-48a0-b61f-b15eba9dd506" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.grant" guid="_a1b69e76-14b8-4750-9742-44f38df53006" type="definition">grant</defterm>, when used in relation to registration, means grant, issue or otherwise confer registration;</txt></definition><definition id="sch-sec.4-ssec.1-def.import_" guid="_0821fd08-7b38-4f4b-a351-da70a58f06f3" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.import" guid="_761e79ad-f663-4837-abd9-0b8ff122be34" type="definition">import</defterm> means import from outside Australia;</txt></definition><definition id="sch-sec.4-ssec.1-def.labelling_" guid="_cb7503e4-ee12-4851-8068-3afb36c2ae5c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.labelling" guid="_eb03dfe9-ce22-4929-b8f9-861f35af9a6d" type="definition">labelling</defterm> of goods includes any means by which, at the point of sale, information is attached to goods or is displayed in relation to goods without being attached to them;</txt></definition><definition id="sch-sec.4-ssec.1-def.localregistrationauthority_" guid="_60c5cc14-bf81-4f18-b0cc-0397e37967d0" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.localregistrationauthority" guid="_90021b30-cc4d-4da7-9cbf-f75a3449205b" type="definition">local registration authority</defterm> of a State for an occupation means the person or authority in the State having the function conferred by legislation of registering persons in connection with their carrying on of that occupation in the State;</txt></definition><definition id="sch-sec.4-ssec.1-def.occupation_" guid="_b2fe0b4a-189d-4508-84a2-802b1b051f80" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.occupation" guid="_bdaecdac-b219-4efc-9373-7c4a4f379a1d" type="definition">occupation</defterm> means an occupation, trade, profession or calling of any kind that may be carried on only by registered persons, where registration is wholly or partly dependent on the attainment or possession of some qualification (for example, training, education, examination, experience, character or being fit or proper), and includes a specialisation in any of the above in which registration may be granted;</txt></definition><definition id="sch-sec.4-ssec.1-def.participatingjurisdiction_" guid="_a00992ce-68c9-4e6c-954a-15eefb293884" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.participatingjurisdiction" guid="_88743e95-423b-4a43-af44-adec68b5c863" type="definition">participating jurisdiction</defterm> has the meaning given by <intref refid="sch-sec.43" target.guid="_b07c290e-7a65-407d-8800-a37be9589d11" check="valid">section&#160;43</intref>;</txt></definition><definition id="sch-sec.4-ssec.1-def.produce_" guid="_da87c076-926b-420c-b81b-f31a0e96c2ca" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.produce" guid="_f335b894-b092-4c96-ae2b-5b212b5e3b98" type="definition">produce</defterm> includes to manufacture, and also includes to harvest or otherwise produce in the course of any form of primary production;</txt></definition><definition id="sch-sec.4-ssec.1-def.registration_" guid="_113d3aad-bf81-455a-8f2e-d4627ad7b5d0" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.registration" guid="_305043c8-f3c7-4c4f-b04a-842f8dddd4b8" type="definition">registration</defterm> includes the licensing, approval, admission, certification (including by way of practising certificates), or any other form of authorisation, of a person required by or under legislation for the carrying on of an occupation;</txt></definition><definition id="sch-sec.4-ssec.1-def.requirements_" guid="_ea9a0bcc-ae5a-4488-8df3-08091ee16b26" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.requirements" guid="_9c9f8422-278f-4e1b-93ad-f7f1bebfa4d4" type="definition">requirements</defterm>, when used in relation to goods, means requirements, prohibitions, restrictions or conditions;</txt></definition><definition id="sch-sec.4-ssec.1-def.sell_" guid="_48cc3160-eca3-4666-b929-3ef71f45969e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.sell" guid="_9ea3b47e-d7cd-4e8c-863f-fb044bdcf391" type="definition">sell</defterm> includes sell by wholesale or retail, and includes distribute for sale, expose or offer for sale or have in possession for sale or agree to sell, and includes barter, and includes supply by way of exchange, lease, hire or hire-purchase;</txt></definition><definition id="sch-sec.4-ssec.1-def.State_" guid="_1142ab0b-8a28-45d6-8d63-a4d7af2190ad" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.State" guid="_dd9873b3-b959-4f73-a009-a8d6076b9d5e" type="definition">State</defterm> includes the Australian Capital Territory or the Northern Territory;</txt></definition><definition id="sch-sec.4-ssec.1-def.substantiveregistration_" guid="_cbbde4c1-0236-4881-89f0-db1bca596eac" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.4-ssec.1-def.substantiveregistration" guid="_a08a13d1-952a-4817-8637-ba44b1a3861f" type="definition">substantive registration</defterm> means registration under a law of a State, but does not include deemed registration;</txt></definition><definition id="sch-sec.4-ssec.1-def.Tribunal_" guid="_d0ff5972-4ea8-42a5-ba52-fb9e5a2eb542" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The mutual recognition principle as applying to goods is as set out in this Part.</txt></block></subclause><subclause id="sch-sec.8-ssec.2" guid="_5550ae5a-bcc9-45a5-8058-92272f6a5a1f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This Part deals with goods produced in or imported into a State and their sale in another State.</txt></block></subclause><subclause id="sch-sec.8-ssec.3" guid="_8286ef7b-af57-49c4-9de9-d364083240c1" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this Part, the firstmentioned State is called <defterm break.before="1">The mutual recognition principle is that, subject to this Part, goods produced in or imported into the first State, that may lawfully be sold in that State either generally or in particular circumstances, may, by virtue of this Act, be sold in the second State either generally or in particular circumstances (as the case may be), without the necessity for compliance with further requirements as described in <intref refid="sch-sec.10" target.guid="_91127707-2935-44f8-85f5-5aef3118b73d" check="valid">section&#160;10</intref>.</txt></block></clause><clause id="sch-sec.10" guid="_91127707-2935-44f8-85f5-5aef3118b73d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sch-sec.10-he" guid="_ce5be1f0-6d50-407b-9954-e6d5a436b266">Requirements that do not need to be complied with</heading><block><txt break.before="1">The further requirements referred to in <intref refid="sch-sec.9" target.guid="_99472444-b179-494f-9c11-d5b65a7af575" check="valid">section&#160;9</intref> are any one or more of the following requirements relating to sale that are imposed by or under the law of the second State—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.10-para1.a" guid="_651045ea-2d7a-4c6e-ab37-b7b3a88b2b26" provision.type="other"><no>(a)</no><block><txt break.before="0">a requirement that the goods satisfy standards of the second State relating to the goods themselves, including for example requirements relating to their production, composition, quality or performance;</txt></block></li><li id="sch-sec.10-para1.b" guid="_36bb03b5-bc18-4132-86c7-0337540f46d3" provision.type="other"><no>(b)</no><block><txt break.before="0">a requirement that the goods satisfy standards of the second State relating to the way the goods are presented, including for example requirements relating to their packaging, labelling, date stamping or age;</txt></block></li><li id="sch-sec.10-para1.c" guid="_c01abd4e-be35-47cb-89f4-ea34bc7da2ef" provision.type="other"><no>(c)</no><block><txt break.before="0">a requirement that the goods be inspected, passed or similarly dealt with in or for the purposes of the second State;</txt></block></li><li id="sch-sec.10-para1.d" guid="_12a47927-fe5d-4440-822b-bce17bc1f802" provision.type="other"><no>(d)</no><block><txt break.before="0">a requirement that any step in the production of the goods not occur outside the second State;</txt></block></li><li id="sch-sec.10-para1.e" guid="_d8fc648b-a848-45d5-9fe7-cb61944188b7" provision.type="other"><no>(e)</no><block><txt break.before="0">any other requirement relating to sale that would prevent or restrict, or would have the effect of preventing or restricting, the sale of the goods in the second State.</txt></block></li></list></block></clause><clause id="sch-sec.11" guid="_df1c34e6-4a5e-473b-a1d7-cd6d735ef835" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sch-sec.11-he" guid="_cf983e52-c1a7-45ad-8cdf-59b2feeb491d">Requirements that do need to be complied with</heading><subclause id="sch-sec.11-ssec.1" guid="_76a76a21-eba7-4757-b748-308c4f9d2590" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The mutual recognition principle is subject to the exceptions specified in this section.</txt></block></subclause><subclause id="sch-sec.11-ssec.2" guid="_04a70497-e5af-4ed9-acc2-014ac009c1c2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The first exception is that the principle does not affect the operation of any laws of the second State that regulate the manner of the sale of goods in the second State or the manner in which sellers conduct or are required to conduct their business in the second State (including laws set out in the examples below), so long as those laws apply equally to goods produced in or imported into the second State.</txt></block><block><txt break.before="1"><i>Examples</i>—Laws relating to the following—</txt><list number.type="default" unnumbered.indent="0"><li id="sch-sec.11-ssec.2-para1.a" guid="_7513e9a8-1c90-4932-b55f-5986892464be" provision.type="other"><no>(a)</no><block><txt break.before="0">the contractual aspects of the sale of goods;</txt></block></li><li id="sch-sec.11-ssec.2-para1.b" guid="_297b037f-3f13-46a6-a8d1-e2483ff5e456" provision.type="other"><no>(b)</no><block><txt break.before="0">the registration of sellers or other persons carrying on occupations;</txt></block></li><li id="sch-sec.11-ssec.2-para1.c" guid="_06b53404-15f2-4bff-8466-0a4699ce439b" provision.type="other"><no>(c)</no><block><txt break.before="0">the requirement for business franchise licences;</txt></block></li><li id="sch-sec.11-ssec.2-para1.d" guid="_85e00cd9-415f-4834-85f2-c500afadcea3" provision.type="other"><no>(d)</no><block><txt break.before="0">the persons to whom goods may or may not be sold;</txt></block></li><li id="sch-sec.11-ssec.2-para1.e" guid="_4d98a4db-38ae-4e40-a61b-5bd3321210fe" provision.type="other"><no>(e)</no><block><txt break.before="0">the circumstances in which goods may or may not be sold.</txt></block></li></list></block></subclause><subclause id="sch-sec.11-ssec.3" guid="_96dfe6fa-6b10-450e-afa3-ddf58ca24d96" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The second exception is that the principle does not affect the operation of any laws of the second State regarding the transportation, storage or handling of goods within the State, so long as—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.11-ssec.3-para1.a" guid="_94a23172-136b-45a3-99ba-85a3566118e4" provision.type="other"><no>(a)</no><block><txt break.before="0">those laws apply equally to goods produced in or imported into the second State; and</txt></block></li><li id="sch-sec.11-ssec.3-para1.b" guid="_98dc90aa-828b-4ecd-885d-aff29dee14e5" provision.type="other"><no>(b)</no><block><txt break.before="0">those laws are directed at matters affecting health and safety of persons in the second State or at preventing, minimising or regulating environmental pollution (including air, water, noise or soil pollution) in the second State.</txt></block></li></list></block></subclause><subclause id="sch-sec.11-ssec.4" guid="_99a4bb37-0da5-47a7-9bad-ac5451ed00e4" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The third exception is that the principle does not affect the operation of any laws of the second State regarding the inspection of goods within the State, so long as—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.11-ssec.4-para1.a" guid="_d99d43b2-5946-4cf2-9d06-34323d4f7f6d" provision.type="other"><no>(a)</no><block><txt break.before="0">inspection or the requirement for inspection is not a prerequisite to the sale of the goods in the second State; and</txt></block></li><li id="sch-sec.11-ssec.4-para1.b" guid="_96fce7da-4d0d-4b8e-bc6a-65f5ac80ebd2" provision.type="other"><no>(b)</no><block><txt break.before="0">those laws apply equally to goods produced in or imported into the second State; and</txt></block></li><li id="sch-sec.11-ssec.4-para1.c" guid="_74536ddd-aafd-4e7c-8c53-8a801362188a" provision.type="other"><no>(c)</no><block><txt break.before="0">those laws are directed at matters affecting the health and safety of persons in the second State or preventing, minimising or regulating environmental pollution (including air, water, noise or soil pollution) in the second State.</txt></block></li></list></block></subclause></clause><clause id="sch-sec.12" guid="_68bbbe79-2119-42b0-92ed-3fe70ffd4493" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sch-sec.12-he" guid="_c30b5960-9e98-4633-bc2d-a5c4be1877df">Defences to offences regarding sale</heading><subclause id="sch-sec.12-ssec.1" guid="_84dda1c6-73cf-4dab-b9b7-bebf3f06a936" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">It is a defence to a prosecution for an offence against a law of the second State in relation to the sale of any goods if the defendant expressly claims that the mutual recognition principle applies and establishes that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.12-ssec.1-para1.a" guid="_a306b0ce-2d73-4a57-a01e-74d231b5f018" provision.type="other"><no>(a)</no><block><txt break.before="0">the goods were labelled at the point of sale with a statement to the effect that the goods were produced in or imported into the first State; and</txt></block></li><li id="sch-sec.12-ssec.1-para1.b" guid="_31801549-df25-4430-8d3f-a237b70a7541" provision.type="other"><no>(b)</no><block><txt break.before="0">the defendant had no reasonable grounds for suspecting that they were not so produced or imported.</txt></block></li></list></block></subclause><subclause id="sch-sec.12-ssec.2" guid="_378c2683-0082-4845-b941-c2fdc17d4670" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The defence is not available if the prosecution proves that the mutual recognition principle did not apply in the circumstances of the alleged offence (because for example the goods did not comply with requirements imposed by the law of the first State).</txt></block></subclause><subclause id="sch-sec.12-ssec.3" guid="_ca6b8b1b-0d36-4870-ad32-9cb940a839db" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Any relevant presumptions or evidentiary procedures under the law of the first State are available to the prosecution or defendant in relation to matters sought to be proved by the prosecution under <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(2)</intref>.</txt></block></subclause><subclause id="sch-sec.12-ssec.4" guid="_d6dc4efd-766b-4c2b-99a2-5b9312c9f432" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Any relevant defences under the law of the first State are available to the defendant in relation to matters sought to be proved by the prosecution under <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(2)</intref>.</txt></block></subclause><subclause id="sch-sec.12-ssec.5" guid="_0a688483-f9ca-4aaf-b6ac-57b9b55ca141" affected.by.uncommenced="0" requirements imposed by or under the law of the second State.</txt></block></subclause><subclause id="sch-sec.13-ssec.2" guid="_308748e2-77aa-4a21-babf-c7774898b7f6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Nothing in this Part requires the labelling of goods as mentioned in <intref refid="sch-sec.12" target.guid="_68bbbe79-2119-42b0-92ed-3fe70ffd4493" check="valid">section&#160;12</intref> if (apart from this Act) they comply with the relevant requirements imposed by or under the law of the second State.</txt></block></subclause></clause><clause id="sch-sec.14" guid="_accfc636-0fae-479a-a25f-5ad2e8a4314e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading provision.type="other"><no>(2)</no><block><txt break.before="0">However, the mutual recognition principle is subject to the exception that it does not affect the operation of laws that regulate the manner of carrying on an occupation in the second State, so long as those laws—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.17-ssec.2-para1.a" guid="_bc12f56f-ab62-41ed-8840-dad64b62c99d" provision.type="other"><no>(a)</no><block><txt break.before="0">apply equally to all persons carrying on or seeking to carry on the occupation under the based on the attainment or possession of some qualification or experience relating to fitness to carry on the occupation.</txt></block></li></list></block></subclause></clause><clause id="sch-sec.18" guid="_bca03be1-62f2-4876-ad09-2519a1e2c319" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>18</no><heading id="sch-sec.18-he" guid="_efec86c6-9563-4e25-a388-e9eef5708fde">Application of this Part</heading><subclause id="sch-sec.18-ssec.1" guid="_9093b750-8fd0-4d18-b098-b456c02281c0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Part applies to individuals and occupations carried on by them.</txt></block></subclause><subclause id="sch-sec.18-ssec.2" guid="_9f0113fe-83d1-454d-ad3d-1dbc537e8000" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This Part extends to an occupation carried on by an individual, where the individual is subject to more than one system of registration or more than one local registration authority in a State, and accordingly this Part applies in relation to each such system of registration and each such authority.</txt></block></subclause><subclause id="sch-sec.18-ssec.3" guid="_1b2bd913-ce8b-4bf7-a9f7-f74df940bce3" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Without limiting <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(2)</intref>, an example of such an occupation is that of a legal practitioner, which involves both the admission as a legal practitioner by a court and the issue of a practising certificate by another body.</txt></block></subclause></clause></division><division id="sch-pt.3-div.2" guid="_18f17899-520e-4325-a3d5-d4da983f777f" affected.by.uncommenced="0"><no>Division 2</no><heading id="sch-pt.3-div.2-he" guid="_6f16d82a-168a-4da7-a5d0-bc7084bd8c3b">Entitlement to registration</heading><clause id="sch-sec.19" guid="_75387af3-9222-49a3-819e-8a61fbeaa1cf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sch-sec.19-he" guid="_9ad6ffe5-3c21-4485-80e8-57594d9c9ced">Notification to local registration authority</heading><subclause id="sch-sec.19-ssec.1" guid="_674e2030-f3ff-47e9-b85d-ca3337f3b607" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person who is registered in the first State for an occupation may lodge a written notice with the local registration authority of the second State for the equivalent occupation, seeking registration for the equivalent occupation in accordance with the mutual recognition principle.</txt></block></subclause><subclause id="sch-sec.19-ssec.2" guid="_bf6bce08-a8f3-407f-be71-43f9fda8a379" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The notice must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.19-ssec.2-para1.a" guid="_f94b4588-fb59-4cdd-ba0b-1f1c801eecd8" provision.type="other"><no>(a)</no><block><txt break.before="0">state that the person is registered for the occupation in the first State and specify that State; and</txt></block></li><li id="sch-sec.19-ssec.2-para1.b" guid="_3787d00a-90b9-40e4-8310-bbfd152c2202" provision.type="other"><no>(b)</no><block><txt break.before="0">state the occupation for which registration is sought and that it is being sought in accordance with the mutual recognition principle; and</txt></block></li><li id="sch-sec.19-ssec.2-para1.c" guid="_80142970-12a8-4e91-bd2e-2c37cc690d26" provision.type="other"><no>(c)</no><block><txt break.before="0">specify all the States in which the person has substantive registration for equivalent occupations; and</txt></block></li><li id="sch-sec.19-ssec.2-para1.d" guid="_2e0b250e-ad3d-4049-82ff-905f723f0d8c" provision.type="other"><no>(d)</no><block><txt break.before="0">state that the person is not the subject of disciplinary proceedings in any State (including any preliminary investigations or action that might lead to disciplinary proceedings) in relation to those occupations; and</txt></block></li><li id="sch-sec.19-ssec.2-para1.e" guid="_f29fdd4d-374b-4a04-8a78-964f65e5c946" provision.type="other"><no>(e)</no><block><txt break.before="0">state that the person’s registration in any State is not cancelled or currently suspended as a result of disciplinary action; and</txt></block></li><li id="sch-sec.19-ssec.2-para1.f" guid="_443939e8-f107-4ce0-9119-b04f2debeb25" provision.type="other"><no>(f)</no><block><txt break.before="0">state that the person is not otherwise personally prohibited from carrying on any such occupation in any State, and is not subject to any special conditions in carrying on that occupation, as a result of criminal, civil or disciplinary proceedings in any State; and</txt></block></li><li id="sch-sec.19-ssec.2-para1.g" guid="_cff5d597-931b-4d91-8794-ffd832597ab1" provision.type="other"><no>(g)</no><block><txt break.before="0">specify any special conditions to which the person is subject in carrying on any such occupation in any State; and</txt></block></li><li id="sch-sec.19-ssec.2-para1.h" guid="_67a84dd9-7f33-4e14-a3fa-1e1f3e0f7e62" provision.type="other"><no>(h)</no><block><txt break.before="0">give consent to the making of inquiries of, and the exchange of information with, the authorities of any State regarding the person’s activities in the relevant occupation or occupations or otherwise regarding matters relevant to the notice.</txt></block></li></list></block></subclause><subclause id="sch-sec.19-ssec.3" guid="_c923665e-48d0-4956-96fe-f8b0e1ac1bce" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The notice must be accompanied by a document that is either the original or a copy of the instrument evidencing the person’s existing registration (or, if there is no such instrument, by sufficient information to identify the person and the person’s registration).</txt></block></subclause><subclause id="sch-sec.19-ssec.4" guid="_c3e0333e-5a6d-4563-a8de-b2dd60594747" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">As regards the instrument evidencing the person’s existing registration, the person must certify in the notice that the accompanying document is the original or a complete and accurate copy of the original.</txt></block></subclause><subclause id="sch-sec.19-ssec.5" guid="_d4b27a46-74d8-434f-a938-12f4cd7e5aac" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The statements and other information in the notice must be verified by statutory declaration.</txt></block></subclause><subclause id="sch-sec.19-ssec.6" guid="_ab4e934c-e098-41c9-8add-fda52ddd7d87" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The local registration authority may permit the notice to be amended after it is lodged.</txt></block></subclause></clause><clause id="sch-sec.20" guid="_68ce0f65-4f0c-4bf4-884b-b2b3cb08a1a4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sch-sec.20-he" guid="_1d1b635c-a3a9-4f92-86cb-dc848100d46c">Entitlement to registration and continued registration</heading><subclause id="sch-sec.20-ssec.1" guid="_326c7360-0f8d-47ab-a714-02e1fe0746be" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person who lodges a notice under <intref refid="sch-sec.19" target.guid="_75387af3-9222-49a3-819e-8a61fbeaa1cf" check="valid">section&#160;19</intref> with a local registration authority of the second State is entitled to be registered in the equivalent occupation, as if the law of the State that deals with registration expressly provided that registration in the first State is a sufficient ground of entitlement to registration.</txt></block></subclause><subclause id="sch-sec.20-ssec.2" guid="_dabecc39-e994-4ee8-b0e7-00a168c2c5d2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The local registration authority may grant registration on that ground and may grant renewals of such registration.</txt></block></subclause><subclause id="sch-sec.20-ssec.3" guid="_587608df-8c10-4394-89e3-7d30bc0dbec3" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Once a person is registered on that ground, the entitlement to registration continues, whether or not registration (including any renewal of registration) ceases in the first State.</txt></block></subclause><subclause id="sch-sec.20-ssec.4" guid="_aba80f78-2af7-4e33-bf5a-32b57d1d2f3c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Continuance of registration is otherwise subject to the laws of the second State, to the extent to which those laws—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.20-ssec.4-para1.a" guid="_3c48decf-a15e-4a2b-ba48-dff538feacc7" provision.type="other"><no>(a)</no><block><txt break.before="0">apply equally to all persons carrying on or seeking to carry on the occupation under the law of the second State; and</txt></block></li><li id="sch-sec.20-ssec.4-para1.b" guid="_3b3e7a24-d897-4c51-b443-4e8a12917f5f" provision.type="other"><no>(b)</no><block><txt break.before="0">are not based on the attainment or possession of some qualification or experience relating to fitness to carry on the occupation.</txt></block></li></list></block></subclause><subclause id="sch-sec.20-ssec.5" guid="_bc6f940a-553e-49e5-be4d-1ad7c8e9664b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The local registration authority may impose conditions on registration, but may not impose conditions that are more onerous than would be imposed in similar circumstances (having regard to relevant qualifications and experience) if it were registration effected apart from this Part, unless they are conditions that apply to the person’s registration in the first State or that are necessary to achieve equivalence of occupations.</txt></block></subclause><subclause id="sch-sec.20-ssec.6" guid="_31755bfb-de8e-4ad1-bc12-900e34b46e62" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">This section has effect subject to this Part.</txt></block></subclause></clause><clause id="sch-sec.21" guid="_b522f9a1-abed-4c13-aa90-03d571ade871" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sch-sec.21-he" guid="_57847781-a9e2-4a45-a2cc-3557ef2853eb">Action following notice</heading><subclause id="sch-sec.21-ssec.1" guid="_17836cfd-4801-40d9-b254-6990bb7d22e0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Registration must be granted within one month after the notice is lodged with the local registration authority under <intref refid="sch-sec.19" target.guid="_75387af3-9222-49a3-819e-8a61fbeaa1cf" check="valid">section&#160;19</intref>.</txt></block></subclause><subclause id="sch-sec.21-ssec.2" guid="_920cff29-4f0f-4b7b-a939-b2600113e7de" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">When granted, registration takes effect as from the date the notice was lodged.</txt></block></subclause><subclause id="sch-sec.21-ssec.3" guid="_d7ce3cc3-9806-4ccd-a497-c12942ea1926" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, the local registration authority may, subject to this Part and within one month after the notice was lodged, postpone or refuse the grant of registration.</txt></block></subclause><subclause id="sch-sec.21-ssec.4" guid="_b65597ae-9bdd-454f-835e-00ab4795fec8" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the local registration authority neither grants the registration nor takes action under <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(3)</intref> within the period of one month after the notice is lodged, the person is entitled to registration immediately at the end of that period and no objection may be taken to the notice on any of the grounds on which refusal or postponement may be effected, except where fraud is involved.</txt></block></subclause></clause><clause id="sch-sec.22" guid="_caa01e2b-a9b8-437a-8bb8-2f0cfd04da10" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>22</no><heading id="sch-sec.22-he" guid="_c31c554d-ad34-4c94-b014-9f186566261c">Postponement of registration</heading><subclause id="sch-sec.22-ssec.1" guid="_962a1998-893e-4c99-a6fa-d0565a6c7198" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A local registration authority may postpone the grant of registration, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.22-ssec.1-para1.a" guid="_692c524f-6d63-45db-be5b-a7e29d77fe58" provision.type="other"><no>(a)</no><block><txt break.before="0">any of the statements or information in the notice as required by <intref refid="sch-sec.19" target.guid="_75387af3-9222-49a3-819e-8a61fbeaa1cf" check="valid">section&#160;19</intref> are materially false or misleading; or</txt></block></li><li id="sch-sec.22-ssec.1-para1.b" guid="_7d825642-80f8-448f-aaf9-5ac88a9f3e8d" provision.type="other"><no>(b)</no><block><txt break.before="0">any document or information as required by <intref refid="sch-sec.19" target.guid="_75387af3-9222-49a3-819e-8a61fbeaa1cf" check="valid">section&#160;19</intref><intref refid="sch-sec.19-ssec.3" target.guid="_c923665e-48d0-4956-96fe-f8b0e1ac1bce" check="valid">(3)</intref> has not been provided or is materially false or misleading; or</txt></block></li><li id="sch-sec.22-ssec.1-para1.c" guid="_269d5ee2-22d4-405f-9217-8ba54e9a94a4" provision.type="other"><no>(c)</no><block><txt break.before="0">the circumstances of the person lodging the notice have materially changed since the date of the notice or the date it was lodged; or</txt></block></li><li id="sch-sec.22-ssec.1-para1.d" guid="_381a076d-3e7b-4074-85a0-efc66248e8f3" provision.type="other"><no>(d)</no><block><txt break.before="0">the authority decides that the occupation in which registration is sought is not an equivalent occupation.</txt></block></li></list></block></subclause><subclause id="sch-sec.22-ssec.2" guid="_b00a9ce9-690c-4e67-ba80-f1af5cbccd57" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the grant of registration has been postponed, the local registration authority may in due course grant or refuse the registration.</txt></block></subclause><subclause id="sch-sec.22-ssec.3" guid="_db467a4e-c74d-45a4-b5ef-c627170ee079" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The local registration authority may not postpone the grant of registration for longer than a period of 6 months, and the person is entitled to registration immediately, at the end of that period, unless registration was refused at or before the end of that period.</txt></block></subclause><subclause id="sch-sec.22-ssec.4" guid="_d0140b70-795c-4e8a-adad-c5f273f676a3" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Nothing in <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(3)</intref> prevents earlier registration from being granted on a review by the Tribunal.</txt></block></subclause></clause><clause id="sch-sec.23" guid="_8006c8c3-4151-41f6-8384-d031fff05605">Refusal of registration</heading><subclause id="sch-sec.23-ssec.1" guid="_ab421188-38ce-4e4d-aab2-1f02d98a357f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A local registration authority may refuse the grant of registration, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.23-ssec.1-para1.a" guid="_da593ce0-0ae0-4718-bc8c-a633391b8ff9" provision.type="other"><no>(a)</no><block><txt break.before="0">any of the statements or information in the notice as required by <intref refid="sch-sec.19" target.guid="_75387af3-9222-49a3-819e-8a61fbeaa1cf" check="valid">section&#160;19</intref> are materially false or misleading; or</txt></block></li><li id="sch-sec.23-ssec.1-para1.b" guid="_e257a62c-7317-4d9d-9999-ab604f570fc9" provision.type="other"><no>(b)</no><block><txt break.before="0">any document or information as required by <intref refid="sch-sec.19" target.guid="_75387af3-9222-49a3-819e-8a61fbeaa1cf" check="valid">section&#160;19</intref><intref refid="sch-sec.19-ssec.3" target.guid="_c923665e-48d0-4956-96fe-f8b0e1ac1bce" check="valid">(3)</intref> has not been provided or is materially false or misleading; or</txt></block></li><li id="sch-sec.23-ssec.1-para1.c" guid="_7a5652d8-20e9-4828-9fa7-2dddb32b79ee" provision.type="other"><no>(c)</no><block><txt break.before="0">the authority decides that the occupation in which registration is sought is not an equivalent occupation and equivalence cannot be achieved by the imposition of conditions.</txt></block></li></list></block></subclause><subclause id="sch-sec.23-ssec.2" guid="_1eeaf703-64ef-4635-b4ec-95f8124077fb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A decision to refuse to grant registration on the ground that the occupation in which registration is sought is not an equivalent occupation takes effect at the end of a specified period (not less than 2 weeks) after the person is notified of the decision, unless it has been previously revoked or there is an application for review to the Tribunal, in which case the Tribunal may make whatever orders it considers appropriate.</txt></block></subclause></clause><clause id="sch-sec.24" guid="_14b76f2f-3272-4a13-8cda-e12a8fb67384" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>24</no><heading id="sch-sec.24-he" check="valid">section&#160;19</intref> with a local registration authority of a State is, pending the grant or refusal of registration, taken to be registered as provided in <intref refid="sch-sec.20" target.guid="_68ce0f65-4f0c-4bf4-884b-b2b3cb08a1a4" check="valid">section&#160;20</intref>.</txt></block></subclause><subclause id="sch-sec.25-ssec.2" guid="_02ebb3f9-1e96-4b23-990d-deb84ee3775a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Such registration is called <defterm id="sch-sec.25-def.deemedregistration" until it is cancelled or suspended or otherwise ceases in accordance with this Part.</txt></block></subclause><subclause id="sch-sec.26-ssec.2" guid="_b734c88c-bc87-4a78-bb3b-8569f175ccee" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person’s deemed registration in the second State ceases if the person becomes substantively registered in the State in connection with the occupation concerned.</txt></block></subclause><subclause id="sch-sec.26-ssec.3" guid="_2f606292-e082-4a4c-abd3-7148aedf49e7" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person’s deemed registration in the second State ceases if the local registration authority of the State refuses to grant registration, subject to any determination of the Tribunal.</txt></block></subclause><subclause id="sch-sec.26-ssec.4" guid="_89c9c92c-8a25-4e2f-91e0-520b672a408b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A person’s deemed registration in the second State ceases if the person ceases to be substantively registered in every other State were substantive registration in the second State.</txt></block></subclause><subclause id="sch-sec.27-ssec.2" guid="_ad73b774-1300-4f71-b199-82afac6f7cbf" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, the person may do so only—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.27-ssec.2-para1.a" guid="_1f9e4859-6f2b-4829-9acc-45efd5052300" provision.type="other"><no>(a)</no><block><txt break.before="0">within the limits conferred by the person’s substantive registration in the first State; and</txt></block></li><li id="sch-sec.27-ssec.2-para1.b" guid="_55e17c1c-7902-4af9-b89c-701624f1bad7" provision.type="other"><no>(b)</no><block><txt break.before="0">within the limits conferred by the person’s deemed registration in the second State; and</txt></block></li><li id="sch-sec.27-ssec.2-para1.c" guid="_c1bab7fb-04e4-44d4-923f-5118fa027668" provision.type="other"><no>(c)</no><block><txt break.before="0">subject to any conditions or undertakings applying to the person’s registration in the first State, unless waived by the local registration authority of the second State under this section; and</txt></block></li><li id="sch-sec.27-ssec.2-para1.d" guid="_5df9b20c-895b-4bf5-92b3-e3cdf1c94c7e" provision.type="other"><no>(d)</no><block><txt break.before="0">subject to any conditions applying to the person’s deemed registration.</txt></block></li></list></block></subclause><subclause id="sch-sec.27-ssec.3" guid="_d7b30ba3-9c4c-47ca-a24b-e19bbf1eff49" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Without limiting anything in this Division—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.27-ssec.3-para1.a" guid="_18e79a3d-79c0-4321-86d0-ac2b6fee0113" provision.type="other"><no>(a)</no><block><txt break.before="0">the person may not carry on the occupation in the second State without complying with any requirements regarding insurance, fidelity funds, trust accounts and the like that are designed to protect the public, clients, customers or others; and</txt></block></li><li id="sch-sec.27-ssec.3-para1.b" guid="_8760cfc1-341b-4b2d-93c5-490f1e6dca93" provision.type="other"><no>(b)</no><block><txt break.before="0">a person who has deemed registration in an occupation in the second State is subject to any disciplinary provisions and arrangements that are applicable to persons who are substantively registered in that State; and</txt></block></li><li id="sch-sec.27-ssec.3-para1.c" guid="_3f96361e-3784-4321-aa30-b9cfe328750c" provision.type="other"><no>(c)</no><block><txt break.before="0">references in the law of the second State to persons registered in an occupation under the law of that State (however expressed) extend to persons who have deemed registration for the occupation under this Act.</txt></block></li></list></block></subclause><subclause id="sch-sec.27-ssec.4" guid="_04934481-5d18-4f9f-ac35-79ee42d1adfb" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, the local registration authority of the second State may waive any condition imposed under the law of the first State, or any undertaking given to the local registration authority of the first State, if it thinks it appropriate in the circumstances.</txt></block></subclause><subclause id="sch-sec.27-ssec.5" guid="_ae79d98d-d920-4332-bd4f-352d9a39c99b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The local registration authority of the second State may impose conditions as if deemed registration were substantive registration, but it must not impose conditions that are more onerous than would be imposed in similar circumstances (having regard to relevant qualifications and experience) if it were registration effected apart from this Part, unless they correspond to conditions or undertakings that apply to the person’s registration in the first State or that are necessary to achieve equivalence of occupations.</txt></block></subclause></clause></division><division id="sch-pt.3-div.4" guid="_d0c19749-5f29-419e-9bb7-c49cba8973c6" affected.by.uncommenced="0"><no>Division 4</no><heading id="sch-pt.3-div.4-he" guid="_9722481f-12f6-44e1-9266-6194223d1d5b">Equivalent occupations</heading><clause id="sch-sec.28" guid="_a7b74ffc-0cad-495a-bc81-2700d391cdd2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>28</no><heading id="sch-sec.28-he" guid="_6af74790-ffe5-49d2-adf7-297153ffd918">Equivalent occupations</heading><block><txt break.before="1">The equivalence of occupations carried on in different States is to be determined in accordance with this Part.</txt></block></clause><clause id="sch-sec.29" guid="_b2590ec3-b2f6-4848-bba4-7d74a8be3360" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>29</no><heading id="sch-sec.29-he" guid="_fc87d3f2-3adf-47a5-a93c-490de63758cf">General principle</heading><subclause id="sch-sec.29-ssec.1" guid="_d0075eb4-72e3-4eb8-8ad0-dcd178cbac1d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An occupation for which persons may be registered in the first State is taken to be equivalent to an occupation for which persons may be registered in the second State if the activities authorised to be carried out under each registration are substantially the same (whether or not this result is achieved by means of the imposition of conditions).</txt></block></subclause><subclause id="sch-sec.29-ssec.2" guid="_5848791f-2914-4c56-acaa-b04a84c6b115" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Conditions may be imposed on registration under this Part so as to achieve equivalence between occupations in different States.</txt></block></subclause><subclause id="sch-sec.29-ssec.3" guid="_3ba147e6-3b4a-4600-a8d9-89aa88e4abd1" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">This section has effect subject to any relevant declarations in force under this Division.</txt></block></subclause></clause><clause id="sch-sec.30" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Part is to be given effect in accordance with relevant declarations (if any) made under this Division provision.type="other"><no>(2)</no><block><txt break.before="0">If a declaration made by the Tribunal and a declaration made by Ministers are inconsistent, the ministerial declaration provision.type="other"><no>31</no><heading id="sch-sec.31-he" guid="_c34a3dcf-09a5-4b80-8bcb-e4f96cfe63da">Declarations by Tribunal</heading><subclause id="sch-sec.31-ssec.1" guid="_aab64d39-4bc3-4b5c-8a54-f05f7f87e66d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">On a review, the Tribunal may make an order that a person who is registered in a particular occupation in a particular State is or is not entitled to registration in another State in a particular occupation, and may specify or describe conditions that will achieve equivalence.</txt></block></subclause><subclause id="sch-sec.31-ssec.2" guid="_33a77508-4755-422a-9f5d-62ee88fbeca3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">On such a review, the Tribunal may make a declaration that occupations carried on in two States are not equivalent, but only if the Tribunal is satisfied that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.31-ssec.2-para1.a" guid="_2d97dadf-ed45-467b-8839-834677ed1264" provision.type="other"><no>(a)</no><block><txt break.before="0">the activities involved in the occupations are not substantially the same (even with the imposition of conditions); or</txt></block></li><li id="sch-sec.31-ssec.2-para1.b" guid="_74d9cbf4-6cf4-45b2-95b9-0fc2e33daaf9" provision.type="other"><no>(b)</no><block><txt break.before="0">registration in one State should not entitle registered persons to carry on a particular activity or class of activity in the other State, where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.31-ssec.2-para1.b-para2.i" guid="_957a2c73-c596-485e-8a47-32eb8f8113e9" provision.type="other"><no>(i)</no><block><txt break.before="0">the activity or class of activity is a material part of the practice of a person registered in the first State for the occupation; and</txt></block></li><li id="sch-sec.31-ssec.2-para1.b-para2.ii" guid="_1dc1a3df-763a-4dba-be13-6885479cceec" provision.type="other"><no>(ii)</no><block><txt break.before="0">the activity or class of activity, if carried out by a person not conforming to the appropriate standards, could reasonably be expected to expose persons in the other State to a real threat to their health or safety or could reasonably be expected to cause significant environmental pollution (including air, water, noise or soil pollution); and</txt></block></li><li id="sch-sec.31-ssec.2-para1.b-para2.iii" guid="_48f7b3a2-68d9-424b-9213-c6981e237182" provision.type="other"><no>(iii)</no><block><txt break.before="0">it is not practicable to protect the health or safety of such persons from that threat or the environment from such pollution by regulating the manner in which services in the occupation are provided.</txt></block></li></list></block></li></list></block></subclause><subclause id="sch-sec.31-ssec.3" guid="_e6533051-06fd-45e6-92e3-e14dc4573e08" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Registrar or other proper officer of the Tribunal must cause a notice setting out the terms of a declaration under this section to be promptly published in the <i>Gazette</i>.</txt></block></subclause><subclause id="sch-sec.31-ssec.4" guid="_d1c47c7e-ff91-4878-b5a0-aaee641115b5" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A declaration made on the basis of paragraph (2)(b) has effect for no longer than 12 months, and the local registration authority must promptly notify appropriate authorities in each other State and the Commonwealth of the declaration.</txt></block></subclause><subclause id="sch-sec.31-ssec.5" guid="_bca766b6-1663-4223-a278-7777934dddb0" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt guid="_b3c52a29-6efb-47a6-9416-a53256fcce9c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A Minister from each of two or more States may jointly declare, by notice in the <i>Gazette</i>, that specified occupations are equivalent, and may specify or describe conditions that will achieve equivalence.</txt></block></subclause><subclause id="sch-sec.32-ssec.2" guid="_f2b7a99e-0eab-4d1a-a7d6-7bf75e0cebf0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The declaration may be amended or break.before="0">is cancelled or suspended; or</txt></block></li><li id="sch-sec.33-ssec.1-para1.b" guid="_7b9acd30-579d-469d-bded-cd2ea1879370" provision.type="other"><no>(b)</no><block><txt break.before="0">is subject to a condition;</txt></block></li></list></block><block><txt break.before="1">on disciplinary grounds, or as a result of or in anticipation of criminal, civil or disciplinary proceedings, then the person’s registration in the equivalent occupation in another State is affected in the same way.</txt></block></subclause><subclause id="sch-sec.33-ssec.2" <intref refid="sch.2-para1.31" target.guid="_72065981-9b90-4ac4-932b-f16efd901a99" check="valid">subsection&#160;(1)</intref>, the notice must include a statement to the effect that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.34-ssec.3-para1.a" guid="_fda5d356-3530-42a7-973a-3fcc53b496ab" provision.type="other"><no>(a)</no><block><txt break.before="0">subject to application for review of the decision may be made to the Tribunal by a person whose interests are affected by the decision; and</txt></block></li><li id="sch-sec.34-ssec.3-para1.b" of that Act applies, application may be made in accordance with <legref jurisd="QLD" type="act" check="invalid">section&#160;28</legref> of that Act by or on behalf of that person for a statement in writing setting out the findings on material questions of fact, referring to the evidence or other material on which those findings were based, and giving the reasons for the affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A local registration authority of a State must furnish without delay any information reasonably required by a local registration authority of another State about a person substantively registered under a law of the firstmentioned State.</txt></block></subclause><subclause id="sch-sec.37-ssec.2" guid="_3dd11bc7-b9c2-429d-a277-0e21adc66336" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The obligation imposed under this section does not apply unless the authority of the other State notifies the authority of the firstmentioned State that the information is required in connection with—</txt><list number.type="manual" unnumbered.indent="0"><li provision.type="other"><no>(3)</no><block><txt break.before="0">The authority of the firstmentioned State is empowered to provide the information, despite any law relating to secrecy or confidentiality.</txt></block></subclause><subclause id="sch-sec.37-ssec.4" guid="_f544d662-2ca6-4f60-9be0-67c93d2ae981" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Nothing in this section affects any obligation or power to provide information apart from this section.</txt></block></subclause></clause><clause id="sch-sec.38" target.guid="_ba8fa1be-3d0a-42f5-b098-4e51c1c738e2" check="valid">section&#160;37</intref>, the information is subject to any law relating to secrecy or confidentiality that would apply if the information were provided under the law of the State under which the authority is constituted or exercises its functions.</txt></block></clause><clause id="sch-sec.39" guid="_4a367ad0-db3d-420a-93b9-f7c278d95f86" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>39</no><heading id="sch-sec.39-he" guid="_8100b41a-35b7-434b-b2ae-c9a121778c21">General responsibilities of local registration authorities</heading><subclause id="sch-sec.39-ssec.1" guid="_11edef56-694b-4a07-8ade-56cec915bb59" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">It is the duty of each local registration authority to facilitate the operation of this Part in relation to the occupations for which the authority is responsible, and in particular to make use of the power to impose conditions in such a way as to promote the mutual recognition principle.</txt></block></subclause><subclause id="sch-sec.39-ssec.2" guid="_a08063a6-56b2-4880-b10e-0bdc58d37e61" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">It is the duty of each local registration authority to prepare and make available guidelines and information regarding the operation of this Part in relation to the occupations for
