guid="_f3632701-1b4f-4bc8-b2db-525bbe5f0ac8">Short title</heading><block><txt break.before="1">This Act may be cited as the <legref jurisd="QLD" type="act" target.doc.id="act-1992-038" target.version.series="3df542a1-8fe7-444e-a8fe-0fca6de546ba" check="valid"><name emphasis="yes">Peaceful Assembly Act 1992</name></legref>.</txt></block></clause><clause id="sec.2" guid="_6de201e0-6176-48d3-82d9-3787e23856b3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_e38e7117-4409-4c9f-8603-51fe02d1d81c">Objects</heading><subclause id="sec.2-ssec.1" guid="_0a8c583f-5bfd-4b43-9a60-aac4790551a9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The objects of this Act are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.1-para1.a" guid="_5f0f308a-5451-42ec-b63c-15f0f07127e8" provision.type="other"><no>(a)</no><block><txt break.before="0">to recognise the right of peaceful assembly; and</txt></block></li><li id="sec.2-ssec.1-para1.b" guid="_7f1ff39f-1324-4405-a97b-54624928a457" provision.type="other"><no>(b)</no><block><txt break.before="0">to ensure, so far as it is appropriate to do so, that persons may exercise the right to participate in public assemblies; and</txt></block></li><li id="sec.2-ssec.1-para1.c" guid="_c81de371-88d3-45f2-aebf-3ffe2158baaa" provision.type="other"><no>(c)</no><block><txt break.before="0">to ensure that the exercise of the right to participate in public assemblies is subject only to such restrictions as are necessary and reasonable in a democratic society in the interests of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.1-para1.c-para2.i" guid="_c0f30321-999f-4b86-97a2-db6053329dba" provision.type="other"><no>(i)</no><block><txt break.before="0">public safety; or</txt></block></li><li id="sec.2-ssec.1-para1.c-para2.ii" guid="_618f6936-4b96-4574-b64e-97ccf415c7b2" provision.type="other"><no>(ii)</no><block><txt break.before="0">public order; or</txt></block></li><li id="sec.2-ssec.1-para1.c-para2.iii" guid="_50e09756-44d4-4713-a588-df29990726e6" provision.type="other"><no>(iii)</no><block><txt break.before="0">the protection of the rights and freedoms of other persons; and</txt></block></li></list></block></li><li id="sec.2-ssec.1-para1.d" guid="_5184febc-1b65-42ca-8a54-9301bbb27207" provision.type="other"><no>(d)</no><block><txt break.before="0">to ensure that the right of persons to participate in public assemblies may be exercised without payment of a fee, charge or other amount for a licence, permit or other authorisation.</txt></block></li></list></block></subclause><subclause id="sec.2-ssec.2" guid="_e143a300-c090-48cd-8aba-e6f3bca97422" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In <intref refid="sec.2-ssec.1" target.guid="_0a8c583f-5bfd-4b43-9a60-aac4790551a9" check="valid">subsection&#160;(1)</intref><intref refid="sec.2-ssec.1-para1.c" target.guid="_c81de371-88d3-45f2-aebf-3ffe2158baaa" check="valid">(c)</intref><intref refid="sec.2-ssec.1-para1.c-para2.iii" target.guid="_50e09756-44d4-4713-a588-df29990726e6" check="valid">(iii)</intref>, a reference to the rights of persons includes a reference to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.2-para1.a" guid="_3e4e1c6f-5063-4b6a-98ec-c5ee1649949f" provision.type="other"><no>(a)</no><block><txt break.before="0">the rights of members of the public to enjoy the natural environment; and</txt></block></li><li id="sec.2-ssec.2-para1.b" guid="_6db4c38f-22b9-4255-aec4-031634fb8a1c" provision.type="other"><no>(b)</no><block><txt break.before="0">the rights of persons to carry on business.</txt></block></li></list></block></subclause></clause><clause id="sec.3" guid="_9ed87dfb-a322-47e9-88ee-980b346c3de0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_014b1578-e18f-4ebe-a1ff-f9f20ea11f92">Relationship with other laws</heading><subclause id="sec.3-ssec.1" guid="_3de3725a-4e2f-494f-8525-488176985f3d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act has effect despite any other law relating to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.a" guid="_0cfc62ed-19a3-4002-b10f-7bfe1c00607f" provision.type="other"><no>(a)</no><block><txt break.before="0">the right of peaceful assembly; or</txt></block></li><li id="sec.3-ssec.1-para1.b" guid="_ec0ac52e-23a5-4b1a-900b-d9bb43963712" provision.type="other"><no>(b)</no><block><txt break.before="0">the movement of traffic or pedestrians; or</txt></block></li><li id="sec.3-ssec.1-para1.c" guid="_03f54e10-835d-4278-bc68-6af4cb808a86" provision.type="other"><no>(c)</no><block><txt break.before="0">loitering; or</txt></block></li><li id="sec.3-ssec.1-para1.d" guid="_e3ff121a-895c-4b6b-9402-6eddad98e537" provision.type="other"><no>(d)</no><block><txt break.before="0">the use or obstruction of a public place; or</txt></block></li><li id="sec.3-ssec.1-para1.e" guid="_a288ffa0-bf3d-449e-aa70-587f5aa69db3" provision.type="other"><no>(e)</no><block><txt break.before="0">the payment of a fee, charge or other amount for a licence, permit or other authorisation relating to a public assembly.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.2" guid="_0ae1ca87-d4eb-4dc3-a29e-f62d79751132" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite <intref refid="sec.3-ssec.1" target.guid="_3de3725a-4e2f-494f-8525-488176985f3d" check="valid">subsection&#160;(1)</intref>, nothing in this Act affects the common law of trespass and, in particular, the right of a person in, or entitled to, possession of land—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-para1.a" guid="_98fade26-bb66-45d9-b40d-e1b2dccca523" provision.type="other"><no>(a)</no><block><txt break.before="0">to request a trespasser to leave the land; and</txt></block></li><li id="sec.3-ssec.2-para1.b" guid="_a57afb5d-ff25-4b0e-81d1-cfa963eba4ff" provision.type="other"><no>(b)</no><block><txt break.before="0">if the trespasser refuses to leave on being requested—to remove the trespasser from the land.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.3" guid="_f7effb22-4ebd-4332-8915-e0cd5a5e62c4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-ssec.3-def.law_" guid="_7ff1ab18-8598-4032-be3e-ca643b1a1f1e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.3-def.law" guid="_a4e6878a-8cd8-44da-a154-f02a0a19e197" type="definition">law</defterm> includes an Act, a statutory rule and the common law.</txt></definition></deflist></block></subclause></clause><clause id="sec.4" guid="_478ac16b-0744-4e88-97c5-03a005cbbd0b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_07f1c405-53b1-4435-90a8-7e4fb3a81afe">Definitions</heading><block><txt break.before="1">In this Act—</txt><deflist><definition id="sec.4-def.appropriatepoliceoffice_" guid="_958083bf-2ce6-430d-8cd2-e3d2ec7eae38" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.appropriatepoliceoffice" guid="_dd322d40-2f9f-40a3-88c7-adfafcd72410" type="definition">appropriate police office</defterm>, in relation to a proposed public assembly, means a police office in the police district in which the assembly is to be held;</txt></definition><definition id="sec.4-def.assemblynotice_" guid="_5eae0612-e702-4c6e-b618-a1bd1edf0bdd" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.assemblynotice" guid="_9963b3c5-9e8b-4e58-91b5-c858e5d7d4e5" type="definition">assembly notice</defterm> means a notice of intention to hold a public assembly mentioned in <intref refid="sec.7" target.guid="_6ac1edee-a320-450f-92b0-405fc0ae1e43" check="valid">section&#160;7</intref>;</txt></definition><definition id="sec.4-def.clerk_" guid="_a5211d5b-2d76-49be-b81e-306f7fd7987f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.clerk" guid="_c3738b0d-a2c0-45e3-83ae-9732d2191437" type="definition">clerk</defterm>, in relation to a local authority, includes a town clerk;</txt></definition><definition id="sec.4-def.Commissioner_" guid="_492fd666-3d22-4f37-bf08-9e2565873a38" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.Commissioner" guid="_25cf5dcb-8a3d-4a98-9675-81df9bd90fe8" type="definition">Commissioner</defterm> means the Commissioner of the Police Service within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-1990-004" target.version.series="bbfe99ab-e691-462a-9d05-7546ddb1435e" check="valid"><name emphasis="yes">Police Service Administration Act 1990</name></legref>;</txt></definition><definition id="sec.4-def.mediationsession_" guid="_c1292f17-2fa0-4db3-9bad-a41e7b27e42c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.mediationsession" guid="_174a45d8-0f7b-4a99-9501-5fe3dbc955ef" type="definition">mediation session</defterm> has the meaning given by <legref refid="act-1990-035" check="invalid" jurisd="QLD" type="act">section&#160;1.3</legref> of the <legref target.doc.id="act-1990-035" target.version.series="fae4f283-1cc3-4a25-94ce-615e63ad1da2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Dispute Resolution Centres Act 1990</name></legref>;</txt></definition><definition id="sec.4-def.organiser_" guid="_4d94793f-f4bb-451e-a0dc-1931665d178b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.organiser" guid="_fb92248e-cb34-4cc9-9d35-a7649913cdf9" type="definition">organiser</defterm>, in relation to a public assembly for which an assembly notice has been given, means the person specified in the notice as the person responsible for organising and conducting the assembly;</txt></definition><definition id="sec.4-def.placeofassembly_" guid="_60b34d7d-4b15-43cb-bec5-a77d6cb199a4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.placeofassembly" guid="_4a7fdfef-bd84-4c0b-83e1-59e183c16d77" type="definition">place of assembly</defterm>, in relation to an assembly that is a procession, includes a place at or through which it is proposed the assembly will stop or pass;</txt></definition><definition id="sec.4-def.policedistrict_" guid="_20f6d32c-b46f-44e1-8fcd-4689626b837e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.policedistrict" guid="_ccc42c9a-ede4-45ee-9abf-ffba0844e57b" type="definition">police district</defterm> means a district established by the Commissioner for the efficient and proper administration, management and functioning of the Police Service;</txt></definition><definition id="sec.4-def.policeoffice_" guid="_0e5d4e04-f94e-4d24-930e-182f60cd1d4e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.policeoffice" guid="_ea8186e4-5a7d-4d97-917f-fc50295cb051" type="definition">police office</defterm> means a place in relation to which a declaration declaring the place to be a police establishment or police station is in force under <legref refid="act-1990-004" check="invalid" jurisd="QLD" type="act">section&#160;10.10</legref> of the <legref target.doc.id="act-1990-004" target.version.series="bbfe99ab-e691-462a-9d05-7546ddb1435e" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Police Service Administration Act 1990</name></legref>;</txt></definition><definition id="sec.4-def.publicassembly_" guid="_6d9d9c45-54bd-4928-b41d-237c9570801b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.publicassembly" guid="_0fde1574-c010-4c09-a612-0a505ec3c8b6" type="definition">public assembly</defterm> means an assembly held in a public place, whether or not the assembly is at a particular place or moving;</txt></definition><definition id="sec.4-def.publicplace_" guid="_7f2c3d77-1523-429a-b87f-a8672cc78ad1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.publicplace" guid="_a3967b83-4778-41df-b736-68339c4b4a49" type="definition">public place</defterm> includes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.publicplace-para1.a" guid="_6683bdaa-1e72-41ee-9e45-91f0d3d54d37" provision.type="other"><no>(a)</no><block><txt break.before="0">a road; and</txt></block></li><li id="sec.4-def.publicplace-para1.b" guid="_3a058000-e737-4009-a37d-5caa49aa86dd" provision.type="other"><no>(b)</no><block><txt break.before="0">a place open to or used by the public as of right; and</txt></block></li><li id="sec.4-def.publicplace-para1.c" guid="_571b69d0-5cfd-4dca-bbf9-0f63f5574fa6" provision.type="other"><no>(c)</no><block><txt break.before="0">a place for the time being open to or used by the public, whether or not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.publicplace-para1.c-para2.i" guid="_1090e66b-4a3e-4682-89a3-dfe7b44c3120" provision.type="other"><no>(i)</no><block><txt break.before="0">the place is ordinarily open to or used by the public; or</txt></block></li><li id="sec.4-def.publicplace-para1.c-para2.ii" guid="_c1833819-b3f7-48ec-a435-617f11880baf" provision.type="other"><no>(ii)</no><block><txt break.before="0">by the express or implied consent of the owner or occupier; or</txt></block></li><li id="sec.4-def.publicplace-para1.c-para2.iii" guid="_01ed8cd5-a86b-4f6d-b0f3-3f6011e506ad" provision.type="other"><no>(iii)</no><block><txt break.before="0">on payment of money;</txt></block></li></list></block></li></list></definition><definition id="sec.4-def.representative_" guid="_56d5f975-4c5e-4fe9-bd55-62e9801a6cda" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.representative" guid="_0eb8859e-b513-4d9d-b12c-e95b7bda0b00" type="definition">representative</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.representative-para1.a" guid="_7099f593-d738-4270-b6ef-7daccc4b7065" provision.type="other"><no>(a)</no><block><txt break.before="0">in relation to the Commissioner—a police officer nominated by the Commissioner; or</txt></block></li><li id="sec.4-def.representative-para1.b" guid="_8a11d52b-30c8-476d-b31e-086d0e616375" provision.type="other"><no>(b)</no><block><txt break.before="0">in relation to a local authority—an officer of the local authority nominated by it;</txt></block></li></list></definition><definition id="sec.4-def.road_" guid="_9a1d77c5-4c39-4b82-b43c-784cca12b447" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.road" guid="_657fccf1-d10c-4039-b2a4-4ca2233154f9" type="definition">road</defterm> has the meaning given by the <legref jurisd="QLD" type="act" target.doc.id="act-1995-009" target.version.series="9b6b47f6-005d-47e6-afd5-1c5039eda4c6" check="valid"><name emphasis="yes">Transport Operations (Road Use Management) Act 1995</name></legref>.</txt><historynote><txt break.before="1"><b>s&#160;4</b> def <defterm guid="_3b8361bb-1a6d-43c3-9e96-98a0366196b6" type="mention">road</defterm> amd <legref jurisd="QLD" type="act" target.doc.id="act-1999-042" target.version.series="20ec89e2-f21d-43cc-836e-1d0ec3c2910d" valid.date="as.made" check="valid">1999 No.&#160;42</legref> <legref jurisd="QLD" type="act" refid="sec.54" target.doc.id="act-1999-042" valid.date="as.made" check="invalid">s&#160;54</legref><legref jurisd="QLD" type="act" refid="sec.54-ssec.3" target.doc.id="act-1999-042" valid.date="as.made" check="invalid">(3)</legref> <legref jurisd="QLD" type="act" refid="sch" target.doc.id="act-1999-042" valid.date="as.made" check="invalid">sch</legref> <legref jurisd="QLD" type="act" refid="pt.3" target.doc.id="act-1999-042" valid.date="as.made" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_444f076c-0979-4bb4-977a-e1574710e288">Right of peaceful assembly</heading><subclause id="sec.5-ssec.1" guid="_cdea0b66-6243-4cf1-9527-a18555742d6a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person has the right to assemble peacefully with others in a public place.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_a03179a1-d571-48eb-ac8b-fda4cd4e565d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The right is subject only to such restrictions as are necessary and reasonable in a democratic society in the interests of—</txt><list number.type="manual" unnumbered.indent="0"><li provision.type="other"><no>(3)</no><block><txt break.before="0">In <intref refid="sec.5-ssec.2" target.guid="_a03179a1-d571-48eb-ac8b-fda4cd4e565d" check="valid">subsection&#160;(2)</intref><intref refid="sec.5-ssec.2-para1.c" target.guid="_a77b1bfd-b9c2-4f60-a90a-0738434e29f4" check="valid">(c)</intref>, a reference to the rights of persons includes a reference to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_3e904c23-c460-44df-9000-b61ddaaee32c" provision.type="other"><no>(a)</no><block><txt break.before="0">the rights of members of the public to enjoy the natural environment; and</txt></block></li><li id="sec.5-ssec.3-para1.b" guid="_39de6823-0370-4869-98be-4455733480a6" provision.type="other"><no>(b)</no><block><txt break.before="0">the rights of persons to carry on business.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.4" guid="_87c604b1-2e4a-49f8-b6e5-4a09331fe193" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Nothing in this section limits the power of a local authority to regulate pedestrian malls, but the power is subject to the right mentioned in <intref refid="sec.5-ssec.1" target.guid="_cdea0b66-6243-4cf1-9527-a18555742d6a" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause></clause><clause id="sec.6" guid="_82d4360e-fc43-4f9c-b141-5e0002dfb7d8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_c7599344-c988-4c4e-89e3-ee4116d69046">Legal immunity for participant in public assembly</heading><subclause id="sec.6-ssec.1" guid="_ee311632-e19c-4ec4-b75f-e277a7c921e7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If a public assembly—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_330a1c16-e643-45a2-bb4f-ce388cdfdf39" provision.type="other"><no>(a)</no><block><txt break.before="0">is an authorised public assembly; and</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_2ae3d00a-6f0f-4388-994e-8243f91d0ffc" provision.type="other"><no>(b)</no><block><txt break.before="0">is peaceful; and</txt></block></li><li id="sec.6-ssec.1-para1.c" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.c-para2.i" guid="_05eca288-0277-404e-9ce1-8e4723cbe280" provision.type="other"><no>(i)</no><block><txt break.before="0">the relevant particulars; and</txt></block></li><li id="sec.6-ssec.1-para1.c-para2.ii" guid="_54975f75-d9a7-4817-a0db-94f2d03a918c" provision.type="other"><no>(ii)</no><block><txt break.before="0">any relevant conditions;</txt></block></li></list></block></li></list></block><block><txt break.before="1">a person who participates in the assembly does not, merely because of the participation, incur any civil or criminal liability because of the obstruction of a public place.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_e12c6d81-ba8a-4531-988b-161eb7cfa36e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-ssec.2-def.relevantcondition_" guid="_bdb005a5-a286-4f75-aab5-b5c2cf4affaa" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-ssec.2-def.relevantcondition" guid="_c99eca23-8b31-4540-87f8-fb511ca56fb6" type="definition">relevant condition</defterm> means a condition specified in relation to the assembly in—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-def.relevantcondition-para1.a" guid="_04fbe4e7-d74c-4b33-8178-d96075c9193c" provision.type="other"><no>(a)</no><block><txt break.before="0">a notice under <intref refid="sec.10" target.guid="_ead39afb-1fa5-4dd4-a111-70ca90a29f14" check="valid">section&#160;10</intref><intref refid="sec.10-ssec.2" target.guid="_236fb73e-8053-4b0c-8c54-27208a384c6a" check="valid">(2)</intref><intref refid="sec.10-ssec.2-para1.a" target.guid="_7e326a4d-d999-4087-80bb-3dad3e2915a6" check="valid">(a)</intref> or <intref refid="sec.10-ssec.2-para1.b" target.guid="_6eb7df6d-3cce-4fba-ad2f-f17ff718d5e0" check="valid">(b)</intref>; or</txt></block></li><li id="sec.6-ssec.2-def.relevantcondition-para1.b" guid="_c0dd87b5-4184-438b-8033-fa74e67a835a" provision.type="other"><no>(b)</no><block><txt break.before="0">an order of a Magistrates Court under <intref refid="sec.12" target.guid="_f0ef933a-8e1d-4b20-8f5e-cb70856e969f" check="valid">section&#160;12</intref> or <intref refid="sec.14" type="definition">relevant particulars</defterm> means the particulars given in the assembly notice for the assembly (except so far as any of the particulars are inconsistent with a relevant condition).</txt></definition></deflist></block></subclause></clause><clause id="sec.7" guid="_6ac1edee-a320-450f-92b0-405fc0ae1e43" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_436f2a9e-da0e-466c-a177-779ea4a79981">Authorised public assembly</heading><block><txt break.before="1">A public assembly is an authorised public assembly if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-para1.a" guid="_0b98361c-7dfe-473a-8a4c-ab31b4658b7b" provision.type="other"><no>(a)</no><block><txt break.before="0">notice of intention to hold the assembly has been given under <intref refid="sec.8" target.guid="_3bb757e5-d987-42f0-986c-6e9deb8c3adf" check="valid">section&#160;8</intref>; and</txt></block></li><li id="sec.7-para1.b" guid="_3aeb9426-2b9e-4676-b09d-458595883e3c" provision.type="other"><no>(b)</no><block><txt break.before="0">the notice complies with <intref refid="sec.9" target.guid="_bf4742ee-ac45-46a8-b4f3-41eb398c1054" check="valid">section&#160;9</intref>; and</txt></block></li><li id="sec.7-para1.c" guid="_98fc4d4c-bdb6-4e76-8a72-95e60c572c17" provision.type="other"><no>(c)</no><block><txt break.before="0">the assembly is taken to have been approved under <intref refid="sec.10" target.guid="_ead39afb-1fa5-4dd4-a111-70ca90a29f14" check="valid">section&#160;10</intref>.</txt></block></li></list></block></clause><clause id="sec.8" guid="_3bb757e5-d987-42f0-986c-6e9deb8c3adf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_789b46be-735c-4d0b-adff-255f545e51d7">Giving of assembly notice</heading><subclause id="sec.8-ssec.1" guid="_3f71aa3f-5731-44bd-a5fc-99b9e5a486ec" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An assembly notice is to be given—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_d0491dae-e753-4849-8dd2-e4b882325954" provision.type="other"><no>(a)</no><block><txt break.before="0">to the Commissioner; and</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_7f613110-ff8d-4e2c-a5ec-f972bbc9385a" provision.type="other"><no>(b)</no><block><txt break.before="0">if it is proposed that the assembly will be held in, or pass through, a place that is a park, reserve, pedestrian mall, square or other public place—to any local authority having jurisdiction in relation to the place.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_c96daacc-e641-4eb1-abbe-d9a72ccfb96b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The notice is to be given—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.a" guid="_dc11b144-4dcd-4fc5-86c4-f7f3c67824be" provision.type="other"><no>(a)</no><block><txt break.before="0">in the case of the Commissioner—by leaving it at, or by sending it to, an appropriate police office; and</txt></block></li><li id="sec.8-ssec.2-para1.b" guid="_9abc11a8-5cd8-4cf8-a3a7-c06f5e138276" provision.type="other"><no>(b)</no><block><txt break.before="0">in the case of a local authority—by leaving it at, or by sending it to, the office of the clerk of the local authority.</txt></block></li></list></block></subclause></clause><clause id="sec.9" guid="_bf4742ee-ac45-46a8-b4f3-41eb398c1054" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_3e450050-00ec-44a3-84d3-fb4400a0f063">Requirements for assembly notice</heading><subclause id="sec.9-ssec.1" guid="_98cb333d-7240-4f49-b7b6-f4bf1531aef3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An assembly notice must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_5af85db7-ffcf-4896-bfd9-3a76473e8b7e" provision.type="other"><no>(a)</no><block><txt break.before="0">be in writing; and</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_24283c14-7aac-4025-addc-202e6df9cc4b" provision.type="other"><no>(b)</no><block><txt break.before="0">be addressed to the Commissioner or the relevant local authority, as the case requires; and</txt></block></li><li id="sec.9-ssec.1-para1.c" guid="_139044ba-c0aa-4ad9-afa1-a218b49f4992" provision.type="other"><no>(c)</no><block><txt break.before="0">be signed by the organiser.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_b0225e71-c31c-4f9a-a89d-02a1184cf3dc" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The notice must contain the following particulars—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_5064b80c-cb4d-4021-9fca-65b64d3d166f" provision.type="other"><no>(a)</no><block><txt break.before="0">the name of the person responsible for organising and conducting the assembly;</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_701f5b7d-4d86-487e-b55b-708944690e19" provision.type="other"><no>(b)</no><block><txt break.before="0">the address for service on the organiser of any notice under this Act;</txt></block></li><li id="sec.9-ssec.2-para1.c" guid="_25822268-aff3-4723-bd34-01a62e794faa" provision.type="other"><no>(c)</no><block><txt break.before="0">the name and address of the person by whom the notice is given;</txt></block></li><li id="sec.9-ssec.2-para1.d" guid="_1d19a445-a2ba-4464-b356-47db65880440" provision.type="other"><no>(d)</no><block><txt break.before="0">the day on which the assembly is proposed to be held;</txt></block></li><li id="sec.9-ssec.2-para1.e" guid="_ac073ae2-037d-4f4d-bf23-c006d8173adb" provision.type="other"><no>(e)</no><block><txt break.before="0">the place at which the assembly is proposed to be held;</txt></block></li><li id="sec.9-ssec.2-para1.f" guid="_bdbc56e2-1972-4991-834d-73735741374d" provision.type="other"><no>(f)</no><block><txt break.before="0">the time at which it is proposed that persons will assemble to participate in the assembly;</txt></block></li><li id="sec.9-ssec.2-para1.g" guid="_b6062960-50bf-4809-8331-996eddf6135e" provision.type="other"><no>(g)</no><block><txt break.before="0">the times at which it is proposed that the assembly will begin and end;</txt></block></li><li id="sec.9-ssec.2-para1.h" guid="_71709bc1-13df-48ed-aa8f-f1bdcb0d3340" provision.type="other"><no>(h)</no><block><txt break.before="0">if the assembly is a procession—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.h-para2.i" guid="_003a1579-b756-4065-a00d-82b1c7cce5a1" provision.type="other"><no>(i)</no><block><txt break.before="0">the proposed route of the procession; and</txt></block></li><li id="sec.9-ssec.2-para1.h-para2.ii" guid="_276840e4-71e0-4dde-a995-61d1f8de1766" provision.type="other"><no>(ii)</no><block><txt break.before="0">any places at which it is proposed that the procession will stop; and</txt></block></li><li id="sec.9-ssec.2-para1.h-para2.iii" guid="_5591fce2-f259-45fc-a073-49358a94b7c6" provision.type="other"><no>(iii)</no><block><txt break.before="0">the length of time it is proposed that the procession will remain at each such place;</txt></block></li></list></block></li><li id="sec.9-ssec.2-para1.i" guid="_693cc8a4-6d4a-4db7-aae4-c806cc226e30" provision.type="other"><no>(i)</no><block><txt break.before="0">the expected number of participants;</txt></block></li><li id="sec.9-ssec.2-para1.j" guid="_b6df6ce9-c365-45e7-824e-89c8f83338e5" provision.type="other"><no>(j)</no><block><txt break.before="0">the purpose of the assembly;</txt></block></li><li id="sec.9-ssec.2-para1.k" guid="_71e73b00-55c4-49ff-85ad-420d689e9968" provision.type="other"><no>(k)</no><block><txt break.before="0">a description of any sound amplification equipment proposed to be used during the assembly.</txt></block></li></list></block></subclause></clause><clause id="sec.10" guid="_ead39afb-1fa5-4dd4-a111-70ca90a29f14" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_02c4b55f-8c05-4ac3-af5e-f59107b4714b">Approval of public assembly</heading><subclause id="sec.10-ssec.1" guid="_2c0074ab-6f52-4c4b-bcbb-08f220182039" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A public assembly is taken to have been approved for the purposes of <intref refid="sec.7" target.guid="_6ac1edee-a320-450f-92b0-405fc0ae1e43" check="valid">section&#160;7</intref><intref refid="sec.7-para1.c" target.guid="_98fc4d4c-bdb6-4e76-8a72-95e60c572c17" check="valid">(c)</intref> if, after the giving of the assembly notice for the assembly—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_b2dd324b-3009-49fa-a1f7-176f919a359f" provision.type="other"><no>(a)</no><block><txt break.before="0">the required notice of permission for the assembly has been given to the organiser of the assembly; or</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_8926c869-8639-4914-8206-515189ae0d6a" provision.type="other"><no>(b)</no><block><txt break.before="0">if the assembly notice was given not less than 5 business days before the day on which the assembly is held—a Magistrates Court has not made an order under <intref refid="sec.12" target.guid="_f0ef933a-8e1d-4b20-8f5e-cb70856e969f" check="valid">section&#160;12</intref> refusing to authorise the holding of the assembly; or</txt></block></li><li id="sec.10-ssec.1-para1.c" guid="_3ebae1e7-b1b1-47c0-9ffa-3c05bb17f824" provision.type="other"><no>(c)</no><block><txt break.before="0">if the assembly notice was given less than 5 business days before the day on which the assembly is held—a Magistrates Court has made an order under <intref refid="sec.14" target.guid="_2b3989f1-0f65-416b-9080-4cceadb4033e" check="valid">section&#160;14</intref> authorising the holding of the assembly.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_236fb73e-8053-4b0c-8c54-27208a384c6a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The required notice of permission for a public assembly is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_7e326a4d-d999-4087-80bb-3dad3e2915a6" provision.type="other"><no>(a)</no><block><txt break.before="0">a notice by the Commissioner stating that the Commissioner does not oppose the holding of the assembly; and</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_6eb7df6d-3cce-4fba-ad2f-f17ff718d5e0" provision.type="other"><no>(b)</no><block><txt break.before="0">if the assembly notice was given to a local authority—a notice by the local authority stating that the authority does not oppose the holding of the assembly; and</txt></block></li><li id="sec.10-ssec.2-para1.c" guid="_60296849-1dea-4a1b-9840-bb3d8a2b1c0d" provision.type="other"><no>(c)</no><block><txt break.before="0">if the place of assembly is a place for the time being open to or used by the public by the express or implied consent of the owner or occupier or on payment of money—a notice by the owner or occupier of the place consenting to the holding of the assembly.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.3" guid="_cbde0acb-c069-4a51-858b-8b35839468e4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A notice mentioned in <intref refid="sec.10-ssec.2" target.guid="_236fb73e-8053-4b0c-8c54-27208a384c6a" check="valid">subsection&#160;(2)</intref> must be in writing.</txt></block></subclause></clause><clause id="sec.11" guid="_ef7471b7-347c-42f7-9af3-a8fa8c68f9ab" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_9dbf2b7d-789a-429f-8fd3-0143fd6dec99">Permission notice may be subject to certain conditions</heading><subclause id="sec.11-ssec.1" guid="_149bdd1e-274e-4d25-bffd-7eb84b10b38b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Commissioner, or local authority concerned, (the <defterm id="sec.11-def.relevantauthority" guid="_55d8cd20-4483-47da-9760-3b4747a07a53" type="definition">relevant authority</defterm>) may, in a notice given under <intref refid="sec.10" target.guid="_ead39afb-1fa5-4dd4-a111-70ca90a29f14" check="valid">section&#160;10</intref><intref refid="sec.10-ssec.2" target.guid="_236fb73e-8053-4b0c-8c54-27208a384c6a" check="valid">(2)</intref><intref refid="sec.10-ssec.2-para1.a" target.guid="_7e326a4d-d999-4087-80bb-3dad3e2915a6" check="valid">(a)</intref> or <intref refid="sec.10-ssec.2-para1.b" target.guid="_6eb7df6d-3cce-4fba-ad2f-f17ff718d5e0" check="valid">(b)</intref>, specify conditions to which the giving of the notice is subject.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_be374887-859f-43c1-8a5e-c34558ab3528" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A condition may not be specified unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.a" guid="_a5bf6522-0688-4124-a9f6-5a18ac2ea7ca" provision.type="other"><no>(a)</no><block><txt break.before="0">the relevant authority has had regard to the objects of this Act; and</txt></block></li><li id="sec.11-ssec.2-para1.b" guid="_205e4fde-b0cc-4eb4-a20e-fff2f5720db0" provision.type="other"><no>(b)</no><block><txt break.before="0">the organiser has agreed, in writing, to the condition; and</txt></block></li><li id="sec.11-ssec.2-para1.c" guid="_70c647e7-f258-4789-83a8-16023b5023b7" provision.type="other"><no>(c)</no><block><txt break.before="0">the consultations required by <intref refid="sec.11-ssec.4" target.guid="_06625291-d7b8-497f-82bc-1c5ab7cb3550" check="valid">subsection&#160;(4)</intref> have been held.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.3" guid="_fdbd9a39-beb1-4fc8-9c7d-8d847651f6e7" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A condition must relate to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.3-para1.a" guid="_b3dcbfce-6675-42c7-a06e-0ac8dc6bf7f1" provision.type="other"><no>(a)</no><block><txt break.before="0">a matter concerning—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.3-para1.a-para2.i" guid="_1333c45d-f208-4c9f-9c37-ab4e8123b47c" provision.type="other"><no>(i)</no><block><txt break.before="0">public safety; or</txt></block></li><li id="sec.11-ssec.3-para1.a-para2.ii" guid="_e7c6df92-5d26-438a-a6d2-f507b5a88b81" provision.type="other"><no>(ii)</no><block><txt break.before="0">the maintenance of public order; or</txt></block></li><li id="sec.11-ssec.3-para1.a-para2.iii" guid="_80715c15-4bd5-4776-9c2b-1800c9f3bc5d" provision.type="other"><no>(iii)</no><block><txt break.before="0">the protection of the rights and freedoms of persons; or</txt></block></li></list></block></li><li id="sec.11-ssec.3-para1.b" guid="_088c8322-cfec-4738-8361-e46d5fbe12e7" provision.type="other"><no>(b)</no><block><txt break.before="0">the payment of clean up costs arising out of the holding of the assembly; or</txt></block></li><li id="sec.11-ssec.3-para1.c" guid="_8b0f0f4d-79eb-4750-b75f-ffe13cf61d48" provision.type="other"><no>(c)</no><block><txt break.before="0">the recognition of any inherent environmental or cultural sensitivity of the place of assembly; or</txt></block></li><li id="sec.11-ssec.3-para1.d" guid="_3d016d99-e8ae-4978-960c-a13347d25e10" provision.type="other"><no>(d)</no><block><txt break.before="0">the application to the place of assembly of any resource management practice of a delicate nature.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.4" guid="_06625291-d7b8-497f-82bc-1c5ab7cb3550" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For the purposes of <intref refid="sec.11-ssec.2" target.guid="_be374887-859f-43c1-8a5e-c34558ab3528" check="valid">subsection&#160;(2)</intref><intref refid="sec.11-ssec.2-para1.c" target.guid="_70c647e7-f258-4789-83a8-16023b5023b7" check="valid">(c)</intref>, the relevant authority must consult, or attempt to consult, with—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.4-para1.a" guid="_48e414ba-d936-4893-b1a3-d76607043f27" provision.type="other"><no>(a)</no><block><txt break.before="0">if there is a body known to the relevant authority to represent persons who have a significant interest in the place of assembly—the body; or</txt></block></li><li id="sec.11-ssec.4-para1.b" guid="_c8f30199-b0b0-4a17-8e65-9c6ffc00f085" provision.type="other"><no>(b)</no><block><txt break.before="0">in any other case—each person, body, or agency, (an <defterm id="sec.11-ssec.4-def.interestedperson" guid="_cef90be9-2ca3-4e68-9b15-33ceddf39091" type="definition">interested person</defterm>) known to the relevant authority to have a significant interest in, or responsibility for, the place of assembly.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.5" guid="_93789560-05e4-4b8d-a3b0-81770665af0f" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the relevant authority considers that, because of time constraints and the number of interested persons involved, it is not practicable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.5-para1.a" guid="_f7a9ce59-04ab-4bea-b8a0-93bdabf0ecc9" provision.type="other"><no>(a)</no><block><txt break.before="0">to hold separate consultations with each interested person; or</txt></block></li><li id="sec.11-ssec.5-para1.b" guid="_08e5bc34-21fd-4ec2-b387-1f1a8a6101a7" provision.type="other"><no>(b)</no><block><txt break.before="0">to contact each interested person for the purpose of arranging consultations;</txt></block></li></list></block><block><txt break.before="1">the relevant authority may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.5-para1.c" guid="_f19e0d98-cd75-428b-b1ad-d4ae5fc08019" provision.type="other"><no>(c)</no><block><txt break.before="0">fix a reasonable time and place for holding the consultations; and</txt></block></li><li id="sec.11-ssec.5-para1.d" guid="_0f45e0c1-e894-4a76-af5c-70a6acb619d0" provision.type="other"><no>(d)</no><block><txt break.before="0">cause a notice of the time and place to be published in a newspaper circulating in the area in which the assembly is proposed to be held.</txt></block></li></list></block></subclause></clause><clause id="sec.12" guid="_f0ef933a-8e1d-4b20-8f5e-cb70856e969f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_e9b013ae-4f66-4cfa-a1a8-a12c5e25780b">Application for refusal to authorise public assembly</heading><subclause id="sec.12-ssec.1" guid="_f4ef1590-4a8a-4e40-b0e2-63d6c81cdf53" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If an assembly notice is given to the Commissioner, or local authority concerned, (the <defterm id="sec.12-def.relevantauthority" guid="_7adf47d3-e4de-46ba-8b88-4824b66a3a44" type="definition">relevant authority</defterm>) not less than 5 business days before the day specified in the notice as the day on which it is proposed that the public assembly be held, the relevant authority may apply to a Magistrates Court for an order refusing to authorise the holding of the assembly.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_9fc04296-f4ca-4a24-948d-fc2af1983805" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Court must be in the Magistrates Courts District in which the public assembly is proposed to be held.</txt></block></subclause><subclause id="sec.12-ssec.3" guid="_b8c1e42a-bb8b-4f83-914d-9e7007bc39d2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Court may, by order—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.3-para1.a" guid="_ee11d83e-f8b5-4c73-864b-61957f73e9c5" provision.type="other"><no>(a)</no><block><txt break.before="0">refuse to authorise the holding of the public assembly; or</txt></block></li><li id="sec.12-ssec.3-para1.b" guid="_85704321-b015-4673-aa73-5c035ccaf684" provision.type="other"><no>(b)</no><block><txt break.before="0">specify conditions that are to apply to the holding of the public assembly.</txt></block></li></list></block></subclause></clause><clause id="sec.13" guid="_2282f6d3-173b-4a3e-ae64-2d06cad1a7e1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_1f6dcb44-d8b1-44f0-8e89-be6fc2143afe">Restrictions affecting application for refusal to authorise public assembly</heading><subclause id="sec.13-ssec.1" guid="_fab7100b-103b-41e7-b0d2-74e29e1209b3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The relevant authority is not entitled to apply for an order under <intref refid="sec.12" target.guid="_f0ef933a-8e1d-4b20-8f5e-cb70856e969f" check="valid">section&#160;12</intref> unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.a" guid="_34af8ce1-e593-4c2f-a61f-d503d3f6dd72" provision.type="other"><no>(a)</no><block><txt break.before="0">the relevant authority has had regard to the objects of this Act; and</txt></block></li><li id="sec.13-ssec.1-para1.b" guid="_59175089-80eb-47dc-b98d-f45fb05484f4" provision.type="other"><no>(b)</no><block><txt break.before="0">the relevant authority has formed the opinion, on reasonable grounds, that if the assembly were to be held—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.b-para2.i" guid="_31b8d024-855a-4b07-802d-6febcbb3abb4" provision.type="other"><no>(i)</no><block><txt break.before="0">the safety of persons would be likely to be placed in jeopardy; or</txt></block></li><li id="sec.13-ssec.1-para1.b-para2.ii" guid="_4616b979-378b-4371-aeee-a203daa6ce5c" provision.type="other"><no>(ii)</no><block><txt break.before="0">serious public disorder would be likely to happen; or</txt></block></li><li id="sec.13-ssec.1-para1.b-para2.iii" guid="_1adcfbe1-fa2d-433c-90d6-69a8b6794860" provision.type="other"><no>(iii)</no><block><txt break.before="0">the rights or freedoms of persons would be likely to be excessively interfered with; and</txt></block></li></list></block></li><li id="sec.13-ssec.1-para1.c" guid="_915ae8cb-8b24-4fac-96b8-6be0c4d48bf6" provision.type="other"><no>(c)</no><block><txt break.before="0">the relevant authority has consulted, or attempted to consult, with each person, body, or agency, (an <defterm id="sec.13-ssec.1-def.interestedperson" guid="_6098394e-107d-43d6-81d7-1f4fc20b2a79" type="definition">interested person</defterm>) with which the relevant authority would be required to consult under <intref refid="sec.11" target.guid="_ef7471b7-347c-42f7-9af3-a8fa8c68f9ab" check="valid">section&#160;11</intref><intref refid="sec.11-ssec.4" target.guid="_06625291-d7b8-497f-82bc-1c5ab7cb3550" check="valid">(4)</intref> for the purposes of <intref refid="sec.11" target.guid="_ef7471b7-347c-42f7-9af3-a8fa8c68f9ab" check="valid">section&#160;11</intref><intref refid="sec.11-ssec.2" target.guid="_be374887-859f-43c1-8a5e-c34558ab3528" check="valid">(2)</intref><intref refid="sec.11-ssec.2-para1.c" target.guid="_70c647e7-f258-4789-83a8-16023b5023b7" check="valid">(c)</intref>; and</txt></block></li><li id="sec.13-ssec.1-para1.d" guid="_cd3041c4-2c16-4645-929c-01e322e10a7d" provision.type="other"><no>(d)</no><block><txt break.before="0">a mediation process has been engaged in and the process has ended.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.2" guid="_be1629e9-48af-4062-8f4c-c3a733c0e3fd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The mediation process is taken to have ended if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.a" guid="_0c0e6336-5535-4a98-a924-b83f1a09bb3f" provision.type="other"><no>(a)</no><block><txt break.before="0">a mediation session has been held at the request of the relevant authority and the session was attended by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.a-para2.i" guid="_9fdd5f23-e8a3-4f5d-97fd-851ff90a3bdd" provision.type="other"><no>(i)</no><block><txt break.before="0">the representative of the relevant authority; and</txt></block></li><li id="sec.13-ssec.2-para1.a-para2.ii" guid="_9a553bbc-b6b1-4b6a-aaf6-d338b12b10f3" provision.type="other"><no>(ii)</no><block><txt break.before="0">the organiser of the assembly; or</txt></block></li></list></block></li><li id="sec.13-ssec.2-para1.b" guid="_d33089c3-f246-48d9-bbc7-02694971a3eb" provision.type="other"><no>(b)</no><block><txt break.before="0">the relevant authority requested that a mediation session be held, but the session was not held because—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.b-para2.i" guid="_12dff643-a045-470a-ba53-dcdda736fbad" provision.type="other"><no>(i)</no><block><txt break.before="0">the matter was a matter that, under the <legref jurisd="QLD" type="act" target.doc.id="act-1990-035" target.version.series="fae4f283-1cc3-4a25-94ce-615e63ad1da2" check="valid"><name emphasis="yes">Dispute Resolution Centres Act 1990</name></legref>, may not be the subject of a mediation session; or</txt></block></li><li id="sec.13-ssec.2-para1.b-para2.ii" guid="_28f858aa-07b6-4ebb-8a7d-542de9939845" provision.type="other"><no>(ii)</no><block><txt break.before="0">the matter was not accepted for mediation under that Act; or</txt></block></li></list></block></li><li id="sec.13-ssec.2-para1.c" guid="_c79f9953-1d03-400e-ad05-345b9af0eb6b" provision.type="other"><no>(c)</no><block><txt break.before="0">the relevant authority requested that a mediation session be held, but—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.c-para2.i" guid="_13276c39-f372-45ef-9d6d-f8f7dd07cee3" provision.type="other"><no>(i)</no><block><txt break.before="0">the organiser of the assembly—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.c-para2.i-para3.A" guid="_57093277-a52a-46bf-b485-2e0badc1cf9a" provision.type="other"><no>(A)</no><block><txt break.before="0">failed to attend, or participate in, the session; or</txt></block></li><li id="sec.13-ssec.2-para1.c-para2.i-para3.B" guid="_804d9816-d8c0-4950-882b-e508ee81c55e" provision.type="other"><no>(B)</no><block><txt break.before="0">withdrew from the session; or</txt></block></li></list></block></li><li id="sec.13-ssec.2-para1.c-para2.ii" guid="_dc716088-7db7-4e0b-9122-a1e8e6c36038" provision.type="other"><no>(ii)</no><block><txt break.before="0">the session was terminated under the <legref jurisd="QLD" type="act" target.doc.id="act-1990-035" target.version.series="fae4f283-1cc3-4a25-94ce-615e63ad1da2" check="valid"><name emphasis="yes">Dispute Resolution Centres Act 1990</name></legref>.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.13-ssec.3" guid="_41ecc48a-40ca-41f3-a42a-d835f6b8325c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the relevant authority considers that, because of time constraints and the number of interested persons involved, it is not practicable, for the purposes of <intref refid="sec.13-ssec.1" target.guid="_fab7100b-103b-41e7-b0d2-74e29e1209b3" check="valid">subsection&#160;(1)</intref><intref refid="sec.13-ssec.1-para1.c" target.guid="_915ae8cb-8b24-4fac-96b8-6be0c4d48bf6" check="valid">(c)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.a" guid="_683e78dd-b4de-4a0e-b175-1c2672e3024f" provision.type="other"><no>(a)</no><block><txt break.before="0">to hold separate consultations with each interested person; or</txt></block></li><li id="sec.13-ssec.3-para1.b" guid="_ef8429e1-bce5-489c-8547-697314286adf" provision.type="other"><no>(b)</no><block><txt break.before="0">to contact each interested person for the purpose of arranging consultations;</txt></block></li></list></block><block><txt break.before="1">the relevant authority may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.c" guid="_b095cb80-7ffe-4bd4-a7aa-7265771df96b" provision.type="other"><no>(c)</no><block><txt break.before="0">fix a reasonable time and place for holding the consultations; and</txt></block></li><li id="sec.13-ssec.3-para1.d" guid="_636d5481-29be-4e7f-a450-d4de8fc732e8" provision.type="other"><no>(d)</no><block><txt break.before="0">cause a notice of the time and place to be published in a newspaper circulating in the area in which the assembly is proposed to be held.</txt></block></li></list></block></subclause></clause><clause id="sec.14" guid="_2b3989f1-0f65-416b-9080-4cceadb4033e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_817d5302-77ad-4811-b01c-9d8d7688738f">Application to authorise public assembly</heading><subclause id="sec.14-ssec.1" guid="_4dc78e48-cf09-40a7-b546-afb072cc4bd9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If an assembly notice is given to the Commissioner, or local authority concerned, (the <defterm id="sec.14-def.relevantauthority" guid="_97c4eb1b-f2ba-41ed-bf1e-67268b9959eb" type="definition">relevant authority</defterm>) less than 5 business days before the day specified in the notice as the day on which it is proposed that guid="_c3ce9233-afc6-44ad-b332-fd7a549ec2c8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The organiser of a public assembly is not entitled to apply for an order under <intref refid="sec.14" target.guid="_2b3989f1-0f65-416b-9080-4cceadb4033e" check="valid">section&#160;14</intref> if the relevant authority, or each relevant authority, as the case requires, has notified the organiser in writing that the relevant authority does not oppose the holding of the assembly.</txt></block></subclause><subclause id="sec.15-ssec.2" guid="_332659de-1bdf-49cd-a020-c0a24640e235" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The organiser is also not entitled to apply for the order unless a mediation process has been engaged in and the process has ended.</txt></block></subclause><subclause id="sec.15-ssec.3" guid="_2971e3a8-abc5-4de2-829b-85e554ee13dc" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The mediation process is taken to have ended if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.3-para1.a" guid="_8302c9b0-141a-4f1b-8242-0d27d4bbe10a" provision.type="other"><no>(a)</no><block><txt break.before="0">a mediation session has been held at the request of the organiser and the session was attended by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.3-para1.a-para2.i" guid="_4cefe081-0d22-48c0-be16-2af718558e19" provision.type="other"><no>(i)</no><block><txt break.before="0">the organiser; and</txt></block></li><li id="sec.15-ssec.3-para1.a-para2.ii" guid="_541e50b7-a36e-47a3-9861-ce045ab08bf5" provision.type="other"><no>(ii)</no><block><txt break.before="0">the representative of the relevant authority or each relevant authority, as the case may be; or</txt></block></li></list></block></li><li id="sec.15-ssec.3-para1.b" guid="_f13d0e76-2fa0-44e4-becc-8e3e9e6f393d" provision.type="other"><no>(b)</no><block><txt break.before="0">the organiser requested that a mediation session be held, but the session was not held because—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.3-para1.b-para2.i" guid="_a469eb24-35aa-46cd-809c-dca3ac1ed6e1" provision.type="other"><no>(i)</no><block><txt break.before="0">the matter was a matter that, under the <legref jurisd="QLD" type="act" target.doc.id="act-1990-035" target.version.series="fae4f283-1cc3-4a25-94ce-615e63ad1da2" check="valid"><name emphasis="yes">Dispute Resolution Centres Act 1990</name></legref>, may not be the subject of a mediation session; or</txt></block></li><li id="sec.15-ssec.3-para1.b-para2.ii" guid="_63e7ea4c-5eb1-4df1-af5a-f525568c6d0d" provision.type="other"><no>(ii)</no><block><txt break.before="0">the matter was not accepted for mediation under that Act; or</txt></block></li></list></block></li><li id="sec.15-ssec.3-para1.c" guid="_d62960e6-b633-4045-8415-b67949f6e533" provision.type="other"><no>(c)</no><block><txt break.before="0">the organiser requested that a mediation session be held, but—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.3-para1.c-para2.i" guid="_4110e781-64bf-49b9-ae53-29eb8436c6a6" provision.type="other"><no>(i)</no><block><txt break.before="0">the representative of the relevant authority or a relevant authority, as the case may be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.3-para1.c-para2.i-para3.A" guid="_c9833ebe-cb83-4e2f-9e36-187b420f6ccd" provision.type="other"><no>(A)</no><block><txt break.before="0">failed to attend, or participate in, the session; or</txt></block></li><li id="sec.15-ssec.3-para1.c-para2.i-para3.B" guid="_41e9f56e-167a-4cb4-87ba-b47761814ad1" provision.type="other"><no>(B)</no><block><txt break.before="0">withdrew from the session; or</txt></block></li></list></block></li><li id="sec.15-ssec.3-para1.c-para2.ii" guid="_563a0453-102f-41c7-a46c-1e3be5573c46" provision.type="other"><no>(ii)</no><block><txt break.before="0">the session was terminated under the <legref jurisd="QLD" type="act" target.doc.id="act-1990-035" target.version.series="fae4f283-1cc3-4a25-94ce-615e63ad1da2" check="valid"><name emphasis="yes">Dispute Resolution Centres Act 1990</name></legref>.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sec.16" guid="_7ff5aa3c-6c03-44e3-ae11-571891ca6fa2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_7fe684bd-fc51-448c-a785-61c03b46e6c1">Hearing and determination of applications</heading><subclause id="sec.16-ssec.1" guid="_d77fa390-1b6a-405a-aab4-ec8d16f16c0b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For the purpose of hearing and determining an application under <intref refid="sec.12" target.guid="_f0ef933a-8e1d-4b20-8f5e-cb70856e969f" check="valid">section&#160;12</intref> or <intref refid="sec.14" target.guid="_2b3989f1-0f65-416b-9080-4cceadb4033e" check="valid">14</intref>, a Magistrates Court is to be constituted by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.1-para1.a" guid="_247388e1-1252-407d-81bc-65bd9934360f" provision.type="other"><no>(a)</no><block><txt break.before="0">a Stipendiary Magistrate; or</txt></block></li><li id="sec.16-ssec.1-para1.b" guid="_bc666427-f905-4b1c-a8d7-b032d336ad58" provision.type="other"><no>(b)</no><block><txt break.before="0">if that is not practicable—2 justices, each of whom is either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.1-para1.b-para2.i" guid="_245a3c53-de6f-43ea-bf4c-d495b612b6d6" provision.type="other"><no>(i)</no><block><txt break.before="0">a justice of the peace (magistrates court); or</txt></block></li><li id="sec.16-ssec.1-para1.b-para2.ii" guid="_8acf5d71-35c5-465b-b5ea-a6135c061f2c" provision.type="other"><no>(ii)</no><block><txt break.before="0">a justice of the peace (qualified);</txt></block></li></list></block><block><txt break.before="1">within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-1991-050" target.version.series="2d45566c-5920-4e8a-9d15-ae354fb20af2" check="valid"><name emphasis="yes">Justices of the Peace and Commissioners for Declarations Act 1991</name></legref>.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.2" guid="_14f52cf6-c660-4761-b180-8d0a3ea82b19" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In determining an application under <intref refid="sec.12" target.guid="_f0ef933a-8e1d-4b20-8f5e-cb70856e969f" check="valid">section&#160;12</intref> or <intref refid="sec.14" target.guid="_2b3989f1-0f65-416b-9080-4cceadb4033e" check="valid">14</intref>, a Magistrates Court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.a" guid="_a2ae7cc7-3373-4a27-86da-17d67ba22b08" provision.type="other"><no>(a)</no><block><txt break.before="0">must have regard to the objects of this Act; and</txt></block></li><li id="sec.16-ssec.2-para1.b" guid="_9871b4f3-8a00-4cfb-902b-46b6eeda75af" provision.type="other"><no>(b)</no><block><txt break.before="0">must determine the application with the greatest possible speed to ensure that the application is not frustrated because of delay by the Court in giving its decision; and</txt></block></li><li id="sec.16-ssec.2-para1.c" guid="_b9499564-7b20-4d8e-afee-901a14056ee9" provision.type="other"><no>(c)</no><block><txt break.before="0">is not bound by the rules of evidence; and</txt></block></li><li id="sec.16-ssec.2-para1.d" guid="_24c6c175-eb77-477a-a902-469234163010" provision.type="other"><no>(d)</no><block><txt break.before="0">must conduct the proceeding with as little formality and technicality as possible.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.3" guid="_ef964af5-a983-40cb-885f-fe572c596fea" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Each party to the application is to bear the party’s own costs of the proceeding, regardless of the outcome of the proceeding.</txt></block></subclause><subclause id="sec.16-ssec.4" guid="_79f68443-9fef-441c-a6ff-40565110c6eb" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Not more than 1 application may be made under <intref refid="sec.12" target.guid="_f0ef933a-8e1d-4b20-8f5e-cb70856e969f" check="valid">section&#160;12</intref> or <intref target.guid="_d77fa390-1b6a-405a-aab4-ec8d16f16c0b" check="valid">Subsection&#160;(1)</intref> has effect despite anything contained in the <legref jurisd="QLD" type="act" target.doc.id="act-1991-050" target.version.series="2d45566c-5920-4e8a-9d15-ae354fb20af2" check="valid"><name emphasis="yes">Justices of the Peace and Commissioners for Declarations Act 1991</name></legref>.</txt></block></subclause></clause><clause id="sec.17" guid="_26c319fa-d906-40e9-9b7a-acb939619b89" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_1b2f64e9-f1e2-449b-9a5a-ec2538660e78">Limitation on delegation</heading><block><txt break.before="1">The Commissioner’s powers under this Act may be delegated only to a police officer who is of the rank of sergeant or higher.</txt><note id="sec.17-note" guid="_15092cb2-e8f4-474f-a46e-4d6904e48167" type="example"><heading id="sec.17-note-he" guid="_6c15bde2-623d-4141-b7d6-da8b44f252a0">Note—</heading><block><txt break.before="1">Under the <legref target.doc.id="act-1990-004"
