guid="_50dd8f3b-40c2-4404-b691-5c4edea2e29a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2-def.affidavit" guid="_f8ac31ae-7454-4a2b-8fac-d0d2a1d55a28" type="definition">affidavit</defterm> includes any statutory or other declaration, affirmation, acknowledgment, or examination.</txt></definition><definition id="sec.2-def.Australianconsularofficer_" guid="_b1c523be-2f17-438a-885b-c2995a95d3d9" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2-def.Australianconsularofficer" guid="_a1493d17-6767-4947-a37d-b7ecea851437" type="definition">Australian consular officer</defterm> means a person appointed to hold or act in any of the following offices (being an office of the Commonwealth) in a country or place outside Australia—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-def.Australianconsularofficer-para1.a" guid="_d1835f40-6d20-4186-8830-e63f3d65a60c" provision.type="other"><no>(a)</no><block><txt break.before="0">ambassador;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.b" guid="_3083daf0-5405-4d39-8eb2-60cc36b593cf" provision.type="other"><no>(b)</no><block><txt break.before="0">high commissioner;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.c" guid="_441e3121-a300-44c9-841c-364a0b281abb" provision.type="other"><no>(c)</no><block><txt break.before="0">Minister;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.d" guid="_fe35ed87-45f5-49c0-a2de-81e4db48b271" provision.type="other"><no>(d)</no><block><txt break.before="0">head of mission;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.e" guid="_ece0e810-d77c-4408-b61b-10b37f80fd57" provision.type="other"><no>(e)</no><block><txt break.before="0">commissioner;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.f" guid="_cdd8b85d-2941-47cc-a97e-5608df00cd9e" provision.type="other"><no>(f)</no><block><txt break.before="0">charge d’affaires;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.g" guid="_19f47de6-1f2b-40b9-adb4-b3a6da5d349e" provision.type="other"><no>(g)</no><block><txt break.before="0">counsellor or secretary at an embassy, high commissioner’s office, legation or other post;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.h" guid="_0ad024cc-ab23-4739-b393-e3c51fbe769f" provision.type="other"><no>(h)</no><block><txt break.before="0">consul general;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.i" guid="_9b2bd33e-df7b-42d1-8c97-ee82eadf6eaa" provision.type="other"><no>(i)</no><block><txt break.before="0">consul;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.j" guid="_3a0f56ee-3692-4301-bcb2-0c001d5819c1" provision.type="other"><no>(j)</no><block><txt break.before="0">vice-consul;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.k" guid="_d7948367-6459-4c5c-9133-cfd8b1979149" provision.type="other"><no>(k)</no><block><txt break.before="0">trade commissioner;</txt></block></li><li id="sec.2-def.Australianconsularofficer-para1.l" guid="_e27d74b7-7582-4909-bf3d-c8cc79a7be52" provision.type="other"><no>(l)</no><block><txt break.before="0">consular check="invalid">(c)</legref> of the <legref jurisd="CTH" type="act" target.doc.id="act-1955-005" target.version.series="C1955A0000" check="valid"><name emphasis="yes">Consular Fees Act 1955</name> (Cwlth)</legref>; or</txt></block></li><li id="sec.2-def.authorisedemployee-para1.b" guid="_3a325a31-273d-4a69-a1f6-ab1418274b38" provision.type="other"><no>(b)</no><block><txt break.before="0">the Australian Trade Commission authorised under <legref jurisd="CTH" type="act" check="invalid">section&#160;3</legref><legref jurisd="CTH" type="act" check="invalid">(d)</legref> of the <legref jurisd="CTH" type="act" target.doc.id="act-1955-005" target.version.series="C1955A0000" check="valid"><name emphasis="yes">Consular Fees Act 1955</name> id="sec.2-def.court" guid="_7af80684-3108-41c0-bb2b-d78d2a4f643f" type="definition">court</defterm> includes any court, judge, magistrate, or justice, and any arbitrator or person having authority by law or by consent of parties to hear, receive, and examine evidence.</txt></definition><definition id="sec.2-def.notarialact_" guid="_271dbcc7-ab13-40b1-be58-bd000c670701" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2-def.notarialact" guid="_948f9114-f944-4852-ba45-cc3ee23fd332" type="definition">notarial act</defterm> includes any act, matter, or thing which in Queensland or elsewhere a notary public can attest or verify or otherwise do by or under any Act of Parliament, custom, or otherwise for the purpose of being used in Queensland.</txt></definition></deflist></block><historynote><txt break.before="1"><b>s&#160;2</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-1995-058" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_dc78f7ac-4bf9-4e15-a2fa-9d9098167ec2">Powers of Australian consular officer or authorised employee</heading><subclause id="sec.3-ssec.1" guid="_1fc14083-40f9-4046-bf33-0a468e00305f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Where any oath, affidavit, or notarial act is required for the purpose of any court or matter in Queensland, any such oath or affidavit, and any such notarial act which, if done in the United Kingdom of Great Britain and Northern Ireland, a notary public could do may, in any country or place outside the Commonwealth, be made, sworn, and done by or before an Australian consular officer or authorised employee exercising his or her functions in that country or place.</txt></block></subclause><subclause id="sec.3-ssec.1A" guid="_9d193581-08aa-4f3b-b546-0e85add4342a" affected.by.uncommenced="0" provision.type="other"><no>(1A)</no><block><txt break.before="0">Every such oath, affidavit, and notarial act made, sworn, or done by or before any such Australian consular officer or authorised employee shall be as effectual as if duly made, sworn, or done before any lawful authority in Queensland.</txt></block></subclause><subclause id="sec.3-ssec.2" guid="_46cea21c-4d6c-4e20-a787-9d2805eed2a4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Any document required, authorised, or permitted by any Act or law of this State to be attested, or verified by, or sealed, or signed, or acknowledged or declared before a justice of the peace of this State may, in any country or place outside the Commonwealth, be attested, or verified, or sealed, or signed, or acknowledged or declared by or before an Australian consular officer or authorised employee exercising his or her functions in that country or place.</txt></block></subclause><subclause id="sec.3-ssec.2A" guid="_96b8e9e5-a49d-4984-9417-09d7e2ff5b3c" affected.by.uncommenced="0" provision.type="other"><no>(2A)</no><block><txt break.before="0">Every document attested or verified by, or sealed, or signed, or acknowledged or declared before any such Australian consular officer or authorised employee shall be as effectual as if duly attested, or verified by, or sealed, or sworn, or acknowledged or declared before a justice of the peace in Queensland.</txt></block></subclause><subclause id="sec.3-ssec.3" guid="_3f5da6be-2ad3-49bc-a81c-db22c1d0ff62" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Any document purporting to have affixed, impressed, or subscribed thereon or thereto the seal or signature or seal and signature of an Australian consular officer or authorised employee in testimony of any oath, affidavit, or notarial act being made, taken, or done by or before the Australian consular officer or authorised employee or of such document having been attested or verified by, or sealed, or signed, or acknowledged or declared before the Australian consular officer or authorised employee shall be admitted in evidence without proof of the seal or signature or seal and signature of that person, or of his or her official character.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;3</b> amd provision.type="other"><no>4</no><heading id="sec.4-he" guid="_5ecd866f-69f2-437b-be46-dfdc6f1d1c96">Things required to be done before British consular officers may be done before Australian consular officers etc.</heading><subclause id="sec.4-ssec.1" guid="_17a64001-9b07-4a70-ad9f-69f1845b8b5b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Where an Act requires, authorises, or permits any notarial act to be done by, or any oath or affidavit to be made or taken or any document to be sealed or signed or acknowledged or declared before, any person appointed to hold or act in any diplomatic or consular office of the United Kingdom of Great Britain and Northern Ireland, whether that person is in that enactment referred to as British ambassador, envoy, Minister, charge d’affaires, secretary of embassy or legation, consul-general, consul, vice-consul, or consular agent, or by any other title, then the same may be done by or, as the case may be, made or taken or sealed or signed or acknowledged or declared before either that person or any Australian consular officer or authorised employee and for that purpose every reference in that enactment to such person shall be deemed to also include a reference to an Australian consular officer or authorised employee within the meaning of this Act.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_24f09f10-beed-4b0d-a5a2-2d5a04b974f5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition
