id="sec.2" guid="_4c92f1f2-1b0f-4c47-b1d9-eadbf332cc50" affected.by.uncommenced="0" spent.amends="0" provision.type="commence"><no>2</no><heading id="sec.2-he" guid="_b42a909c-a797-4526-8102-ea2ea210f4d5">Commencement</heading><subclause id="sec.2-ssec.1" guid="_d294bb0e-ca3f-4c1a-b53a-106a8929e006" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This regulation, other than <intref refid="sec.3" target.guid="_107c018f-0146-4d5d-827e-2b1541bf1945" check="valid">section&#160;3</intref>, commences on 1 September 2017.</txt></block></subclause><subclause id="sec.2-ssec.2" guid="_12930677-67d7-4190-92e4-532c278966a5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.3" target.guid="_107c018f-0146-4d5d-827e-2b1541bf1945" check="valid">Section&#160;3</intref> commences on 1 October 2017.</txt></block></subclause></clause><clause id="sec.2A" guid="_c6f2d496-d286-4fab-9838-2cd8e6f53d34" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2A</no><heading id="sec.2A-he" guid="_bcb11270-9d45-4037-80c2-16dfc6bb70da">Information required for application for registration of residential park—<legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>, <legref jurisd="QLD" type="act" refid="sec.18A" target.doc.id="act-2003-074" check="invalid">s&#160;18A</legref></heading><block><txt break.before="1">For <legref jurisd="QLD" type="act" refid="sec.18A" target.doc.id="act-2003-074" check="invalid">section&#160;18A</legref><legref jurisd="QLD" type="act" refid="sec.18A-ssec.3" target.doc.id="act-2003-074" check="invalid">(3)</legref><legref jurisd="QLD" type="act" refid="sec.18A-ssec.3-para1.j" target.doc.id="act-2003-074" check="invalid">(j)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>, the following information is prescribed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2A-para1.a" guid="_3b147286-fd8f-4766-b6a5-41f90e8815eb" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a copy of any development approvals for the planning and construction of the residential park—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2A-para1.a-para2.i" guid="_f987e51b-b56c-4ab5-8c42-b3f8952ea353" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">required under the <legref jurisd="QLD" type="act" target.doc.id="act-2016-025" target.version.series="d4a7e9d3-f73d-48a3-9459-9be0b66a1c15" check="valid"><name emphasis="yes">Planning Act 2016</name></legref>; and</txt></block></li><li id="sec.2A-para1.a-para2.ii" guid="_6f3d5931-c8bf-4b09-944d-14f58ae74ecf" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">obtained by the park owner;</txt></block></li></list></block></li><li id="sec.2A-para1.b" guid="_daa1ea9d-3858-4cfe-a710-aca042d0bf7b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">whether the residential park will contain types of accommodation in addition to owner-occupied manufactured homes;</txt><note id="sec.2A-para1.b-note" guid="_ce3a9220-eaea-4723-83d0-c64596c3c87e" type="example"><heading id="sec.2A-para1.b-note-he" guid="_f3c158e2-c3d6-4e8d-8839-c3eca990888f">Examples of additional types of accommodation—</heading><block><txt break.before="1">caravans, holiday rentals, residential premises (including manufactured homes) under residential tenancy agreements</txt></block></note></block></li><li id="sec.2A-para1.c" guid="_a6612b03-d45c-4c21-8255-f952d360586f" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">details of any other residential parks owned by the park owner;</txt></block></li><li id="sec.2A-para1.d" guid="_f946677d-770c-431e-8a73-13e8d74d306e" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">a copy of any instrument used, or to be used, by the park owner as a template for—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2A-para1.d-para2.i" guid="_21d8f236-a1f5-48df-a9f0-454efa66e309" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a site agreement; or</txt></block></li><li id="sec.2A-para1.d-para2.ii" guid="_50f49295-34c4-4ce1-9ea7-2087a1f738bc" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">an agreement for the sale of a manufactured home in the residential park to a prospective home owner;</txt></block></li></list></block></li><li id="sec.2A-para1.e" guid="_b963339a-2037-422b-8dec-2a81abb5defc" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">an estimate of the proposed site rent, or the proposed range of site rent, payable by a home owner in the first year of operation of the residential park.</txt></block></li></list></block><historynote><txt break.before="1"><b>s&#160;2A</b> ins <legref jurisd="QLD" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>, <legref jurisd="QLD" type="act" refid="sec.18C" target.doc.id="act-2003-074" check="invalid">s&#160;18C</legref></heading><block><txt break.before="1">For <legref jurisd="QLD" type="act" refid="sec.18C" target.doc.id="act-2003-074" check="invalid">section&#160;18C</legref><legref jurisd="QLD" type="act" refid="sec.18C-ssec.2" target.doc.id="act-2003-074" check="invalid">(2)</legref><legref jurisd="QLD" type="act" refid="sec.18C-ssec.2-para1.l" target.doc.id="act-2003-074" check="invalid">(l)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>, the following information is prescribed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2B-para1.a" guid="_73763504-1191-4177-bd84-0ced4a525456" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the information prescribed under <intref refid="sec.2A" target.guid="_c6f2d496-d286-4fab-9838-2cd8e6f53d34" check="valid">section&#160;2A</intref> that was included in, or accompanied, the application to register the residential park;</txt></block></li><li id="sec.2B-para1.b" guid="_91990173-8898-498e-8f30-90cfa0528f82" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the comparison document, or information included in the comparison document, for the residential park; </txt></block></li><li id="sec.2B-para1.c" guid="_80a472a1-770f-4f85-876b-31ad37a3e2ac" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">whether the residential park has started operating; </txt></block></li><li id="sec.2B-para1.d" guid="_c7cf17e8-2a99-4cf3-82e0-76a0711f3971" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">if the residential park has started operating—the date the park check="invalid">section&#160;18G</legref><legref jurisd="QLD" type="act" refid="sec.18G-ssec.3" target.doc.id="act-2003-074" check="invalid">(3)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>, a residential park is exempt from the requirement under <legref jurisd="QLD" type="act" refid="sec.18G" target.doc.id="act-2003-074" check="invalid">section&#160;18G</legref><legref jurisd="QLD" type="act" refid="sec.18G-ssec.1" target.doc.id="act-2003-074" check="invalid">(1)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref> if the id="sec.3-para1.b" guid="_a1babd15-15a8-4b4b-a735-0ed6af035926" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">require a home owner to pay other charges but does not fully explain the charges; or</txt></block></li><li id="sec.3-para1.c" guid="_c1cfe228-6a17-4a3b-a8b2-60e2af607301" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">require a home owner to gain the consent of the park owner before the home owner complies with a requirement under law; or</txt></block></li><li id="sec.3-para1.d" guid="_cf0f82ee-6035-485a-87fb-1199b0c0da2b" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">state that if the seller assigns the seller’s interest in a site agreement to a buyer, the site agreement between the seller and the park owner does not end until the buyer enters into a site agreement with the park owner; or</txt></block></li><li id="sec.3-para1.e" guid="_4223ced0-cc92-4f4e-b8cd-5f8e20f03c84" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">require the home owner to give a current building inspection certificate to the park owner; or</txt></block></li><li id="sec.3-para1.f" guid="_cff5e192-05a0-41e0-bea7-c550f962dc8c" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">restrict or prohibit an alteration to the home that is not visible from the outside of the home; or</txt></block></li><li id="sec.3-para1.g" guid="_5bdf5236-66b5-482f-b0d9-5f448a84b290" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">allow the park owner to consent to the alteration to the exterior of a home or addition to the home in a way that is contrary to <legref jurisd="QLD" type="act" refid="sec.98" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" target.guid="_2b822897-34f4-48ce-8520-23c4896a97ee" check="valid">section&#160;98</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>; or</txt></block></li><li id="sec.3-para1.h" guid="_624c4d5c-1f03-463e-b1b7-4241eab3d460" provision.type="other" affected.by.uncommenced="0"><no>(h)</no><block><txt break.before="0">require the home owner to indemnify the park owner and the park owner’s employees, contractors or agents for loss that was not caused by the home owner, a guest of a home owner, or a home owner’s contractors or agents; or</txt></block></li><li id="sec.3-para1.i" guid="_8ce92d5a-f499-4833-b845-b6f2861468c5" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">give the park owner either of the following rights, however described— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.i-para2.i" guid="_57342efa-e4df-4c2b-94ec-a2a7718e01e3" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a right to buy a home before another person may be offered the home; </txt></block></li><li id="sec.3-para1.i-para2.ii" guid="_1e727b54-fee7-4d4b-b486-2a618fd65a71" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a right to make a final offer to buy a home after all other offers have been made to buy the home; or</txt></block></li></list></block></li><li id="sec.3-para1.j" guid="_0fe7ce4e-216d-4986-925f-d36850b898ce" provision.type="other" affected.by.uncommenced="0"><no>(j)</no><block><txt break.before="0">state site rent will not be reduced if there is a decrease or reduction in the standards, amenity or community facilities or services, including if— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.j-para2.i" guid="_23999479-faea-4490-a8e3-bf726049cc8b" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">there is a decrease in amenity or standard of the residential park’s common areas and communal facilities mentioned in <legref jurisd="QLD" type="act" refid="sec.72" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" target.guid="_df5df334-b671-4e44-ac61-432b548c6269" check="valid">section&#160;72</legref><legref jurisd="QLD" type="act" check="invalid">(1)</legref><legref jurisd="QLD" type="act" refid="sec.72-ssec.1-para1.a" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="invalid">(a)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>; or</txt></block></li><li id="sec.3-para1.j-para2.ii" guid="_cf56ada4-d9f4-469e-9b52-3912aa174994" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a communal facility or services mentioned in <legref jurisd="QLD" type="act" refid="sec.72" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" target.guid="_df5df334-b671-4e44-ac61-432b548c6269" check="valid">section&#160;72</legref><legref jurisd="QLD"
