affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_f33f5d04-8363-4ae9-a690-6981c865ef4e">Vexatious proceedings orders</heading><clause id="sec.5" guid="_124d7625-d657-4191-993e-94598038c956" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_68e4bad7-e89b-4199-913c-12ce7fe17e6b">Applications for vexatious proceedings orders</heading><subclause id="sec.5-ssec.1" guid="_9dc14bcf-53b0-4b7d-9a2d-38ca5bfeaf0f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Any of the following persons may apply to the Court for a vexatious proceedings order in relation to a person mentioned in <intref refid="sec.6" target.guid="_47b96740-e6a0-4bff-9ca6-1d31e6b97a0d" check="valid">section&#160;6</intref><intref refid="sec.6-ssec.1" target.guid="_7bd22777-30ce-4db8-9f3c-71c873aa6fc6" check="valid">(1)</intref><intref refid="sec.6-ssec.1-para1.a" target.guid="_c54ab8e2-91e4-478d-baa8-04e97ae92c50" check="valid">(a)</intref> or <intref refid="sec.6-ssec.1-para1.b" target.guid="_90049e44-1391-40fb-9ade-eea8db068b1c" check="valid">(b)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_873561e5-525e-4707-9bf0-b377a864114b" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the Attorney-General;</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_b66aa85b-90b2-4936-8c42-dbcae1f58ac2" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the Crown solicitor;</txt></block></li><li id="sec.5-ssec.1-para1.c" guid="_b9f2f9e9-4a8e-4c78-9dd0-278017c154d1" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the registrar of the Court;</txt></block></li><li id="sec.5-ssec.1-para1.d" guid="_bb9c91fb-a8b7-4aba-9429-9ec653dcc3c9" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">a person against whom another person has instituted or conducted a vexatious proceeding;</txt></block></li><li id="sec.5-ssec.1-para1.e" guid="_ea6e6d13-736b-4701-976b-be2dbdade75a" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">a person who has a sufficient interest in the matter.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_520235c8-61d2-4bf2-a68b-f2b934f35b29" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An application may be made by a person mentioned in <intref refid="sec.5-ssec.1" target.guid="_9dc14bcf-53b0-4b7d-9a2d-38ca5bfeaf0f" check="valid">subsection&#160;(1)</intref><intref refid="sec.5-ssec.1-para1.d" target.guid="_bb9c91fb-a8b7-4aba-9429-9ec653dcc3c9" check="valid">(d)</intref> or <intref refid="sec.5-ssec.1-para1.e" target.guid="_ea6e6d13-736b-4701-976b-be2dbdade75a" check="valid">(e)</intref> only with the leave of the Court.</txt></block></subclause></clause><clause id="sec.6" guid="_47b96740-e6a0-4bff-9ca6-1d31e6b97a0d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_c5d52de1-3119-4672-9534-e6e1e50961fc">Making vexatious proceedings orders</heading><subclause id="sec.6-ssec.1" guid="_7bd22777-30ce-4db8-9f3c-71c873aa6fc6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the Court is satisfied that a person is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_c54ab8e2-91e4-478d-baa8-04e97ae92c50" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a person who has frequently instituted or conducted vexatious proceedings in Australia; or</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_90049e44-1391-40fb-9ade-eea8db068b1c" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a person who, acting in concert with a person who is subject to a vexatious proceedings order or who is mentioned in <intref refid="sec.6-ssec.1-para1.a" target.guid="_c54ab8e2-91e4-478d-baa8-04e97ae92c50" check="valid">paragraph&#160;(a)</intref>, has instituted or conducted a vexatious proceeding in Australia.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_0298ca04-9904-4ef3-956a-cd988aad2b65" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Court may make any or all of the following orders—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_28805430-f33b-4d24-a65b-d64931224a02" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">an order staying all or part of any proceeding in Queensland already instituted by the person;</txt></block></li><li id="sec.6-ssec.2-para1.b" guid="_1784739d-6955-45d3-9e61-f518ebd62fe2" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">an order prohibiting the person from instituting proceedings, or proceedings of a particular type, in Queensland;</txt></block></li><li id="sec.6-ssec.2-para1.c" guid="_ac317a6c-41cc-4aa2-938b-75a2b695fdc6" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">any other order the Court considers appropriate in relation to the person.</txt><note id="sec.6-ssec.2-para1.c-note" guid="_7c799988-6b76-433e-add1-ed34d14e94e9" type="example"><heading id="sec.6-ssec.2-para1.c-note-he" guid="_58b7cbd4-0924-4a34-8d06-a0144c7efdc7">Examples of another order for <intref refid="sec.6-ssec.2-para1.c" target.guid="_ac317a6c-41cc-4aa2-938b-75a2b695fdc6" check="valid">paragraph&#160;(c)</intref>—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.c-note-para2" guid="_38a5b6b6-3403-4dca-a1b3-274811628d55" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">an order directing that the person may only file documents by mail</txt></block></li><li id="sec.6-ssec.2-para1.c-note-para2-oc.2" guid="_0739ae01-54d1-4193-8b53-9d2f7cfb5390" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">an order to give security for costs</txt></block></li><li id="sec.6-ssec.2-para1.c-note-para2-oc.3" guid="_65ad43ff-b7f7-40a5-8993-80639747022a" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">an order for costs</txt></block></li></list></block></note></block></li></list></block></subclause><subclause id="sec.6-ssec.3" guid="_4b8e22f4-9cd2-42dd-bbe5-77111cdc5d92" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Court may make a vexatious proceedings order on its own initiative or on the application of a person mentioned in <intref refid="sec.5" target.guid="_124d7625-d657-4191-993e-94598038c956" check="valid">section&#160;5</intref><intref refid="sec.5-ssec.1" target.guid="_9dc14bcf-53b0-4b7d-9a2d-38ca5bfeaf0f" check="valid">(1)</intref>.</txt></block></subclause><subclause id="sec.6-ssec.4" guid="_9f6b8231-6d08-46a5-88b2-0f85a39fbd93" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Court must not make a vexatious proceedings order in relation to a person without hearing the person or giving the person an opportunity of being heard.</txt></block></subclause><subclause id="sec.6-ssec.5" guid="_94715d5c-deca-45bb-b8aa-3b562cd2aa5c" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">For <intref refid="sec.6-ssec.1" target.guid="_7bd22777-30ce-4db8-9f3c-71c873aa6fc6" check="valid">subsection&#160;(1)</intref>, the Court may have regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.5-para1.a" guid="_ed67c07e-90b3-412c-aa5d-089e17c6fa3d" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">proceedings instituted or conducted in any Australian court or tribunal, including proceedings instituted or conducted before the commencement of this section; and</txt></block></li><li id="sec.6-ssec.5-para1.b" guid="_54ba2601-6fe8-4d67-8782-e86dac880f2d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">orders made by any Australian court or tribunal, including orders made before the commencement of this section.</txt></block></li></list></block></subclause></clause><clause id="sec.7" guid="_4e4a00e4-18ec-4973-8c6a-72dc10170d7e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_9fabeed7-9d08-43ae-982c-cce4a0d78df4">Order may be varied or set aside</heading><subclause id="sec.7-ssec.1" guid="_0e26057e-31df-4aa0-98d0-b88e1b7c241d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Court may, by order, vary or set aside a vexatious proceedings order.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_2faa29a9-c696-47db-8577-073459484704" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Court may make the order on its own initiative or on the application of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-para1.a" guid="_3fcd7bf4-76aa-4406-95f2-ffbf166e12cb" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the person subject to the vexatious proceedings order; or</txt></block></li><li id="sec.7-ssec.2-para1.b" guid="_f1b992c7-2f0f-40ef-8639-e5b4ed5063c6" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a person mentioned in <intref refid="sec.5" target.guid="_124d7625-d657-4191-993e-94598038c956" check="valid">section&#160;5</intref><intref refid="sec.5-ssec.1" target.guid="_9dc14bcf-53b0-4b7d-9a2d-38ca5bfeaf0f" check="valid">(1)</intref>.</txt></block></li></list></block></subclause></clause><clause id="sec.8" guid="_aa5f3559-ca5d-43da-b24b-4c1c2a944a85" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_7618d5ec-c03f-4c55-a2f6-aa2ddbf5226b">Order may be reinstated</heading><subclause id="sec.8-ssec.1" guid="_a8cd44bb-22b8-4c67-9f9f-ba62a08d2249" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_19b71570-d48b-4fbe-928b-a7040d3ec3e4" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the Court sets aside a vexatious proceedings order prohibiting a person from instituting proceedings, or proceedings of a particular type, in Queensland; and</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_d1d47926-5e3d-4d20-9b0a-2ec5bcbd59e3" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the Court is satisfied that, within 5 years of the vexatious proceedings order being set aside—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.b-para2.i" guid="_28a21a8c-f923-4ccf-908a-89977f4505d5" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the person has instituted or conducted a vexatious proceeding in an Australian court or tribunal; or</txt></block></li><li id="sec.8-ssec.1-para1.b-para2.ii" guid="_0d7e0a2c-1541-4be0-b2cf-86f4c0989e1d" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the person has acted in concert with another person who has instituted or conducted a vexatious proceeding in an Australian court or tribunal.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_4bd092c8-a19c-461f-8f80-e652be973668" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Court may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.a" guid="_d80c7996-500b-4bc0-ae45-860d4e90b9fb" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">by order, reinstate the vexatious proceedings order; and</txt></block></li><li id="sec.8-ssec.2-para1.b" guid="_81ef3222-d20c-430b-9a53-da2a22851178" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">make any other order the Court considers appropriate in relation to the person, including, for example, an order varying the vexatious proceedings order.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.3" guid="_b45b0070-d8a4-48a4-9f81-f1219b1e6c10" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Court may make an order under <intref refid="sec.8-ssec.2" target.guid="_4bd092c8-a19c-461f-8f80-e652be973668" check="valid">subsection&#160;(2)</intref> on its own initiative or on the application of a person mentioned in <intref refid="sec.5" target.guid="_124d7625-d657-4191-993e-94598038c956" check="valid">section&#160;5</intref><intref refid="sec.5-ssec.1" target.guid="_9dc14bcf-53b0-4b7d-9a2d-38ca5bfeaf0f" check="valid">(1)</intref>.</txt></block></subclause><subclause id="sec.8-ssec.4" guid="_49169dfd-29e4-43c4-9027-f6e7abc5cac6" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Court must not reinstate a vexatious proceedings order in relation to a person without hearing the person or giving the person an opportunity of being heard.</txt></block></subclause></clause><clause id="sec.9" guid="_4cad9fc7-8997-46db-b8c0-3429c306b2ce" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_98399c46-4927-4ee5-97f6-1f7df6b1fbd9">Notification and register of orders</heading><subclause id="sec.9-ssec.1" guid="_b9341612-1d74-4aee-a5ea-b7c6c78c33c3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_04e7c936-25da-4bd3-a55f-687fa7042745" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a vexatious proceedings order; or</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_26d84eaa-6964-457b-82a3-8c8e060bc8b0" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">an order varying or setting aside a vexatious proceedings order; or</txt></block></li><li id="sec.9-ssec.1-para1.c" guid="_77762520-4b1a-420d-8d31-37e64c827686" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">an order reinstating a vexatious proceedings order; or</txt></block></li><li id="sec.9-ssec.1-para1.d" guid="_c3ba4e8e-470a-404a-bdff-71d0c053da41" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">an order made under <intref refid="sec.8" target.guid="_aa5f3559-ca5d-43da-b24b-4c1c2a944a85" check="valid">section&#160;8</intref><intref refid="sec.8-ssec.2" target.guid="_4bd092c8-a19c-461f-8f80-e652be973668" check="valid">(2)</intref><intref refid="sec.8-ssec.2-para1.b" target.guid="_81ef3222-d20c-430b-9a53-da2a22851178" check="valid">(b)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_88318bd9-539b-4dcc-993f-5a756a29cebb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The registrar of the Court must arrange for a copy of the order to be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_41a33e47-4119-4ecc-bc03-8b2f820b4997" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">published in the gazette within 14 days after the order is made; and</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_a8e5a3c0-9780-45e4-bfbb-52d2e4dfdc60" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">entered in a publicly available register kept for the purposes of this Act in the registry of the Court at Brisbane within 7 days after the order is made.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_8a0c56ae-ecd8-4acb-b38e-fe33bc6f5b13" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The registrar of the Court may also arrange for details of the order to be published in another way.</txt><note id="sec.9-ssec.3-note" guid="_8cf0ce18-0c57-4330-ab38-0d0a2e1233c7" type="example"><heading id="sec.9-ssec.3-note-he" guid="_42dc91ec-e4c5-4d7f-9b73-1b06f086de68">Example—</heading><block><txt break.before="1">publication on the Court’s website</txt></block></note></block></subclause><subclause id="sec.9-ssec.4" guid="_968f7a6a-3cac-4036-b3a6-24d73c3605ae" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The registrar of the Court may remove a copy of an order from the register mentioned in <intref refid="sec.9-ssec.2" target.guid="_88318bd9-539b-4dcc-993f-5a756a29cebb" check="valid">subsection&#160;(2)</intref><intref refid="sec.9-ssec.2-para1.b" target.guid="_a8e5a3c0-9780-45e4-bfbb-52d2e4dfdc60" check="valid">(b)</intref> if the registrar is satisfied that the person in relation to whom the order was made has died.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;9</b> affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the Court makes a vexatious proceedings order prohibiting a person from instituting proceedings, or proceedings of a particular type, in Queensland—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_7e166a88-ec3a-42c1-9fbd-52f4f4ad1811" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the person may not institute proceedings, or proceedings of the particular type, in Queensland without the leave of the Court under <intref refid="sec.13" target.guid="_4ac2f196-3a46-438e-a1b3-abe1f81f9413" check="valid">section&#160;13</intref>; and</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_cb3ca069-a3ee-4c3e-8625-c647093a3508" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">another person may not, acting in concert with the person, order prohibiting the person from instituting proceedings, or proceedings of a particular type, in Queensland; or</txt></block></li><li id="sec.11-ssec.1-para1.b" guid="_599207bf-30f5-4c5c-9a28-951f4b87a558" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">acting in concert with another person who is subject to an order mentioned in <intref refid="sec.11-ssec.1-para1.a" target.guid="_62769b66-bda6-4307-9ca5-92c3a6a032d4" check="valid">paragraph&#160;(a)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.2" guid="_f4fdf332-0d50-40c8-920c-435025a44ccc" affected.by.uncommenced="0" target.version.series="241eda00-248b-4065-bddc-0ad3c401de03" check="valid"><name emphasis="yes">Vexatious Litigants Act 1981</name></legref>, <legref jurisd="QLD" type="act" refid="sec.8" target.doc.id="act-1981-035" target.version.series="241eda00-248b-4065-bddc-0ad3c401de03" check="invalid">section&#160;8</legref> or <legref jurisd="QLD" type="act" refid="sec.9" target.doc.id="act-1981-035" target.version.series="241eda00-248b-4065-bddc-0ad3c401de03" check="invalid">9</legref>; and</txt></block></li></list></block></li><li id="sec.11-ssec.3-para1.b" guid="_1eb8e6af-ec61-41e9-8244-c152108f8e85" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">lists all other proceedings the applicant has instituted in Australia, including proceedings instituted before the commencement of this section; and</txt></block></li><li id="sec.11-ssec.3-para1.c" guid="_d6baa6ee-a5e1-422f-a874-7a74dff35caa" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">discloses all facts material to the application, whether supporting or adverse to the application, that are refid="sec.11" target.guid="_c4ea5a1b-f378-4e21-9875-cfe6a6c67ad0" check="valid">section&#160;11</intref><intref refid="sec.11-ssec.3" target.guid="_8d38114e-243e-447f-816a-181c96193cb3" check="valid">(3)</intref>; or</txt></block></li><li id="sec.12-ssec.1-para1.b" guid="_dbb305d0-6a01-454f-8085-04e46d459648" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt Court considers an oral hearing is necessary—even if the applicant does not appear at the hearing.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.3" provision.type="other"><no>(1)</no><block><txt break.before="0">Before the Court grants an application made under <intref refid="sec.11" target.guid="_c4ea5a1b-f378-4e21-9875-cfe6a6c67ad0" check="valid">section&#160;11</intref> for leave to institute a proceeding, it must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.a" guid="_398778f5-42e2-4703-b32b-bf5b3a7dc84c" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">order that the applicant serve each relevant person with a copy of the application and affidavit and a notice that the person is entitled to appear and be heard on the application; and</txt></block></li><li id="sec.13-ssec.1-para1.b" guid="_5cba7c19-06b6-4506-9d8a-93c90a4429ff" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">give the applicant and each relevant person, on appearance, an opportunity to be heard at the hearing of the application.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.2" guid="_8d826b16-49d8-4ec1-84e3-2892d94e1216" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">At the hearing of the application, the Court may receive as evidence any record of evidence given, or affidavit filed, in any proceeding in any Australian court or tribunal in which the applicant is, or at any time was, involved either as a party or as a person acting in concert with a party.</txt></block></subclause><subclause id="sec.13-ssec.3" guid="_a085540c-8849-4955-84c2-1d98ca89573b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Court may grant leave to institute a particular proceeding or a proceeding of a particular type (the <defterm id="sec.13-def.proceeding" guid="_07c24d05-f7ae-4a10-952e-9f1651f71d0e" type="definition">proceeding</defterm>), subject to the conditions the Court considers appropriate.</txt></block></subclause><subclause id="sec.13-ssec.4" guid="_15440112-d4da-4bcd-8f28-8a19aa560131" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, the Court may grant leave only if it is satisfied that guid="_94555004-7ed7-434a-84c1-dc797f6021ae" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the person against whom the applicant proposes to institute the proceeding;</txt></block></li><li id="sec.13-ssec.5-def.relevantperson-para1.b" guid="_80c8f52c-3aad-438d-adf9-5e5c81c6b967" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the Attorney-General;</txt></block></li><li id="sec.13-ssec.5-def.relevantperson-para1.c" guid="_7700eb50-e109-4da0-b23b-1f1c161bdb21" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the Crown solicitor;</txt></block></li><li id="sec.13-ssec.5-def.relevantperson-para1.d" guid="_5cdd9ed7-bc11-4c1b-b15d-41c087a1c702" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the registrar of the Court if the registrar applied for a vexatious proceedings order in relation to the applicant;</txt></block></li><li id="sec.13-ssec.5-def.relevantperson-para1.e" guid="_dfb29be8-8c5b-41a1-992c-48ceffb7ac1b" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">any person mentioned in <intref refid="sec.5" target.guid="_124d7625-d657-4191-993e-94598038c956" check="valid">section&#160;5</intref><intref refid="sec.5-ssec.1" target.guid="_9dc14bcf-53b0-4b7d-9a2d-38ca5bfeaf0f" check="valid">(1)</intref><intref refid="sec.5-ssec.1-para1.d" target.guid="_bb9c91fb-a8b7-4aba-9429-9ec653dcc3c9" check="valid">(d)</intref> or <intref refid="sec.5-ssec.1-para1.e" target.guid="_ea6e6d13-736b-4701-976b-be2dbdade75a" check="valid">(e)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.5-def.relevantperson-para1.e-para2.i" guid="_a602bf15-98f9-40a7-a3cd-17f25900e039" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">who, with the leave of the Court, applied for a vexatious proceedings order in relation to the applicant; and</txt></block></li><li id="sec.13-ssec.5-def.relevantperson-para1.e-para2.ii" guid="_d427462e-b99a-4210-9640-59b9df1f0173" provision.type="other" commencement</heading><subclause id="sec.15-ssec.1" guid="_43607393-e924-4b01-8588-6ee14f1eb825" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.1-para1.a" guid="_552b9047-1a7b-4638-aff2-72d724244552" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">an application has been made under the repealed Act; and</txt></block></li><li id="sec.15-ssec.1-para1.b" guid="_86384110-47f0-4e33-ad4a-b8ee59f18c32" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">immediately before the commencement, the application has not provision.type="other"><no>(2)</no><block><txt break.before="0">The repealed Act continues to apply in relation to deciding the application as if the <legref jurisd="QLD" type="act" target.doc.id="act-2005-044" target.version.series="0d369fef-5cdf-4cee-89eb-5dd8a699bbca" check="valid"><name emphasis="yes">Vexatious Proceedings Act 2005</name></legref> had not been enacted.</txt></block></subclause></clause><clause id="sec.16" guid="_a8a04c2f-c9e1-4c8b-8e62-12baeb71130d" affected.by.uncommenced="0" spent.amends="0" provision.type="transitional"><no>16</no><heading id="sec.16-he" guid="_938b85dd-df5b-485e-8fa7-e145facf9c93">Orders under repealed Act taken to be orders under this Act</heading><subclause id="sec.16-ssec.1" guid="_b7c9aa12-4ebd-4f56-9286-b570025296ea" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An order under section&#160;3 of the repealed Act that is in force immediately before the commencement is taken to be a vexatious proceedings order for the purposes of this Act.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_7ce67c02-b71d-4da8-9a04-f6631916004e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An order under section&#160;3 of the repealed Act that is made or reinstated on or after the commencement because of section&#160;15 is taken to be a vexatious proceedings order for the purposes of this Act.</txt><note id="sec.16-ssec.2-note"
