emphasis="yes">Parliamentary Service By-law 2023</name></legref>.</txt></block></clause><clause id="sec.2" guid="_50612ef6-5741-486c-921f-5d74ff74aedb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_db13970c-59cc-4658-99e2-496d70aeafa3">Purpose of by-law</heading><block><txt break.before="1">The purpose of this by-law is to give directions under <legref refid="sec.50" target.doc.id="act-1988-067" target.version.series="f62b43a2-ddde-45f8-ad12-f4b23dc21f97" target.guid="_e39f789c-51e5-4535-8321-e0c04adb0e92" check="valid" jurisd="QLD" type="act">section&#160;50</legref> of the <legref target.doc.id="act-1988-067" target.version.series="f62b43a2-ddde-45f8-ad12-f4b23dc21f97" check="valid" jurisd="QLD" type="act">Act</legref> by prescribing behaviour and conduct for persons entering or on the parliamentary precinct.</txt><note id="sec.2-note" guid="_f20e94c8-dbf0-454a-82af-8e95ec5243a0" type="example"><heading id="sec.2-note-he" guid="_6f8e491e-1139-476d-ba56-4ee571f29817">Notes—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.2-note-para1.1" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_2b1198c2-f28d-4cf9-ab0b-02993316247f">Authorisation of directions by authorised officers</heading><subclause id="sec.4-ssec.1" guid="_6163cf72-5a4e-46d7-a42a-f6a5a6048c9e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An authorised officer may give a direction under this by-law that is not inconsistent with directions given by the Speaker under <legref refid="sec.50" target.doc.id="act-1988-067" target.version.series="f62b43a2-ddde-45f8-ad12-f4b23dc21f97" target.guid="_e39f789c-51e5-4535-8321-e0c04adb0e92" check="valid" jurisd="QLD" type="act">section&#160;50</legref> of the <legref target.doc.id="act-1988-067" target.version.series="f62b43a2-ddde-45f8-ad12-f4b23dc21f97" check="valid" jurisd="QLD" type="act">Act</legref> (including by this by-law).</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_841c6416-bea6-4e69-8414-cf82d4334b62">Behaviour and conduct</heading><clause id="sec.5" guid="_533236d6-56ad-4f5e-b540-52b28e41faad" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_2da40f50-dc48-4d76-b847-653894f05ee3">Entry pass and identification</heading><subclause id="sec.5-ssec.1" guid="_62c37bf1-b62e-48bb-8864-117747746762" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person must, if directed by an authorised officer, wear an entry pass issued to the person by the authorised officer while the person is on the parliamentary precinct.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_669d227b-8b94-4e11-b170-8254b506b631" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person entering or on the parliamentary precinct must, if directed by an authorised officer—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_c115cfb5-59c8-4710-8254-9852db8b0670" provision.type="other"><no>(a)</no><block><txt break.before="0">give the authorised officer the information, including the person’s name, address and phone number, the authorised officer needs to issue an entry pass to the person; and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_a0753e55-c201-46db-9154-b662454a200a" provision.type="other"><no>(b)</no><block><txt break.before="0">produce photographic identification to the authorised officer to verify the person’s identity as shown, or to be shown, on an entry pass issued to the person.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_f2c28011-e1e2-4e53-90be-68bc5c0fa340" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person entering or on the parliamentary precinct must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_c53f4e35-18a6-4641-86fe-d248deee242a" provision.type="other"><no>(a)</no><block><txt break.before="0">give information under <intref refid="sec.5-ssec.2" target.guid="_669d227b-8b94-4e11-b170-8254b506b631" check="valid">subsection&#160;(2)</intref><intref refid="sec.5-ssec.2-para1.a" target.guid="_c115cfb5-59c8-4710-8254-9852db8b0670" check="valid">(a)</intref> that is false; or</txt></block></li><li id="sec.5-ssec.3-para1.b" guid="_657246f6-c1bb-4ab9-b093-b2f2bf557f94" provision.type="other"><no>(b)</no><block><txt break.before="0">give an entry pass issued to the person to another person who is not an authorised officer.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.4" guid="_2bf2c4b6-f766-4abf-b289-9e8a7dd59355" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A person who is issued an entry pass must, when leaving the parliamentary precinct—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.4-para1.a" guid="_b867bdd1-ee77-40cc-a3b6-53ad4801de01" provision.type="other"><no>(a)</no><block><txt break.before="0">return the entry pass to an authorised officer; or </txt></block></li><li id="sec.5-ssec.4-para1.b" guid="_a6772edd-bf6d-47fc-97da-d53a78a59bef" provision.type="other"><no>(b)</no><block><txt break.before="0">if returning the entry pass is not practicable—notify an authorised officer that the person is leaving the parliamentary precinct.</txt></block></li></list></block></subclause></clause><clause id="sec.6" guid="_8a870c73-650e-4676-88f4-9fc9ea84d4ea" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_d1457f51-b159-43a5-81fb-ebc3df5ab308">Using someone else’s entry pass or identity card prohibited</heading><subclause id="sec.6-ssec.1" guid="_c67954bc-ccf1-4de4-bbb7-4e3942ba9d2f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person must not enter, or attempt to enter, the parliamentary precinct using—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_618d78ec-4a32-456c-9dd8-f56a7020db7e" provision.type="other"><no>(a)</no><block><txt break.before="0">an entry pass issued to someone else; or</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_8a6f3895-d8f5-43f1-966d-861c2f338445" provision.type="other"><no>(b)</no><block><txt break.before="0">someone else’s parliamentary identity card.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_3149c4d3-0094-4ede-a572-450e34347248" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-ssec.2-def.parliamentaryidentitycard_" guid="_82208448-72a5-4620-907d-4b3a6690f76e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-ssec.2-def.parliamentaryidentitycard" guid="_53c113bf-91e6-4c9f-ac0b-25c7c432e086" type="definition">parliamentary identity card</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-def.parliamentaryidentitycard-para1.a" guid="_b0c6e5d8-ca53-4e06-92db-1b1748136277" provision.type="other"><no>(a)</no><block><txt break.before="0">an identity card issued to an authorised officer under <intref refid="sec.18" target.guid="_942c18da-37c1-4cbd-88cc-400b63898db5" check="valid">section&#160;18</intref>; or</txt></block></li><li id="sec.6-ssec.2-def.parliamentaryidentitycard-para1.b" guid="_de166353-2711-446f-88ba-1efa14bd2b1e" provision.type="other"><no>(b)</no><block><txt break.before="0">another identity card issued to a person for the purpose of, or whose purposes include, identifying the person as a person who may enter or be on the parliamentary precinct.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.7" guid="_15a6eec6-3aa6-40fc-a480-9d6346897e2b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_fd2d8f63-09ea-4fae-b4f8-7d5c668c4258">Scanning and searching</heading><subclause id="sec.7-ssec.1" guid="_3f68d4cb-545d-4884-ba84-3141647841c8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person entering the parliamentary precinct must, if directed by an authorised officer, do 1 or more of the following things—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_05588251-818f-4027-8c91-534593f870ea" provision.type="other"><no>(a)</no><block><txt break.before="0">walk through a walk-through detector;</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_22757227-dabe-4801-b880-c356017723e1" provision.type="other"><no>(b)</no><block><txt break.before="0">pass the person’s belongings through an X-ray machine;</txt></block></li><li id="sec.7-ssec.1-para1.c" guid="_1faeed31-a343-4d8f-bd70-a2bfa04b3a53" provision.type="other"><no>(c)</no><block><txt break.before="0">allow the authorised officer to pass a handheld scanner in close proximity to the person;</txt></block></li><li id="sec.7-ssec.1-para1.d" guid="_2e2187bf-593b-497a-a4e3-58d676b71822" provision.type="other"><no>(d)</no><block><txt break.before="0">allow the authorised officer to pass a handheld scanner in close proximity to the person’s belongings.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_5135184c-2766-4612-8aa3-7e60cf0c41ae" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person entering the parliamentary precinct must, if directed by an authorised officer, do 1 or more of the following things—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-para1.a" guid="_e2c94a2d-0b44-401f-b763-3ab86cd4471d" provision.type="other"><no>(a)</no><block><txt break.before="0">allow the authorised officer to inspect the person’s belongings;</txt></block></li><li id="sec.7-ssec.2-para1.b" guid="_a5882020-519e-4f68-a294-ac562d04d4a7" provision.type="other"><no>(b)</no><block><txt break.before="0">remove 1 or more outer garments worn by the person as specified by the authorised officer and allow the officer to inspect the garments; </txt></block></li><li id="sec.7-ssec.2-para1.c" guid="_b6f5a9d4-b42b-4e6c-8a4c-cfea22b71c23" provision.type="other"><no>(c)</no><block><txt break.before="0">remove all articles from the person’s clothing and allow the authorised officer to inspect them;</txt></block></li><li id="sec.7-ssec.2-para1.d" guid="_677e0a41-542f-47de-a94e-b2307b8b9dd0" provision.type="other"><no>(d)</no><block><txt break.before="0">open an article for inspection and allow the authorised officer to inspect it;</txt></block></li><li id="sec.7-ssec.2-para1.e" guid="_3b9afcc9-686b-44f3-b780-fced9b1e1d56" provision.type="other"><no>(e)</no><block><txt break.before="0">allow the officer, or another authorised officer, to touch a garment the person is wearing to the extent it is necessary to help the officer decide if the person is concealing a restricted item.</txt></block></li></list><note id="sec.7-ssec.2-note" guid="_d6cdd901-82a1-4d6b-bb69-a71f29259800" type="example"><heading id="sec.7-ssec.2-note-he" guid="_538fd798-d4b4-4137-8d39-eb18c2b7147c">Note—</heading><block><txt break.before="1">See <intref refid="sec.17" target.guid="_bd731289-8cef-4828-8e4d-812cd77f4447" check="valid">section&#160;17</intref> in relation to an authorised officer doing a thing mentioned in this subsection.</txt></block></note></block></subclause><subclause id="sec.7-ssec.3" guid="_99b09b27-6b93-4505-840d-f99740ef8001" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">An authorised officer giving a direction under <intref refid="sec.7-ssec.2" target.guid="_5135184c-2766-4612-8aa3-7e60cf0c41ae" check="valid">subsection&#160;(2)</intref><intref refid="sec.7-ssec.2-para1.e" target.guid="_3b9afcc9-686b-44f3-b780-fced9b1e1d56" check="valid">(e)</intref> must ensure, as far as reasonably practicable, the authorised officer who is to touch the person’s garment is of the same sex as the person.</txt></block></subclause><subclause id="sec.7-ssec.4" guid="_0ae8ca46-f360-47cc-b654-5378e922ccc4" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A person entering the parliamentary precinct must not engage in behaviour or conduct directed at avoiding a direction being given to the person under <intref refid="sec.7-ssec.1" target.guid="_3f68d4cb-545d-4884-ba84-3141647841c8" check="valid">subsection&#160;(1)</intref> or <intref refid="sec.7-ssec.2" target.guid="_5135184c-2766-4612-8aa3-7e60cf0c41ae" check="valid">(2)</intref>.</txt></block></subclause><subclause id="sec.7-ssec.5" guid="_5f9bbc86-0e4a-4432-9500-d7376b58d578" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.7-ssec.5-def.handheldscanner_" guid="_c763fa38-75b1-4396-b121-ea8f78d60619" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.5-def.handheldscanner" guid="_ce664cde-9ab8-4d3c-9a3f-85544fdfa16b" type="definition">handheld scanner</defterm> means a device that may be passed over or around a person or a person’s belongings to detect metal or other substances.</txt></definition><definition id="sec.7-ssec.5-def.inspect_" guid="_4cc26c17-0914-4a72-be5c-25faa9a92cb7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.5-def.inspect" guid="_9f0a5e84-99d4-42eb-a34e-35167e7f18ef" type="definition">inspect</defterm>, an article, includes handle the article, open it and examine its contents.</txt></definition><definition id="sec.7-ssec.5-def.walkthroughdetector_" guid="_966a2a39-197a-481d-9a6b-08f0bb3de44b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.5-def.walkthroughdetector" guid="_28b0e656-26cb-42af-ba11-6e4d3dde3a4e" type="definition">walk-through detector</defterm> means a device through which a person walks, that detects metal or other substances.</txt></definition><definition id="sec.7-ssec.5-def.Xraymachine_" guid="_29bdeceb-54f5-49d6-9872-857bf1f7ae8b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.5-def.Xraymachine" guid="_2c723b4c-7d90-4de1-9d26-6778f1a3264a" type="definition">X-ray machine</defterm> means a device through which a person’s belongings are passed and X-rayed.</txt></definition></deflist></block></subclause></clause><clause id="sec.8" guid="_3265a0b9-3d8b-4fbe-9a95-a9c9201876da" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_07e52498-526e-4068-8b65-f25adc5438e2">Restricted items</heading><block><txt break.before="1">A person must not, without the permission of the Speaker or an authorised officer, bring a restricted item on to the parliamentary precinct, or have a restricted item in the person’s possession on the parliamentary precinct.</txt></block></clause><clause id="sec.9" guid="_18c5a0ba-211b-4e8b-831a-6031fe42b900" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_7ca64d93-c454-42a1-9401-63e1cfe461cc">Leaving items in custody of authorised officer</heading><subclause id="sec.9-ssec.1" guid="_aa07fac9-2172-4cda-8f84-a4ded14aec68" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person entering the parliamentary precinct or a part of the parliamentary precinct must, if directed by an authorised officer, place a prescribed item in the temporary custody of the authorised officer while the person is on the parliamentary precinct or the part of the parliamentary precinct.</txt><note id="sec.9-ssec.1-note" guid="_180adbbf-8834-4b39-ad5e-89e68d3fa90a" type="example"><heading id="sec.9-ssec.1-note-he" guid="_346c4197-4d59-436f-85f3-484bb06b281d">Examples of a part of the parliamentary precinct—</heading><block><txt break.before="1">galleries of the Legislative Assembly chamber, a room where a committee of the Legislative Assembly is meeting</txt></block></note></block></subclause><subclause id="sec.9-ssec.2" guid="_1df13345-9133-4a55-9cfd-1400dc515e09" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.9-ssec.2-def.personalrecordingdevice_" guid="_7966c30c-2926-463e-8eb4-8cb43e9a744f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.2-def.personalrecordingdevice" guid="_b1d9627d-d3a8-4166-8929-74c2d4f4d2a6" type="definition">personal recording device</defterm> means a mobile phone, camera or other device ordinarily intended for personal use that is capable of recording audio or capturing images.</txt></definition><definition id="sec.9-ssec.2-def.prescribeditem_" guid="_9e36f164-7125-4f38-9216-002778e567ab" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.2-def.prescribeditem" guid="_9eeae8c9-34b1-4a84-a20d-a93fcdf0d0a7" type="definition">prescribed item</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-def.prescribeditem-para1.a" guid="_c5c623e8-6060-4be8-a673-1cff457a2f1e" provision.type="other"><no>(a)</no><block><txt break.before="0">any baggage or bulky object the person is carrying; or</txt></block></li><li id="sec.9-ssec.2-def.prescribeditem-para1.b" guid="_6e338150-c0df-43a1-bb6f-93dd091b8365" provision.type="other"><no>(b)</no><block><txt break.before="0">a badge, banner, sign or other thing that displays a political statement; or</txt><note id="sec.9-ssec.2-def.prescribeditem-para1.b-note" guid="_c7229b7f-81ab-48fc-8baf-b8fb49a640fd" type="example"><heading id="sec.9-ssec.2-def.prescribeditem-para1.b-note-he" guid="_fb746388-f1fa-4833-abaf-8225b94a28c9">Example of other thing—</heading><block><txt break.before="1">item of clothing</txt></block></note></block></li><li id="sec.9-ssec.2-def.prescribeditem-para1.c" guid="_772668a0-55dc-4d02-9a97-ac65db1f79a9" provision.type="other"><no>(c)</no><block><txt break.before="0">a personal recording device; or</txt></block></li><li id="sec.9-ssec.2-def.prescribeditem-para1.d" guid="_427c85be-65de-491a-af91-76a5910a5660" provision.type="other"><no>(d)</no><block><txt break.before="0">anything else the authorised officer considers should be left in temporary custody.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.10" guid="_4cae6514-74cb-46d6-89a1-21094e0f022e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_fe57d6e1-d0f8-414f-99ee-6c9e0ef21288">Covering or obscuring political statements on clothing</heading><subclause id="sec.10-ssec.1" guid="_6f593aaf-f7a3-4ce0-8c20-b25d0e65caf7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a person entering the parliamentary precinct—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_4f869db9-f449-4f12-848e-3a322f861c02" provision.type="other"><no>(a)</no><block><txt break.before="0">is wearing an item of clothing that displays a political statement; and</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_665d04bc-e2fb-4da2-b405-5c16a29975b9" provision.type="other"><no>(b)</no><block><txt break.before="0">it is not reasonably practicable for the person to place the item of clothing in the temporary custody of an authorised officer under <intref refid="sec.9" target.guid="_18c5a0ba-211b-4e8b-831a-6031fe42b900" check="valid">section&#160;9</intref>.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_9486c0ab-1750-4cd2-a70f-429c86ee46c0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The person must, if directed by an authorised officer, cover or obscure the political statement and not uncover or reveal the political statement at any time while the person is on the parliamentary precinct. </txt></block></subclause></clause><clause id="sec.11" of political statements and other matters restricted</heading><block><txt break.before="0">A person on the parliamentary precinct must not, without the permission of the Speaker or an authorised officer— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-para1.a" guid="_b3fc4ef0-1a0e-47a3-8c0e-0f015cc8741c" provision.type="other"><no>(a)</no><block><txt break.before="0">display a political statement on a banner, sign or other thing; or</txt></block></li><li id="sec.11-para1.b" guid="_3859032f-af6d-470b-97da-78d58482c4a0" provision.type="other"><no>(b)</no><block><txt break.before="0">attach a banner, sign or other thing displaying a political statement or other matter to a building, fence or other structure on the parliamentary precinct.</txt></block></li></list><note id="sec.11-note" guid="_a75adaf9-d611-4709-888d-08065967cd6e" type="example"><heading id="sec.11-note-he" guid="_f6879a1a-dc2d-4097-9f67-0cb6fd284f25">Example of other thing—</heading><block><txt break.before="1">item of clothing</txt></block></note></block></clause><clause id="sec.12" guid="_5788972c-ea2f-4b4f-ac6b-56a9da562e45" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_c295f7af-f521-40e4-9c4f-033a35c97356">Vehicle use restricted</heading><subclause id="sec.12-ssec.1" guid="_91a3ce94-908a-4d0c-a845-f41233a31bb0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person must not, without the permission of the Speaker or an authorised officer, drive or park a vehicle on the parliamentary precinct.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_73c5a259-106e-4ef6-83e6-c2e2ca91ab5f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person must not drive or park a vehicle on an area of the parliamentary precinct in a way contrary to a notice that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_e760fe30-5377-409b-9ed0-ba0c21305e26" provision.type="other"><no>(a)</no><block><txt break.before="0">is located with reasonable prominence at or near the area; and</txt></block></li><li id="sec.12-ssec.2-para1.b" guid="_7f1c927d-18ed-45cc-a18c-5b198761655b" provision.type="other"><no>(b)</no><block><txt break.before="0">placed, or purportedly placed, by or under the authority of the Speaker or the Clerk.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.3" guid="_5590713c-34d8-44b4-bb2f-0eec760105de" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person driving or parking a vehicle on the parliamentary precinct must comply with any direction given to the person by an authorised guid="_4292f8d6-119e-45e5-a6cc-f2fce02586fe" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person must not, without the permission of the Speaker or an authorised officer, enter a restricted part of the parliamentary precinct.</txt></block></subclause><subclause id="sec.13-ssec.2" guid="_9cf0ce24-9fde-4a2b-8383-1743a939dbbd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.13-ssec.2-def.restrictedpart_" guid="_fd21b938-cc49-420e-b1d8-b41515b20c58" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.13-ssec.2-def.restrictedpart" guid="_da68332c-c037-438b-8c33-58289f02a8c4" type="definition">restricted part</defterm>, of the parliamentary precinct, means a part of the parliamentary precinct identified as a part to which entry is restricted to members of the Legislative Assembly or officers or employees of the parliamentary service by a notice placed, or purportedly placed, by or under the authority of the Speaker or the Clerk at or near the entry to the part.</txt></definition></deflist></block></subclause></clause><clause id="sec.14" guid="_fd6bf963-3779-4941-924e-5289d22573ce" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_895bbebd-235b-4192-ac7d-1a9b4d4d7ae0">Damage to property</heading><block><txt break.before="0">A person must not vandalise or otherwise damage—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-para1.a" guid="_8f3dba0c-2326-451b-bd78-f53a4709310f" provision.type="other"><no>(a)</no><block><txt break.before="0">a building forming part of the parliamentary precinct; or</txt></block></li><li id="sec.14-para1.b" guid="_8bbc1888-c6e5-4bb9-9ca6-fbef480d3799" provision.type="other"><no>(b)</no><block><txt break.before="0">other property within the parliamentary precinct for which the parliamentary service has administrative responsibility.</txt></block></li></list></block></clause><clause id="sec.15" guid="_61025b91-9fed-49a3-a869-564540471824" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_cc2c89d9-5621-4178-b0b4-ccb682607f35">Person must not smoke on parliamentary precinct</heading><subclause id="sec.15-ssec.1" guid="_6df6e2b4-c14f-4c70-88df-0bfa9051143a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person must not smoke on the parliamentary precinct other than in a nominated outdoor smoking place.</txt></block></subclause><subclause id="sec.15-ssec.2" guid="_1d89b05b-db3f-413e-a126-31cda60b355b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person contravening <intref refid="sec.15-ssec.1" target.guid="_6df6e2b4-c14f-4c70-88df-0bfa9051143a" check="valid">subsection&#160;(1)</intref> must, if directed by an authorised officer, stop smoking.</txt></block></subclause><subclause id="sec.15-ssec.3" guid="_8faa4b83-4dc2-431b-a610-9770eea1046c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><definition id="sec.15-ssec.3-def.nominatedoutdoorsmokingplace_" guid="_e5ef991f-b33f-4f02-ac38-1391dfb67e57" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.15-ssec.3-def.nominatedoutdoorsmokingplace" guid="_5afb73b0-b4ac-4a23-81d8-50b9286e9e37" type="definition">nominated outdoor smoking place</defterm> means a clearly designated part of the parliamentary precinct—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.3-def.nominatedoutdoorsmokingplace-para1.a" guid="_9d196c9e-5c59-47dc-bacc-8fcefa7f94e1" provision.type="other"><no>(a)</no><block><txt break.before="0">where smoking is not prohibited under the <legref target.doc.id="act-1998-001" target.version.series="07dd98e5-90f8-44e4-b099-b79a2970057d" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Tobacco and Other Smoking Products Act 1998</name></legref>; and</txt></block></li><li id="sec.15-ssec.3-def.nominatedoutdoorsmokingplace-para1.b" guid="_b6e8a757-39dd-49e5-9516-c73b2463e9ca" provision.type="other"><no>(b)</no><block><txt break.before="0">established by the Speaker as an area where smoking is permitted.</txt></block></li></list></definition><definition id="sec.15-ssec.3-def.smoke_" guid="_4c643a36-c9b9-479e-971d-765d95a68050" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.15-ssec.3-def.smoke" guid="_38d90a77-683b-4f79-87de-c133c72bf3f0" type="definition">smoke</defterm> see the <legref check="invalid" jurisd="QLD" type="act"><name emphasis="yes">Tobacco and Other Smoking Products Act 1988</name></legref>.</txt></definition></block></subclause></clause><clause id="sec.16" guid="_b6c19638-c89e-4604-9922-5ef6ee6cf136" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_7fa84ba8-4585-43cb-93fc-46a7fb81e448">Other prohibited conduct or behaviour</heading><block><txt break.before="0">A person on the parliamentary precinct must not engage in behaviour or conduct that constitutes, or is likely to constitute—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-para1.a" guid="_71b34dce-4217-4050-8d4b-f349e47f145a" provision.type="other"><no>(a)</no><block><txt break.before="0">intimidation or harassment of a member of the Legislative Assembly or another person on the precinct; or</txt></block></li><li id="sec.16-para1.b" guid="_8b5e27e8-ab7b-4e0a-bf16-887b85fedebb" provision.type="other"><no>(b)</no><block><txt break.before="0">a danger to a person on the precinct; or</txt></block></li><li id="sec.16-para1.c" guid="_a611996c-a3d2-430f-8e68-be7748e8891d" provision.type="other"><no>(c)</no><block><txt break.before="0">a disruption of the proceedings of the Legislative Assembly or any of its committees.</txt></block></li></list></block></clause></part><part id="pt.3" guid="_0101d923-c9ea-448a-b90e-cb999c99ff6f" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_654a6fc2-8443-46ef-862a-478368d45795">Other provisions</heading><clause id="sec.17" guid="_bd731289-8cef-4828-8e4d-812cd77f4447" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_54b30273-57e3-497e-a092-807f790239c0">Safeguards for searching persons</heading><subclause id="sec.17-ssec.1" guid="_381aaa99-e1e4-460a-9c69-0599cb3c3a69" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An authorised officer doing a thing mentioned in <intref refid="sec.7" target.guid="_15a6eec6-3aa6-40fc-a480-9d6346897e2b" check="valid">section&#160;7</intref><intref refid="sec.7-ssec.2" target.guid="_5135184c-2766-4612-8aa3-7e60cf0c41ae" check="valid">(2)</intref> in relation to a person who is given a direction under that section must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.1-para1.a" guid="_0f83b344-5d8a-4aeb-8ea2-57d2def19cf4" provision.type="other"><no>(a)</no><block><txt break.before="0">ensure, as far as reasonably practicable, minimal embarrassment is caused to the person; and</txt></block></li><li id="sec.17-ssec.1-para1.b" guid="_b3e30123-c314-4726-9a1e-5ed10cf64a03" provision.type="other"><no>(b)</no><block><txt break.before="0">take reasonable care to protect the dignity of the person.</txt></block></li></list></block></subclause><subclause id="sec.17-ssec.2" guid="_e69d0770-c067-4495-b885-f2ee6c32c2f7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, if an authorised officer reasonably suspects it is necessary to protect the dignity of a person who is given a direction under <intref refid="sec.7" target.guid="_15a6eec6-3aa6-40fc-a480-9d6346897e2b" check="valid">section&#160;7</intref><intref refid="sec.7-ssec.2" target.guid="_5135184c-2766-4612-8aa3-7e60cf0c41ae" check="valid">(2)</intref> and it is reasonably practicable, the authorised officer may ask the person to allow an inspection of the person’s belongings under <intref refid="sec.7" target.guid="_15a6eec6-3aa6-40fc-a480-9d6346897e2b" check="valid">section&#160;7</intref><intref refid="sec.7-ssec.2" target.guid="_5135184c-2766-4612-8aa3-7e60cf0c41ae" check="valid">(2)</intref> to be conducted out of public view, for example, in a part of the parliamentary precinct.</txt></block></subclause></clause><clause id="sec.18" guid="_942c18da-37c1-4cbd-88cc-400b63898db5" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>18</no><heading id="sec.18-he" guid="_f80213f7-e6ea-474e-a785-3cc6729f7dd5">Identity card</heading><subclause id="sec.18-ssec.1" guid="_78f82923-1293-4299-9e05-e57fd9ce9e9f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Clerk may issue an authorised officer with an identity card, in a form approved by the Clerk, identifying the person as an authorised officer under this by-law.</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_ae516dfb-d8e3-4a04-9f40-286c6f80c053" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An authorised officer may act under this by-law in relation to a person only if the authorised officer has an identity card issued under <intref refid="sec.18-ssec.1" target.guid="_78f82923-1293-4299-9e05-e57fd9ce9e9f" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.18-ssec.3" guid="_9c81f14f-c2e0-4d2e-83da-81c81b6fdb39" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In acting under this by-law in relation to a person, an authorised officer must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.3-para1.a" guid="_f22694e4-fba8-489a-9f90-18593a167dac" provision.type="other"><no>(a)</no><block><txt break.before="0">produce the authorised officer’s identity card for the person’s inspection before acting; or</txt></block></li><li id="sec.18-ssec.3-para1.b" guid="_3daa7b4d-d59d-4417-b834-6cc7965fb58d" provision.type="other"><no>(b)</no><block><txt break.before="0">have the authorised officer’s identity card displayed so it is clearly visible to the person when acting.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.4" guid="_8ddf60b2-1964-4e6c-b8fe-57e906a324d9" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, if it is not practicable to comply with <intref refid="sec.18-ssec.3" target.guid="_9c81f14f-c2e0-4d2e-83da-81c81b6fdb39" check="valid">subsection&#160;(3)</intref>, the authorised officer must produce the identity card for the person’s inspection at the first reasonable opportunity.</txt></block></subclause><subclause id="sec.18-ssec.5" guid="_614f2b38-e693-4e23-b127-5c9fa809bd2b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If a person who is issued an identity card under this section stops being an authorised officer, the person must return the identity id="sch.1-def.politicalstatement_" guid="_98d59c1f-1536-4685-9179-842f9478c104" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.1-def.politicalstatement" guid="_4334f1b2-8825-478a-80b8-86973d7ac6f6" type="definition">political statement</defterm> means a statement or design that a reasonable person would associate with a political organisation, cause or belief.</txt></definition><definition id="sch.1-def.restricteditem_" guid="_3cc678c5-be98-43dc-b0ba-0d8d3abfab75" affected.by.uncommenced="0"><txt break.before="1"><defterm
