and</txt></block></li><li id="sec.3-para1.b" guid="_dd1b3eb9-875f-4f6b-92a4-891e805f7152" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">to promote Queensland as a unified, harmonious and inclusive community by establishing the multicultural charter; and</txt></block></li><li id="sec.3-para1.c" guid="_91b70de8-3c8e-41c3-9b22-226c89c3fb0e" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">to ensure services provided by government entities are responsive to the diversity of the people of Queensland by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.c-para2.i" guid="_8d6a3552-be8d-4987-b300-563f4e157d91" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">establishing the council; and</txt></block></li><li id="sec.3-para1.c-para2.ii" guid="_2cbc3835-930d-45a6-b7a7-b29bcb2c6b51" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">providing for the multicultural policy and multicultural action plan; and</txt></block></li><li id="sec.3-para1.c-para2.iii" guid="_01d36136-c53f-4e12-8e0d-844735e24beb" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">requiring that employees of government entities be made aware of the multicultural charter, multicultural policy and multicultural action plan; and</txt></block></li><li id="sec.3-para1.c-para2.iv" guid="_e7f57b4a-a5c7-419f-8993-ca6a5330d760" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">establishing reporting obligations for particular government entities.</txt></block></li></list></block></li></list></block></clause><clause id="sec.4" guid="_7f3a69f2-7298-4002-8707-3212888c6065" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_2f51287f-aa6a-4d43-ab75-2116ca26e165">Act binds all persons</heading><block><txt break.before="1">This Act binds all persons, including the State.</txt></block></clause><clause id="sec.5" guid="_ab378ddd-b9aa-4e55-8204-b1da82ba251d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_494550ae-ccdd-47fa-8af2-3f99dcda9040">Definitions</heading><block><txt break.before="1">In this Act—</txt><deflist><definition id="sec.5-def.chiefexecutive_" guid="_d25a8d0b-20b8-46de-9b70-81ba1e34ef5c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.chiefexecutive" guid="_a1173ded-e514-477f-ba0b-ee0a6926333b" type="definition">chief executive</defterm>, of a government entity, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-def.chiefexecutive-para1.a" guid="_f17f2bd9-23f6-4957-a74c-7a866d3e5a97" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for a department—the chief executive in relation to the department under the <legref jurisd="QLD" type="act" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid"><name emphasis="yes">Public Sector Act 2022</name></legref>, <legref jurisd="QLD" type="act" refid="sec.10" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" target.guid="_e8950546-95a6-4454-8984-ca810911ce72" check="valid">section&#160;16(a)</legref>; or</txt></block></li><li id="sec.5-def.chiefexecutive-para1.b" guid="_4aabb0ce-ff02-46b8-a44b-767df53e2660" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for a public service entity mentioned in the <legref jurisd="QLD" type="act" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid"><name emphasis="yes">Public Sector Act 2022</name></legref>, <legref jurisd="QLD" type="act" refid="sec.9" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="invalid">section&#160;9</legref><legref jurisd="QLD" type="act" refid="sec.9-para1.b" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="invalid">(b)</legref>—the head of the entity mentioned in the <legref jurisd="QLD" type="act" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid"><name emphasis="yes">Public Sector Act 2022</name></legref>, <legref jurisd="QLD" type="act" refid="sch.1" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="invalid">schedule&#160;1</legref>; or</txt></block></li><li id="sec.5-def.chiefexecutive-para1.c" guid="_3b0c7e3a-1b0a-4899-999d-65634eec975a" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">for a registry or other administrative office of a court or tribunal—the chief executive of the department in which is administered the legislation under which the court or tribunal is established; or</txt></block></li><li id="sec.5-def.chiefexecutive-para1.d" guid="_39a546f7-e057-4159-955d-c36ba4e6ab90" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">for another entity—the person responsible for the management of the entity.</txt></block></li></list><historynote><txt break.before="1"><b>s&#160;5</b> def <defterm guid="_4a6911df-cba8-4a69-a392-dd450ff0547c" type="mention">chief executive</defterm> amd <legref valid.date="as.made" check="invalid" jurisd="QLD" type="act">2022 No.&#160;34</legref> <legref valid.date="as.made" check="invalid" jurisd="QLD" type="act">s&#160;365</legref> <legref valid.date="as.made" check="invalid" jurisd="QLD" type="act">sch&#160;3</legref></txt></historynote></definition><definition id="sec.5-def.council_" guid="_8de106d7-1a91-4c43-9056-11f690722b32" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.council" guid="_e9854402-22ed-43c5-a41b-0d1ba2f1c7f9" type="definition">council</defterm> means the Multicultural Queensland Advisory Council established under <intref refid="sec.8" target.guid="_ad63e1ff-0d6b-4c8c-b263-6bbdb67c7374" check="valid">section&#160;8</intref>.</txt></definition><definition id="sec.5-def.diversity_" guid="_99102a68-1bc4-42bd-b66d-57c546831025" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.diversity" guid="_d6138711-d127-4ccc-a510-1c12943d28b0" type="definition">diversity</defterm> means cultural, linguistic and religious diversity.</txt></definition><definition id="sec.5-def.employee_" guid="_8a34258c-8e4e-49a0-ae43-566f0491d608" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.employee" guid="_e94307e8-a443-4ced-b901-ddb5ffe7152c" type="definition">employee</defterm>, of a government entity, includes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-def.employee-para1.a" guid="_5e8375ef-ea9c-4f1e-8ad5-fd2664e25440" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">an officer or member of the entity; and</txt></block></li><li id="sec.5-def.employee-para1.b" guid="_6151d11f-6044-48c6-8fd9-17499c0ef460" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">an individual who works for the entity under a contract for services.</txt></block></li></list></definition><definition id="sec.5-def.governmententity_" guid="_58edc630-342d-4d1e-b9c0-5af03dfbb79c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.governmententity" guid="_ad38f015-8b48-41a0-8032-f4c68d309793" type="definition">government entity</defterm> means a government entity under the <legref jurisd="QLD" type="act" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid"><name emphasis="yes">Public Sector Act 2022</name></legref>, <legref jurisd="QLD" type="act" refid="sec.24" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" target.guid="_29dd4b4e-d6d2-4ee5-a408-c19296e428b1" check="valid">section&#160;276</legref>.</txt><historynote><txt break.before="1"><b>s&#160;5</b> def <defterm guid="_dc3cae4f-6f30-4ed1-a1b1-990f1b7ca165" type="mention">government entity</defterm> amd <legref jurisd="QLD" type="act" valid.date="as.made" check="invalid">2022 No.&#160;34</legref> <legref jurisd="QLD" type="act" valid.date="as.made" check="invalid">s&#160;365</legref> <legref jurisd="QLD" type="act" valid.date="as.made" check="invalid">sch&#160;3</legref></txt></historynote></definition><definition id="sec.5-def.multiculturalactionplan_" guid="_e7694cd5-c437-4e1a-99f3-6b48c107efaf" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.multiculturalactionplan" guid="_6f986a0f-fbd9-4e38-a00f-09a679a79493" type="definition">multicultural action plan</defterm> see <intref refid="sec.20" target.guid="_a4196c3f-dfcb-4879-a91f-f103bf245a98" check="valid">section&#160;20</intref><intref refid="sec.20-ssec.1" target.guid="_f4fcde7b-50e1-4528-ab46-41e4e4c6ec4e" check="valid">(1)</intref>.</txt></definition><definition id="sec.5-def.multiculturalcharter_" guid="_ce5843a3-c740-4733-b635-73c38817e7a7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.multiculturalcharter" guid="_6b223bbe-d76e-426c-8eb9-ea58b8cec624" type="definition">multicultural charter</defterm> means the Multicultural Queensland Charter set out in <intref refid="sch.1" target.guid="_11bafb7e-7610-4954-9c8c-d48e23ff3beb" check="valid">schedule&#160;1</intref>.</txt></definition><definition id="sec.5-def.multiculturalpolicy_" guid="_98e39026-88bd-4dfa-9a52-13bc7c714299" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.multiculturalpolicy" guid="_18c2beab-4b6c-4034-9d1d-043757a5ecf7" type="definition">multicultural policy</defterm> see <intref refid="sec.19" target.guid="_b4ca043c-0889-4e25-8410-b0a3b9a5cac4" check="valid">section&#160;19</intref><intref refid="sec.19-ssec.1" target.guid="_fa8fb91c-3fff-4b87-a759-e679efac067e" check="valid">(1)</intref>.</txt></definition><definition id="sec.5-def.multiculturalpolicyoutcomes_" guid="_b8cd814d-9840-4f33-b149-89e6cb2a2c3e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-def.multiculturalpolicyoutcomes" guid="_5bed6caf-a3a2-4436-81aa-8cc51d49cece" type="definition">multicultural policy outcomes</defterm> means the outcomes stated in the multicultural policy under <intref refid="sec.19" target.guid="_b4ca043c-0889-4e25-8410-b0a3b9a5cac4" check="valid">section&#160;19</intref><intref refid="sec.19-ssec.2" target.guid="_abdb6968-808f-43af-b10b-3082db7f374c" check="valid">(2)</intref><intref refid="sec.19-ssec.2-para1.b" target.guid="_aef3535d-3525-4ac2-9b1e-fa7b034d1aca" check="valid">(b)</intref>.</txt></definition></deflist></block></clause><clause id="sec.6" guid="_a173e463-936e-460c-b12d-74cb609f7c66" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_01bb5ef6-64ac-49ec-8c5a-8331262c9d46">Application of Act</heading><subclause id="sec.6-ssec.1" guid="_a8028a62-6799-46a8-aac4-e71a052aaf33" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act does not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_1c31bfeb-6ffe-4230-8030-b548a6d24318" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">create rights for anyone; or</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_d5eaff8f-dac8-4744-9d73-446a084b54e5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">impose legally enforceable obligations on the State, the Minister, a member of the council, a government entity, a chief executive or employee of a government entity, or anyone else.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_c4324295-3979-4b40-8c89-38eca9071f47" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">No provision of this Act creates a civil cause of action based on a contravention of the provision.</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_e87ff0b1-cd0f-419f-a371-22f050a8e832" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Failure to comply with this Act does not affect the validity of any decision.</txt></block></subclause><subclause id="sec.6-ssec.4" guid="_de9547ee-1bf7-4944-b922-a13719bb34f7" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If there is a conflict between this Act and another Act that requires an entity to consider principles or comply with requirements in the exercise of the entity’s functions or powers, the other Act prevails to the extent of the inconsistency.</txt></block></subclause></clause></part><part id="pt.2" guid="_93a222e2-4389-4e2a-b644-e8ff495a139f" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_8ecc241f-badd-46a1-b9db-6632f3b498bc">Multicultural Queensland Charter</heading><clause id="sec.7" guid="_652f26ce-2c47-47a0-92df-e9786912ebd5" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_dd56943f-0459-4f88-97c4-fde546d0d36d">The Multicultural Queensland Charter</heading><block><txt break.before="1">The Multicultural Queensland Charter is set out in <intref refid="sch.1" target.guid="_11bafb7e-7610-4954-9c8c-d48e23ff3beb" check="valid">schedule&#160;1</intref>.</txt></block></clause></part><part id="pt.3" guid="_c7d5dc1d-4942-4fb2-b72b-73df20961ea0" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_84aa1853-27db-4edb-a6e2-7d1839408179">Multicultural Queensland Advisory Council</heading><clause id="sec.8" guid="_ad63e1ff-0d6b-4c8c-b263-6bbdb67c7374" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_1a66f53e-6af3-4a39-b716-020b5caa9435">Establishment</heading><block><txt break.before="1">The Multicultural Queensland Advisory Council is established.</txt></block></clause><clause id="sec.9" guid="_3d1bda97-10e7-41eb-aa5c-8783d049e783" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_5a65da3d-4d7a-4e02-b1d2-332b7e4342f0">Functions</heading><subclause id="sec.9-ssec.1" guid="_50dde30b-58d3-46b2-afed-db54582d581e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The functions of the council are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_f1b168a0-fe5c-4880-8acf-6ed5544d76c8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">to give advice and make recommendations to the Minister about the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a-para2.i" guid="_bbeb8cda-e921-4998-b0f3-7004cd24c0c2" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the needs, aspirations and contributions of people from diverse backgrounds;</txt></block></li><li id="sec.9-ssec.1-para1.a-para2.ii" guid="_af5fb2d9-7327-4fe5-bb81-8bfc201d2e43" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">raising awareness of the multicultural charter within the Queensland community;</txt></block></li><li id="sec.9-ssec.1-para1.a-para2.iii" guid="_91ae65c9-0e38-490a-862d-d9806144291c" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">developing and implementing government policies about multiculturalism;</txt></block></li><li id="sec.9-ssec.1-para1.a-para2.iv" guid="_ebe8ba88-7571-47f3-876b-47d8910c214e" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">how services and programs funded by the Government can be responsive to the needs of people from diverse backgrounds; and</txt></block></li><li id="sec.20-ssec.5-para1.b" guid="_f23ffa9d-3fff-4438-9e91-bf9aae2d05b9" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">stops having effect when a further plan prepared under <intref refid="sec.20-ssec.3" target.guid="_c7c54ead-79f3-42de-8e05-ce4c687d7c37" check="valid">subsection&#160;(3)</intref><intref refid="sec.20-ssec.3-para1.b" target.guid="_7c64b641-0cdd-4c23-8372-8952e82b7207" check="valid">(b)</intref> takes effect.</txt></block></li></list></block></subclause></clause><clause id="sec.21" guid="_370a0d29-c4f8-47d1-bcbf-e22af9f8af62" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_cb486414-ca35-4f37-84c6-6e8df35c65ac">Report on multicultural policy</heading><subclause id="sec.21-ssec.1" guid="_6a9c090c-ce88-4e5d-9beb-d1c92a30b6d8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Minister must, as soon as practicable after each multicultural action plan stops having effect, table a report in the Legislative Assembly about the multicultural policy.</txt></block></subclause><subclause id="sec.21-ssec.2" guid="_ceb648fb-cd50-4b30-ae67-11132245b9f7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The report must include information about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.a" guid="_e917d68c-d454-4e40-860a-e7240e9b30a9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the extent to which the multicultural policy outcomes are being achieved; and</txt></block></li><li id="sec.21-ssec.2-para1.b" guid="_643bc991-f051-466a-a8e2-c734d437a4b6" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the actions required by the multicultural action plan taken by government entities in the period for which the plan was in effect.</txt></block></li></list></block></subclause></clause><clause id="sec.22" guid="_b649223c-fbe7-4c58-bf33-577a12f68a2f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>22</no><heading id="sec.22-he" guid="_90302a2f-580f-4ddf-a2dd-462d88ee9a6f">Chief executives to ensure awareness</heading><block><txt break.before="1">The chief executive of a government entity must ensure employees of the entity are aware of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-para1.a" guid="_3c98a46e-9a0d-48d9-a8c8-5da08aaac7b8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the multicultural charter, multicultural policy and multicultural action plan; and</txt></block></li><li id="sec.22-para1.b" guid="_0a4ff8db-73db-4e70-acf8-618e3ab403c1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">how the multicultural charter, multicultural policy and multicultural action plan apply to the work of the employees.</txt></block></li></list></block></clause><clause id="sec.23" guid="_46341555-3950-46f9-8fec-402ed786cb7d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_9d4ff52b-9b48-4161-ab62-18ff94e2ff90">Government entities to consider multicultural charter</heading><block><txt break.before="1">The employees of a government entity must consider the multicultural charter when developing policies or providing services of the entity.</txt></block></clause><clause id="sec.24" guid="_7368261e-1ef8-4f5f-b664-8fe466f9b356" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>24</no><heading id="sec.24-he" guid="_19ba3470-8c96-4eee-a566-cca76ff72b9f">Government entities’ reporting obligations</heading><subclause id="sec.24-ssec.1" guid="_dd406054-3bee-49ee-8cb2-c9cfd4df3959" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a government entity if the multicultural action plan requires the entity to take 1 or more stated actions.</txt></block></subclause><subclause id="sec.24-ssec.2" guid="_5bbdaeb9-8214-4ca9-911c-1e25ee7105e2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The government entity must, as soon as practicable after the end of each financial year, make the information stated in <intref refid="sec.24-ssec.3" target.guid="_15e801b3-9017-49cf-b22a-340241cdd26e" check="valid">subsection&#160;(3)</intref> publicly available, including, for example, by publishing the information on the entity’s website.</txt></block></subclause><subclause id="sec.24-ssec.3" guid="_15e801b3-9017-49cf-b22a-340241cdd26e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For <intref refid="sec.24-ssec.2" target.guid="_5bbdaeb9-8214-4ca9-911c-1e25ee7105e2" check="valid">subsection&#160;(2)</intref>, the information is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.3-para1.a" guid="_cf3c8cbb-4241-459c-a7de-621187433cc2" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a statement of the actions the multicultural action plan requires the government entity to take;
