</txt></block></li><li id="sec.4-para1.b" guid="_dd970bbc-5314-48a1-9d34-c3ffbc44459a" provision.type="other"><no>(b)</no><block><txt break.before="0">an instrument of mortgage for a lot; </txt></block></li><li id="sec.4-para1.c" guid="_5ca74607-6b52-4c69-99c5-87a4b22c1670" provision.type="other"><no>(c)</no><block><txt break.before="0">an instrument releasing a mortgage of a lot; </txt></block></li><li id="sec.4-para1.d" guid="_28d75937-4d67-4864-8d8b-3b83846a114d" provision.type="other"><no>(d)</no><block><txt break.before="0">a caveat for a lot; </txt></block></li><li id="sec.4-para1.e" guid="_9c9ec628-e66a-4feb-b7df-d50abdb382f2" provision.type="other"><no>(e)</no><block><txt break.before="0">a request to withdraw a caveat lodged over a lot; </txt></block></li><li id="sec.4-para1.f" guid="_ad39bc69-ab9c-4307-b7ec-840a587f34e5" provision.type="other"><no>(f)</no><block><txt break.before="0">a priority notice for a lot;</txt></block></li><li id="sec.4-para1.g" guid="_95f1f10c-c05b-4f6b-949b-a4d00cc46960" provision.type="other"><no>(g)</no><block><txt break.before="0">a request to extend a priority notice over a lot;</txt></block></li><li id="sec.4-para1.h" guid="_cbc7b7c7-2a7a-4eba-803a-fb685f38b620" provision.type="other"><no>(h)</no><block><txt break.before="0">a request to withdraw a priority notice over a lot;</txt></block></li><li id="sec.4-para1.i" guid="_f48e9793-1e68-40cf-9c70-6691757bbcc1" provision.type="other"><no>(i)</no><block><txt break.before="0">an application to be registered as a personal representative for a registered owner of a lot who has died.</txt></block></li></list></block></clause><clause id="sec.5" guid="_8ed001b5-8d98-45dd-896c-e40d645d7597" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_f83c500d-721d-4182-b3be-05c9abd0773b">Required instruments that must be lodged or deposited using Electronic Lodgment Network</heading><subclause id="sec.5-ssec.1" guid="_8ef59e81-2029-44ff-ad3b-34f70ef67644" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A required instrument must be lodged or deposited using an Electronic Lodgment Network if it is an instrument or document that may be lodged electronically under the <legref jurisd="QLD" type="act" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" check="valid"><name emphasis="no">Electronic Conveyancing National Law (Queensland)</name></legref>, <legref jurisd="QLD" type="act" refid="sec.7" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" target.guid="_13e49cca-4fdf-4bb8-885c-86d0074bd392" check="valid">section&#160;7</legref>.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_75d45b47-2ced-4c29-8e1d-0a874c1d62ce" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, <intref refid="sec.5-ssec.1" target.guid="_8ef59e81-2029-44ff-ad3b-34f70ef67644" check="valid">subsection&#160;(1)</intref> does not apply to a required instrument that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_7d95e7df-3046-4260-8ba3-668a9fc4af61" provision.type="other"><no>(a)</no><block><txt break.before="0">can not be prepared, lodged or deposited using an Electronic Lodgment Network because—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a-para2.i" guid="_35b8f3db-701e-4ddc-a480-6953a51dc072" provision.type="other"><no>(i)</no><block><txt break.before="0">the Electronic Lodgment Network does not have the functionality to prepare, lodge or deposit the required instrument; or</txt></block></li><li id="sec.5-ssec.2-para1.a-para2.ii" guid="_6048fbcc-f2f5-43d6-9f0f-58f0aba8f37c" provision.type="other"><no>(ii)</no><block><txt break.before="0">on the day a subscriber attempts to lodge or deposit the required instrument using the Electronic Lodgment Network to complete a transaction, circumstances beyond the control of the subscriber prevent the lodgement or deposit; or</txt><note id="sec.5-ssec.2-para1.a-para2.ii-note" guid="_ecbb9ae6-dfaa-474b-93ef-0c7ea5ec6051" type="example"><heading id="sec.5-ssec.2-para1.a-para2.ii-note-he" guid="_9b14261b-6ec2-4b77-9328-07ed3b999154">Examples—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a-para2.ii-note-para3.1" guid="_9737741c-45eb-4423-a260-ea79c5749555" provision.type="other"><no>1</no><block><txt break.before="0">A subscriber does not, on a day the subscriber attempts to complete the transaction, have access to the internet for the whole of the day.</txt></block></li><li id="sec.5-ssec.2-para1.a-para2.ii-note-para3.2" guid="_1854bfbd-f3f8-4502-ad77-d92110c84e74" provision.type="other"><no>2</no><block><txt break.before="0">The Electronic Lodgment Network, on a day a subscriber attempts to complete the transaction, is unavailable for use for the whole of the day.</txt></block></li></list></block></note></block></li></list></block></li><li id="sec.5-ssec.2-para1.b" guid="_c07876ca-bb25-4ece-8294-bc0ca1f8607a" provision.type="other"><no>(b)</no><block><txt break.before="0">can not be accepted or processed by the system used in the land registry because the system does not have the functionality to accept or process instruments or other documents lodged or deposited using an Electronic Lodgment Network; or</txt></block></li><li id="sec.5-ssec.2-para1.c" guid="_8e4cecd6-0aa1-4ca0-a3f3-158d8e78f829" provision.type="other"><no>(c)</no><block><txt break.before="0">is required to be prepared, lodged or deposited with— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.c-para2.i" guid="_9b0368b6-5be8-4145-a640-9ecdba4c1c3b" provision.type="other"><no>(i)</no><block><txt break.before="0">another instrument or document and the other instrument or document can not be lodged or deposited using an Electronic Lodgment Network for a reason mentioned in <intref refid="sec.5-ssec.2-para1.a" target.guid="_7d95e7df-3046-4260-8ba3-668a9fc4af61" check="valid">paragraphs&#160;(a)</intref><intref refid="sec.5-ssec.2-para1.a-para2.i" target.guid="_35b8f3db-701e-4ddc-a480-6953a51dc072" check="valid">(i)</intref> or (b); or</txt><note id="sec.5-ssec.2-para1.c-para2.i-note" guid="_3170a7c5-5655-4d69-93ad-361868d40903" type="example"><heading id="sec.5-ssec.2-para1.c-para2.i-note-he" guid="_9da9d7c3-5b4f-4ffc-97c1-bda33f46c946">Example—</heading><block><txt break.before="1">A transfer of a lot in fee simple that must be lodged with a plan of survey and the plan can not be lodged using an Electronic Lodgment Network.</txt></block></note></block></li><li id="sec.5-ssec.2-para1.c-para2.ii" guid="_9c2d547f-7e84-45f5-bf55-59555e9ef853" provision.type="other"><no>(ii)</no><block><txt break.before="0">another required instrument to which <intref refid="sec.5-ssec.3" target.guid="_338b83dc-e870-4203-8dd7-7440fa84a0a5" check="valid">subsection&#160;(3)</intref> applies; or</txt></block></li></list></block></li><li id="sec.5-ssec.2-para1.d" guid="_46ec20cb-e240-436e-99a5-72927c70019f" provision.type="other"><no>(d)</no><block><txt break.before="0">replaces another required instrument that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.d-para2.i" guid="_76db67d8-07e4-4307-9e4e-76bd4fd08bf0" provision.type="other"><no>(i)</no><block><txt break.before="0">is rejected, withdrawn, or permitted to be withdrawn, by the registrar under <legref jurisd="QLD" type="act" refid="sec.157" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" target.guid="_5e4c947e-2d9e-41fc-82b7-16d27010b777" check="valid">section&#160;157</legref> or <legref jurisd="QLD" type="act" refid="sec.159" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" target.guid="_fcb86589-aa82-4d94-8806-e5da698edd6f" check="valid">159</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid">Act</legref>; and</txt></block></li><li id="sec.5-ssec.2-para1.d-para2.ii" guid="_7d98fff8-68f1-4f8b-85a8-572c4ff6cc49" provision.type="other"><no>(ii)</no><block><txt break.before="0">is part of a transaction for which an associated financial transaction, within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" check="valid"><name emphasis="no">Electronic Conveyancing National Law (Queensland)</name></legref>, <legref jurisd="QLD" type="act" refid="sec.3" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" target.guid="_3a728d43-89ed-42d4-9ff9-309a859c7a1e" check="valid">section&#160;3</legref>, has been completed; or</txt></block></li></list></block></li><li id="sec.5-ssec.2-para1.e" guid="_56bc35d3-bbf4-47df-81f9-84fb10d88f1f" provision.type="other"><no>(e)</no><block><txt break.before="0">gives effect to a transaction that is not an ELN lodgement or ELN transfer within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-2001-071" target.version.series="71cb964b-9054-4eee-8796-7f1d6e3aa52c" check="valid"><name emphasis="yes">Duties Act 2001</name></legref>, <legref jurisd="QLD" type="act" refid="sec.156D" target.doc.id="act-2001-071" target.version.series="71cb964b-9054-4eee-8796-7f1d6e3aa52c" target.guid="_ab141955-b7f0-44f4-ae9a-18e7940be6b3" check="valid">section&#160;156D</legref>.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_338b83dc-e870-4203-8dd7-7440fa84a0a5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Also, <intref refid="sec.5-ssec.1" target.guid="_8ef59e81-2029-44ff-ad3b-34f70ef67644" check="valid">subsection&#160;(1)</intref> does not apply to a required instrument if a party to the required instrument is an individual—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_ce162e94-bcf4-42b8-838c-920d71c63660" provision.type="other"><no>(a)</no><block><txt break.before="0">who is not a subscriber; and</txt></block></li><li id="sec.5-ssec.3-para1.b" guid="_d44b6e63-0f0e-462f-bcbc-db91fda504a7" provision.type="other"><no>(b)</no><block><txt break.before="0">who is not represented by either of the following for the purpose of completing a transaction to which the instrument relates—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.b-para2.i" guid="_326e625c-a203-4e00-a541-315d4ed0c070" provision.type="other"><no>(i)</no><block><txt break.before="0">an Australian legal practitioner within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-2007-024" target.version.series="164fc9cf-e977-4597-b06d-cc4d9c090a38" check="valid"><name emphasis="yes">Legal Profession Act 2007</name></legref>, <legref jurisd="QLD" type="act" refid="sec.6" target.doc.id="act-2007-024" target.version.series="164fc9cf-e977-4597-b06d-cc4d9c090a38" target.guid="_85409192-53cb-4705-a44f-7ba6e1a848a6" check="valid">section&#160;6</legref><legref jurisd="QLD" type="act" refid="sec.6-ssec.1" target.doc.id="act-2007-024" target.version.series="164fc9cf-e977-4597-b06d-cc4d9c090a38" target.guid="_cb2e1fbd-4f86-4fc8-b293-052e0b0cfc8f" check="valid">(1)</legref>; or</txt></block></li><li id="sec.5-ssec.3-para1.b-para2.ii" guid="_6d684d83-26a3-4594-999d-6e9816d32aa9" provision.type="other"><no>(ii)</no><block><txt break.before="0">an incorporated legal practice within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-2007-024" target.version.series="164fc9cf-e977-4597-b06d-cc4d9c090a38" check="valid"><name emphasis="yes">Legal Profession Act 2007</name></legref>, <legref jurisd="QLD" type="act" refid="sec.111" target.doc.id="act-2007-024" target.version.series="164fc9cf-e977-4597-b06d-cc4d9c090a38" target.guid="_aa527a1b-9ba8-435d-bcca-ac57c1f3f195" check="valid">section&#160;111</legref>.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-ssec.4" guid="_ab13cb6f-4077-4ffc-a445-2249adca4598" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.4-def.ElectronicLodgmentNetwork_" guid="_ac837120-af78-4ac1-b924-8c15284aaca8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.4-def.ElectronicLodgmentNetwork" guid="_3576a6be-96ee-4827-ab96-822aec3a1ffa" type="definition">Electronic Lodgment Network</defterm> has the same meaning given by the <legref jurisd="QLD" type="act" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" check="valid"><name emphasis="no">Electronic Conveyancing National Law (Queensland)</name></legref>, <legref jurisd="QLD" type="act" refid="sec.13" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" target.guid="_739bb135-af81-408c-af6f-b6556f1afdae" check="valid">section&#160;13</legref>.</txt></definition><definition id="sec.5-ssec.4-def.subscriber_" guid="_e5d1a96c-bf06-4a3c-b609-e1365a2585de" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.4-def.subscriber" guid="_88162321-9ed7-4b47-b742-3e94e66febe1" type="definition">subscriber</defterm> see the <legref jurisd="QLD" type="act" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" check="valid"><name emphasis="no">Electronic Conveyancing National Law (Queensland)</name></legref>, <legref jurisd="QLD" type="act" refid="sec.3" target.doc.id="act-2013-ecnlq" target.version.series="4dec7407-a53c-4ece-8244-61701c26f49b" target.guid="_3a728d43-89ed-42d4-9ff9-309a859c7a1e" check="valid">section&#160;3</legref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.6" guid="_11bfee42-8d98-452a-8ba8-fda440a1d8b7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_10b3073c-9328-4ab0-81eb-ff4a9fc7433f">Transitional provision—required instrument executed before commencement</heading><block><txt break.before="1">Despite <intref refid="sec.5" target.guid="_8ed001b5-8d98-45dd-896c-e40d645d7597" check="valid">section&#160;5</intref>, a required instrument that was executed by a party in hard copy form before the commencement can not be lodged or deposited using an Electronic Lodgment Network.</txt></block></clause></body></wrapper></subordleg>
