of Act</heading><subclause id="sec.4-ssec.1" guid="_e79b05b0-6853-4f59-a87b-0c049446f76e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The purpose of this Act is to manage health and safety risks posed by therapeutic goods by applying Commonwealth regulatory controls on therapeutic goods in Queensland, to the extent those controls do not otherwise apply.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_ab68bcb2-6808-4510-a99f-78953f0a0dd5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The purpose is achieved by applying <legref jurisd="QLD" type="act" check="invalid">relevant Commonwealth law</legref>s in Queensland in a way that allows—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.2-para1.a" guid="_dfec6528-c862-4a0a-95e4-048f5ff091b3" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the uniform administration of the applied laws by Commonwealth entities; and</txt></block></li><li id="sec.4-ssec.2-para1.b" guid="_a61e987a-1295-4e9a-a1e6-8fd9489b523e" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">offences against the applied laws to be treated as if they were offences against Commonwealth check="valid">section&#160;7</intref>.</txt></definition><definition id="sec.5-ssec.1-def.Commonwealthentity_" guid="_226892de-d87a-4431-90ba-34c37f65934c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.1-def.Commonwealthentity" guid="_5e6e4951-5b8e-4739-8650-e839bad58e5e" type="definition">Commonwealth entity</defterm> means a Commonwealth authority or Commonwealth officer.</txt><note id="sec.5-ssec.1-def.Commonwealthentity-note" guid="_fa9d0511-e0a4-426e-8925-d920ce89fea0" type="example"><heading id="sec.5-ssec.1-def.Commonwealthentity-note-he" guid="_01a64e93-4db1-4de2-ab29-d5249647dff5">Note—</heading><block><txt break.before="1">For the meaning of Commonwealth authority and Commonwealth officer, see <intref refid="sec.5-ssec.2" target.guid="_c3147a9b-cfc4-49c3-b724-0e0543aa62bb" check="valid">subsection&#160;(2)</intref> and the <legref jurisd="CTH" type="act" target.doc.id="act-1989-021" target.version.series="C2004A03952" target.doc.id="act-1989-021" target.version.series="C2004A03952" check="valid"><name emphasis="yes">Therapeutic Goods Act 1989</name> (Cwlth)</legref>; and</txt></block></li><li id="sec.5-ssec.1-def.CommonwealthTherapeuticGoodsLaws-para1.b" guid="_e25ede28-61f8-43cf-b3c1-0b70b9b0570d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the regulations, orders and manufacturing principles under the <legref jurisd="CTH" type="act" target.doc.id="act-1989-021" target.version.series="C2004A03952" check="valid"><name emphasis="yes">Therapeutic Goods Act 1989</name> (Cwlth)</legref>.</txt></block></li></list></definition><definition id="sec.5-ssec.1-def.Secretary_" guid="_ad3cfae4-fcf4-4f6a-b835-5ec50538879f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.1-def.Secretary" guid="_a0281874-c52f-4365-9f40-dec2dd176347" type="definition">Secretary</defterm> means the Secretary of the department of the Commonwealth in which the Commonwealth Therapeutic Goods Laws are administered.</txt></definition></deflist></block></subclause><subclause id="sec.5-ssec.2" guid="_c3147a9b-cfc4-49c3-b724-0e0543aa62bb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Other terms used in this Act and also defined in the <legref jurisd="QLD" type="act" check="invalid">Commonwealth Therapeutic Goods Laws</legref> have the same meanings in this Act as they have in the Commonwealth Therapeutic Goods Laws, to the extent the context permits.</txt></block></subclause></clause><clause id="sec.6" guid="_f65a82b4-b5e9-4d9d-a923-a82b7ca7a736" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_1f7f68de-f51f-4ad5-803a-3a8bb6c6065c">Interpretation of applied laws</heading><subclause id="sec.6-ssec.1" guid="_49cf40e9-9a5f-45e4-9825-ba6cebac5dee" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a Commonwealth law (an <defterm id="sec.6-def.appliedlaw" guid="_baa17a86-78ad-43f2-a0f1-db9f32249c55" type="definition">applied law</defterm>) applied as a law of Queensland under this Act.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_19bdf88a-7260-4ef6-9e00-6c62f70ce240" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The <legref jurisd="CTH" type="act" target.doc.id="act-1901-002" target.version.series="C1901A00002" check="valid"><name emphasis="yes">Acts Interpretation Act 1901</name> (Cwlth)</legref> applies in relation to the interpretation of an applied law as if the applied law were a Commonwealth law and not a Queensland law.</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_232ef00e-0f0f-4477-a3dc-8e453ba42597" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">To the extent <intref refid="sec.6-ssec.2" target.guid="_19bdf88a-7260-4ef6-9e00-6c62f70ce240" check="valid">subsection&#160;(2)</intref> applies, the <legref jurisd="QLD" type="act" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" check="valid"><name emphasis="yes">Acts Interpretation Act 1954</name></legref> and <legref jurisd="QLD" type="act" target.doc.id="act-1992-022" target.version.series="efb0bef8-86cb-4bd3-92c0-a6d1337573b4" check="valid"><name emphasis="yes">Statutory Instruments Act 1992</name></legref> do not apply in relation to the interpretation of the applied law.</txt></block></subclause></clause></division></part><part id="pt.2" guid="_cfe1f302-5c35-421f-b947-50dea86461e9" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_8f6a07df-f06e-46dd-8019-79cef6bb4fcc">Applied therapeutic goods provisions</heading><clause id="sec.7" guid="_6476b3b0-6f3e-42c8-a968-272c8c7c596d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_3e611d87-3b41-49ba-bda6-6188ee2b0d5e">Application of Commonwealth Therapeutic Goods Laws</heading><subclause id="sec.7-ssec.1" guid="_c7f6bc16-2ff1-4830-bf96-96d3a982d1e5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Commonwealth Therapeutic Goods Laws apply as laws of Queensland as if the Commonwealth Therapeutic Goods Laws extended to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_14d1d16c-dfb4-45bd-a4f7-b5dd79b30ef9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">things done or omitted to be done by entities that are not corporations; and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_a0e2a306-ad7b-453c-8bde-cd9fb718613a" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">things done or omitted to be done in the course of trade and commerce within the limits of Queensland.</txt><note id="sec.7-ssec.1-para1.b-note" guid="_a98c002b-eeb9-40b7-8fbe-88b6cd25ada2" type="example"><heading id="sec.7-ssec.1-para1.b-note-he" guid="_19f2dc80-d8f2-4efe-8726-edb0c40c990e">Note—</heading><block><txt break.before="1">For the meaning of corporation, see <intref refid="sec.5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A regulation may modify the application, as a law of Queensland, of the Commonwealth Therapeutic Goods Laws.</txt></block></subclause><subclause id="sec.7-ssec.3" guid="_39f3fd24-d6da-47fb-8052-1cd9a63772d4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Commonwealth Therapeutic Goods Laws, as applied and modified under this section, are the <defterm id="sec.7-def.appliedtherapeuticgoodsprovisions" guid="_7c42aea8-b7b1-495f-8b33-69f095ef8ccc" type="definition">applied therapeutic goods provisions</defterm>.</txt></block></subclause></clause><clause id="sec.8" guid="_7a0fc5f5-01c4-4587-92f4-2347527313b0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_b89d2c76-1871-4c77-ba7b-91816acc5a6f">Functions and powers of Commonwealth entities</heading><subclause id="sec.8-ssec.1" guid="_018995db-7c23-4c08-8123-56f92380127b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a Commonwealth entity that has a function or power under the Commonwealth Therapeutic Goods Laws.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_38669e1a-bd03-4499-a28b-811cf3965095" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Commonwealth entity is taken to have the same function or power for the applied therapeutic goods provisions.</txt></block><note id="sec.8-ssec.2-note" guid="_0a6b2c4b-d389-4a15-8b0e-b532d661bfb4" type="example"><heading id="sec.8-ssec.2-note-he" guid="_343257f9-3618-4350-b940-ea2176e99216">Example—</heading><block><txt break.before="1">The Secretary may include, or cancel the inclusion of, therapeutic goods in the register maintained under the <legref jurisd="CTH" type="act" target.doc.id="act-1989-021" target.version.series="C2004A03952" check="valid"><name emphasis="yes">Therapeutic Goods Act 1989</name> (Cwlth)</legref>, <legref jurisd="CTH" type="act" refid="sec.9A" target.doc.id="act-1989-021" target.version.series="C2004A03952" check="invalid">section&#160;9A</legref> for the applied therapeutic goods provisions.</txt></block></note></subclause><subclause id="sec.8-ssec.3" guid="_12c03275-e090-41d5-aa7c-6850930f7213" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">When performing the function or exercising the power for the applied therapeutic goods provisions, the Commonwealth entity must, to the extent practicable, act as if the entity were performing the function or exercising the power under the Commonwealth Therapeutic Goods Laws.</txt></block></subclause><subclause id="sec.8-ssec.4" guid="_0f2518d7-b0c4-4c52-bd7c-87964245cdcf" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">To remove any doubt, it is declared that a delegation, or the appointment of a person, made by a Commonwealth entity in the performance of a function or exercise of a power under the Commonwealth Therapeutic Goods Laws is taken to have effect for the applied therapeutic goods
