type="act" target.doc.id="act-2003-083" target.version.series="d6f42d2f-7e2f-4a99-8d0d-74ddf2019d59" check="valid"><name emphasis="yes">Australian Crime Commission (Queensland) Act 2003</name></legref>.</txt></block></clause><clause id="sec.2" guid="_c0e081cd-6bd5-4acf-82ec-557285e51856" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_6a4392ef-ce52-4466-b0c0-5ddbc163d511">Commencement</heading><block><txt break.before="1">This Act commences on a day to be fixed by proclamation.</txt></block></clause><clause id="sec.3" guid="_5bd75735-70e7-4dc3-942b-00bcc6a897b1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_80d9f12f-0ff4-442f-bfd5-969e392b17b0">Interpretation</heading><subclause id="sec.3-ssec.1" guid="_e332283d-9b0a-49ca-8589-1ef66c9c5106" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The dictionary in <intref refid="sch.2" target.guid="_dd67e92c-7085-44d5-bb03-3ccb9e526a3a" check="valid">schedule&#160;2</intref> defines particular words used in this Act.</txt></block></subclause><subclause id="sec.3-ssec.2" guid="_8b42c068-4f69-4399-a3fc-ec72c0598e6e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If this Act uses a term that is used in the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref>, the term has the same meaning in this Act as it has in the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref> unless the contrary intention appears in this Act.</txt></block></subclause><subclause id="sec.3-ssec.3" guid="_87b91275-b801-41a3-aa60-2a0ce0f8dca0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the head of an ACC operation/investigation suspects that an offence (the <defterm id="sec.3-def.incidentaloffence" guid="_dfa7a992-808c-47cf-8653-c38f786489e4" type="definition">incidental offence</defterm>) that is not a serious and organised crime may be directly or indirectly connected with, or may be a part of, a course of activity involving the commission of a serious and organised crime (whether or not the head has identified the nature of that serious and organised crime), then the incidental offence is, for so long only as the head so suspects, taken, for the purposes of this Act, to be a serious and organised crime.</txt></block></subclause><subclause id="sec.3-ssec.4" guid="_345aee02-40cb-4af9-9e2d-d78d34652129" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A reference in this Act, other than <intref refid="pt.2" target.guid="_6bd93a1b-8322-4660-9f40-12e58812fc03" check="valid">part&#160;2</intref>, to a function includes a reference to a power or duty.</txt></block></subclause><subclause id="sec.3-ssec.5" guid="_f94a9d1e-ee17-48b9-9592-fbc29404e506" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_3f8efe92-9277-4b33-abf9-3a25156ee8da">Act binds all persons</heading><subclause id="sec.4-ssec.1" guid="_c120b584-ba39-4273-b182-9d221ef9ab30" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act binds all persons including the State and, as far as the legislative power of the Parliament permits, the Commonwealth and the other States.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_775c7fe0-6b42-4b8f-91a0-cdbb28e9d165" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.4-ssec.1" target.guid="_c120b584-ba39-4273-b182-9d221ef9ab30" check="valid">Subsection&#160;(1)</intref> does not make the State, the Commonwealth or another State liable to be prosecuted for an offence.</txt></block></subclause></clause></part><part id="pt.2" guid="_6bd93a1b-8322-4660-9f40-12e58812fc03" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_ae0226b3-f3a2-496e-af6d-6da54e709d0a">The Australian Crime Commission, the Board and the Inter-Governmental Committee</heading><division id="pt.2-div.1" guid="_f3edc48e-6a6d-4347-a6f1-a2f4613b2725" affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.2-div.1-he" guid="_3b9599d8-d166-47c3-b5d2-e93367852f44">The Australian Crime Commission</heading><clause id="sec.5" guid="_67089adc-ffe6-4da7-b938-fbbc6b925b80" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_4f8ee16e-cf12-4e5f-96c6-7bf0a21d0934">Functions of ACC</heading><block><txt break.before="1">The ACC has the following functions—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_deaa1ef0-22b7-408e-ad6c-3fae7d3011db" provision.type="other"><no>(a)</no><block><txt break.before="0">to undertake an intelligence operation in so far as the serious and organised crime is, or the serious and organised crimes are or include, an offence or offences against a law of the State (irrespective of whether that offence or those offences have a federal aspect);</txt></block></li><li id="sec.5-para1.b" guid="_f4451213-d9ab-45be-8d66-6a790c89f595" provision.type="other"><no>(b)</no><block><txt break.before="0">to investigate a matter relating to a relevant criminal activity, in so far as the serious and organised crime is, or the serious and organised crimes are or include, an offence or offences against a law of the State (irrespective of whether that offence or those offences have a federal aspect);</txt></block></li><li id="sec.5-para1.c" guid="_7447dfab-5a5e-4448-8933-5dd300c842e2" provision.type="other"><no>(c)</no><block><txt break.before="0">to provide a report to the Board on the outcome of an operation mentioned in <intref refid="sec.5-para1.a" target.guid="_deaa1ef0-22b7-408e-ad6c-3fae7d3011db" check="valid">paragraph&#160;(a)</intref> or an investigation mentioned in <intref refid="sec.5-para1.b" target.guid="_f4451213-d9ab-45be-8d66-6a790c89f595" check="valid">paragraph&#160;(b)</intref>;</txt></block></li><li id="sec.5-para1.d" guid="_65204e11-a83b-41ef-95b9-230410e70872" provision.type="other"><no>(d)</no><block><txt break.before="0">the functions conferred on the ACC by other provisions of this Act or any other Act.</txt></block></li></list></block></clause><clause id="sec.6" guid="_e2266ee0-3e47-468b-9e7b-42eba759c044" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_81eee7fb-0ccd-4615-9b2b-e299fd3b75b2">CEO to manage ACC operations/investigations</heading><subclause id="sec.6-ssec.1" guid="_7dad7252-dd6f-4dc6-a3d4-5a496fc9793d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The CEO is to manage, coordinate and control ACC operations/investigations.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_a1060b50-19cc-4036-add5-c5f7b0be01aa" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">As soon as practicable after the Board consents under <legref jurisd="CTH" type="act" refid="sec.55A" check="invalid">section&#160;55A</legref><legref jurisd="CTH" type="act" refid="sec.55A-ssec.3" check="invalid">(3)</legref> of the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref> to the ACC undertaking an intelligence operation under <intref refid="sec.5" target.guid="_67089adc-ffe6-4da7-b938-fbbc6b925b80" check="valid">section&#160;5</intref><intref refid="sec.5-para1.a" target.guid="_deaa1ef0-22b7-408e-ad6c-3fae7d3011db" check="valid">(a)</intref> or conducting an investigation under <intref refid="sec.5" target.guid="_67089adc-ffe6-4da7-b938-fbbc6b925b80" check="valid">section&#160;5</intref><intref refid="sec.5-para1.b" target.guid="_f4451213-d9ab-45be-8d66-6a790c89f595" check="valid">(b)</intref>, the CEO must determine, in writing, the head of the operation or investigation.</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_26a4d8d7-2169-4d60-a51c-847ac710cb37" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Before the CEO determines the head of the operation or investigation, the CEO must consult the chair of the Board, and the other members of the Board the CEO thinks appropriate, in relation to the determination.</txt></block></subclause><subclause id="sec.6-ssec.4" guid="_f4d49890-3c84-4b09-92e1-5d9cacaba497" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Subject to the consultation with the examiners as is appropriate and practicable, the CEO may make arrangements as to the examiner who is to be able to exercise his or her powers under this Act in relation to a special ACC operation/investigation.</txt></block></subclause></clause><clause id="sec.7" guid="_1bc90b1d-8b3c-4def-94ad-3858677e2757" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_25061cc8-fadf-4fbb-a16c-5fa7649778a6">Counsel assisting ACC</heading><block><txt break.before="1">The CEO may appoint a lawyer to assist the ACC as counsel in relation to ACC operations/investigations generally or in relation to a particular matter or matters.</txt></block></clause></division><division id="pt.2-div.2" guid="_ee62a586-c2b9-43bd-bff8-098be51a4c6f" affected.by.uncommenced="0"><no>Division 2</no><heading id="pt.2-div.2-he" guid="_c7f830b1-0541-4730-a865-4579a33a0f12">The Board of the ACC</heading><clause id="sec.8" guid="_c4726670-8d61-48ad-b08a-becfc5b1d59f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_a71e8e9f-bcbf-47c7-a60b-3c71d0cdc8df">Functions of the Board</heading><subclause id="sec.8-ssec.1" guid="_6641bdfc-1688-4467-bb0a-1379b249ac82" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Board has the following functions—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_70c56f1f-2aa5-4019-bf30-92ccd9fd44b3" provision.type="other"><no>(a)</no><block><txt break.before="0">to determine, in writing, whether an ACC State intelligence operation is a special operation or whether an ACC State investigation is a special investigation;</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_3e3bdce7-a809-4886-9dd1-698802356425" provision.type="other"><no>(b)</no><block><txt break.before="0">to determine, in writing, the class or classes of persons to participate in an ACC State intelligence operation or ACC State investigation;</txt></block></li><li id="sec.8-ssec.1-para1.c" guid="_77842959-84a4-48a8-a141-034803105c51" provision.type="other"><no>(c)</no><block><txt break.before="0">to establish task forces;</txt></block></li><li id="sec.8-ssec.1-para1.d" guid="_ae7da61d-ad16-41ad-b17f-636321e1044c" provision.type="other"><no>(d)</no><block><txt break.before="0">the other functions conferred on the Board by other provisions of this Act.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_1516f2b7-a26a-46d9-95f3-1def46de0c6a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Board may determine, in writing, that an ACC State intelligence operation is a special operation.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_a8ca6cee-2eeb-4ddd-a6b3-6fe0a8ff3a57" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Before making a determination under <intref refid="sec.8-ssec.2" target.guid="_1516f2b7-a26a-46d9-95f3-1def46de0c6a" check="valid">subsection&#160;(2)</intref>, the Board must consider whether methods of collecting the criminal information and intelligence that do not involve the use of powers in this Act have been effective.</txt></block></subclause><subclause id="sec.8-ssec.4" guid="_0ec4d1bb-0d71-4128-be46-a8c966a14a0f" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Board may determine, in writing, that an ACC State investigation is a special investigation.</txt></block></subclause><subclause id="sec.8-ssec.5" guid="_59b3abb3-5c5c-467e-a7ea-b0a76c67b53a" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Before making a determination under <intref refid="sec.8-ssec.4" target.guid="_0ec4d1bb-0d71-4128-be46-a8c966a14a0f" check="valid">subsection&#160;(4)</intref>, the Board must consider whether ordinary police methods of investigation into the matters are likely to be effective.</txt></block></subclause><subclause id="sec.8-ssec.6" guid="_1ed11d8f-ae18-4db8-847f-3729e25a8418" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A determination under <intref refid="sec.8-ssec.2" target.guid="_1516f2b7-a26a-46d9-95f3-1def46de0c6a" check="valid">subsection&#160;(2)</intref> or <intref refid="sec.8-ssec.4" target.guid="_0ec4d1bb-0d71-4128-be46-a8c966a14a0f" check="valid">(4)</intref> must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.6-para1.a" guid="_8619f0eb-36db-4aa3-9e56-b76e8f767929" provision.type="other"><no>(a)</no><block><txt break.before="0">describe the general nature of the circumstances or allegations constituting the relevant criminal activity to which the operation or investigation relates; and</txt></block></li><li id="sec.8-ssec.6-para1.b" guid="_36f6e2b0-8346-4447-b1ae-64b1cb7bed3c" provision.type="other"><no>(b)</no><block><txt break.before="0">state that the serious and organised crime is, or the serious and organised crimes are or include, an offence or offences against a law of the State but need not specify the particular offence or offences; and</txt></block></li><li id="sec.8-ssec.6-para1.c" guid="_d55df9c9-7848-4fb5-b1d5-c20144ef7137" provision.type="other"><no>(c)</no><block><txt break.before="0">set out the purpose of the operation or investigation.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.7" guid="_286a009a-72f1-4204-b6d6-2c19798d36b3" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The chair of the Board must, within the period of 3 days beginning on the day a determination under <intref refid="sec.8-ssec.2" target.guid="_1516f2b7-a26a-46d9-95f3-1def46de0c6a" check="valid">subsection&#160;(2)</intref> or <intref refid="sec.8-ssec.4" target.guid="_0ec4d1bb-0d71-4128-be46-a8c966a14a0f" check="valid">(4)</intref> is made, give a copy of the determination to the Inter-Governmental Committee.</txt></block></subclause><subclause id="sec.8-ssec.8" guid="_a2d95f7d-ca01-499e-b5c6-7fb86f4a2750" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">A determination under <intref refid="sec.8-ssec.2" target.guid="_1516f2b7-a26a-46d9-95f3-1def46de0c6a" check="valid">subsection&#160;(2)</intref> or <intref refid="sec.8-ssec.4" target.guid="_0ec4d1bb-0d71-4128-be46-a8c966a14a0f" check="valid">(4)</intref> has effect immediately after it is made.</txt></block></subclause><subclause id="sec.8-ssec.9" guid="_a314ece0-bbf8-4bc2-a850-99c96d547b90" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0"><intref refid="sec.9" target.guid="_eeb42b6f-9f8c-43a6-9e48-7da25fa8916c" check="valid">Sections&#160;9</intref> to <intref refid="sec.15" target.guid="_ae09e16d-4b85-4464-b863-2fbd8d691f9c" check="valid">15</intref> have effect in relation to the Board’s functions under this Act.</txt></block></subclause></clause><clause id="sec.9" guid="_eeb42b6f-9f8c-43a6-9e48-7da25fa8916c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_19d874d3-abdd-474a-97db-9c7e56458506">Board meetings</heading><subclause id="sec.9-ssec.1" guid="_c38f08f3-638c-44e8-af59-053f454e1294" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chair of the Board may convene meetings of the Board.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_80fd0233-afb4-46db-9a51-b8cb08f0996e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chair, in exercising his or her power to convene meetings, must ensure that meetings of the Board are scheduled to meet the requirements set out in <legref jurisd="CTH" type="act" refid="sec.7D" check="invalid">section&#160;7D</legref> of the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref>.</txt></block></subclause></clause><clause id="sec.10" guid="_4d3c01d2-02cc-4e64-bfa2-2bdca61b9d3f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_98a6fc56-2ee1-4b77-bb37-4db12f7e06a1">Presiding at Board meetings</heading><block><txt break.before="1">A meeting of the Board must be presided over by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_9d3ecb54-f995-49d1-bc9e-29fad81390bc" provision.type="other"><no>(a)</no><block><txt break.before="0">if the chair of the Board is present—the chair; or</txt></block></li><li id="sec.10-para1.b" guid="_15719b47-6e97-4797-961d-38e720ea2eeb" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—another eligible Commonwealth Board member who is present and who is nominated, in writing, by the chair to preside.</txt></block></li></list></block></clause><clause id="sec.11" guid="_1b186d9e-69e2-40e4-9c12-301ca8fab6e8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_571517d4-b370-4429-a9e2-a2c7dff5cf5f">Quorum at Board meetings</heading><block><txt break.before="1">At a meeting of the Board a quorum is constituted by 9 Board members (not including the CEO).</txt></block><historynote><txt break.before="1"><b>s&#160;11</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2006-026" valid.date="as.made" check="invalid">s&#160;4</legref><legref jurisd="QLD" type="act" refid="sch.2" target.doc.id="act-2006-026" valid.date="as.made" check="invalid"/></txt></historynote></clause><clause id="sec.12" guid="_0421bb41-ea7d-4260-8ff5-9c3273044c65" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_380eeaa6-9218-46cd-a6b3-fb02e92567e6">Voting at Board meetings</heading><subclause id="sec.12-ssec.1" guid="_6631c445-a0a6-4e2c-8abe-5639e5779e88" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Subject to this section, a question arising at a meeting of the Board is to be determined by a majority of the votes of Board members present.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_ef77514c-5897-465a-84bf-da2ce813e9c9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The person presiding at a meeting has—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_60d91e79-5d02-497f-85c0-df3ba748b735" provision.type="other"><no>(a)</no><block><txt break.before="0">a deliberative vote; and</txt></block></li><li id="sec.12-ssec.2-para1.b" guid="_e8e13146-519f-4b92-9d7e-b4cdd8029aa8" provision.type="other"><no>(2)</no><block><txt break.before="0">The resolution is as valid and effectual as if it had been passed at a meeting of the Board duly convened and id="sec.15-he" guid="_7ac99f24-3fea-42e9-881d-a75925d76cb8">Board committees</heading><subclause id="sec.15-ssec.1" guid="_c84961e7-a256-4ccc-ab8d-fb7b11c8e7a5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Board may, with the unanimous agreement of all the members of the Board (not including the CEO), establish a committee or committees guid="_ac035f52-c870-423f-8bbd-07add1973f32">Functions of Committee</heading><subclause id="sec.16-ssec.1" guid="_b2622bdc-840c-401c-9969-83e69a9fbeff" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Within the period of 30 days beginning on the day the Committee is given a copy of a determination (a <defterm id="sec.16-def.specialdetermination" guid="_aa26ea12-dbb6-436d-bf73-e06da674227e" type="definition">special determination</defterm>) under <intref refid="sec.8" target.guid="_c4726670-8d61-48ad-b08a-becfc5b1d59f" check="valid">section&#160;8</intref><intref refid="sec.8-ssec.2" target.guid="_1516f2b7-a26a-46d9-95f3-1def46de0c6a" check="valid">(2)</intref> or <intref refid="sec.8-ssec.4" target.guid="_0ec4d1bb-0d71-4128-be46-a8c966a14a0f" check="valid">(4)</intref>, the Committee may by resolution, with the agreement of the member of the Committee representing the Commonwealth and at least 5 other members of the Committee, request the chair of the Board to give further information to the Committee in relation to the determination.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_0d27dd24-905b-48d8-838d-82d52fa2b3ac" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subject to <intref refid="sec.16-ssec.3" target.guid="_444ba913-75ed-4e43-aad8-964c553c1c07" check="valid">subsection&#160;(3)</intref>, the chair of the Board must comply with the break.before="0">If the chair of the Board considers that disclosure of information to the public could prejudice the safety or reputation of persons or the operations of law enforcement agencies, the provision.type="other"><no>(4)</no><block><txt break.before="0">If the chair of the Board does not give the Committee information on the ground that the chair considers that disclosure of the information to the public could prejudice the safety or reputation of persons or the operations of law enforcement agencies, the Committee may refer the request to the State Minister.</txt></block></subclause><subclause id="sec.16-ssec.5" guid="_e52a33f5-7ca0-490e-9ab8-dded3c84f26a" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the Committee refers the request to the State Minister, he or she—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.5-para1.a" guid="_de77aeb0-5438-473e-85d2-06b64bc5d829" provision.type="other"><no>(a)</no><block><txt break.before="0">must determine in writing whether disclosure of the information could prejudice the safety or reputation of persons or the operations of law enforcement agencies; and</txt></block></li><li id="sec.16-ssec.5-para1.b" guid="_f7396f00-2d82-4fb5-8242-5cc1ee8444ed" provision.type="other"><no>(b)</no><block><txt break.before="0">must provide copies of that determination to the chair of the Board and the Committee; and</txt></block></li><li id="sec.16-ssec.5-para1.c" guid="_79ae9ec8-34c7-4e45-9cf5-3c6f93e09eee" provision.type="other"><no>(c)</no><block><txt break.before="0">must not disclose his or her reasons for determining the question of whether the information could prejudice the safety or reputation of persons or the operations of law enforcement agencies in the way stated in the determination.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.6" guid="_50f09438-ac25-45af-ad12-7776f35a8792" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Within the period of 30 days beginning on the day the Committee makes a request under <intref refid="sec.16-ssec.1" target.guid="_b2622bdc-840c-401c-9969-83e69a9fbeff" check="valid">subsection&#160;(1)</intref> in relation to a special determination, the Committee may by resolution, with the agreement of the member of the Committee representing the Commonwealth and at least 5 other members of the Committee, revoke the determination.</txt></block></subclause><subclause id="sec.16-ssec.7" guid="_a11e39e6-9944-451e-9c41-7610fc476870" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The Committee must notify the chair of the Board and the CEO of the revocation.</txt></block></subclause><subclause id="sec.16-ssec.8" guid="_dd7eee24-ed46-45e4-8244-68bf0b01bbc7" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt exercise the power under <intref refid="sec.16-ssec.1" target.guid="_b2622bdc-840c-401c-9969-83e69a9fbeff" check="valid">subsection&#160;(1)</intref> or <intref refid="sec.16-ssec.6" target.guid="_50f09438-ac25-45af-ad12-7776f35a8792" check="valid">(6)</intref> for any special determination, whether the Committee is requested to do so by any person, or in any other circumstances.</txt></block></subclause></clause></division></part><part id="pt.3" guid="_209259e0-9c0e-4ac0-9cd7-417212f90016" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_871776b3-0f6c-4b35-a3ef-f44a12afe194">Examinations</heading><block><txt break.before="1">An examiner may conduct an examination for the purposes of a special ACC operation/investigation.</txt></block></clause><clause id="sec.18" guid="_24828d84-1872-475f-af1b-dc1dfa0baad9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>18</no><heading id="sec.18-he" guid="_331d9cf3-2560-4af1-9b7b-10842ddf2799">Conduct of examination</heading><subclause id="sec.18-ssec.1" guid="_2d1d49fb-2892-476f-b5e5-4787908267f8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An examiner may regulate the conduct of proceedings at an examination as the examiner thinks fit.</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_e0435245-2586-40a3-88f3-5f9e5a4a2f15" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">At an examination before an examiner—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a" guid="_3a447d22-262c-4933-aa3c-ceebd838fd3a" provision.type="other"><no>(a)</no><block><txt break.before="0">a person giving evidence may be represented by a lawyer; and</txt></block></li><li id="sec.18-ssec.2-para1.b" guid="_af4573da-75d9-4c36-b7aa-117e57db9b0e" provision.type="other"><no>(b)</no><block><txt break.before="0">if, because of the existence of special circumstances, the examiner consents to a person who is not giving evidence being represented by a lawyer—the person may be so represented.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.3" guid="_c7dcdc9b-6929-47d1-adc5-3bb39c4fc415" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">An examination before an examiner must be held in private and the examiner may give directions as to the persons who may be present during the examination or a part of the examination.</txt></block></subclause><subclause id="sec.18-ssec.4" guid="_9b11a8ef-82c4-40d2-b05a-1fa3f652b4cc" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Nothing in a direction given by the examiner under <intref refid="sec.18-ssec.3" target.guid="_c7dcdc9b-6929-47d1-adc5-3bb39c4fc415" check="valid">subsection&#160;(3)</intref> prevents the presence, when evidence is being taken at an examination before the examiner, of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.4-para1.a" guid="_cbc6544f-199d-4b45-aa33-ffea43e9be90" provision.type="other"><no>(a)</no><block><txt break.before="0">a person representing the person giving evidence; or</txt></block></li><li id="sec.18-ssec.4-para1.b" guid="_c8790679-9bab-4f96-ad52-e3c582c39e00" provision.type="other"><no>(b)</no><block><txt break.before="0">a person representing, under <intref refid="sec.18-ssec.2" target.guid="_e0435245-2586-40a3-88f3-5f9e5a4a2f15" check="valid">subsection&#160;(2)</intref>, a person who, because of a direction given by the examiner under <intref refid="sec.18-ssec.3" target.guid="_c7dcdc9b-6929-47d1-adc5-3bb39c4fc415" check="valid">subsection&#160;(3)</intref>, is entitled to be present.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.5" guid="_195467a6-f49d-40a4-953c-c075701e522f" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If an examination before an examiner is being held, a person (other than a member of the staff of the ACC approved by the examiner) must not be present at the examination unless the person is entitled to be present because of a direction given by the examiner under <intref refid="sec.18-ssec.3" target.guid="_c7dcdc9b-6929-47d1-adc5-3bb39c4fc415" check="valid">subsection&#160;(3)</intref> or because of <intref refid="sec.18-ssec.4" target.guid="_9b11a8ef-82c4-40d2-b05a-1fa3f652b4cc" check="valid">subsection&#160;(4)</intref>.</txt></block><penalty id="sec.18-ssec.5-pen" guid="_d98173ba-70f1-406e-9dc1-9d4573d0e7c7"><block><txt break.before="1">Maximum penalty—30 penalty units or 1 year’s imprisonment.</txt></block></penalty></subclause><subclause id="sec.18-ssec.6" guid="_0ce6d112-db9d-47a2-b09a-ae822dcf4d95" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">At an examination before an examiner the following persons may, so far as the examiner thinks appropriate, examine or cross-examine any witness on any matter that the examiner considers relevant to the ACC operation/investigation—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.6-para1.a" guid="_4d59eca5-b859-4c95-8e60-bdb8d9b370ca" provision.type="other"><no>(a)</no><block><txt break.before="0">counsel assisting the examiner generally or in relation to the matter to which the ACC operation/investigation relates;</txt></block></li><li id="sec.18-ssec.6-para1.b" guid="_485866ca-28f6-44fb-a188-fb11131e0ca7" provision.type="other"><no>(b)</no><block><txt break.before="0">any person authorised by the examiner to appear before the examiner at the examination;</txt></block></li><li id="sec.18-ssec.6-para1.c" guid="_72455db1-0b60-432f-a8c0-1a8a1370b96c" provision.type="other"><no>(c)</no><block><txt break.before="0">any lawyer representing a person at the examination in accordance with <intref refid="sec.18-ssec.2" target.guid="_e0435245-2586-40a3-88f3-5f9e5a4a2f15" check="valid">subsection&#160;(2)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.7" guid="_ee878a0c-24c1-41cb-8424-a15559413838" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">If a person (other than a member of the staff of the ACC) is present at an examination before an examiner while another person (the <defterm id="sec.18-def.witness" guid="_d9afa05e-8dcd-4ce1-94cc-72b9bf0f6707" type="definition">witness</defterm>) is giving evidence at the examination, the examiner must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.7-para1.a" guid="_c7f64351-54d2-445d-9506-8391dd36fb12" provision.type="other"><no>(a)</no><block><txt break.before="0">inform the witness that the person is present; and</txt></block></li><li id="sec.18-ssec.7-para1.b" guid="_c07903a6-7f7b-4d75-9ab8-725e60190e8a" provision.type="other"><no>(b)</no><block><txt break.before="0">give the witness an opportunity to comment on the presence of the person.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.8" guid="_d5387e26-26ad-430d-859b-4b3541eb3431" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">To remove any doubt, it is declared that a person does not cease to be entitled to be present at an examination before an examiner, or part of an examination before an examiner, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.8-para1.a" guid="_c7aa067d-f72a-494d-b0f0-5fd7ccff87a5" provision.type="other"><no>(a)</no><block><txt break.before="0">the examiner fails to comply with <intref refid="sec.18-ssec.7" target.guid="_ee878a0c-24c1-41cb-8424-a15559413838" check="valid">subsection&#160;(7)</intref>; or</txt></block></li><li id="sec.18-ssec.8-para1.b" guid="_8b875703-671b-4c4c-8f40-cd6dc96a62d6" provision.type="other"><no>(b)</no><block><txt break.before="0">a witness comments adversely on the presence of the person under <intref refid="sec.18-ssec.7" target.guid="_ee878a0c-24c1-41cb-8424-a15559413838" check="valid">subsection&#160;(7)</intref><intref refid="sec.18-ssec.7-para1.b" target.guid="_c07903a6-7f7b-4d75-9ab8-725e60190e8a" check="valid">(b)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.9" guid="_ccc1eb5d-868a-4697-8a74-449465daac28" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">An examiner may direct that the following must not be published, or must not be published except in the way, and to the persons, that the examiner specifies—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.9-para1.a" guid="_689a8b8f-b1b9-40a9-9a4e-c8ac482338ad" provision.type="other"><no>(a)</no><block><txt break.before="0">any evidence given before the examiner;</txt></block></li><li id="sec.18-ssec.9-para1.b" guid="_b678ec3a-888c-4697-b868-e5b7e52acef4" provision.type="other"><no>(b)</no><block><txt break.before="0">the contents of any document, or a description of any thing, produced to the examiner;</txt></block></li><li id="sec.18-ssec.9-para1.c" guid="_8fad4bc1-256a-434e-8ea8-20fb823d9040" provision.type="other"><no>(c)</no><block><txt break.before="0">any information that might enable a person who has given evidence before the examiner to be identified;</txt></block></li><li id="sec.18-ssec.9-para1.d" guid="_e5a14b9e-21d5-45bd-8d0f-93eb7d4aa1ce" provision.type="other"><no>(d)</no><block><txt break.before="0">the fact that any person has given or may be about to give evidence at an examination.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.10" guid="_2628fccf-6c6a-4be8-ae5f-cd69045f02cd" affected.by.uncommenced="0" provision.type="other"><no>(10)</no><block><txt break.before="0">The examiner must give a direction under <intref refid="sec.18-ssec.9" target.guid="_ccc1eb5d-868a-4697-8a74-449465daac28" check="valid">subsection&#160;(9)</intref> if the failure to do so might prejudice the safety or reputation of a person or prejudice the fair trial of a person who has been, or may be, charged with an offence.</txt></block></subclause><subclause id="sec.18-ssec.11" guid="_f19f5ec9-152c-427b-8643-e11c9cd4867a" affected.by.uncommenced="0" provision.type="other"><no>(11)</no><block><txt break.before="0">Subject to <intref refid="sec.18-ssec.12" target.guid="_23a53d49-04d9-4f09-85c0-8d5a63b7a0a6" check="valid">subsection&#160;(12)</intref>, the CEO may, in writing, vary or revoke a direction under <intref refid="sec.18-ssec.9" target.guid="_ccc1eb5d-868a-4697-8a74-449465daac28" check="valid">subsection&#160;(9)</intref>.</txt></block></subclause><subclause id="sec.18-ssec.12" guid="_23a53d49-04d9-4f09-85c0-8d5a63b7a0a6" affected.by.uncommenced="0" provision.type="other"><no>(12)</no><block><txt break.before="0">The CEO must not vary or revoke a direction if to do so might prejudice the safety or reputation of a person or prejudice the fair trial of a person who has been or may be charged with an offence.</txt></block></subclause><subclause id="sec.18-ssec.13" guid="_c9dc0c93-db7e-4de8-b492-49104e58572f" affected.by.uncommenced="0" provision.type="other"><no>(13)</no><block><txt break.before="0">If—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.13-para1.a" guid="_b8957d6e-621c-44fd-96f1-37405009fd09" provision.type="other"><no>(a)</no><block><txt break.before="0">a person has been charged with an offence before a Federal Court or before a court of the State; and</txt></block></li><li id="sec.18-ssec.13-para1.b" guid="_c7cc733c-f9fe-4205-86a2-4a0aafe61bca" provision.type="other"><no>(b)</no><block><txt break.before="0">the court considers that it may be desirable in the interests of justice that particular evidence given before an examiner, being evidence in relation to which the examiner has given a direction under <intref refid="sec.18-ssec.9" target.guid="_ccc1eb5d-868a-4697-8a74-449465daac28" check="valid">subsection&#160;(9)</intref>, be made available to the person or to a lawyer representing the person;</txt></block></li></list></block><block><txt break.before="1">the court may give to the examiner or to the CEO a certificate to that effect.</txt></block></subclause><subclause id="sec.18-ssec.14" guid="_5f93a1ba-b521-4949-a227-ae28ea3fef47" affected.by.uncommenced="0" provision.type="other"><no>(14)</no><block><txt break.before="0">If a court gives a certificate to the examiner or CEO under <intref refid="sec.18-ssec.13" target.guid="_c9dc0c93-db7e-4de8-b492-49104e58572f" check="valid">subsection&#160;(13)</intref>, the examiner or the CEO must make the evidence available to the court.</txt></block></subclause><subclause id="sec.18-ssec.15" guid="_307d0504-6b71-4c34-bd64-557cbfce49fa" affected.by.uncommenced="0" provision.type="other"><no>(15)</no><block><txt break.before="0">If—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.15-para1.a" guid="_fcbb640d-36d3-4722-9c5f-5c90f59198d0" provision.type="other"><no>(a)</no><block><txt break.before="0">the examiner or the CEO makes evidence available to a court under <intref refid="sec.18-ssec.14" target.guid="_5f93a1ba-b521-4949-a227-ae28ea3fef47" check="valid">subsection&#160;(14)</intref>; and</txt></block></li><li id="sec.18-ssec.15-para1.b" guid="_cc636f97-35e1-4546-a54f-e7767ec8ab8a" provision.type="other"><no>(b)</no><block><txt break.before="0">the court, after examining the evidence, is satisfied that the interests of justice so require;</txt></block></li></list></block><block><txt break.before="1">the court may make the evidence available to the person charged with the offence concerned or to a lawyer representing the person.</txt></block></subclause><subclause id="sec.18-ssec.16" guid="_1ce8f03f-924e-455b-861d-8702e4af21dd" affected.by.uncommenced="0" provision.type="other"><no>(16)</no><block><txt break.before="0">A person must not make a publication in contravention of a direction given under <intref refid="sec.18-ssec.9" target.guid="_ccc1eb5d-868a-4697-8a74-449465daac28" check="valid">subsection&#160;(9)</intref>.</txt></block><penalty id="sec.18-ssec.16-pen" guid="_7705f3bd-7252-4d88-beb9-cd58120ebb0e"><block><txt break.before="1">Maximum penalty—30 penalty units or 1 year’s imprisonment.</txt></block></penalty></subclause><subclause id="sec.18-ssec.17" guid="_a27a4903-1255-4480-8a78-aa9987ae5633" affected.by.uncommenced="0" provision.type="other"><no>(17)</no><block><txt break.before="0">At the conclusion of an examination held by an examiner, the examiner must give the head of the special ACC operation/investigation—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.17-para1.a" guid="_581bdee1-85ad-4f27-b9a6-59e40fa0025c" provision.type="other"><no>(a)</no><block><txt break.before="0">a record of the proceedings of the examination; and</txt></block></li><li id="sec.18-ssec.17-para1.b" guid="_a4bdd3dd-9704-46a4-8020-829a4f2b98f6" provision.type="other"><no>(b)</no><block><txt break.before="0">any documents or other things given to the examiner at, or in connection with, the examination.</txt></block></li></list></block></subclause></clause><clause id="sec.19" guid="_ff45c314-1657-4bac-8895-8c43a3367c77" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" guid="_6559b070-9ef4-470f-9286-05eb367eb372">Power to summon witnesses and take evidence</heading><subclause id="sec.19-ssec.1" guid="_0dd6d0f5-9e45-4efe-946f-9e4ed9a0f2b0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An examiner may summon a person to appear before the examiner at an examination to give evidence and to produce the documents or other things, if any, referred to in the summons.</txt></block></subclause><subclause id="sec.19-ssec.2" guid="_2f95455b-4e14-46dd-8353-999384136ff7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Before issuing a summons under <intref refid="sec.19-ssec.1" target.guid="_0dd6d0f5-9e45-4efe-946f-9e4ed9a0f2b0" check="valid">subsection&#160;(1)</intref>, the examiner must be satisfied that it is reasonable in all the circumstances to do so.</txt></block></subclause><subclause id="sec.19-ssec.3" guid="_8b376514-bde1-4720-87f9-e83774d6a54e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The examiner must also record in writing the reasons for the issue of the summons.</txt></block></subclause><subclause id="sec.19-ssec.4" guid="_bf899d38-98b6-4ec5-8e74-d04cf546447c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A summons under <intref refid="sec.19-ssec.1" target.guid="_0dd6d0f5-9e45-4efe-946f-9e4ed9a0f2b0" check="valid">subsection&#160;(1)</intref> requiring a person to appear before an examiner at an examination must be accompanied by a copy of the determination of the Board that the State ACC intelligence operation is a special operation or that the State ACC investigation is a special investigation.</txt></block></subclause><subclause id="sec.19-ssec.5" guid="_da5cc02a-52e3-42ce-a218-5248852dd6d9" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A summons under <intref refid="sec.19-ssec.1" target.guid="_0dd6d0f5-9e45-4efe-946f-9e4ed9a0f2b0" check="valid">subsection&#160;(1)</intref> requiring a person to appear before an examiner at an examination must, unless the examiner issuing the summons is satisfied that, in the particular circumstances of the special ACC operation/investigation to which the examination relates, it would prejudice the effectiveness of the special ACC operation/investigation for the summons to do so, set out, so far as is reasonably practicable, the general nature of the matters in relation to which the examiner intends to question the person.</txt></block></subclause><subclause id="sec.19-ssec.6" guid="_e4e252d4-8969-4a5a-ac0b-137a893b6877" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Nothing in <intref refid="sec.19-ssec.5" target.guid="_da5cc02a-52e3-42ce-a218-5248852dd6d9" check="valid">subsection&#160;(5)</intref> prevents the examiner from questioning the person in relation to any matter that relates to a special ACC operation/investigation.</txt></block></subclause><subclause id="sec.19-ssec.7" guid="_72c450a7-67de-4932-8080-d1585de49eba" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The examiner who is holding an examination may require a person appearing at the examination to produce a document or other thing.</txt></block></subclause><subclause id="sec.19-ssec.8" guid="_f854600c-cd5d-4fe0-b00e-bda249d143ef" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">An examiner may, at an examination, take evidence on oath or affirmation and for that purpose—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.8-para1.a" guid="_9c2c6319-7ec7-4530-8824-a322cd387f48" provision.type="other"><no>(a)</no><block><txt break.before="0">the examiner may require a person appearing at the examination to give evidence either to take an oath or to make an affirmation in a form approved by the examiner; and</txt></block></li><li id="sec.19-ssec.8-para1.b" guid="_ebba4287-8f3a-4403-aefc-749cd8585b1e" provision.type="other"><no>(b)</no><block><txt break.before="0">the examiner, or a person who is an authorised person in relation to the ACC, may administer an oath or affirmation to a person so appearing at the examination.</txt></block></li></list></block></subclause><subclause id="sec.19-ssec.9" guid="_902c3cc0-3ec5-46f7-84c6-6a5f3ad64424" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">In this section, a reference to a person who is an authorised person in relation to the ACC is a reference to a person authorised in writing, or a person included in a class of persons authorised in writing, for the purposes of this section by the CEO.</txt></block></subclause><subclause id="sec.19-ssec.10" guid="_7294765c-40f9-4f82-848a-d5c9592f50ce" affected.by.uncommenced="0" provision.type="other"><no>(10)</no><block><txt break.before="0">The powers conferred by this section are not exercisable except for the purposes of a special ACC operation/investigation.</txt></block></subclause></clause><clause id="sec.20" guid="_13d40092-19fc-4351-baf8-e3f2d5278016" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_5322cb2b-806c-4c54-a0e4-a60009ca4e34">Power to obtain documents</heading><subclause id="sec.20-ssec.1" guid="_9a5d197e-d7f1-43ac-b0d6-ba8e0d699954" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An examiner may, by notice in writing served on a person, require the person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.1-para1.a" guid="_f4dfd4be-f86f-4541-9e57-e75a955f2855" provision.type="other"><no>(a)</no><block><txt break.before="0">to attend, at a time and place specified in the notice, before a person specified in the notice, being the examiner or a member of the staff of the ACC; and</txt></block></li><li id="sec.20-ssec.1-para1.b" guid="_a1d14bac-c55a-47ba-ae13-4545f325f778" provision.type="other"><no>(b)</no><block><txt break.before="0">to produce at that time and place to the person so specified a document or thing specified in the notice, being a document or thing that is relevant to a special ACC operation/investigation.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.2" guid="_753505a9-7f0c-4b85-ab2c-0ba77ccfff4a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Before issuing a notice under <intref refid="sec.20-ssec.1" target.guid="_9a5d197e-d7f1-43ac-b0d6-ba8e0d699954" check="valid">subsection&#160;(1)</intref>, the examiner must be satisfied that it is reasonable in all the circumstances to do so.</txt></block></subclause><subclause id="sec.20-ssec.3" guid="_4dbc2066-1a8f-435c-940a-ae2aad7344ef" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The examiner must record in writing the reasons for the issue of the notice.</txt></block></subclause><subclause id="sec.20-ssec.4" guid="_ae24a765-a2d1-43b2-94aa-3b9cf557d50a" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A notice may be issued under this section in relation to a special ACC operation/investigation, whether or not an examination before an examiner is being held for the purposes of the operation or investigation.</txt></block></subclause><subclause id="sec.20-ssec.5" guid="_74a517f6-35eb-42c3-9b5c-66c87b0b0cc8" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A person must not refuse or fail to comply with a notice served on the person under this section.</txt></block><penalty id="sec.20-ssec.5-pen" guid="_3bbd7b0c-3402-4313-b0ca-ede3a290309e"><block><txt break.before="1">Maximum penalty—300 penalty units or 5 years imprisonment.</txt></block></penalty></subclause><subclause id="sec.20-ssec.6" guid="_28fb32df-b57d-487e-b7d5-ac60dc25ad76" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The provisions of <intref refid="sec.23" target.guid="_9e15f57c-b63f-49bf-89a0-c5024a98fc3d" check="valid">section&#160;23</intref><intref refid="sec.23-ssec.3" target.guid="_bf97ffa1-cca6-489d-885b-43c1f8c9ad26" check="valid">(3)</intref> to <intref refid="sec.23-ssec.9" target.guid="_ea4c0e40-3b2a-4ff8-b5df-049126f502d0" check="valid">(9)</intref> apply in relation to a person who is required to produce a document or thing by a notice served on him or her under this section in the same way as they apply in relation to a person who is required to produce a document or thing at an examination before an examiner.</txt></block></subclause></clause><clause id="sec.21" guid="_c899cf56-d0d1-491c-b1fc-179e6d88ea52" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_42c4528e-9aa5-499b-9098-987e5b7e0ab4">Disclosure of summons or notice may be prohibited</heading><subclause id="sec.21-ssec.1" guid="_ee456c7f-69ca-4c9a-bd47-feecfa578faf" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The examiner issuing a summons under <intref refid="sec.19" target.guid="_ff45c314-1657-4bac-8895-8c43a3367c77" check="valid">section&#160;19</intref> or a notice under <intref refid="sec.20" target.guid="_13d40092-19fc-4351-baf8-e3f2d5278016" check="valid">section&#160;20</intref> must, or may, as provided in <intref refid="sec.21-ssec.2" target.guid="_bf5f83db-dab4-43f3-b0ad-9afe949195d9" check="valid">subsection&#160;(2)</intref>, include in it a notation to the effect that disclosure of information about the summons or notice, or any official matter connected with it, is prohibited except in the circumstances, if any, specified in the notation.</txt></block></subclause><subclause id="sec.21-ssec.2" guid="_bf5f83db-dab4-43f3-b0ad-9afe949195d9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A notation must not be included in the summons or notice except as follows—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.a" guid="_27d9be9e-4545-479f-a390-9e073ef1a039" provision.type="other"><no>(a)</no><block><txt break.before="0">the examiner must include the notation if satisfied that failure to do so would reasonably be expected to prejudice—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.a-para2.i" guid="_3d08ce44-ae5f-4fa0-91a6-798ae6f91a9c" provision.type="other"><no>(i)</no><block><txt break.before="0">the safety or reputation of a person; or</txt></block></li><li id="sec.21-ssec.2-para1.a-para2.ii" guid="_6f4d98e2-9fc1-49b9-aeb6-b16e9f6a0b28" provision.type="other"><no>(ii)</no><block><txt break.before="0">the fair trial of a person who has been or may be charged with an offence; or</txt></block></li><li id="sec.21-ssec.2-para1.a-para2.iii" guid="_4fa67422-61ce-4404-8c9a-98609d97d1c2" provision.type="other"><no>(iii)</no><block><txt break.before="0">the effectiveness of an operation or investigation;</txt></block></li></list></block></li><li id="sec.21-ssec.2-para1.b" guid="_36bae27f-3ae4-4bb8-b256-aad4c6a6b4bd" provision.type="other"><no>(b)</no><block><txt break.before="0">the examiner may include the notation if satisfied that failure to do so might prejudice—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.b-para2.i" guid="_d82c4243-5317-45e9-868d-90ac17442565" provision.type="other"><no>(i)</no><block><txt break.before="0">the safety or reputation of a person; or</txt></block></li><li id="sec.21-ssec.2-para1.b-para2.ii" guid="_cda5c3df-dacc-4281-ba8a-11e9992359e0" provision.type="other"><no>(ii)</no><block><txt break.before="0">the fair trial of a person who has been or may be charged with an offence; or</txt></block></li><li id="sec.21-ssec.2-para1.b-para2.iii" guid="_ac57ab87-ddce-458e-a0b2-d56e4c4ba6eb" provision.type="other"><no>(iii)</no><block><txt break.before="0">the effectiveness of an operation or investigation;</txt></block></li></list></block></li><li id="sec.21-ssec.2-para1.c" guid="_2453ffc3-60f3-4007-8849-c0f7bf774ab7" provision.type="other"><no>(c)</no><block><txt break.before="0">the examiner may include the notation if satisfied that failure to do so might otherwise be contrary to the public interest.</txt></block></li></list></block></subclause><subclause id="sec.21-ssec.3" guid="_ccfec5c8-6220-4844-90ae-5ca96a454ee0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a notation is included in the summons or notice, it must be accompanied by a written statement setting out the rights and obligations conferred or imposed by <intref refid="sec.22" target.guid="_1a59c9c0-d5b3-4f61-95b4-6fb826b6eb62" check="valid">section&#160;22</intref> on the person who was served with, or otherwise given, the summons or notice.</txt></block></subclause><subclause id="sec.21-ssec.4" guid="_8e7fbb8c-01e4-4781-bc5e-ce7204b0230c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A notation that is included under this section in any summons or notice relating to the operation or investigation is cancelled by this subsection if, after the ACC has concluded the operation or investigation concerned—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.4-para1.a" guid="_a98238d7-7c7b-4eca-a032-9585d7fca768" provision.type="other"><no>(a)</no><block><txt break.before="0">no evidence of an offence has been obtained as described in <intref refid="sec.34" target.guid="_99bd48ef-c1c6-41d6-8126-e2f65b80f092" check="valid">section&#160;34</intref><intref refid="sec.34-ssec.1" target.guid="_dc5c7c5b-6538-4f19-a3f0-96a742a29c13" check="valid">(1)</intref>; or</txt></block></li><li id="sec.21-ssec.4-para1.b" guid="_522dbe57-ec82-454c-a691-22e33fbf2341" provision.type="other"><no>(b)</no><block><txt break.before="0">evidence of an offence or offences has been assembled and given as required by <intref refid="sec.34" target.guid="_99bd48ef-c1c6-41d6-8126-e2f65b80f092" check="valid">section&#160;34</intref><intref refid="sec.34-ssec.1" target.guid="_dc5c7c5b-6538-4f19-a3f0-96a742a29c13" check="valid">(1)</intref> and the CEO has been advised that no person will be prosecuted; or</txt></block></li><li id="sec.21-ssec.4-para1.c" guid="_b44b7cde-45d2-48df-bdd3-b7d03e8b7b25" provision.type="other"><no>(c)</no><block><txt break.before="0">evidence of an offence or offences committed by only 1 person has been assembled and given as required by <intref refid="sec.34" target.guid="_99bd48ef-c1c6-41d6-8126-e2f65b80f092" check="valid">section&#160;34</intref><intref refid="sec.34-ssec.1" target.guid="_dc5c7c5b-6538-4f19-a3f0-96a742a29c13" check="valid">(1)</intref> and criminal proceedings have begun against that person; or</txt></block></li><li id="sec.21-ssec.4-para1.d" guid="_0e782efb-ce11-4a7b-b869-64e4ffea96a3" provision.type="other"><no>(d)</no><block><txt break.before="0">evidence of an offence or offences committed by 2 or more persons has been assembled and given as required by <intref refid="sec.34" target.guid="_99bd48ef-c1c6-41d6-8126-e2f65b80f092" check="valid">section&#160;34</intref><intref refid="sec.34-ssec.1" target.guid="_dc5c7c5b-6538-4f19-a3f0-96a742a29c13" check="valid">(1)</intref> and—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.4-para1.d-para2.i" guid="_36053604-778f-459c-acfd-92398d1df11f" provision.type="other"><no>(i)</no><block><txt break.before="0">criminal proceedings have begun against all those persons; or</txt></block></li><li id="sec.21-ssec.4-para1.d-para2.ii" guid="_d52edb10-b5d3-473f-a1e9-24975a373bf0" provision.type="other"><no>(ii)</no><block><txt break.before="0">criminal proceedings have begun against 1 or more of those persons and the CEO has been advised that no other of those persons will be prosecuted.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.21-ssec.5" guid="_408f6c8c-ee6f-42cf-a43b-ba989f431ff1" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If a notation is cancelled by <intref refid="sec.21-ssec.4" target.guid="_8e7fbb8c-01e4-4781-bc5e-ce7204b0230c" check="valid">subsection&#160;(4)</intref>, the CEO must serve a written notice of that fact on each person who was served with, or otherwise given, the summons or notice containing the notation.</txt></block></subclause><subclause id="sec.21-ssec.6" guid="_9350ae60-1f77-4634-ba0a-bb64514a0335" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.21-ssec.6-def.officialmatter_" guid="_d214f2e7-47ce-4cbd-945e-fc37db29e93f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.21-ssec.6-def.officialmatter" guid="_646b103e-d415-4700-b2dd-f248c9dbec0d" type="definition">official matter</defterm> has the same meaning as in <intref refid="sec.22" target.guid="_1a59c9c0-d5b3-4f61-95b4-6fb826b6eb62" check="valid">section&#160;22</intref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.22" guid="_1a59c9c0-d5b3-4f61-95b4-6fb826b6eb62" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>22</no><heading id="sec.22-he" guid="_ab885492-fc1c-4653-b810-f6585799ea3b">Offences of disclosure</heading><subclause id="sec.22-ssec.1" guid="_4512a913-8392-4407-8a3e-83a6f06e896c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person who is served with, or otherwise given, a summons or notice containing a notation made under <intref refid="sec.21" or</txt></block></li><li id="sec.22-ssec.1-para1.b" guid="_4cddba00-47c4-4f01-8ec1-5e685657f19e" provision.type="other"><no>(b)</no><block><txt break.before="0">the existence of, or any information about, any official matter connected with the summons or notice.</txt></block></li></list></block><penalty id="sec.22-ssec.1-pen" guid="_75b290de-98e0-4cd2-bfd8-9dfe99f37f7c"><block><txt break.before="1">Maximum penalty—30 penalty units or 1 year’s imprisonment.</txt></block></penalty></subclause><subclause id="sec.22-ssec.2" guid="_cfa7de3d-6a36-4e05-82aa-96f1af3042b6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.22-ssec.1" target.guid="_4512a913-8392-4407-8a3e-83a6f06e896c" check="valid">Subsection&#160;(1)</intref> does not prevent the person from making a disclosure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.2-para1.a" guid="_a3189b5e-6868-4346-bc93-fb8ac9e51956" provision.type="other"><no>(a)</no><block><txt break.before="0">in accordance with the circumstances, if any, specified in the notation; or</txt></block></li><li id="sec.22-ssec.2-para1.b" guid="_4666f820-8e46-49fa-8c72-122866376057" provision.type="other"><no>(b)</no><block><txt break.before="0">to a lawyer for the purpose of obtaining legal advice or representation relating to the summons, notice or matter; or</txt></block></li><li id="sec.22-ssec.2-para1.c" guid="_3b62088f-6458-404e-b153-3f748f5da6b7" provision.type="other"><no>(c)</no><block><txt break.before="0">if the person is a body corporate—to an officer or agent of the body corporate for the purpose of ensuring compliance with the summons or notice; or</txt></block></li><li id="sec.22-ssec.2-para1.d" guid="_405bc7b5-5f7a-45a0-9ebb-e81a1928ae3f" provision.type="other"><no>(d)</no><block><txt break.before="0">if the person is a lawyer—for the purpose of obtaining the agreement of another person under <intref refid="sec.23" target.guid="_9e15f57c-b63f-49bf-89a0-c5024a98fc3d" check="valid">section&#160;23</intref><intref refid="sec.23-ssec.3" target.guid="_bf97ffa1-cca6-489d-885b-43c1f8c9ad26" check="valid">(3)</intref> to the lawyer answering a question or producing a document at an examination before an examiner.</txt></block></li></list></block></subclause><subclause id="sec.22-ssec.3" guid="_21cf2afd-86d3-4fc4-ac82-4949e696ab62" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a disclosure is made to a person as permitted by <intref refid="sec.22-ssec.2" target.guid="_cfa7de3d-6a36-4e05-82aa-96f1af3042b6" check="valid">subsection&#160;(2)</intref> or <intref refid="sec.22-ssec.4" target.guid="_3f1d6ab2-173c-4708-94bc-cfdc00f42a77" check="valid">(4)</intref>, the following provisions apply—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.3-para1.a" guid="_93b3aa58-4bd0-4705-9f1a-8c141db8f9fd" provision.type="other"><no>(a)</no><block><txt break.before="0">while he or she is a person of a kind to whom a disclosure is so permitted to be made, he or she must not disclose the existence of, or any information about, the summons or notice, or any official matter connected with it, except as permitted by <intref refid="sec.22-ssec.4" target.guid="_3f1d6ab2-173c-4708-94bc-cfdc00f42a77" check="valid">subsection&#160;(4)</intref>;</txt></block></li><li id="sec.22-ssec.3-para1.b" guid="_1a7805ed-431f-404f-88cb-c42c6c261172" provision.type="other"><no>(b)</no><block><txt break.before="0">while he or she is no longer a person of a kind to whom a disclosure is so permitted to be made, he or she must not, in any circumstances, make a record of, or disclose the existence of, the summons, notice or matter, or disclose any information about any of them.</txt></block></li></list></block><penalty id="sec.22-ssec.3-pen" guid="_d4093f87-31ce-452f-8cdf-d87984722476"><block><txt break.before="1">Maximum penalty—30 penalty units or 1 year’s imprisonment.</txt></block></penalty></subclause><subclause id="sec.22-ssec.4" guid="_3f1d6ab2-173c-4708-94bc-cfdc00f42a77" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A person to whom information has been disclosed, as permitted by <intref refid="sec.22-ssec.2" target.guid="_cfa7de3d-6a36-4e05-82aa-96f1af3042b6" check="valid">subsection&#160;(2)</intref> or this subsection, may disclose that information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.4-para1.a" guid="_7a925f10-bca5-4215-abf6-d345fbf5287a" provision.type="other"><no>(a)</no><block><txt break.before="0">if the person is an officer or agent of a body corporate referred to in <intref refid="sec.22-ssec.2" target.guid="_cfa7de3d-6a36-4e05-82aa-96f1af3042b6" check="valid">subsection&#160;(2)</intref><intref refid="sec.22-ssec.2-para1.c" target.guid="_3b62088f-6458-404e-b153-3f748f5da6b7" check="valid">(c)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.4-para1.a-para2.i" guid="_1fe66e0b-6ede-4ee4-a98f-b9700be4ef90" provision.type="other"><no>(i)</no><block><txt break.before="0">to another officer or agent of the body corporate for the purpose of ensuring compliance with the summons or notice; or</txt></block></li><li id="sec.22-ssec.4-para1.a-para2.ii" guid="_879ea2f2-6a75-4f5c-94b0-2768929f28fa" provision.type="other"><no>(ii)</no><block><txt break.before="0">to a lawyer for the purpose of obtaining legal advice or representation relating to the summons, notice or matter; or</txt></block></li></list></block></li><li id="sec.22-ssec.4-para1.b" guid="_2b0854f2-8440-4bf8-a92b-5aa159007598" provision.type="other"><no>(b)</no><block><txt break.before="0">if the person is a lawyer—for the purpose of giving legal advice, or making representations, relating to the summons, notice or matter.</txt></block></li></list></block></subclause><subclause id="sec.22-ssec.5" guid="_6ca2704c-8f6b-46e5-9b4d-de8d28acf719" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">This section ceases to apply to a summons or notice after the sooner of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.5-para1.a" guid="_3cbd97a7-c2c4-49bb-bb39-1b9285707c5d" provision.type="other"><no>(a)</no><block><txt break.before="0">the cancellation of the notation contained in the summons or notice by <intref refid="sec.21" target.guid="_c899cf56-d0d1-491c-b1fc-179e6d88ea52" check="valid">section&#160;21</intref><intref refid="sec.21-ssec.4" target.guid="_8e7fbb8c-01e4-4781-bc5e-ce7204b0230c" check="valid">(4)</intref>; or</txt></block></li><li id="sec.22-ssec.5-para1.b" guid="_668ba53e-883a-4bcf-a7ce-4c7e572c5f16" provision.type="other"><no>(b)</no><block><txt break.before="0">the elapse of 5 years after the issue of the summons or notice.</txt></block></li></list></block></subclause><subclause id="sec.22-ssec.6" guid="_c554a9bf-c257-4fab-a180-1b63a5672952" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A reference in this section to disclosing something’s existence includes disclosing information from which a person could reasonably be expected to infer its existence.</txt></block></subclause><subclause id="sec.22-ssec.7" guid="_29a5c8eb-0d42-4722-898e-6a3773943c97" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.22-ssec.7-def.officialmatter_" guid="_e92f1bb4-38be-4a37-a244-7028b833b97a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.22-ssec.7-def.officialmatter" guid="_61acc4f0-e4ac-40d1-ba71-c21d9de7ffba" type="definition">official matter</defterm> means any of the following (whether past, present or contingent)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.7-def.officialmatter-para1.a" guid="_b1e80320-b380-49f5-bbb9-59e2b224b08e" provision.type="other"><no>(a)</no><block><txt break.before="0">the determination referred to in <intref refid="sec.19" target.guid="_ff45c314-1657-4bac-8895-8c43a3367c77" check="valid">section&#160;19</intref><intref refid="sec.19-ssec.4" target.guid="_bf899d38-98b6-4ec5-8e74-d04cf546447c" check="valid">(4)</intref>;</txt></block></li><li id="sec.22-ssec.7-def.officialmatter-para1.b" guid="_43511cf0-199a-4604-8472-ef268dbcc0a6" provision.type="other"><no>(b)</no><block><txt break.before="0">an ACC operation/investigation;</txt></block></li><li id="sec.22-ssec.7-def.officialmatter-para1.c" guid="_1983b027-a5c4-4cba-8a48-9bec5ab8bccc" provision.type="other"><no>(c)</no><block><txt break.before="0">an examination held by an examiner;</txt></block></li><li id="sec.22-ssec.7-def.officialmatter-para1.d" guid="_c984b762-1e5f-436b-bc8a-ae8736b18508" provision.type="other"><no>(d)</no><block><txt break.before="0">court proceedings.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.23" guid="_9e15f57c-b63f-49bf-89a0-c5024a98fc3d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_ff7d949d-5448-47b6-bd33-7b41d8e86794">Failure of witnesses to attend and answer questions</heading><subclause id="sec.23-ssec.1" guid="_20e60a15-eab0-4cda-99e0-0501002eb921" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person served, as prescribed, with a summons to appear as a witness at an examination before an examiner must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.1-para1.a" guid="_2b05fbd6-2a21-4fc6-affd-a066bc359f02" provision.type="other"><no>(a)</no><block><txt break.before="0">fail to attend as required by the summons; or</txt></block></li><li id="sec.23-ssec.1-para1.b" guid="_c0a48b55-43e9-429d-9389-5d8ce6e2e277" provision.type="other"><no>(b)</no><block><txt break.before="0">fail to attend from day to day unless excused, or released from further attendance, by the examiner.</txt></block></li></list></block><penalty id="sec.23-ssec.1-pen" guid="_5cbd8681-7b52-4864-bec4-6d2c8cc787fc"><block><txt break.before="1">Maximum penalty—300 penalty units or 5 years imprisonment.</txt></block></penalty></subclause><subclause id="sec.23-ssec.2" guid="_61ef55f6-efc4-4fa4-acd4-ab57f6ea9b37" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person appearing as a witness at an examination before an examiner must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.2-para1.a" guid="_fd64ea3d-7df1-4e24-9078-d356c356927a" provision.type="other"><no>(a)</no><block><txt break.before="0">when required under <intref refid="sec.19" target.guid="_ff45c314-1657-4bac-8895-8c43a3367c77" check="valid">section&#160;19</intref> either to take an oath or make an affirmation—refuse or fail to comply with the requirement; or</txt></block></li><li id="sec.23-ssec.2-para1.b" guid="_43b7a63e-0206-48e9-9c4f-3ef766f5f9fc" provision.type="other"><no>(b)</no><block><txt break.before="0">refuse or fail to answer a question that he or she is required to answer by the examiner; or</txt></block></li><li id="sec.23-ssec.2-para1.c" guid="_ec3a7795-ef15-4445-a626-4aae9307cd90" provision.type="other"><no>(c)</no><block><txt break.before="0">refuse or fail to produce a document or thing that he or she was required to produce by a summons under this Act served on him or her as prescribed.</txt></block></li></list></block><penalty id="sec.23-ssec.2-pen" guid="_fff49ca8-f998-4429-b683-2eee3a138988"><block><txt break.before="1">Maximum penalty—300 penalty units or 5 years imprisonment.</txt></block></penalty></subclause><subclause id="sec.23-ssec.3" guid="_bf97ffa1-cca6-489d-885b-43c1f8c9ad26" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sec.23-ssec.4" target.guid="_ea4c8973-75ef-4f39-8d16-f6ee92e40075" check="valid">Subsection&#160;(4)</intref> applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.3-para1.a" guid="_a526052c-3114-4a8c-8481-1e4b60d9132b" provision.type="other"><no>(a)</no><block><txt break.before="0">a lawyer is required to answer a question or produce a document at an examination before an examiner; and</txt></block></li><li id="sec.23-ssec.3-para1.b" guid="_e66c2c5a-6da7-4a70-9e67-838866b5776a" provision.type="other"><no>(b)</no><block><txt break.before="0">the answer to the question would disclose, or the document contains, a privileged communication made by or to the lawyer in his or her capacity as a lawyer.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.4" guid="_ea4c8973-75ef-4f39-8d16-f6ee92e40075" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The lawyer is entitled to refuse to comply with the requirement unless the person to whom or by whom the communication was made agrees to the lawyer complying with the requirement.</txt></block></subclause><subclause id="sec.23-ssec.5" guid="_dbf410eb-b184-41f4-a54d-e1c7b2652b57" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the lawyer refuses to comply with the requirement, he or she must, if so required by the examiner, give the examiner the name and address of the person to whom or by whom the communication was made.</txt></block><penalty id="sec.23-ssec.5-pen" guid="_63423063-289f-4023-8966-7c3787e7a871"><block><txt break.before="1">Maximum penalty—300 penalty units or 5 years imprisonment.</txt></block></penalty></subclause><subclause id="sec.23-ssec.6" guid="_25d54dd7-8379-41e1-b289-2a72330fc362" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0"><intref refid="sec.23-ssec.8" target.guid="_f889c8c3-9ab8-40e0-b0ec-4c405a2f4e48" check="valid">Subsection&#160;(8)</intref> limits the use that can be made of any answers given at an examination before an examiner, or documents or things produced at an examination before an examiner.</txt></block></subclause><subclause id="sec.23-ssec.7" guid="_4cfc5d8f-af70-4164-bd79-e17d748158db" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0"><intref refid="sec.23-ssec.8" target.guid="_f889c8c3-9ab8-40e0-b0ec-4c405a2f4e48" check="valid">Subsection&#160;(8)</intref> only applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.7-para1.a" guid="_521700e8-3700-439c-bf7a-b7e976453736" provision.type="other"><no>(a)</no><block><txt break.before="0">a person appearing as a witness at an examination before an examiner—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.7-para1.a-para2.i" guid="_3faab8bb-40a8-45ae-84b4-5d3f5e830e72" provision.type="other"><no>(i)</no><block><txt break.before="0">answers a question that he or she is required to answer by the examiner; or</txt></block></li><li id="sec.23-ssec.7-para1.a-para2.ii" guid="_8fe806b1-75f7-464e-a01d-12004d5b45f2" provision.type="other"><no>(ii)</no><block><txt break.before="0">produces a document or thing that he or she was required to produce by a summons under this Act served on him or her as prescribed; and</txt></block></li></list></block></li><li id="sec.23-ssec.7-para1.b" guid="_e19bfa16-4c0e-47d5-a2df-b701f64ecfbe" provision.type="other"><no>(b)</no><block><txt break.before="0">for the production of a document that is, or forms part of, a record of an existing or past business, the document—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.7-para1.b-para2.i" guid="_84c04a64-5c72-4023-bdf2-4883a6fa2c80" provision.type="other"><no>(i)</no><block><txt break.before="0">sets out details of earnings received by the person from his or her employment; and</txt></block></li><li id="sec.23-ssec.7-para1.b-para2.ii" guid="_bc674adc-7297-4184-875a-54d873dfb3d5" provision.type="other"><no>(ii)</no><block><txt break.before="0">does not set out any other information; and</txt></block></li></list></block></li><li id="sec.23-ssec.7-para1.c" guid="_cfb100b7-74b5-40ae-b373-56daa46253d6" provision.type="other"><no>(c)</no><block><txt break.before="0">before answering the question or producing the document or thing, the person claims that the answer, or the production of the document or thing, might tend to incriminate the person or make the person liable to a penalty.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.8" guid="_f889c8c3-9ab8-40e0-b0ec-4c405a2f4e48" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">The answer, or the document or thing, is not admissible in evidence against the person in a criminal proceeding, or a proceeding for the imposition of a penalty, other than—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.8-para1.a" guid="_ff6626eb-feb1-4ef0-9073-2ba93b001c7e" provision.type="other"><no>(a)</no><block><txt break.before="0">confiscation proceedings; or</txt></block></li><li id="sec.23-ssec.8-para1.b" guid="_07f1092e-849d-444f-bf74-262cebd7ed08" provision.type="other"><no>(b)</no><block><txt break.before="0">a proceeding in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.8-para1.b-para2.i" guid="_e23d12e8-b22f-4b46-8dd4-d780f1aac7d5" provision.type="other"><no>(i)</no><block><txt break.before="0">in the case of an answer—the falsity of the answer; or</txt></block></li><li id="sec.23-ssec.8-para1.b-para2.ii" guid="_04b7e85d-1b90-4308-8086-5ca2e0533ea8" provision.type="other"><no>(ii)</no><block><txt break.before="0">in the case of the production of a document—the falsity of any statement contained in the document.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.23-ssec.9" guid="_ea4c0e40-3b2a-4ff8-b5df-049126f502d0" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0"><intref refid="sec.23-ssec.4" target.guid="_ea4c8973-75ef-4f39-8d16-f6ee92e40075" check="valid">Subsection&#160;(4)</intref> does not affect the law relating to legal professional privilege.</txt></block></subclause></clause><clause id="sec.24" guid="_c05d19e4-5de0-4d27-9b2f-6bf81f9339fb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>24</no><heading id="sec.24-he" guid="_267437c2-cf50-4563-97c1-0af9337a52c0">Warrant for arrest of witness</heading><subclause id="sec.24-ssec.1" guid="_a5d429c0-c48c-414d-9937-31af8e599d67" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">On application by an examiner, a judge of the Federal Court or the Supreme Court may issue a warrant for the apprehension of a person if the judge is satisfied by evidence on oath that there are reasonable grounds to believe—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.1-para1.a" guid="_0bc98455-1275-4858-a142-44870239890e" provision.type="other"><no>(a)</no><block><txt break.before="0">that the person has been ordered, under <intref refid="sec.28" target.guid="_6d492898-0b74-49cb-aad4-7284bc30f98b" check="valid">section&#160;28</intref>, to deliver his or her passport to the examiner, whether or not the person has complied with the order, but is nevertheless likely to leave Australia for the purpose of avoiding giving evidence before the examiner; or</txt></block></li><li id="sec.24-ssec.1-para1.b" guid="_887b2b19-1169-4e72-a7ac-c188801a9a2c" provision.type="other"><no>(b)</no><block><txt break.before="0">that a summons has been issued under <intref refid="sec.19" target.guid="_ff45c314-1657-4bac-8895-8c43a3367c77" check="valid">section&#160;19</intref><intref refid="sec.19-ssec.1" target.guid="_0dd6d0f5-9e45-4efe-946f-9e4ed9a0f2b0" check="valid">(1)</intref> in relation to the person, and the person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.1-para1.b-para2.i" guid="_48bcd245-3242-4406-9792-0c21f7909327" provision.type="other"><no>(i)</no><block><txt break.before="0">has absconded or is likely to abscond; or</txt></block></li><li id="sec.24-ssec.1-para1.b-para2.ii" guid="_f1a6ebb8-8c43-46dc-b640-019d45a3b777" provision.type="other"><no>(ii)</no><block><txt break.before="0">is otherwise attempting, or is otherwise likely to attempt, to evade service of the summons; or</txt></block></li></list></block></li><li id="sec.24-ssec.1-para1.c" guid="_a8662ed6-576d-4f73-8254-496a53ebea2b" provision.type="other"><no>(c)</no><block><txt break.before="0">that the person has committed an offence under <intref refid="sec.23" target.guid="_9e15f57c-b63f-49bf-89a0-c5024a98fc3d" check="valid">section&#160;23</intref><intref refid="sec.23-ssec.1" target.guid="_20e60a15-eab0-4cda-99e0-0501002eb921" check="valid">(1)</intref> or is likely to do so.</txt></block></li></list></block></subclause><subclause id="sec.24-ssec.2" guid="_04cbd258-487a-4cbd-a205-74170f9fe71f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The warrant may be executed by any person to whom it is addressed and the person executing it has power to break into and enter any premises, vessel, aircraft or vehicle for the purpose of executing it.</txt></block></subclause><subclause id="sec.24-ssec.3" guid="_4dd1e395-6d0f-4410-83b2-419932af218f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A member of the Australian Federal Police can not execute the warrant unless he or she is also a member of the staff of the ACC.</txt></block></subclause><subclause id="sec.24-ssec.4" guid="_914effe3-142f-4dbc-ac72-af1194c31f67" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The warrant may be executed even if the warrant is not at the time in the possession of the person executing it.</txt></block></subclause><subclause id="sec.24-ssec.5" guid="_1c8526ca-a463-43f4-8696-1978f19bbd21" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A person executing the warrant may only use the reasonable force that is necessary for the execution.</txt></block></subclause><subclause id="sec.24-ssec.6" guid="_55b8a7a1-69cc-4aad-ba85-0b7b905ca0d6" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If a person is apprehended under the warrant, he or she must be brought, as soon as practicable, before a judge of the Federal Court or the Supreme Court.</txt></block></subclause><subclause id="sec.24-ssec.7" guid="_e4341c8b-9847-4749-bf70-56c00513f656" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The judge may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.7-para1.a" guid="_05963fed-d8cd-4303-8e6f-33197a93801c" provision.type="other"><no>(a)</no><block><txt break.before="0">admit the person to bail, with the security the judge thinks fit, on the conditions he or she thinks necessary to ensure the appearance of the person as a witness before the examiner; or</txt></block></li><li id="sec.24-ssec.7-para1.b" guid="_64da46e4-a7a9-4c10-b0f8-d007b4a5ea49" provision.type="other"><no>(b)</no><block><txt break.before="0">order the continued detention of the person for the purposes of ensuring his or her appearance as a witness before the examiner; or</txt></block></li><li id="sec.24-ssec.7-para1.c" guid="_7711333d-184c-4cc0-9354-c86ce0a7aff2" provision.type="other"><no>(c)</no><block><txt break.before="0">order the release of the person.</txt></block></li></list></block></subclause><subclause id="sec.24-ssec.8" guid="_e65e201e-7243-4a30-9377-0816704a0864" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">If a person is under detention under this section, he or she must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.8-para1.a" guid="_970352cc-883b-4203-982f-e7c00e8c713f" provision.type="other"><no>(a)</no><block><txt break.before="0">within 14 days after he or she was brought, or last brought, before a judge of the Federal Court or the Supreme Court under this section; or</txt></block></li><li id="sec.24-ssec.8-para1.b" guid="_ffbc3c89-afd9-4714-a68a-f44a3b99ec8b" provision.type="other"><no>(b)</no><block><txt break.before="0">within the shorter or longer time as a judge has fixed on the last previous appearance of the person before a judge under this section;</txt></block></li></list></block><block><txt break.before="1">be again brought before a judge.</txt></block></subclause><subclause id="sec.24-ssec.9" guid="_0846bf37-e5aa-4422-ac85-14a1d8c9d8f8" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">The judge may then exercise any of the powers of a judge under <intref refid="sec.24-ssec.7" target.guid="_e4341c8b-9847-4749-bf70-56c00513f656" check="valid">subsection&#160;(7)</intref>.</txt></block></subclause><subclause id="sec.24-ssec.10" guid="_fe74fbc7-e3e0-47a0-9d06-f25eab592f5b" affected.by.uncommenced="0" Territories.</txt></definition></deflist></block></subclause></clause><clause id="sec.25" guid="_abfa6d02-fd54-4092-8e2b-a640809817d7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>25</no><heading id="sec.25-he" guid="_e35cdbae-559d-481e-a008-e4e0a80c9ad1">False or misleading evidence</heading><block><txt break.before="1">A person must not, at an examination before an examiner, give evidence that the person knows is false or misleading in a material particular.</txt></block><penalty id="sec.25-pen" guid="_68023434-7e95-4279-a7cc-370a861a273b"><block><txt break.before="1">Maximum penalty—300 penalty units or 5 years imprisonment.</txt></block></penalty></clause><clause id="sec.26" guid="_d3f9cb5d-c2b6-4f2d-95f9-a63cc9a8e890" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>26</no><heading id="sec.26-he" guid="_7b19711b-f3d5-4f42-8a83-90ddc2cc9b4a">Protection of witnesses from harm or intimidation</heading><subclause id="sec.26-ssec.1" guid="_221b3243-b8a4-4e0a-9fbf-7974e34114b8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if it appears to an examiner that, because of the fact that a person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.1-para1.a" guid="_b2e70c26-8e6c-463e-8693-292d9c3276a5" provision.type="other"><no>(a)</no><block><txt break.before="0">is to appear, is appearing or has appeared at an examination before the examiner to give evidence or to produce a document or thing; or</txt></block></li><li id="sec.26-ssec.1-para1.b" guid="_a5ebf179-7efd-4aa0-bdc0-a4e9a4688c3e" provision.type="other"><no>(b)</no><block><txt break.before="0">proposes to give or has given information, or proposes to produce or has produced a document or thing, to the ACC otherwise than at an examination before the examiner;</txt></block></li></list></block><block><txt break.before="1">the safety of the person may be prejudiced or the person may be subjected to intimidation or harassment.</txt></block></subclause><subclause id="sec.26-ssec.2" guid="_c346db4a-ac6a-4dd6-8991-ef16847421c9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The examiner may make the arrangements (including arrangements with the State Minister or with members of the Australian Federal Police or of the Queensland Police Service) that are necessary to avoid prejudice to the safety of the person, or to protect the person from intimidation or harassment.</txt></block></subclause></clause><clause id="sec.27" guid="_0adcb3ae-afc6-4024-bab6-e3b69cb76b3d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>27</no><heading id="sec.27-he" guid="_4f8ea8fd-9564-4278-9b00-e4cd9f1d6bc7">Legal protection of examiners, counsel and witnesses</heading><subclause id="sec.27-ssec.1" guid="_8958715d-b038-42ad-8ce2-97484b1ab524" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An examiner has, in the performance of his or her functions or the exercise of his or her powers as an examiner in relation to an examination before the examiner, the same protection and immunity as a justice of the High Court.</txt></block></subclause><subclause id="sec.27-ssec.2" guid="_787daaeb-3b25-44e0-8823-491b3350650c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A lawyer assisting the ACC or an examiner or representing a person at an examination before an examiner has the same protection and immunity as a barrister has in appearing for a party in proceedings in the High Court.</txt></block></subclause><subclause id="sec.27-ssec.3" guid="_eafc63c5-995f-4c48-9a98-1a0f9b69ccb3" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Subject to this Act, a person summoned to attend or appearing before an examiner as a witness has the same protection as a witness in proceedings in the High Court.</txt></block></subclause></clause><clause id="sec.28" guid="_6d492898-0b74-49cb-aad4-7284bc30f98b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>28</no><heading id="sec.28-he" guid="_13e45b81-fa90-465d-816e-8a2b3f89b76e">Order for delivery to examiner of passport of witness</heading><subclause id="sec.28-ssec.1" guid="_6db8af83-77fc-4341-a27b-09441fd97b0e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0"><intref refid="sec.28-ssec.2" target.guid="_3057827a-c68f-40ce-a3e4-42d1b1d7e8fe" check="valid">Subsection&#160;(2)</intref> applies if, on application by an examiner, a judge of the Federal Court sitting in chambers is satisfied by evidence on oath that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.1-para1.a" guid="_cebbb351-e8d1-4f32-bdbb-0b6071d0cbab" provision.type="other"><no>(a)</no><block><txt break.before="0">in connection with a special ACC operation/investigation, a summons has been issued under this Act requiring a person to appear before an examiner at an examination (whether or not the summons has been served), or a person has appeared before an examiner at an examination, to give evidence or to produce documents or other things; and</txt></block></li><li id="sec.28-ssec.1-para1.b" guid="_4a78026e-5f2a-4de9-bb21-cf631b08550f" provision.type="other"><no>(b)</no><block><txt break.before="0">there are reasonable grounds for believing that the person may be able to give to the examiner evidence or further evidence that is, or to produce to the examiner documents or other things or further documents or other things that are, relevant to the special ACC operation/investigation and could be of particular significance to the special ACC operation/investigation; and</txt></block></li><li id="sec.28-ssec.1-para1.c" guid="_f351ebe2-7869-4c33-ac5b-e2f1f5ecf219" provision.type="other"><no>(c)</no><block><txt break.before="0">there are reasonable grounds for suspecting that the person intends to leave Australia and has in his or her possession, custody or control a passport issued to him or her.</txt></block></li></list></block></subclause><subclause id="sec.28-ssec.2" guid="_3057827a-c68f-40ce-a3e4-42d1b1d7e8fe" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The judge may make an order requiring the person to appear before a judge of the Federal Court on a date, and at a time and place, specified in the order to show cause why he or she should not be ordered to deliver the passport to the examiner.</txt></block></subclause><subclause id="sec.28-ssec.3" guid="_3d574bc7-c5c3-4ee0-b260-288430476998" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a person appears before a judge of the Federal Court under an order made under <intref refid="sec.28-ssec.2" target.guid="_3057827a-c68f-40ce-a3e4-42d1b1d7e8fe" check="valid">subsection&#160;(2)</intref>, the judge may, if he or she thinks fit, make an order—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.3-para1.a" guid="_1d6a385c-3d26-4acf-98a6-9e650dbbf4ba" provision.type="other"><no>(a)</no><block><txt break.before="0">requiring the person to deliver to the examiner any passport issued to him or her that is in his or her possession, custody or control; and</txt></block></li><li id="sec.28-ssec.3-para1.b" guid="_8d098026-c183-4130-84b0-c77984af6be4" provision.type="other"><no>(b)</no><block><txt break.before="0">authorising the examiner to retain the passport until the expiration of the period, not exceeding one month, specified in the order.</txt></block></li></list></block></subclause><subclause id="sec.28-ssec.4" guid="_b68fadb7-1cac-4fe5-88f8-bdc5f506a4e0" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A judge of the Federal Court may, on application by the examiner, extend for a further period (not exceeding 1 month) or further periods (not exceeding 1 month in each case) the period for which the examiner is authorised to retain a passport under an order made under <intref refid="sec.28-ssec.3" target.guid="_3d574bc7-c5c3-4ee0-b260-288430476998" check="valid">subsection&#160;(3)</intref>, but so that the total period for which the examiner is authorised to retain the passport does not exceed 3 months.</txt></block></subclause><subclause id="sec.28-ssec.5" guid="_d9151975-3d3c-4964-8c06-74017b45fd3c" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A judge of the Federal Court may, at any time while the examiner is authorised under an order made under this section to retain a passport issued to a person, on application made by the person, revoke the order and, if the order is revoked, the examiner must immediately return the passport to the person.</txt></block></subclause><subclause id="sec.28-ssec.6" guid="_c857afa7-1096-4ba2-80df-5ce0835866f3" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.28-ssec.6-def.Australia_" guid="_acb6aa09-b262-4aaa-8e18-41777390ef68" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.28-ssec.6-def.Australia" guid="_84df59a0-f401-47b8-8020-acff3ac4991b" type="definition">Australia</defterm> includes the external Territories.</txt></definition></deflist></block></subclause></clause></part><part id="pt.4" guid="_b2878ea6-c2f4-4829-8105-3e75f24d28d0" affected.by.uncommenced="0"><no>Part 4</no><heading id="pt.4-he" guid="_4e77986e-6b6a-4076-913a-be01b4cdf02f">Search warrants</heading><clause id="sec.29" guid="_e5171761-2f47-4163-bbba-25743c06843b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>29</no><heading id="sec.29-he" guid="_c7e76ad3-8fa8-4e62-a37d-369ab99da50f">Search warrants</heading><subclause id="sec.29-ssec.1" guid="_9041decc-5582-4ef1-bab8-29ca5db4eacf" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An eligible person may apply to an issuing officer for the issue of a warrant under <intref refid="sec.29-ssec.2" target.guid="_ee3f4413-3ff7-4bdb-ad74-f81e24261801" check="valid">subsection&#160;(2)</intref> if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.1-para1.a" guid="_b142cd75-ae4a-4872-98a2-b30d88548029" provision.type="other"><no>(a)</no><block><txt break.before="0">the eligible person has reasonable grounds for suspecting that, on a particular day (the <defterm id="sec.29-ssec.1-def.relevantday" guid="_96c07026-96aa-4771-8e2f-266aefffc2b9" type="definition">relevant day</defterm>), being the day on which, or a particular day within 1 month after the day on which, the application is made, there may be, on any land or on or in any premises, vessel, aircraft or vehicle, a thing of a particular kind connected with a special ACC operation/investigation (a <defterm id="sec.29-ssec.1-def.thingoftherelevantkind" guid="_e21863f8-12b4-4424-9404-ccb517fc4cb4" type="definition">thing of the relevant kind</defterm>); and</txt></block></li><li id="sec.29-ssec.1-para1.b" guid="_c324e0dc-f65d-4186-88fe-7494fbb5d456" provision.type="other"><no>(b)</no><block><txt break.before="0">the eligible person believes on reasonable grounds that, if a summons were issued for the production of the thing, the thing might be concealed, lost, mutilated or destroyed.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.2" guid="_ee3f4413-3ff7-4bdb-ad74-f81e24261801" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If an application under <intref refid="sec.29-ssec.1" target.guid="_9041decc-5582-4ef1-bab8-29ca5db4eacf" check="valid">subsection&#160;(1)</intref> is made, the issuing officer may issue a warrant authorising a person named in the warrant (the <defterm id="sec.29-def.authorisedperson" guid="_dc3d7788-0eac-436c-b164-4a5d7688f09b" type="definition">authorised person</defterm>), with the assistance the authorised person thinks necessary and if necessary by force—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.2-para1.a" guid="_a2216309-3354-4edc-8e8a-8c0c34a03c20" provision.type="other"><no>(a)</no><block><txt break.before="0">to enter the land or on or into the premises, vessel, aircraft or vehicle; and</txt></block></li><li id="sec.29-ssec.2-para1.b" guid="_140508a9-677b-4eb5-86d2-b180a87e5709" provision.type="other"><no>(b)</no><block><txt break.before="0">to search the land, premises, vessel, aircraft or vehicle for a thing of the relevant kind; and</txt></block></li><li id="sec.29-ssec.2-para1.c" guid="_b7b71468-f2ae-4c21-8ffa-c862ed4b1852" provision.type="other"><no>(c)</no><block><txt break.before="0">to seize any thing of the relevant kind found on the land or on or in the premises, vessel, aircraft or vehicle; and</txt></block></li><li id="sec.29-ssec.2-para1.d" guid="_21e17995-488b-465f-9d83-cf5839c8244e" provision.type="other"><no>(d)</no><block><txt break.before="0">deliver a thing so seized to any person participating in the special ACC operation/investigation.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.3" guid="_c71c61ec-957b-4bb7-8b92-5118056ce382" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A member of the Australian Federal Police can not be an authorised person unless he or she is also a member of the staff of the ACC.</txt></block></subclause><subclause id="sec.29-ssec.4" guid="_dab5ab4e-3081-4470-bab2-e07b9b112dc5" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">An issuing officer must not issue a warrant under <intref refid="sec.29-ssec.2" target.guid="_ee3f4413-3ff7-4bdb-ad74-f81e24261801" check="valid">subsection&#160;(2)</intref> unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.4-para1.a" guid="_e98194ba-713a-4ee9-b44d-9e3f7c4b9e3f" provision.type="other"><no>(a)</no><block><txt break.before="0">an affidavit has been given to him or her setting out the grounds on which the issue of the warrant is being sought; and</txt></block></li><li id="sec.29-ssec.4-para1.b" guid="_2ca4302f-296d-4e2a-b3ce-6a52b7832235" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant, or some other person, has given to the issuing officer, either orally or by affidavit, the further information, if any, the issuing officer requires concerning the grounds on which the issue of the warrant is being sought; and</txt></block></li><li id="sec.29-ssec.4-para1.c" guid="_54fc9811-3269-4f6a-9e02-85c97c78aa69" provision.type="other"><no>(c)</no><block><txt break.before="0">the issuing officer is satisfied that there are reasonable grounds for issuing the warrant.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.5" guid="_dbb0d57d-e851-4ef6-94e5-fd1fb411b01f" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If an issuing officer issues a warrant under <intref refid="sec.29-ssec.2" target.guid="_ee3f4413-3ff7-4bdb-ad74-f81e24261801" check="valid">subsection&#160;(2)</intref>, he or she must state on the affidavit given to him or her as mentioned in <intref refid="sec.29-ssec.4" target.guid="_dab5ab4e-3081-4470-bab2-e07b9b112dc5" check="valid">subsection&#160;(4)</intref><intref refid="sec.29-ssec.4-para1.a" target.guid="_e98194ba-713a-4ee9-b44d-9e3f7c4b9e3f" check="valid">(a)</intref> which of the grounds specified in that affidavit he or she has relied on to justify the issue of the warrant and particulars of any other grounds relied on by him or her to justify the issue of the warrant.</txt></block></subclause><subclause id="sec.29-ssec.6" guid="_cab00cf4-4346-481e-aa6d-3b9cf3d3ef37" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A warrant issued under this section must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.6-para1.a" guid="_21819d03-982a-4539-9fa2-4949b1ff7ff5" provision.type="other"><no>(a)</no><block><txt break.before="0">include a statement of the purpose for which the warrant is issued, which must include a reference to the special ACC operation/investigation and with which the thing of the relevant kind is connected; and</txt></block></li><li id="sec.29-ssec.6-para1.b" guid="_476f1b4f-9a4a-40a2-beea-975b2ca5b35e" provision.type="other"><no>(b)</no><block><txt break.before="0">state whether entry is authorised to be made at any time of the day or night or during specified hours of the day or night; and</txt></block></li><li id="sec.29-ssec.6-para1.c" guid="_6a93fc5f-e87e-4bf7-9783-97e4e8072559" provision.type="other"><no>(c)</no><block><txt break.before="0">include a description of the kind of thing authorised to be seized; and</txt></block></li><li id="sec.29-ssec.6-para1.d" guid="_5dd55433-6db0-4ddf-946e-fcb35514e977" provision.type="other"><no>(d)</no><block><txt break.before="0">specify a date, not being later than 1 month after the date of issue of the warrant, on which the warrant ceases to have effect.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.7" guid="_3c5b7b7d-dab0-4ef3-a934-1609ee66c1c6" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">A warrant issued under this section may be executed, in accordance with its terms, at any time during the period commencing on the relevant day and ending on the date specified in the warrant as the date on which the warrant ceases to have effect.</txt></block></subclause><subclause id="sec.29-ssec.8" guid="_b3754b10-901a-4d41-96d1-6af189b457ef" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">A person executing a warrant issued under this section may only use the reasonable force necessary for the execution.</txt></block></subclause><subclause id="sec.29-ssec.9" guid="_c97d3f49-7dc2-4f42-897d-5506d3143f89" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0"><intref refid="sec.29-ssec.10" target.guid="_7c6f9400-3b83-4ec0-afed-d47b2631e236" check="valid">Subsection&#160;(10)</intref> applies if, in the course of searching, under a warrant issued under this section, for a thing of the relevant kind, the person executing the warrant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.9-para1.a" guid="_b7086359-93e8-44e5-88a0-88fc57576ea7" provision.type="other"><no>(a)</no><block><txt break.before="0">finds a thing that he or she believes on reasonable grounds to be evidence that would be admissible in the prosecution of a person for an offence against a law of the Commonwealth or of a State, or of a Territory; and</txt></block></li><li id="sec.29-ssec.9-para1.b" guid="_4daa5002-0947-41fe-a884-6a80878b6612" provision.type="other"><no>(b)</no><block><txt break.before="0">believes on reasonable grounds that it is necessary to seize the thing to prevent its concealment, loss, mutilation or destruction, or its use in committing the offence.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.10" guid="_7c6f9400-3b83-4ec0-afed-d47b2631e236" affected.by.uncommenced="0" provision.type="other"><no>(10)</no><block><txt break.before="0">The person may seize the thing and, if he or she does so, the thing is to be taken, for the purposes of this Act, to have been seized under the warrant.</txt></block></subclause><subclause id="sec.29-ssec.11" guid="_c186e003-3afe-4002-a383-ad8cf2d1e3e1" affected.by.uncommenced="0" provision.type="other"><no>(11)</no><block><txt break.before="0">If a thing is seized under a warrant issued under this section—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.11-para1.a" guid="_6f360e55-ed4c-4ee2-aff5-622a91f45bcb" provision.type="other"><no>(a)</no><block><txt break.before="0">the head of the special ACC operation/investigation may retain the thing if, and for so long as, retention of the thing by the head of the special ACC operation/investigation is reasonably necessary for the purposes of the special ACC operation/investigation to which the thing is relevant; and</txt></block></li><li id="sec.29-ssec.11-para1.b" guid="_e95363c1-6010-4d8c-ae93-86ed874ad95f" provision.type="other"><no>(b)</no><block><txt break.before="0">if the retention of the thing by the head of the special ACC operation/investigation is not, or ceases to be, reasonably necessary for the purposes mentioned in <intref refid="sec.29-ssec.11-para1.a" target.guid="_6f360e55-ed4c-4ee2-aff5-622a91f45bcb" check="valid">paragraph&#160;(a)</intref>, a person participating in the special ACC operation/investigation must cause the thing to be delivered to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.11-para1.b-para2.i" guid="_082a4035-82ca-413a-9894-3c1ac7c61ffe" provision.type="other"><no>(i)</no><block><txt break.before="0">if the thing may be used in evidence in proceedings of a kind referred to in <intref refid="sec.29-ssec.15" target.guid="_f9dba572-9a5b-474e-bc27-4287184dab90" check="valid">subsection&#160;(15)</intref>—the authority or person responsible for taking the proceedings; or</txt></block></li><li id="sec.29-ssec.11-para1.b-para2.ii" guid="_eb69ed6d-c090-4fac-b317-e0dac82ea7c1" provision.type="other"><no>(ii)</no><block><txt break.before="0">if <intref refid="sec.29-ssec.11-para1.b-para2.i" target.guid="_082a4035-82ca-413a-9894-3c1ac7c61ffe" check="valid">subparagraph&#160;(i)</intref> does not apply—the person who appears to the person participating in the special ACC operation/investigation to be entitled to the possession of the thing;</txt></block></li></list><txt break.before="1">unless the CEO has given the thing to the Attorney-General of the Commonwealth or of a State, or to a law enforcement agency, or to another person or authority, under <intref refid="sec.34" target.guid="_99bd48ef-c1c6-41d6-8126-e2f65b80f092" check="valid">section&#160;34</intref><intref refid="sec.34-ssec.1" target.guid="_dc5c7c5b-6538-4f19-a3f0-96a742a29c13" check="valid">(1)</intref><intref refid="sec.34-ssec.1-para1.a" target.guid="_d7c89633-5138-45a7-be40-c6cf4f88d56b" check="valid">(a)</intref>, <intref refid="sec.34-ssec.1-para1.b" target.guid="_3ea63bac-d8f0-4b33-ad52-b2163e946d1c" check="valid">(b)</intref> or <intref refid="sec.34-ssec.1-para1.c" target.guid="_21ee6cc4-a70e-40fd-8f3d-ffc97bc285af" check="valid">(c)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.12" guid="_9611bbbe-7a56-49a2-b508-98f7623f0375" affected.by.uncommenced="0" provision.type="other"><no>(12)</no><block><txt break.before="0">A person participating in the special ACC operation/investigation may, instead of delivering a thing under <intref refid="sec.29-ssec.11" target.guid="_c186e003-3afe-4002-a383-ad8cf2d1e3e1" check="valid">subsection&#160;(11)</intref><intref refid="sec.29-ssec.11-para1.b" target.guid="_e95363c1-6010-4d8c-ae93-86ed874ad95f" check="valid">(b)</intref><intref refid="sec.29-ssec.11-para1.b-para2.ii" target.guid="_eb69ed6d-c090-4fac-b317-e0dac82ea7c1" check="valid">(ii)</intref>, deliver the thing to the Attorney-General of the Commonwealth or of a State, or to a law enforcement agency, for the purpose of assisting in the investigation of criminal offences, if the person participating in the special ACC operation/investigation is satisfied that the thing is likely to be useful for that purpose.</txt></block></subclause><subclause id="sec.29-ssec.13" guid="_512cb12b-09a0-475a-8384-08cc0dfdf8ff" affected.by.uncommenced="0" provision.type="other"><no>(13)</no><block><txt break.before="0">Nothing in this section affects a right of a person to apply for, or the power of a person to issue, a warrant, being a right or power existing otherwise than by virtue of this section.</txt></block></subclause><subclause id="sec.29-ssec.14" guid="_5ebf3e0c-e0d2-44c0-8cd8-c2d2fa3cfd53" affected.by.uncommenced="0" provision.type="other"><no>(14)</no><block><txt considers it necessary to do so, the eligible person may make application by telephone for a warrant under <intref refid="sec.29" target.guid="_e5171761-2f47-4163-bbba-25743c06843b" check="valid">section&#160;29</intref>.</txt></block></subclause><subclause id="sec.30-ssec.2" guid="_370db71a-640f-4eb5-912e-cbd7b022efd1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Before so making application, the eligible person must prepare an affidavit that sets out the grounds on which the issue of the warrant the application of the terms of the warrant and the date on which and the time at which it was signed; and</txt></block></li><li id="sec.30-ssec.3-para1.c" guid="_1b79110f-f3e8-4987-b05e-5594e4767dc5" provision.type="other"><no>(c)</no><block><txt break.before="0">record on the warrant his or her reasons for issuing the warrant; and</txt></block></li><li id="sec.30-ssec.3-para1.d" guid="_4cd296a8-7bb6-4d07-89d8-4f3f1d8586f1" provision.type="other"><no>(d)</no><block><txt break.before="0">send a copy of the warrant to the CEO.</txt></block></li></list></block></subclause><subclause id="sec.30-ssec.4" guid="_54d2a001-e9c7-4b81-b209-9f7559372a92" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If a warrant is issued under <intref refid="sec.29" target.guid="_e5171761-2f47-4163-bbba-25743c06843b" check="valid">section&#160;29</intref> on an application made by telephone—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.30-ssec.4-para1.a" guid="_899dc532-bba6-48c0-9cd7-9dee824d620c" provision.type="other"><no>(a)</no><block><txt break.before="0">a member of the staff of the ACC or a member of the Queensland Police Service may complete a form of warrant in the terms indicated by the issuing officer under <intref refid="sec.30-ssec.3" target.guid="_c53a3d51-a225-468f-b572-5c01f828b011" check="valid">subsection&#160;(3)</intref>; and</txt></block></li><li id="sec.30-ssec.4-para1.b" guid="_b90f2d50-98d4-450b-b88d-6484c86b2d9a" provision.type="other"><no>(b)</no><block><txt break.before="0">if a form of warrant is so completed, the member must write on it the name of the issuing officer who issued the warrant and the date on which and the time at which it was signed.</txt></block></li></list></block></subclause><subclause id="sec.30-ssec.5" guid="_f4b2e0a5-8d98-4db8-8d9e-5e0d4afbc18c" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If a person completes a form of warrant under <intref refid="sec.30-ssec.4" target.guid="_54d2a001-e9c7-4b81-b209-9f7559372a92" check="valid">subsection&#160;(4)</intref>, the person must, not later than the day next following the date of expiry of the warrant, send to the issuing officer who signed the warrant the form of warrant completed by him or her and the affidavit duly sworn in connection with the warrant.</txt></block></subclause><subclause id="sec.30-ssec.6" guid="_82ad8e58-4c2a-4313-a61c-9168e1c5da65" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">On receipt of the documents referred to in <intref refid="sec.30-ssec.5" target.guid="_f4b2e0a5-8d98-4db8-8d9e-5e0d4afbc18c" check="valid">subsection&#160;(5)</intref> the issuing officer must attach them to the warrant signed by him or her and deal with the documents in the way in which he or she would have dealt with the affidavit if the application for the warrant had been made to him or her under <intref refid="sec.29" target.guid="_e5171761-2f47-4163-bbba-25743c06843b" check="valid">section&#160;29</intref>.</txt></block></subclause><subclause id="sec.30-ssec.7" guid="_0cdec195-196c-4427-8eec-035cc86fe109" guid="_13692750-cb5c-4df6-81d3-08028fedc141" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act does not purport to confer a duty on a Commonwealth body or person to perform a function, or to exercise a power, if the conferral of the duty would be beyond the legislative power of the Parliament of the State.</txt></block></subclause><subclause guid="_dc5c7c5b-6538-4f19-a3f0-96a742a29c13" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the ACC, in carrying out an ACC operation/investigation, obtains evidence of an offence against a law of the Commonwealth or of a State or Territory, being evidence that would be admissible in a prosecution for the offence, the CEO must assemble the evidence and give it to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.34-ssec.1-para1.a" guid="_d7c89633-5138-45a7-be40-c6cf4f88d56b" provision.type="other"><no>(a)</no><block><txt break.before="0">the Attorney-General of the Commonwealth or the State, as the case requires; or</txt></block></li><li id="sec.34-ssec.1-para1.b" guid="_3ea63bac-d8f0-4b33-ad52-b2163e946d1c" provision.type="other"><no>(b)</no><block><txt break.before="0">the relevant law enforcement agency; or</txt></block></li><li id="sec.34-ssec.1-para1.c" guid="_21ee6cc4-a70e-40fd-8f3d-ffc97bc285af" provision.type="other"><no>(c)</no><block><txt break.before="0">any person or authority (other than a law enforcement agency) who is authorised by or under a law of the Commonwealth or of the State or Territory to prosecute the offence.</txt></block></li></list></block></subclause><subclause id="sec.34-ssec.2" guid="_a2d7ac35-c90d-4455-bd86-80dad9d76d45" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the ACC, in carrying out an ACC operation/investigation, obtains evidence that would be admissible in confiscation proceedings, the CEO may assemble the evidence and give it to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.34-ssec.2-para1.a" guid="_08d8e615-f32f-4dc5-9cdc-1f6fed953ad2" provision.type="other"><no>(a)</no><block><txt break.before="0">the Attorney-General of the Commonwealth or the relevant State, as the case requires; or</txt></block></li><li id="sec.34-ssec.2-para1.b" guid="_89c3d38a-0985-4c5e-8d3d-a3f39cdc6f93" provision.type="other"><no>(b)</no><block><txt break.before="0">a relevant law enforcement agency; or</txt></block></li><li id="sec.34-ssec.2-para1.c" guid="_6d82411a-8f00-4cff-84fe-fd64ba4aa164" provision.type="other"><no>(c)</no><block><txt break.before="0">any person or authority (other than a law enforcement agency) who is authorised to commence the confiscation proceedings.</txt></block></li></list></block></subclause><subclause id="sec.34-ssec.3" guid="_a6bb2795-200a-4997-bf1d-cfdb773d2b31" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If, as a result of the performance of any of the ACC’s functions, the Board considers that 1 of the following recommendations should be made to the Commonwealth Minister or to the appropriate State Minister of a participating State, the Board may make the recommendation to the Commonwealth Minister or appropriate State Minister—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.34-ssec.3-para1.a" guid="_580e0d6f-cf84-48c8-8799-2c0c614533ab" provision.type="other"><no>(a)</no><block><txt break.before="0">for reform of the law relating to relevant offences, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.34-ssec.3-para1.a-para2.i" guid="_9efbc375-8844-4ebf-a64f-a5816bdafd78" provision.type="other"><no>(i)</no><block><txt break.before="0">evidence and procedure applicable to the trials of relevant offences; and</txt></block></li><li id="sec.34-ssec.3-para1.a-para2.ii" guid="_a87eb788-eca9-486f-a62d-9aee8a39c67f" provision.type="other"><no>(ii)</no><block><txt break.before="0">relevant offences in relation to, or involving, corporations; and</txt></block></li><li id="sec.34-ssec.3-para1.a-para2.iii" guid="_96f65322-6630-497f-9ee2-c276cabc52de" provision.type="other"><no>(iii)</no><block><txt break.before="0">taxation, banking and financial frauds; and</txt></block></li><li id="sec.34-ssec.3-para1.a-para2.iv" guid="_8b2d0ff3-0010-4a89-956a-54bc224426fe" provision.type="other"><no>(iv)</no><block><txt break.before="0">reception by Australian courts of evidence obtained in foreign countries as to relevant offences; and</txt></block></li><li id="sec.34-ssec.3-para1.a-para2.v" guid="_9fd9dc12-923a-47f6-8148-3e9a43f730ee" provision.type="other"><no>(v)</no><block><txt break.before="0">maintenance and preservation of taxation, banking and financial records;</txt></block></li></list></block></li><li id="sec.34-ssec.3-para1.b" guid="_3f58e414-22e8-447a-bc09-1defb1510890" provision.type="other"><no>(b)</no><block><txt break.before="0">for reform of administrative practices;</txt></block></li><li id="sec.34-ssec.3-para1.c" guid="_79634479-2555-4d3c-9937-61fc966fc745" provision.type="other"><no>(c)</no><block><txt break.before="0">for reform of administration of the courts in relation to trials of relevant offences.</txt></block></li></list></block></subclause><subclause id="sec.34-ssec.4" guid="_8df0ae83-5e4b-4152-b499-afd2641d2b4e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the ACC has obtained particular information or intelligence in the course of performing 1 or more of its functions, nothing in this Act is to be taken to prevent the ACC from making use of the information or intelligence in the performance of any of its other functions.</txt></block></subclause></clause><clause id="sec.35" guid="_510ad059-2bc7-4350-86cd-21bd379788b8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>35</no><heading id="sec.35-he" guid="_4be83969-1280-4dc3-b0cb-6e48f1f28967">Functions of federal judicial officers</heading><subclause id="sec.35-ssec.1" guid="_6284c72a-ef0f-452b-92b5-09bcd61b4de7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A function conferred on a federal judicial officer by this Act is conferred on the federal judicial officer in a personal capacity and not as a court or a member of a court.</txt></block></subclause><subclause id="sec.35-ssec.2" guid="_06ab8156-6f70-461f-bcae-37a1c58b5672" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The federal judicial officer need not accept the function conferred.</txt></block></subclause><subclause id="sec.35-ssec.3" guid="_c62110ed-f6bf-4a35-925a-95e65119bb04" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Anything done or made by a federal judicial officer under this Act has effect only by virtue of this Act and is not to be taken by implication to be done or made by a court.</txt></block></subclause><subclause id="sec.35-ssec.4" guid="_98b10877-e3d8-42f6-8c86-0b77658a64bf" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A federal judicial officer performing a function under this Act has the same protection and immunity as if he or she were performing that function as, or as a member of, a court (being the court of which the federal judicial officer is a member).</txt></block></subclause><subclause id="sec.35-ssec.5" guid="_c7f4a28e-145e-46b0-89f6-a485a48d37fb" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1"><defterm id="sec.35-ssec.5-def.federaljudicialofficer" guid="_34ab3466-5d72-4613-97a2-5426a98bff25" type="definition">federal judicial officer</defterm> means a judge of the Federal provision.type="other"><no>36</no><heading id="sec.36-he" guid="_8c67ee0f-a45d-44ec-85d5-4e7ca3de021c">Limitation on challenge to Board determination</heading><block><txt break.before="1">If—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.36-para1.a" guid="_b34d6035-9e10-4a44-9ba2-646b98a742f6" provision.type="other"><no>(a)</no><block><txt break.before="0">an ACC State intelligence operation is determined by the Board to be a special operation; or</txt></block></li><li id="sec.36-para1.b" guid="_2b65ffa0-e4df-42e5-82d3-5701c0c9aec8" provision.type="other"><no>(b)</no><block><txt break.before="0">an ACC State investigation is determined by the Board to be a special investigation;</txt></block></li></list></block><block><txt break.before="1">then, except in a proceeding instituted by the Attorney-General of the Commonwealth or of a State, any act or thing done by the ACC because of that determination must not be challenged, reviewed, quashed or called in question in any court of the State on the ground that the determination was not lawfully made.</txt></block></clause><clause id="sec.37" guid="_7db2d0d5-30ba-4214-9276-a96a5127fc00" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>37</no><heading id="sec.37-he" guid="_00b716d2-55d8-48bd-83ac-d4bc268a42e2">Cooperation with law enforcement agencies and coordination with overseas authorities</heading><subclause id="sec.37-ssec.1" guid="_7b121fb2-3a75-462f-aa66-83f27c1418a6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">In performing its functions under this Act, the ACC must, so far as is practicable, work in cooperation with law enforcement agencies.</txt></block></subclause><subclause id="sec.37-ssec.2" guid="_3d35e401-a405-46e0-ba03-94e006527962" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In performing its functions under this Act, the ACC may coordinate its activities with the activities of authorities and persons in other countries performing functions similar to functions of the ACC.</txt></block></subclause></clause><clause id="sec.38" guid="_0eea895a-be75-4795-8c0e-38842732fc1d" break.before="1">The ACC has power to do all things necessary to be done for or in connection with, or reasonably incidental to, the performance of its functions under this Act, and any specific powers conferred on the ACC by this Act are not to be taken to limit by implication the generality of this section.</txt></block></clause></part><part id="pt.6" guid="_5900aab9-b1c8-4d61-91b0-8c5c747d4159" affected.by.uncommenced="0"><no>Part 6</no><heading id="pt.6-he" guid="_55d2fd14-b557-4655-8ea8-e4967e87ebb5">General</heading><clause id="sec.39" guid="_4ab4661d-a7d4-4e79-82e8-2765c37164e2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>39</no><heading id="sec.39-he" guid="_7759fd37-8162-449d-94a1-ec08907f709c">Double jeopardy</heading><block><txt break.before="1">A person is not liable to be punished for an act or omission that is an offence under this Act if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.39-para1.a" guid="_0382d279-f5ec-4ce0-8b81-92ac15b70755" provision.type="other"><no>(a)</no><block><txt break.before="0">the act or omission is also an offence under Act</name></legref>.</txt></block></li></list></block></clause><clause id="sec.40" guid="_075eb889-b54f-4fd5-b256-12e894a740c7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>40</no><heading id="sec.40-he" guid="_d78a7294-388e-46f4-a582-45259465056f">Proceedings for an offence</heading><subclause id="sec.40-ssec.1" guid="_e35136d8-d67e-4607-a296-3ad62ff8cbc5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Subject to <intref refid="sec.40-ssec.2" target.guid="_11766aa4-73b0-40d0-984f-fe984cfaaf2f" check="valid">subsection&#160;(2)</intref>, a proceeding for an offence against this Act must be taken in a summary way under the <legref jurisd="QLD" type="act" target.doc.id="act-1886-017" target.version.series="506b5b47-5bcd-438c-b6a7-27cb65143289" check="valid"><name emphasis="yes">Justices Act 1886</name></legref> within the later of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.40-ssec.1-para1.a" guid="_c4f407ca-1f4b-49d6-8508-8108453e2dee" provision.type="other"><no>(a)</no><block><txt break.before="0">1 year after the offence is committed;</txt></block></li><li id="sec.40-ssec.1-para1.b" guid="_18d21269-473c-4024-aefc-43d858b40c9b" provision.type="other"><no>(b)</no><block><txt break.before="0">1 year after the commission of the offence comes to the complainant’s knowledge, but within 2 years after the commission of the offence.</txt></block></li></list></block></subclause><subclause id="sec.40-ssec.2" guid="_11766aa4-73b0-40d0-984f-fe984cfaaf2f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A proceeding for an indictable offence may, at the election of the prosecution, be taken—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.40-ssec.2-para1.a" guid="_177c9b06-b8a7-4c9d-8a05-5ef5335bc76a" provision.type="other"><no>(a)</no><block><txt break.before="0">by way of summary proceedings under before a magistrate if it is a proceeding—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.40-ssec.3-para1.a" guid="_3f83c5b8-ba34-4f79-8cd9-e4427f57f728" provision.type="other"><no>(a)</no><block><txt break.before="0">for the summary conviction of the person; or</txt></block></li><li id="sec.40-ssec.3-para1.b" guid="_895c53f0-9062-4541-afee-5200f9a72fda" provision.type="other"><no>(b)</no><block><txt break.before="0">for an examination of witnesses in relation to the provision.type="other"><no>(4)</no><block><txt break.before="0">If a proceeding for an indictable offence is brought before a justice who is not a magistrate, jurisdiction is limited to taking or making a procedural action or order as defined under the <legref jurisd="QLD" type="act" target.doc.id="act-1991-050" target.version.series="2d45566c-5920-4e8a-9d15-ae354fb20af2" check="valid"><name emphasis="yes">Justices of the Peace and Commissioners for Declarations Act 1991</name></legref>.</txt></block></subclause><subclause id="sec.40-ssec.5" guid="_6c27628d-80c1-4ef7-876e-d3e493cc6a74" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the magistrate hearing a charge of an indictable offence considers the charge should be prosecuted on indictment, the magistrate—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.40-ssec.5-para1.a" guid="_72f80076-83b0-4f6c-963b-cbe3346b8e96" provision.type="other"><no>(a)</no><block><txt break.before="0">must not decide the charge as a summary offence; and</txt></block></li><li id="sec.40-ssec.5-para1.b" guid="_7f069624-c9f2-4d79-80bc-9829d11659b2" provision.type="other"><no>(b)</no><block><txt break.before="0">must proceed by way of a committal proceeding.</txt></block></li></list></block></subclause><subclause id="sec.40-ssec.6" guid="_9e45a01f-0145-426c-9ef1-a0e5ce0f12a9" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If a magistrate acts under <intref refid="sec.40-ssec.5" target.guid="_6c27628d-80c1-4ef7-876e-d3e493cc6a74" provision.type="other"><no>(a)</no><block><txt break.before="0">any plea of the person charged, made at the start of the proceeding, must be disregarded; and</txt></block></li><li id="sec.40-ssec.6-para1.b" guid="_e13d4acf-5f01-446c-8a2f-b94eb2d11293" provision.type="other"><no>(b)</no><block><txt break.before="0">any evidence brought in the proceeding before the magistrate decided to act under <intref refid="sec.40-ssec.5" target.guid="_6c27628d-80c1-4ef7-876e-d3e493cc6a74" check="valid">subsection&#160;(5)</intref> is taken to be evidence in the proceeding for the committal of the person for trial or sentence; and</txt></block></li><li id="sec.40-ssec.6-para1.c" guid="_fc3ee293-c891-4b99-bf17-66b13172d4ab" provision.type="other"><no>(c)</no><block><txt break.before="0">before committing the person for trial or sentence, the magistrate must make a statement to the person under the <legref jurisd="QLD" type="act" target.doc.id="act-1886-017" target.version.series="506b5b47-5bcd-438c-b6a7-27cb65143289" check="valid"><name emphasis="yes">Justices Act 1886</name></legref>, <legref jurisd="QLD" type="act" refid="sec.104" target.doc.id="act-1886-017" target.version.series="506b5b47-5bcd-438c-b6a7-27cb65143289" target.guid="_bb9d5e96-b511-4178-b3e2-c13667a08733" check="valid">section&#160;104</legref><legref jurisd="QLD" type="act" refid="sec.104-ssec.2" target.doc.id="act-1886-017" target.version.series="506b5b47-5bcd-438c-b6a7-27cb65143289" target.guid="_1472e544-4ae1-407b-826e-00ce5dbf8bb2" check="valid">(2)</legref><legref jurisd="QLD" type="act" refid="sec.104-ssec.2-para1.b" target.doc.id="act-1886-017" target.version.series="506b5b47-5bcd-438c-b6a7-27cb65143289" or 1 year’s imprisonment.</txt></block></subclause><subclause id="sec.40-ssec.8" guid="_4f275f85-5625-4dc3-95a9-379bfa606c5a" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt refid="sec.41" target.guid="_1dcff311-5a69-4902-bce2-8edcabd31de7" check="valid">section&#160;41</intref> applies.</txt></definition></deflist></block></subclause></clause><clause id="sec.41" guid="_1dcff311-5a69-4902-bce2-8edcabd31de7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>41</no><heading id="sec.41-he" guid="_6fa79daa-362e-410e-bd67-45b1b644658c">Indictable offences</heading><block><txt break.before="1">An offence against this Act punishable by at least 5 years imprisonment is a crime.</txt></block></clause><clause id="sec.42" guid="_d297d7e9-7157-4d93-9a26-f13d9576e695" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>42</no><heading id="sec.42-he" guid="_657a7207-1621-48d2-b8b3-17876c9a1b42">Arrangements for Board to obtain information or intelligence</heading><block><txt break.before="1">The State Minister may make an arrangement with the Commonwealth Minister for the Board to be given by the State, or an authority of the State, information or intelligence relating to relevant criminal activities.</txt></block></clause><clause id="sec.43" guid="_09822563-d8e2-4a39-b987-956538cba09d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>43</no><heading id="sec.43-he" guid="_44a81651-fc1f-4e06-93de-4b6e4c178dd6">Administrative arrangements with the Commonwealth</heading><block><txt break.before="1">The State Minister may make an arrangement with the Commonwealth Minister under which the State will, as agreed on under the arrangement, make available a person who is an officer or employee of the State or of an authority of the State or a member of the Queensland Police Service to perform services for the ACC.</txt></block></clause><clause id="sec.44" guid="_3b04b921-7d2d-4f21-ac03-82e00d48c254" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>44</no><heading id="sec.44-he" guid="_aee52690-9c26-4ec3-acb2-952c194a876a">Judges to perform functions under the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref></heading><block><txt break.before="1">A Supreme Court judge may perform functions conferred on the judge by <legref jurisd="CTH" type="act" refid="sec.22" check="invalid">section&#160;22</legref>, <legref jurisd="CTH" type="act" refid="sec.23" check="invalid">23</legref> or <legref jurisd="CTH" type="act" refid="sec.31" check="invalid">31</legref> of the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref>.</txt></block></clause><clause id="sec.45" guid="_30b960bf-0788-4351-8f47-fa1704ba16ee" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>45</no><heading id="sec.45-he" guid="_09a32dec-26ff-45c7-bda6-69c49621e203">Providing reports and information</heading><subclause id="sec.45-ssec.1" guid="_4557c98f-9f95-4169-be3a-84052b454787" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chair of the Board must keep the Commonwealth Minister informed of the general conduct of the ACC in the performance of the ACC’s functions under this Act.</txt></block></subclause><subclause id="sec.45-ssec.2" guid="_2f9e358e-2909-41af-8d1e-48fa160d2008" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the Commonwealth Minister requests the chair of the Board to give to him or her information about a specific matter relating to the ACC’s conduct in the performance of its functions under this Act, the chair must comply with the request.</txt></block></subclause><subclause id="sec.45-ssec.3" guid="_d4b5068f-2d5c-4bb7-94a7-8e208fb9e5d1" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Subject to <intref refid="sec.45-ssec.4" target.guid="_044eb1bf-900c-4c1c-9459-0ab2653b429a" check="valid">subsection&#160;(4)</intref>, if the State Minister requests the chair of the Board to give to him or her information about a specific matter relating to the ACC’s conduct in the performance of its functions under this Act, the chair must comply with the request.</txt></block></subclause><subclause id="sec.45-ssec.4" guid="_044eb1bf-900c-4c1c-9459-0ab2653b429a" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the chair of the Board considers that disclosure of information to the public could prejudice the safety or reputation of persons or the operations of law enforcement agencies, the chair must not provide the information under <intref refid="sec.45-ssec.3" target.guid="_d4b5068f-2d5c-4bb7-94a7-8e208fb9e5d1" check="valid">subsection&#160;(3)</intref>.</txt></block></subclause><subclause id="sec.45-ssec.5" guid="_34b2ea41-02de-42f6-9655-8a6120026be7" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Subject to <intref refid="sec.45-ssec.7" target.guid="_37905686-7d7f-4a7f-821f-e3c41de86164" check="valid">subsection&#160;(7)</intref>, the chair of the Board—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.45-ssec.5-para1.a" guid="_8f67b566-32c5-4805-8c58-0705ed6d89d8" provision.type="other"><no>(a)</no><block><txt break.before="0">must, when requested by the Inter-Governmental Committee to give information to the Committee about a specific matter relating to an ACC operation/investigation that the ACC has conducted or is conducting, comply with the request; and</txt></block></li><li id="sec.45-ssec.5-para1.b" guid="_5f6e9bc9-81f7-419b-b02e-c33d814f4141" provision.type="other"><no>(b)</no><block><txt break.before="0">must when requested by the Inter-Governmental Committee to do so, and may at the other times the chair of the Board thinks appropriate, inform the Committee about the general conduct of the ACC in the performance of the ACC’s functions under this Act.</txt></block></li></list></block></subclause><subclause id="sec.45-ssec.6" guid="_b52893c2-826c-4ba7-9da9-ea621269bf3f" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Subject to <intref refid="sec.45-ssec.7" target.guid="_37905686-7d7f-4a7f-821f-e3c41de86164" check="valid">subsection&#160;(7)</intref>, the chair of the Board must give to the Inter-Governmental Committee, for transmission to the Governments represented on the Committee, a report of the findings of any special ACC operation/investigation conducted by the ACC.</txt></block></subclause><subclause id="sec.45-ssec.7" guid="_37905686-7d7f-4a7f-821f-e3c41de86164" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The chair of the Board—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.45-ssec.7-para1.a" guid="_e9549985-f365-4a94-8992-dff2cbd081ba" provision.type="other"><no>(a)</no><block><txt break.before="0">must not give to the Inter-Governmental Committee any matter the disclosure of which to members of the public could prejudice the safety or reputation of persons or the operations of law enforcement agencies (<defterm id="sec.45-ssec.7-def.relevantmatter" guid="_12bfe2fb-ec74-461a-9a45-7ca7de1b7a7b" type="definition">relevant matter</defterm>); and</txt></block></li><li id="sec.45-ssec.7-para1.b" guid="_aa943bae-68ab-4ed5-8a0d-2394764d81ce" provision.type="other"><no>(b)</no><block><txt break.before="0">if the findings of the ACC in an investigation include any relevant matter, must prepare a separate report in relation to the relevant matter and give that report to the State Minister.</txt></block></li></list></block></subclause><subclause id="sec.45-ssec.8" guid="_84454d59-fd7f-4ca3-9a4b-3e381d69778d" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">The chair of the Board may include in a report given under <intref refid="sec.45-ssec.6" target.guid="_b52893c2-826c-4ba7-9da9-ea621269bf3f" check="valid">subsection&#160;(6)</intref> a recommendation that the report be laid before the Legislative Assembly.</txt></block></subclause><subclause id="sec.45-ssec.9" guid="_6006e2f8-19ad-4d33-89a7-f1cbc718f589" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">The CEO may give to a relevant authority any information that has come into the ACC’s possession under this Act and that is relevant to the activities of that agency or authority if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.45-ssec.9-para1.a" guid="_5ebaf981-dca2-427e-b846-7085659c1792" provision.type="other"><no>(a)</no><block><txt break.before="0">it appears to the CEO to be appropriate to do so; and</txt></block></li><li id="sec.45-ssec.9-para1.b" guid="_2bb22aa5-0e1a-4028-ade8-8a7d7d7283fc" provision.type="other"><no>(b)</no><block><txt break.before="0">to do so would not be contrary to a law of the Commonwealth, a State or a Territory that would otherwise apply.</txt></block></li></list></block></subclause><subclause id="sec.45-ssec.10" guid="_e07d80ea-12fb-47c6-92df-46a2d66a501c" affected.by.uncommenced="0" provision.type="other"><no>(10)</no><block><txt break.before="0">The CEO may, whenever it appears to the CEO to be appropriate to do so, give to authorities and persons responsible for taking civil remedies by or on behalf of the Commonwealth, a State or a Territory, any information that has come into the ACC’s possession under this Act and that may be relevant for the purposes of so taking the remedies for matters connected with, or arising out of, offences against—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.45-ssec.10-para1.a" guid="_cbf28177-4017-4aaa-b504-1b0ef77fcd30" provision.type="other"><no>(a)</no><block><txt break.before="0">the laws of the Commonwealth; or</txt></block></li><li id="sec.45-ssec.10-para1.b" guid="_4c8d9fd8-e795-446d-94cc-7d8e137d763a" provision.type="other"><no>(b)</no><block><txt break.before="0">the laws of a State; or</txt></block></li><li id="sec.45-ssec.10-para1.c" guid="_b6549324-bca0-41f2-8a39-41af3eaa50a8" provision.type="other"><no>(c)</no><block><txt break.before="0">the laws of a Territory.</txt></block></li></list></block></subclause><subclause id="sec.45-ssec.11" guid="_b8ac50b9-ec73-4379-b849-43029d7e756c" affected.by.uncommenced="0" provision.type="other"><no>(11)</no><block><txt break.before="0">If any information relating to the performance of the functions of an authority of the Commonwealth or a State or the Administration of a Territory comes into the ACC’s possession under this Act, the CEO may, if he or she considers it desirable to do so—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.45-ssec.11-para1.a" guid="_60d50010-25e4-46b0-a8f0-ea8e1a2fd4f3" provision.type="other"><no>(a)</no><block><txt break.before="0">give that information to the authority or Administration; and</txt></block></li><li id="sec.45-ssec.11-para1.b" guid="_4b6a64ec-059f-4734-b7e7-4a083ff954ef" provision.type="other"><no>(b)</no><block><txt break.before="0">make any recommendations to the authority or Administration as to the performance of its functions that the CEO considers appropriate.</txt></block></li></list></block></subclause><subclause id="sec.45-ssec.12" guid="_3aaeb76b-d862-43dc-98d7-74dffd8f9468" affected.by.uncommenced="0" provision.type="other"><no>(12)</no><block><txt break.before="0">A report under this Act that sets out any finding that an offence has been committed, or makes any recommendation for the institution of a prosecution for an offence, must not be made available to the public unless the finding or recommendation is expressed to be based on evidence that would be admissible in the prosecution of a person for that offence.</txt></block></subclause><subclause id="sec.45-ssec.13" guid="_0919e3c3-0d8a-4aec-a940-2e6f47c18755" Intelligence Organisation any information that has come into the ACC’s possession under this Act and that is relevant to security as defined in <legref jurisd="QLD" type="act" refid="sec.4" check="invalid">section&#160;4</legref> of the <legref jurisd="CTH" type="act" target.doc.id="act-1979-113" target.version.series="C2004A02123" check="valid"><name emphasis="yes">Australian Security Intelligence Organisation Act 1979</name> (Cwlth)</legref>.</txt></block></subclause><subclause id="sec.45-ssec.14" guid="_0cc68f0d-3257-4e9f-928b-c9ac72f843d7" affected.by.uncommenced="0" provision.type="other"><no>(14)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.45-ssec.14-def.relevantauthority_" guid="_57acd644-0e47-45b8-bf86-3e9b433896b7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.45-ssec.14-def.relevantauthority" guid="_c023b30a-fde5-4b32-911c-45098f9e2818" type="definition">relevant authority</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.45-ssec.14-def.relevantauthority-para1.a" guid="_12dd7781-d724-4da5-b18f-0eb8d10888d9" provision.type="other"><no>(a)</no><block><txt break.before="0">a law enforcement agency; or</txt></block></li><li id="sec.45-ssec.14-def.relevantauthority-para1.b" guid="_fe524208-53fc-4711-85c1-ca9f22fddd6b" provision.type="other"><no>(b)</no><block><txt break.before="0">a foreign law enforcement agency; or</txt></block></li><li id="sec.45-ssec.14-def.relevantauthority-para1.c" guid="_d28b02e1-7b79-41a9-9c67-2886be4e1d81" provision.type="other"><no>(c)</no><block><txt break.before="0">an authority of the Commonwealth, a State or a Territory prescribed under a regulation.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.46" guid="_25d209b2-bf8a-43fd-a94e-3089a6c8676b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>46</no><heading id="sec.46-he" guid="_cfbde20e-45c4-4aaa-a6ee-fcd8c9e6ad44">Secrecy</heading><subclause id="sec.46-ssec.1" guid="_fb793185-c5fd-40f5-a1bb-783d153074db" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.46-ssec.1-para1.a" guid="_8cea4c31-b075-4435-bf70-9fd6549c7f2d" provision.type="other"><no>(a)</no><block><txt break.before="0">the CEO; and</txt></block></li><li id="sec.46-ssec.1-para1.b" guid="_89101257-3b0c-4dbc-bd30-6ab9e401d89b" provision.type="other"><no>(b)</no><block><txt break.before="0">a member of the Board; and</txt></block></li><li id="sec.46-ssec.1-para1.c" guid="_313cc96e-dc12-4975-84c4-c4646604fe76" provision.type="other"><no>(c)</no><block><txt break.before="0">a member of the staff of the ACC; and</txt></block></li><li id="sec.46-ssec.1-para1.d" guid="_faa610bf-77c7-4173-99eb-115081b0376d" provision.type="other"><no>(d)</no><block><txt break.before="0">an examiner.</txt></block></li></list></block></subclause><subclause id="sec.46-ssec.2" guid="_ac76e88c-fd6e-4649-a427-10c0b2143ce2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person to whom this section applies must not, either directly or indirectly, except for the purposes of a relevant Act or otherwise in connection with the performance of his or her functions under a relevant Act, and either while he or she is or after he or she ceases to be a person to whom this section applies—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.46-ssec.2-para1.a" guid="_918a01b0-c59f-4063-8978-ead15b3c2530" provision.type="other"><no>(a)</no><block><txt break.before="0">make a record of any relevant information; or</txt></block></li><li id="sec.46-ssec.2-para1.b" guid="_48c6fe3a-3e74-46df-b5c3-4c2f6bcf40bc" provision.type="other"><no>(b)</no><block><txt break.before="0">divulge or communicate to any person any relevant information.</txt></block></li></list></block><penalty id="sec.46-ssec.2-pen" guid="_51ccb6f1-37d9-4d60-87f6-d7283586febf"><block><txt break.before="1">Maximum penalty—75 penalty units or 1 year’s imprisonment.</txt></block></penalty></subclause><subclause id="sec.46-ssec.3" guid="_afe0147d-fcca-456a-8127-05bd35fe760d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person to whom this section applies can not be required to produce in any court a relevant document, or to divulge or communicate to a court a relevant matter or thing, except if the ACC, or the CEO, the acting CEO, a member of the Board or an examiner in his or her official capacity, is a party to the relevant proceeding or it is necessary to do so—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.46-ssec.3-para1.a" guid="_009a8a2c-936c-4fff-b51d-2a50b377afed" provision.type="other"><no>(a)</no><block><txt break.before="0">for the purpose of carrying into effect the provisions of a relevant Act; or</txt></block></li><li id="sec.46-ssec.3-para1.b" guid="_46335b14-2dd3-472b-b850-385b601552ee" provision.type="other"><no>(b)</no><block><txt break.before="0">for the purposes of a prosecution instituted as a result of an operation or investigation carried out by the ACC in the performance of its functions.</txt></block></li></list></block></subclause><subclause id="sec.46-ssec.4" guid="_41d5384f-efc6-441a-b3bf-fb96525aaf1a" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.46-ssec.4-def.court_" guid="_d9a90a44-6c72-43ba-9049-ed4d9278637c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.46-ssec.4-def.court" guid="_39afa97d-971b-42ea-bb30-2b22fa81ca10" type="definition">court</defterm> includes any tribunal, authority or person having power to require the production of documents or the answering of questions.</txt></definition><definition id="sec.46-ssec.4-def.memberofthestaffoftheACC_" guid="_8378a9fb-d3a8-47c3-8ae9-f9aae67a2dae" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.46-ssec.4-def.memberofthestaffoftheACC" guid="_568d7982-b18d-4d15-abd8-4da428e4cc5d" type="definition">member of the staff of the ACC</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.46-ssec.4-def.memberofthestaffoftheACC-para1.a" guid="_9e1c6fa4-6a41-4823-9004-4236ef327004" provision.type="other"><no>(a)</no><block><txt break.before="0">a person referred to in the definition <defterm guid="_cc130edb-2a80-479c-ae99-135653b2d869" type="mention">member of the staff of the ACC</defterm> in <legref jurisd="CTH" type="act" refid="sec.4" check="invalid">section&#160;4</legref><legref jurisd="CTH" type="act" refid="sec.4-ssec.1" check="invalid">(1)</legref> of the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref>; or</txt></block></li><li id="sec.46-ssec.4-def.memberofthestaffoftheACC-para1.b" guid="_6273a084-dd4c-4ff2-889b-1b91ad84b40c" provision.type="other"><no>(b)</no><block><txt break.before="0">a person who assists, or performs services for or on behalf of, a lawyer appointed under <intref refid="sec.7" target.guid="_1bc90b1d-8b3c-4def-94ad-3858677e2757" check="valid">section&#160;7</intref> in the performance of the lawyer’s functions as counsel to the ACC.</txt></block></li></list></definition><definition id="sec.46-ssec.4-def.produce_" guid="_faea4c8b-8067-418e-a2b1-df6264163c0d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.46-ssec.4-def.produce" guid="_0d8c557e-de3b-471f-98f6-9c86b933ec95" type="definition">produce</defterm> includes permit access to.</txt></definition><definition id="sec.46-ssec.4-def.relevantAct_" guid="_a7a00e39-963f-4b5c-bccc-8987e0596143" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.46-ssec.4-def.relevantAct" guid="_02b4a419-62f7-40e8-8a74-1af378d30f2b" type="definition">relevant Act</defterm> means the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref>, this Act or any corresponding Act of another State.</txt></definition><definition id="sec.46-ssec.4-def.relevantdocument_" guid="_22d4986c-2676-4ee4-88d6-4af9d91c2d13" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.46-ssec.4-def.relevantdocument" guid="_4e2c4b09-8243-478b-8404-bd5006ec4ce0" type="definition">relevant document</defterm> means a document that has come into a person’s custody or control in the course of, or because of, the performance of the person’s functions under this Act.</txt></definition><definition id="sec.46-ssec.4-def.relevantinformation_" guid="_70a55aed-1ad5-4f10-b82e-6a8ef3459a58" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.46-ssec.4-def.relevantinformation" guid="_a027621a-26a8-4d69-b8bf-496a73792901" type="definition">relevant information</defterm> means information acquired by a person because of, or in the course of, the performance of the person’s functions under this Act.</txt></definition><definition id="sec.46-ssec.4-def.relevantmatterorthing_" guid="_586c9f99-5045-4d0b-a3b6-5904c72baac1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.46-ssec.4-def.relevantmatterorthing" guid="_f9b0ae8f-d105-48cb-ba30-f2a097726411" type="definition">relevant matter or thing</defterm> means a matter or thing that has come to a person’s notice in the performance of the person’s functions under this Act.</txt></definition></deflist></block></subclause></clause><clause id="sec.47" guid="_fd4f1859-0e94-4616-af3a-1775b29012ae" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>47</no><heading id="sec.47-he" guid="_293c9148-82cf-4959-92d1-df1b3a3d96d8">Delegation</heading><block><txt break.before="1">The CEO may, by writing, delegate to a member of the staff of the ACC who is an SES employee, or an acting SES employee, all or any of the CEO’s functions under this Act.</txt></block></clause><clause id="sec.48" guid="_270c4841-7655-4ebf-9c3a-b8b7274a5131" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>48</no><heading id="sec.48-he" guid="_79d8a222-b622-45d1-8a39-7fe6321af8de">Liability for damages</heading><block><txt break.before="1">A member of the Board is not liable to an action or other proceeding for damages for or in relation to an act done or omitted in good faith in performance or purported performance of any function conferred or expressed to be conferred by or under this Act.</txt></block></clause><clause id="sec.49" guid="_c9446655-edf0-4f01-81a3-10a2e5e70232" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>49</no><heading id="sec.49-he" guid="_4f88a9ec-3cc5-44dc-af26-982eb15486ee">Obstructing, hindering or disrupting the ACC or an examiner</heading><block><txt break.before="1">A person must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.49-para1.a" guid="_827c683e-e4b8-4412-87cc-38380b62cb1d" provision.type="other"><no>(a)</no><block><txt break.before="0">obstruct or hinder—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.49-para1.a-para2.i" guid="_acd5641e-52fd-4eb7-a3e1-c0c559067fc6" provision.type="other"><no>(i)</no><block><txt break.before="0">the ACC in the performance of its functions; or</txt></block></li><li id="sec.49-para1.a-para2.ii" guid="_854c940c-fce4-468f-bbb2-1ef5259e6136" provision.type="other"><no>(ii)</no><block><txt break.before="0">an examiner in the performance of his or her functions as an examiner; or</txt></block></li></list></block></li><li id="sec.49-para1.b" guid="_1663d50d-1edb-4217-b7d4-04814e63690a" provision.type="other"><no>(b)</no><block><txt break.before="0">disrupt an examination before an examiner.</txt></block></li></list></block><penalty id="sec.49-pen" guid="_6e0c57db-5b72-4698-a54e-406d3d602315"><block><txt break.before="1">Maximum penalty—300 penalty units or 5 years imprisonment.</txt></block></penalty></clause><clause id="sec.50" guid="_7de8f100-3f1e-41e6-9437-c106703a47b1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>50</no><heading id="sec.50-he" guid="_32ff187d-f0ca-4aa1-b989-6d280b0c56ff">Public meetings and bulletins</heading><subclause id="sec.50-ssec.1" guid="_7203099d-b91b-41f4-9cb6-e7745bc61681" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Board may hold meetings in public to inform the public about, or receive submissions in relation to, the performance of the ACC’s functions, including its functions under this Act.</txt></block></subclause><subclause id="sec.50-ssec.2" guid="_9b1bcb31-d975-4528-a33a-abb66407340e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Board may publish bulletins to inform the public about the performance of the ACC’s functions, including its functions under this Act.</txt></block></subclause><subclause id="sec.50-ssec.3" guid="_90a3a93d-250b-4578-90b8-bf27d7b5564c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Board must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.50-ssec.3-para1.a" guid="_79a20ecd-d857-4959-90e4-f85d5e2e4c09" provision.type="other"><no>(a)</no><block><txt break.before="0">divulge in the course of a meeting held under <intref refid="sec.50-ssec.1" target.guid="_7203099d-b91b-41f4-9cb6-e7745bc61681" check="valid">subsection&#160;(1)</intref>; or</txt></block></li><li id="sec.50-ssec.3-para1.b" guid="_2fe387e5-3ee6-49d2-a1ff-6f7b1ec65d27" provision.type="other"><no>(b)</no><block><txt break.before="0">include in a bulletin published under <intref refid="sec.50-ssec.2" target.guid="_9b1bcb31-d975-4528-a33a-abb66407340e" check="valid">subsection&#160;(2)</intref>;</txt></block></li></list></block><block><txt break.before="1">any matter the disclosure of which to members of the public could prejudice the safety or reputation of a person or prejudice the fair trial of a person who has been or may be charged with an offence.</txt></block></subclause></clause><clause id="sec.51" guid="_8307a84f-2217-4dbb-99a1-8483c64d065d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>51</no><heading id="sec.51-he" guid="_f3f591ca-484c-4479-b639-326898c32a5f">Annual report</heading><subclause id="sec.51-ssec.1" guid="_7acf92fa-0e10-4737-ae4a-a28ca03a143a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An annual report in relation to a year must include the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.51-ssec.1-para1.a" guid="_a32d927c-d643-4a85-afc4-6769bd6e40ef" provision.type="other"><no>(a)</no><block><txt break.before="0">a description of any ACC State investigation that the ACC conducted during the year and that the Board determined to be a special investigation;</txt></block></li><li id="sec.51-ssec.1-para1.b" guid="_2b3a251e-b912-4023-9b84-71abaf386b9c" provision.type="other"><no>(b)</no><block><txt break.before="0">a description, which may include statistics, of any patterns or trends, and the nature and scope, of any criminal activity that have come to the attention of the ACC during that year in the performance of its functions under this Act;</txt></block></li><li id="sec.51-ssec.1-para1.c" guid="_88a90d7f-c46d-4f75-9ea0-66516ed337a2" provision.type="other"><no>(c)</no><block><txt break.before="0">any recommendations for changes in the laws of the Commonwealth, of a participating State or of a Territory, or for administrative action, that, as a result of the performance of the ACC’s functions under this Act, the Board considers should be made;</txt></block></li><li id="sec.51-ssec.1-para1.d" guid="_aaf5229b-32ac-4043-8388-4b320ee273e7" provision.type="other"><no>(d)</no><block><txt break.before="0">the general nature and the extent of any information given by the CEO during that year under this Act to a law enforcement agency;</txt></block></li><li id="sec.51-ssec.1-para1.e" guid="_88b43f60-7b0f-4bae-8641-02b13641aa3f" provision.type="other"><no>(e)</no><block><txt break.before="0">the extent to which ACC State investigations have resulted in the prosecution in that year of persons for offences;</txt></block></li><li id="sec.51-ssec.1-para1.f" guid="_7441eb65-6b21-48ab-a788-d8159e9a1a28" provision.type="other"><no>(f)</no><block><txt break.before="0">the extent to which ACC State investigations have resulted in confiscation proceedings;</txt></block></li><li id="sec.51-ssec.1-para1.g" guid="_afaa0fc8-26e5-4862-ae9d-d4c7a97fb109" provision.type="other"><no>(g)</no><block><txt break.before="0">particulars of the number and results of court proceedings involving the ACC in relation to its functions under this Act being proceedings that were determined, or otherwise disposed of, during that year.</txt></block></li></list></block></subclause><subclause id="sec.51-ssec.2" guid="_d9bc0ffc-f477-41f6-979f-0e9144d6f174" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An annual report must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.51-ssec.2-para1.a" guid="_024abbba-8ea1-4513-ae9e-8a759c5eab0b" provision.type="other"><no>(a)</no><block><txt break.before="0">identify persons as being suspected of having committed offences; or</txt></block></li><li id="sec.51-ssec.2-para1.b" guid="_6eb0c550-0a39-4150-b0c3-70be49c46334" provision.type="other"><no>(b)</no><block><txt break.before="0">identify persons as having committed offences unless those persons have been convicted of those offences.</txt></block></li></list></block></subclause><subclause id="sec.51-ssec.3" guid="_603e4b4c-c952-4cca-8941-3fe3151b9b02" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In any annual report the chair of the Board must take reasonable care to ensure that the identity of a person is not revealed if to reveal his or her identity might, having regard to any material appearing in the report, prejudice the safety or reputation of a person or prejudice the fair trial of a person who has been or may be charged with an offence.</txt></block></subclause><subclause id="sec.51-ssec.4" guid="_47d03e9e-9715-47ae-a055-b30f83d3efef" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The State Minister is to cause a copy of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.51-ssec.4-para1.a" guid="_9c523469-66e9-45dd-bc0a-7b1300351688" provision.type="other"><no>(a)</no><block><txt break.before="0">each annual report that he or she receives; and</txt></block></li><li id="sec.51-ssec.4-para1.b" guid="_f1711154-16d6-47a8-a2f8-8094fb0ff58f" provision.type="other"><no>(b)</no><block><txt break.before="0">any comments made on the report by the Inter-Governmental Committee, being comments that accompanied the report;</txt></block></li></list></block><block><txt break.before="1">to be laid before the Legislative Assembly within 15 sitting days after he or she receives the report.</txt></block></subclause><subclause id="sec.51-ssec.5" guid="_fa898b39-d754-4b41-9476-ecaa7dcc8e11" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.51-ssec.5-def.annualreport_" guid="_1bf76ee2-5531-47e5-ad61-29e444089e47" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.51-ssec.5-def.annualreport" guid="_199ed345-7dfd-4d43-be8f-a31388013233" type="definition">annual report</defterm> means a report by the chair of the Board under <legref jurisd="CTH" type="act" refid="sec.61" check="invalid">section&#160;61</legref> of the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC Act</name></legref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.52" guid="_3ba84746-c4a5-480c-8822-e26faf34f13f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>52</no><heading id="sec.52-he" guid="_6aa21faf-907f-4e90-a90e-e886778d81e3">Things done for multiple purposes</heading><block><txt break.before="1">The validity of anything done for the purposes of this Act is not affected only because it was done also for the purposes of the <legref jurisd="CTH" type="act" check="invalid"><name emphasis="no">ACC provision.type="other"><no>(1)</no><block><txt break.before="0">The Governor in Council may make regulations under this Act.</txt></block></subclause><subclause id="sec.53-ssec.2" break.before="1">If an ACC State investigation relates to a matter into which an NCA investigation had been commenced but not completed before 1 January 2003, the Board of the ACC is taken to have determined, in writing, that the ACC State investigation is a special investigation.</txt></block></clause><clause id="sec.57" guid="_07ff4008-2e84-4290-9a62-2c6968a6311b" affected.by.uncommenced="0" spent.amends="0" provision.type="transitional"><no>57</no><heading id="sec.57-he" guid="_7e23de50-03f4-4b44-bb11-8f1d019eb3a1">Assembling and giving evidence obtained by the NCA</heading><block><txt break.before="0">before 1 January 2003, the National Crime Authority obtained evidence of a kind referred to in <legref jurisd="QLD" type="act" refid="sec.6" check="invalid">section&#160;6</legref><legref jurisd="QLD" type="act" refid="sec.6-ssec.1" check="invalid">(1)</legref> of the <legref jurisd="QLD" type="act" check="invalid"><name emphasis="no">NCA (State Provisions) Act</name></legref>; but</txt></block></li><li id="sec.57-para1.b" guid="_f5929aee-5342-4dbe-8ebf-21b8ae304f26" provision.type="other"><no>(b)</no><block><txt break.before="0">the break.before="1">section&#160;34(1) applies as if that evidence had been obtained by the ACC in carrying out an ACC operation/investigation.</txt></block></clause><clause id="sec.58" check="invalid"><name emphasis="no">NCA (State Provisions) Act</name></legref> immediately before 1 January 2003 has effect as if it had been made under section&#160;42.</txt></block></clause><clause evasion;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.iv" guid="_1f034e6d-6e38-4541-9459-6cad10f81553" provision.type="other"><no>(iv)</no><block><txt break.before="0">money laundering;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.v" guid="_b69dd358-4735-4e7b-a31d-f5b8647bff28" provision.type="other"><no>(v)</no><block><txt break.before="0">currency violations;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.vi" guid="_14a7595a-0a48-4a33-9afa-df21225aa0ae" provision.type="other"><no>(vi)</no><block><txt break.before="0">illegal drug dealings;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.vii" guid="_78038efa-c560-47ca-85cc-d0cd75dc78b7" provision.type="other"><no>(vii)</no><block><txt break.before="0">illegal gambling;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.viii" guid="_9834de64-3b52-4990-96cc-47f00ac102a8" provision.type="other"><no>(viii)</no><block><txt break.before="0">obtaining financial benefit by vice engaged in by others;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.ix" guid="_2cd6d191-06af-47c0-97b1-d8512521b1b8" provision.type="other"><no>(ix)</no><block><txt break.before="0">extortion;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.x" guid="_0491af64-bd2a-4b73-ab4a-5eea3fd7a566" provision.type="other"><no>(x)</no><block><txt break.before="0">violence;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xi" guid="_b71388c5-e7ea-4736-bd3c-d9c784233b37" provision.type="other"><no>(xi)</no><block><txt break.before="0">bribery or corruption of, or by, an officer of the Commonwealth, an officer of a State or an officer of a Territory;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xii" guid="_34d24adb-a7e5-4f79-b8e8-03b9f07051b5" provision.type="other"><no>(xii)</no><block><txt provision.type="other"><no>(xiii)</no><block><txt break.before="0">bankruptcy and company violations;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xiv" guid="_0ab59d70-0e5a-4e30-b98c-a02a0ca854b8" provision.type="other"><no>(xiv)</no><block><txt break.before="0">harbouring of criminals;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xv" guid="_af5fc2e1-c52b-47d9-935d-13b5ecb0d9d8" provision.type="other"><no>(xv)</no><block><txt break.before="0">forging of passports;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xvi" guid="_3e8200de-57e8-4c54-bd95-68e353b5e428" provision.type="other"><no>(xvi)</no><block><txt break.before="0">firearms;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xvi-oc.2" guid="_8966ca9d-830a-4bfd-9330-0e17f717e05e" provision.type="other"><no>(xvi)</no><block><txt break.before="0">armament dealings;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xvii" guid="_60a883b2-49ff-438c-b1b0-66336e9aa1f7" provision.type="other"><no>(xvii)</no><block><txt break.before="0"> illegal importation or exportation of fauna into or out of Australia;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xix" guid="_744f6a12-3d18-406f-9a90-a4ad72500176" provision.type="other"><no>(xix)</no><block><txt break.before="0">cybercrime;</txt></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.d-para2.xx" guid="_b567dd1b-6b1e-436c-b585-3105843b0607" provision.type="other"><no>(xx)</no><block><txt break.before="0">matters of the same general nature as 1 or more of the matters listed above; and</txt></block></li></list></block></li><li id="sch.2-def.seriousandorganisedcrime-para1.e" guid="_4dc870c2-0fd8-42fb-b531-732d8af9a2ba" provision.type="other"><no>(e)</no><block><txt break.before="0">that is punishable by imprisonment for a period of 3 years or
