would be necessary for any person to take the oaths commonly called the oaths of allegiance supremacy and abjuration or any of them or the oath prescribed by the <legref target.doc.id="act-1867-012" target.version.series="0189401f-e1ed-41f5-af4e-09e81b78a458" check="valid" jurisd="QLD" type="act">Act</legref> of Parliament commonly called the <legref target.doc.id="act-1830-009" target.version.series="4507ce57-7590-448a-af3d-1dbbca706a1d" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Roman Catholic Relief Act 1830</name></legref> or to make the declaration prescribed by the <legref target.doc.id="act-1867-012" target.version.series="0189401f-e1ed-41f5-af4e-09e81b78a458" check="valid" jurisd="QLD" type="act">Act</legref> of Parliament passed in the ninth year of the reign of King George IV <intref refid="ch.17" check="invalid">chapter&#160;17</intref> and whensoever it shall be necessary for any person to take the oath of allegiance it shall be sufficient for such person to take in lieu of the said several oaths and declaration the following oath of allegiance—</txt></block><block><txt break.before="1">‘I A.B. do sincerely promise and swear that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth the Second, as lawful Sovereign of the United Kingdom, Australia, and her other Realms and Territories, and to Her Heirs and Successors, according to law.’;</txt></block><block><txt break.before="1">anything in the said Acts of Parliament or in any other statute Act or law notwithstanding.</txt></block></clause><clause judge thereof or before any district court or court of quarter sessions or before any justice of the peace authorised by writ of dedimus potestatem for that purpose.</txt></block><historynote><txt break.before="0">The oath of office to be hereafter taken by justices of the peace shall (in lieu of the oath in that behalf heretofore taken by them) be the oath following—</txt></block><block><txt break.before="1">‘I A.B. do sincerely promise and swear that as a justice of the peace for the State of Queensland I will at all times and in all things do equal justice to the poor and rich and discharge the duties of my office according to the law to the best of my knowledge and ability without fear favour or affection.’.</txt></block></subclause><subclause id="sec.3-ssec.2" emphasis="yes">Oaths Acts Amendment Act 1981</name></legref>, wardens appointed under the <legref target.doc.id="act-1989-110" target.version.series="731a7ca0-1e25-47e4-89d8-24d4d17632dd" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Mineral Resources Act 1989</name></legref> and commissioners of the Queensland Industrial Relations Commission appointed after the passing of the <legref target.doc.id="act-2012-028" target.version.series="13e169f5-f549-44de-a805-772a12c5639b" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Holidays and Other Legislation Amendment Act 2012</name></legref> shall take the oath of allegiance and also the oath of office hereinbefore mentioned with the necessary adaptations.</txt></block></subclause><subclause id="sec.3-ssec.3" guid="_bc4f1384-595a-4c83-ba3a-43adc213cced" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Commissioners of the Queensland Industrial prejudice to the provisions of any Act requiring the taking of a further oath of allegiance upon the demise of Her Majesty, there shall be substituted for the oath of allegiance prescribed by <intref refid="sec.1" target.guid="_ae5fbba2-4abe-4033-a3ad-38f5b71ca152" check="valid">section&#160;1</intref>, and for any oath of allegiance prescribed under any Act, other than the <legref target.doc.id="act-2001-080" target.version.series="ef897e46-6927-436a-bd01-4f83c18c3970" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Constitution of Queensland 2001</name></legref>, an oath of allegiance in the following form—</txt></block><block><txt break.before="1">I, , do sincerely promise and swear that I will be faithful and bear true allegiance to Her Majesty, Queen Elizabeth the Second, as lawful Sovereign of the United Kingdom, Australia, and her other Realms and Territories, and to Her Heirs and Successors, according to law.</txt></block><block><txt break.before="1">So guid="_d057f53d-6e61-4997-9015-609c80f8f0a4">Declarations substituted for oaths and affirmations</heading><block><txt break.before="1">In any case whereby any statute law or ordinance made or to be made relating to any of the public revenue of the State or any of the public offices or public departments or by any official regulation in any department any oath solemn affirmation or affidavit might but for the passing of this Act be required to be taken or made by any person on the doing of any act matter or thing or for the purpose of verifying any book entry or return or for any other purpose whatsoever it shall be lawful for the Governor in Council of the said State if the Governor in Council shall so think fit to substitute a declaration to the same effect as the oath solemn affirmation or affidavit which might but for the passing of this Act be required to be taken or made and the person who might under the <legref target.doc.id="act-1867-012" target.version.series="0189401f-e1ed-41f5-af4e-09e81b78a458" check="valid" jurisd="QLD" type="act">Act</legref> or Acts imposing the same be required to take or make such oath solemn affirmation or affidavit shall in the presence of the officer or person empowered by such Act or Acts to administer such oath solemn affirmation or affidavit make and subscribe such declaration and every such officer or person is hereby empowered and required to administer the same accordingly.</txt></block></clause><clause id="sec.7" guid="_3dbf8c96-b4ed-4d5f-bd25-21402e60f856" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_6fd56d7e-7157-484b-8673-69751dba26ca">Act not to extend to oath of allegiance</heading><block><txt break.before="1">However, nothing in <intref refid="sec.6" target.guid="_83003221-5218-4920-b8f9-7c1fb343fa52" check="valid">section&#160;6</intref> contained shall extend or apply to the oath of allegiance in any case in which the same now is or may be required to be taken by any person who may be appointed to any office but such oath of allegiance shall continue to be required and shall be administered and taken as well and in the same manner as if this Act had not been passed.</txt></block></clause><clause id="sec.8" guid="_db52e5a2-8384-444e-9c01-fa466faaffeb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_5f221904-3934-403b-bf35-027fc1d56c36">Nor to oaths in judicial proceeding</heading><block><txt break.before="1">In addition, nothing in <intref refid="sec.6" target.guid="_83003221-5218-4920-b8f9-7c1fb343fa52" check="valid">section&#160;6</intref> contained shall extend or apply to any oath solemn affirmation or affidavit which now is or hereafter may be made or taken or be required to be made or taken in any judicial proceeding in any court of justice or in any proceeding for or by way of summary conviction before any justice or justices of the peace but all such oaths affirmations and affidavits shall continue to be required and to be administered taken and made as well and in the same manner as if this Act had not been passed.</txt></block></clause><clause id="sec.9" guid="_ccd1b64a-0f4c-4964-b706-0a8b1c39f44f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_743628b4-90f7-46f8-9f16-26e5fefa7fb7">Such substitution to be notified in gazette</heading><block><txt break.before="1">When the Governor in Council shall in any such case as aforesaid have substituted a declaration in lieu of an oath solemn affirmation or affidavit the same shall be notified in the gazette and from and after the expiration of 21 days next following the day of the date of the gazette wherein such notification shall have been first published the provisions of this Act shall extend and apply to each and every case office or department specified in such notification.</txt></block></clause><clause id="sec.10" guid="_44ec0e73-b8d9-490c-960b-ecbef6fc758e" affected.by.uncommenced="0"
