guid="_0c9cd8f5-ddde-4e95-876c-5c08da91e8f7">Main purpose of Act</heading><block><txt break.before="1">The main purpose of this Act is to establish the Director of Child Protection Litigation to apply for child protection orders and conduct child protection proceedings.</txt></block></clause><clause id="sec.5" guid="_fa0e924d-c786-4695-b853-ff868f467736" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_d3a142bf-cc78-4af1-bc08-0df157cafe36">Paramount principle</heading><block><txt break.before="1">The main principle for administering this Act is that the safety, wellbeing and best interests of a child, both through childhood and for the rest of his or her life, are paramount.</txt></block><note id="sec.5-note" guid="_0d7413b9-37db-470a-bc7c-539c1fbd4633" type="example"><heading id="sec.5-note-he" guid="_a7cc2b24-afe2-4808-9ea9-57665b3687f6">Example—</heading><block><txt break.before="1">If the director is making a decision under this Act about a child protection proceeding where there is conflict between the child’s safety, wellbeing and best interests, and the interests of adults involved in the proceeding, the conflict must be resolved in favour of the child’s safety, wellbeing and best interests.</txt></block></note><historynote><txt break.before="1"><b>s&#160;5</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2017-044" target.version.series="77cef0a9-cc26-4abc-87c1-78622e5e1c34" valid.date="as.made" check="valid">2017 No.&#160;44</legref> <legref jurisd="QLD" type="act" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_fbfa9ba3-88c4-4736-b692-53bdb9278f63">Other general principles</heading><subclause id="sec.6-ssec.1" guid="_29129c16-af70-4203-88ce-3a39acee4110" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act is to be administered having regard to the following principles—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_deabfddb-081d-4e5f-833d-d7f2b01c31fa" provision.type="other"><no>(a)</no><block><txt break.before="0">collaboration between the director and chief executive (child safety) best achieves fair, timely and consistent outcomes for the protection of children;</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_9333c97d-500d-499d-89da-bf4a87bf6ace" provision.type="other"><no>(b)</no><block><txt break.before="0">in protecting a child, the director should only take the action that is warranted in the circumstances, including, for example, by applying for the least intrusive child protection order;</txt></block></li><li id="sec.6-ssec.1-para1.c" guid="_25973142-5765-4073-b641-c830358c1c13" provision.type="other"><no>(c)</no><block><txt break.before="0">the director should consider whether sufficient, relevant and appropriate evidence is available in deciding whether to make an application for a child protection order;</txt></block></li><li id="sec.6-ssec.1-para1.d" guid="_9a82355d-e69d-45b9-97ed-041d3d21331e" provision.type="other"><no>(d)</no><block><txt break.before="0">each principle stated in the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" refid="sec.5B" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_86e073b2-6e53-48b7-8673-afd2d0799cc5" check="valid">section&#160;5B</legref> for ensuring the safety, wellbeing and best interests of a child, to the extent the principle is capable of being applied to a person performing a function or exercising a power under this Act, including, for example—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.d-para2.i" guid="_c211cd0c-5e52-4bb0-9c64-f546d9fdd48f" provision.type="other"><no>(i)</no><block><txt break.before="0">a child has a right to be protected from harm or risk of harm; and</txt></block></li><li id="sec.6-ssec.1-para1.d-para2.ii" guid="_e82fc27e-17c8-432f-af96-f0ad237b9001" provision.type="other"><no>(ii)</no><block><txt break.before="0">a delay in making a decision in relation to a child should be avoided, unless appropriate for the child;</txt></block></li></list></block></li><li id="sec.6-ssec.1-para1.e" guid="_3e91c9dc-800a-4570-b198-298dd9edf7bd" provision.type="other"><no>(e)</no><block><txt break.before="0">each principle stated in the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" refid="sec.5BA" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_e5489504-b033-4455-8528-b75c7fed452a" check="valid">section&#160;5BA</legref> for achieving permanency for a child, to the extent the principle is capable of being applied to a person performing a function or exercising a power under this Act;</txt></block></li><li id="sec.6-ssec.1-para1.f" guid="_aff4d244-90b5-4b31-96b1-819ea2481279" provision.type="other"><no>(f)</no><block><txt break.before="0">each additional principle applying in relation to an Aboriginal or Torres Strait Islander child stated in the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" refid="sec.5C" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_80e9009d-5720-4495-93be-dc1878c05f5a" check="valid">section&#160;5C</legref>.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_e3dd8cc6-cff3-4fd0-95bb-cd41080a3ca0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, each principle relevant to exercising powers and making decisions under the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" refid="sec.5D" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_470dd3f5-aa54-49f6-aa14-d5ed176b9656" check="valid">section&#160;5D</legref><legref jurisd="QLD" type="act" refid="sec.5D-ssec.1" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_adde43ad-6bf7-4738-9437-7654b4e93ed4" check="valid">(1)</legref> applies to the extent the principle is capable of being applied to a person exercising a power or making a decision under this Act.</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_d03a79b0-c3de-4115-9bb3-1f4b8006f39a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In addition, the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" refid="sec.5E" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" target.guid="_0d198b0a-6578-4b65-b4f7-e9b89740bece" check="valid">section&#160;5E</legref> applies in relation to a person giving a child an opportunity to express their views under this Act.</txt></block></subclause><subclause id="sec.6-ssec.4" guid="_969f48bf-7320-419e-aedb-df9cef794ab8" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-ssec.4-def.permanency_" guid="_3ba18dfa-d4c5-4593-8c24-b749eaa31af3" affected.by.uncommenced="0"><txt break.before="1"><defterm provision.type="other"><no>(i)</no><block><txt break.before="0">the functions of the chief executive (child safety) under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-029" of allowing a person to carry out research, the director may authorise the person to have access to information relating to the administration of this Act, including information from a member of the break.before="0">The person keeps all rights accrued or accruing to the person as a public service officer as if service as the director were a continuation of service as a public service this Act, the director must not, without the Minister’s consent, engage in any work relating to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.30-para1.a" guid="_e6ea4e0d-54a9-4e40-a96c-45b381e18c39" provision.type="other"><no>(a)</no><block><txt break.before="0">the protection or rights and interests of children and young people; or</txt></block></li><li id="sec.30-para1.b" guid="_0bdc9262-6da3-46bd-bc9f-8f2d4e7fcb82" provision.type="other"><no>(b)</no><block><txt break.before="0">an adult who has been charged with an offence functions</heading><subclause id="sec.31-ssec.1" guid="_4f6676ca-32e0-4778-a255-a66ef69bc9b1" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a person appointed as the director if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.1-para1.a" guid="_9039d14c-4bb2-4c0a-918e-f1c92551a872" provision.type="other"><no>(a)</no><block><txt break.before="0">before the appointment, the person was involved in a matter in the practice of the person’s profession; and</txt></block></li><li id="sec.31-ssec.1-para1.b" guid="_c139ca36-1a18-4d8b-9ce6-b9e856010def" provision.type="other"><no>(b)</no><block><txt break.before="0">at the time of the appointment, the matter has not been finally decided or otherwise dealt with.</txt></block></li></list></block></subclause><subclause id="sec.31-ssec.2" guid="_52e9623c-aa4a-495d-a97e-3f0e84ef5155" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The involvement does not prevent the person from, or limit the person in, performing the person’s functions as director.</txt></block></subclause><subclause id="sec.31-ssec.3" guid="_1d740a90-c265-4afe-a39e-e5ae44b2a804" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, the person must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.3-para1.a" guid="_05ab9245-5402-495b-accb-15928f7f4085" provision.type="other"><no>(a)</no><block><txt break.before="0">disclose information given to the person in his or her professional capacity in relation to the matter before the person’s appointment as director, other than to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.3-para1.a-para2.i" guid="_e073ae33-a532-47a9-a204-1aa19effdaf6" provision.type="other"><no>(i)</no><block><txt break.before="0">the person for whom the director was acting in the matter in the practice of the director’s profession; or</txt></block></li><li id="sec.31-ssec.3-para1.a-para2.ii" guid="_e3c404ba-bb1b-41ac-85bd-35a86e5a8dfd" provision.type="other"><no>(ii)</no><block><txt break.before="0">a legal representative of that person; or</txt></block></li><li id="sec.31-ssec.3-para1.a-para2.iii" guid="_9d10c0e2-e973-4b17-8f05-12b69f9e0e2c" provision.type="other"><no>(iii)</no><block><txt break.before="0">a person authorised by the person or legal representative mentioned in <intref refid="sec.31-ssec.3-para1.a-para2.i" target.guid="_e073ae33-a532-47a9-a204-1aa19effdaf6" check="valid">subparagraph&#160;(i)</intref> or <intref refid="sec.31-ssec.3-para1.a-para2.ii" target.guid="_e3c404ba-bb1b-41ac-85bd-35a86e5a8dfd" check="valid">(ii)</intref> to receive the information; or</txt></block></li></list></block></li><li id="sec.31-ssec.3-para1.b" guid="_d29e7599-f330-427d-b4b1-cab4b88732d1" provision.type="other"><no>(b)</no><block><txt break.before="0">act personally in relation to the provision.type="other"><no>32</no><heading id="sec.32-he" guid="_714cce7a-dd35-450c-b118-4ab6400ffba2">Vacancy in office</heading><subclause id="sec.32-ssec.1" guid="_cb7c23b2-3937-4a0b-841e-dc4333e847a2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The office of the director becomes vacant if the director—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.1-para1.a" guid="_da027742-1625-49cb-98a2-eca48882c0f2" provision.type="other"><no>(a)</no><block><txt break.before="0">resigns office by signed notice to the Minister giving at least 1 month’s notice; or</txt></block></li><li id="sec.32-ssec.1-para1.b" guid="_6e03bf8b-866f-42cc-adf4-7561f4a5a34b" provision.type="other"><no>(b)</no><block><txt break.before="0">is convicted of an indictable offence; or</txt></block></li><li id="sec.32-ssec.1-para1.c" guid="_06269972-ab01-4879-b134-3b33b667bfd5" provision.type="other"><no>(c)</no><block><txt break.before="0">is an insolvent under administration under the <legref jurisd="CTH" target.doc.id="act-2001-050" target.version.series="C2004A00818" check="valid" type="act"><name emphasis="no">Corporations Act</name></legref>, <legref jurisd="CTH" refid="sec.9" target.doc.id="act-2001-050" target.version.series="C2004A00818" check="invalid" type="act">section&#160;9</legref>; or</txt></block></li><li id="sec.32-ssec.1-para1.d" guid="_468232c7-66ba-4611-9c06-ed3aeecb1c6f" provision.type="other"><no>(d)</no><block><txt break.before="0">is removed from office by the Governor in Council under <intref refid="sec.32-ssec.3" target.guid="_8fbe65be-9667-4874-a644-1f81ca66bd12" check="valid">subsection&#160;(3)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.32-ssec.2" guid="_41f139d6-4cdf-4749-8b8c-01260a7e28d2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, if the director is suspended by the Minister under <intref refid="sec.32-ssec.5" target.guid="_28aa16e3-330c-4014-b01d-69c221b03027" check="valid">subsection&#160;(5)</intref>, the office is vacant during the period of suspension.</txt></block></subclause><subclause id="sec.32-ssec.3" guid="_8fbe65be-9667-4874-a644-1f81ca66bd12" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Governor in Council may, at any time, remove the director from office on the recommendation of the Minister.</txt></block></subclause><subclause id="sec.32-ssec.4" guid="_7e12eb42-3a57-41fe-9ace-11c914d08f43" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Minister may recommend the director’s removal if the Minister is satisfied the director—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.4-para1.a" guid="_beb3c98e-cf93-4b80-9a43-9a2db307448c" provision.type="other"><no>(a)</no><block><txt break.before="0">has been guilty of misconduct; or</txt></block></li><li id="sec.32-ssec.4-para1.b" guid="_5b6e4ede-9cb7-4ca5-a2be-960ab7721218" provision.type="other"><no>(b)</no><block><txt break.before="0">is incapable of performing his or her duties; or</txt></block></li><li id="sec.32-ssec.4-para1.c" guid="_eb2cca2a-f4e3-4b3d-b30b-02ac0c20463e" provision.type="other"><no>(c)</no><block><txt break.before="0">has neglected his or her duties or performed them incompetently.</txt></block></li></list></block></subclause><subclause id="sec.32-ssec.5" guid="_28aa16e3-330c-4014-b01d-69c221b03027" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The Minister may suspend the director for up to 60 days by signed notice to the director if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.5-para1.a" guid="_e71b114b-84e2-45e9-8c90-5980707bd560" provision.type="other"><no>(a)</no><block><txt break.before="0">there is an allegation of misconduct against the director; or</txt></block></li><li id="sec.32-ssec.5-para1.b" guid="_916ebf90-34f5-4e1d-afca-c87cb7caa8c1" provision.type="other"><no>(b)</no><block><txt break.before="0">the Minister is satisfied a matter has arisen in relation to the director that may be grounds for removal under this section.</txt></block></li></list></block></subclause></clause><clause id="sec.33" guid="_d9c75491-5813-4d23-aa23-799478b55ab9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>33</no><heading id="sec.33-he" guid="_ce665f1b-a276-4357-bce1-0d1b798c0604">Acting director</heading><subclause id="sec.33-ssec.1" guid="_2f928ccc-6059-461f-a7f8-f850f5035137" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If there is a vacancy in the office of the director or the director is absent or for any other reason is unable to perform the functions of the office, the Minister may appoint a person to act as the director for a period of not more than 6 months.</txt></block></subclause><subclause id="sec.33-ssec.2" guid="_632741d9-3f20-4201-b60b-a23d5b9548a1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person can not be appointed to act as the director unless the Minister could recommend the person be appointed as director under <intref refid="sec.25" target.guid="_d0e116ce-0904-433d-b7db-94e604a727af" check="valid">section&#160;25</intref>.</txt></block></subclause><subclause id="sec.33-ssec.3" guid="_5dc81089-cdfb-4bf9-9344-4484b19487a6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person appointed to act as the director may be appointed to act as director for a further period—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.33-ssec.3-para1.a" guid="_d2676ed6-fd9b-4f96-ab55-3b22bd13447b" provision.type="other"><no>(a)</no><block><txt break.before="0">if the appointment is continuous on 1 or more of the person’s previous appointments as acting director and the total period of continuous appointments is not more than 6 months—by the Minister; or</txt></block></li><li id="sec.33-ssec.3-para1.b" guid="_de6ef4ff-876d-40cc-98a5-e76d7c600c46" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—by the Governor in Council.</txt></block></li></list></block></subclause><subclause id="sec.33-ssec.4"
