guid="_37b42308-62b6-4459-b8c3-995faf5ee15f">Main purposes</heading><block><txt break.before="1">The main purposes of this Act are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.a" guid="_901654c1-33e3-4c50-a87a-f20e9f595b2f" provision.type="other"><no>(a)</no><block><txt break.before="0">to provide for the employment of staff in the offices of particular members of the Legislative Assembly; and</txt></block></li><li id="sec.4-para1.b" guid="_56fee02c-5298-46ab-af7f-a98072f3a5b3" provision.type="other"><no>(b)</no><block><txt break.before="0">to provide for the proper work performance and conduct of the staff members.</txt></block></li></list></block></clause></part><part id="pt.2" guid="_f2e79878-c517-4503-ae4a-862fe9395645" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_95640a1a-e65a-43e7-a2d0-cc678200ccc3">Employment of staff members</heading><clause id="sec.5" guid="_852425cd-3999-4d9e-9377-0aaffda37de8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_6e32cb2f-6096-46a1-9c7b-223d8570c811">Functions of staff member</heading><block><txt break.before="1">The functions of a staff member are the functions given to the staff member, under the staff member’s contract of employment and by directions mentioned in <intref refid="sec.14" check="valid" target.guid="_fa849df1-a310-4688-8975-be378c14fc78">section&#160;14</intref>, to help the employing member to effectively discharge the employing member’s duties.</txt><note id="sec.5-note" guid="_99ae6919-fb8b-406c-8e1b-73062fe09b10" type="example"><heading id="sec.5-note-he" guid="_9abfba71-b20f-493b-8495-4e27e0e01481">Examples of functions that may be given to a staff member—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.5-note-para1" guid="_26684067-e067-4467-adc7-407d5521551f" provision.type="other"><no>•</no><block><txt break.before="0">providing advice</txt></block></li><li id="sec.5-note-para1-oc.2" guid="_33abb7f9-562c-473b-9c02-ff2a317a6e8c" provision.type="other"><no>•</no><block><txt break.before="0">providing administrative support</txt></block></li><li id="sec.5-note-para1-oc.3" guid="_61e69544-2d39-4e2d-a15c-044f11e6d2e2" provision.type="other"><no>•</no><block><txt break.before="0">developing policy proposals</txt></block></li><li id="sec.5-note-para1-oc.4" guid="_9686d025-20bb-4676-aeda-ef471ec8c21a" provision.type="other"><no>•</no><block><txt break.before="0">for a ministerial staff member, working with public sector units to implement government policies</txt></block></li><li provision.type="other"><no>6</no><heading id="sec.6-he" guid="_f0c3fbce-220a-49f5-bdd1-96e123b07d33">Employment of ministerial staff member</heading><block><txt break.before="1">The chief executive may, on the Premier’s recommendation, employ a person as a staff member in the office of a stated Minister.</txt></block></clause><clause id="sec.7" guid="_a52dd169-0d37-42d5-b7a7-8ba0442ba934" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_cfa200b9-76a9-4e82-ae6e-cbf6cda92ed1">Employment of staff member of Leader of the Opposition</heading><block><txt break.before="1">The chief executive may, on the recommendation of the Leader of the Opposition, employ a person as a staff member in the office of the Leader of the Opposition.</txt></block></clause><clause id="sec.8" guid="_c2269d43-6d3b-47b1-a027-947138a8ec91" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_f07f0e5b-b499-4616-8d62-6707038bee76">Employment of staff member of other non-government member</heading><subclause id="sec.8-ssec.1" guid="_815a8ede-f5b8-4d40-b240-fdf9e42e05a4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a non-government member, other than the Leader of the Opposition, who is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_b6989953-ba7e-4308-bcaa-7c44a7c5ec94" provision.type="other"><no>(a)</no><block><txt break.before="0">the leader of a political party; or</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_e28c7280-6093-4c0b-8dd5-4db3375ee0dd" provision.type="other"><no>(b)</no><block><txt break.before="0">an independent member.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_fd895e22-b55c-4a35-b048-5dec6a0f58b7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may, on the member’s recommendation, employ a person as a staff member in the member’s office.</txt></block></subclause></clause><clause id="sec.9" guid="_b3dec00e-8e23-4ffb-ad3f-e86242696bd4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_f96a63ab-e5b5-4ff7-85d9-3201b31c02b2">No entitlement to staffing of office</heading><block><txt break.before="1"><intref refid="sec.6" check="valid" target.guid="_eb16ea41-0e63-450c-895f-9fffad9716f5">Sections&#160;6</intref> to <intref refid="sec.8" check="valid" target.guid="_c2269d43-6d3b-47b1-a027-947138a8ec91">8</intref> do not confer an entitlement on any member of the Legislative Assembly to have a staff member, or any particular number of staff members, employed in the office of the member of the Legislative Assembly.</txt><note id="sec.9-note" guid="_4779aa85-2065-4d16-ab87-11599268607e" type="example"><heading id="sec.9-note-he" guid="_4d13bc41-7344-432a-870c-d6e5adf119df">Notes—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.9-note-para1.1" guid="_2d0fbf8e-bd74-4ad3-9cfa-5167f56eef73" provision.type="other"><no>1</no><block><txt break.before="0">Decisions about the employment of staff members depend on resources available to the chief executive for the purpose.</txt></block></li><li id="sec.9-note-para1.2" guid="_f4ca73b3-4b9f-4bb4-ae7a-55788d6b4e50" provision.type="other"><no>2</no><block><txt break.before="0">The level of need for the employment of a staff member for a non-government member mentioned in <intref refid="sec.8" check="valid" target.guid="_c2269d43-6d3b-47b1-a027-947138a8ec91">section&#160;8</intref> may be affected, among other matters, by whether the member has an increased workload because of the particular composition of the Legislative Assembly.</txt></block></li></list></block></note></block></clause><clause id="sec.10" guid="_4d270762-c1f1-4df1-a2f7-326a904b1e0f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_ece6ea1c-e212-45ed-9465-6450ea30a045">Basis of employment</heading><subclause id="sec.10-ssec.1" guid="_1c1bb38c-9d27-4008-981e-8f5d7d17e85f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The employment of a person as a staff member is on the terms and conditions stated in the person’s contract of employment.</txt></block></subclause><subclause id="sec.10-ssec.2" guid="_f552d12f-2357-4a18-bf88-655870e36638" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The contract may include terms and conditions about any of the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_ff3a4000-7411-41b5-aabe-9435242a2723" provision.type="other"><no>(a)</no><block><txt break.before="0">remuneration;</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_f89a408e-1eba-4739-ada0-cf96e67e147d" provision.type="other"><no>(b)</no><block><txt break.before="0">the term of employment;</txt></block></li><li id="sec.10-ssec.2-para1.c" guid="_2cd59a11-5e4f-4afc-9afc-25ceb015bc2e" provision.type="other"><no>(c)</no><block><txt break.before="0">ending the employment before the end of the stated term;</txt></block></li><li id="sec.10-ssec.2-para1.d" guid="_f7d5c7f3-5e2a-4fb5-acdf-46ee277fc86d" provision.type="other"><no>(d)</no><block><txt break.before="0">suspension from duty or other disciplinary action.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.3" guid="_1962c7cb-d982-4fc4-beef-104677323b66" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sec.10-ssec.2" check="valid" target.guid="_f552d12f-2357-4a18-bf88-655870e36638">Subsection&#160;(2)</intref> does not limit the matters that may be dealt with in the stated terms and conditions.</txt></block></subclause><subclause id="sec.10-ssec.4" guid="_d23f608c-da16-4e74-9b3b-476a1f3c8c30" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The employment may be full-time or part-time.</txt></block></subclause><subclause id="sec.10-ssec.5" guid="_973ad08b-bdf7-4676-a4ca-c90501a42d49" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The employment may be on a temporary or casual basis.</txt></block></subclause></clause><clause id="sec.11" guid="_f0330249-e873-4f8a-b46f-d47d6d2f950a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_25b804b9-7d42-474b-95b9-17e54cfda08d">Nature of employment</heading><block><txt break.before="1">A person employed as a staff member—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-para1.a" guid="_e944ee2e-a2e6-4b34-b21f-61dc738cae5d" provision.type="other"><no>(a)</no><block><txt break.before="0">does not, only because of the employment, become a public service employee; and</txt></block></li><li id="sec.11-para1.b" guid="_e7f5d198-64ef-49c4-bf91-3a3c6f2d359f" provision.type="other"><no>(b)</no><block><txt break.before="0">is an employee for the <legref jurisd="QLD" type="act" target.doc.id="act-2016-063" target.version.series="f12a0429-f8d5-43ea-8dd7-a48341b6571f" check="valid"><name emphasis="yes">Industrial Relations Act 2016</name></legref>; and</txt></block></li><li id="sec.11-para1.c" guid="_60b65bc7-0cbf-4458-944e-e83669134a6d" provision.type="other"><no>(c)</no><block><txt break.before="0">is an employee of the State.</txt><note id="sec.11-para1.c-note" guid="_84758bb4-619d-4354-9caf-372a76b539ba" type="example"><heading id="sec.11-para1.c-note-he" guid="_60b21ca9-3fc9-40e1-bec6-e5c96ae271d2">Note for <intref refid="sec.11-para1.c" check="valid" target.guid="_60b65bc7-0cbf-4458-944e-e83669134a6d">paragraph&#160;(c)</intref>—</heading><block><txt break.before="1">A delegation may be made to a staff member under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-009" target.version.series="3bbc6476-dce9-45a6-a821-229426b13686" check="valid"><name emphasis="yes">Financial Accountability Act 2009</name></legref>, <legref jurisd="QLD" type="act" refid="sec.76" target.doc.id="act-2009-009" target.version.series="3bbc6476-dce9-45a6-a821-229426b13686" check="valid" target.guid="_84fcf04e-939e-4982-bec6-18392f48c0c7">section&#160;76</legref>.</txt></block></note></block></li></list></block><historynote><txt break.before="1"><b>s&#160;11</b> amd <legref break.before="1">For the <legref jurisd="QLD" type="act" target.doc.id="act-1990-020" target.version.series="e53ce4ed-7c7f-41dc-8e60-c8e538c9aeef" check="valid"><name emphasis="yes">Superannuation (State Public Sector) Act 1990</name></legref>, a staff member is taken to be an employee of the department.</txt></block></clause><clause id="sec.13" guid="_0538280f-89c4-4e91-a9c0-4d309265ebeb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_9390b1e1-963d-464a-bb85-2ab5b63144af">Preservation of public service employee’s rights</heading><subclause id="sec.13-ssec.1" guid="_7cdcb378-d8b3-409f-ad0e-1d1bb90d4e7f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, immediately before being employed as a staff member, a person was employed on tenure as a public service employee.</txt></block></subclause><subclause id="sec.13-ssec.2" guid="_f67da3dc-d0bf-47c7-8b9a-6b06aa9d8634" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The person keeps all rights accrued or accruing to the person as a public service employee as if service as a staff member were a continuation of service as a public service employee.</txt></block></subclause><subclause id="sec.13-ssec.3" guid="_4f1c00c1-f4cc-41d9-be24-75a786b2bcdf" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the person’s contract of employment as a staff member ends other than by disciplinary action, or the contract expires and is not renewed or replaced by another contract of employment as a staff member—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.a" guid="_28912b38-6fad-459c-adfe-16dfba277e3d" provision.type="other"><no>(a)</no><block><txt break.before="0">the person becomes a public service employee employed on tenure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.a-para2.i" guid="_3d8a448a-e9a1-45d3-a450-9e742ed8f79e" provision.type="other"><no>(i)</no><block><txt break.before="0">at the classification level at which the person would have been employed if the person had continued in employment as a public service employee on tenure; and</txt></block></li><li id="sec.13-ssec.3-para1.a-para2.ii" guid="_2f06ee9e-abf5-4dfb-b443-6559cf1562ff" provision.type="other"><no>(ii)</no><block><txt break.before="0">on the remuneration to which the person would have been entitled if the person had continued in employment as a public service employee on tenure; and</txt></block></li><li id="sec.13-ssec.3-para1.a-para2.iii" guid="_9e68023a-94aa-4f53-8d67-ab191c8ee4a7" provision.type="other"><no>(iii)</no><block><txt break.before="0">in the department in which the person was employed immediately before being employed as a staff member or, if the department has changed, the department that is the nearest practical equivalent; and</txt></block></li></list></block></li><li id="sec.13-ssec.3-para1.b" guid="_39304761-bd4b-4739-8cea-c803dc30d7a2" provision.type="other"><no>(b)</no><block><txt break.before="0">the person’s service as a staff member is taken to be service as a public service employee for working out the person’s rights as a public service employee.</txt></block></li></list></block></subclause></clause></part><part id="pt.3" guid="_8ba78b93-abb4-411b-823f-f0b349074e11" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_1718a8c5-3e54-496b-84c7-74159e588f10">Work performance and conduct of staff members</heading><division id="pt.3-div.1" guid="_f8f1aa55-e700-4b4e-be09-a34269f29bf3" affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.3-div.1-he" guid="_1e572425-56f9-4aa8-a655-d859ec267e97">Directions</heading><clause id="sec.14" guid="_fa849df1-a310-4688-8975-be378c14fc78" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_3ae1bc01-e146-4bda-b0fc-bd4ab2da0fc1">Staff members subject to direction</heading><subclause id="sec.14-ssec.1" guid="_0a1a6e9f-2ba6-4ffc-8523-c3166e010ae7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A ministerial staff member is subject to the direction of his or her employing member and the Premier.</txt></block></subclause><subclause id="sec.14-ssec.2" guid="_15dfbaa8-6c31-40d4-9839-95c8e60bc680" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A staff member other than a ministerial staff member is subject to the direction of his or her employing member.</txt></block></subclause><subclause id="sec.14-ssec.3" guid="_7f4e3ef5-7518-4b95-8f0f-a62699beb1d3" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A staff member may also be subject to the direction of other persons under the staff member’s contract of employment (for example, a more senior staff member).</txt></block></subclause></clause><clause id="sec.15" guid="_e2c2a3da-bacd-4406-a2a5-7494b2299fdf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_32c253e0-b85b-48c0-9e46-fccef56f056b">Staff members not empowered to direct public service employees</heading><subclause id="sec.15-ssec.1" guid="_508278c8-4e81-4be8-ad20-38f5a0f3ffe7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A public service employee is not subject to the direction of a staff member.</txt></block></subclause><subclause id="sec.15-ssec.2" guid="_a19e813d-3f8d-4c4e-9c0c-002dcf710e4e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.15-ssec.1" check="valid" target.guid="_508278c8-4e81-4be8-ad20-38f5a0f3ffe7">Subsection&#160;(1)</intref> does not prevent a staff member giving a direction to a public service employee on behalf of a person who may lawfully give the direction.</txt><note id="sec.15-ssec.2-note" guid="_dc6578f7-5013-4eb9-a08d-061ee6d59b82" type="example"><heading id="sec.15-ssec.2-note-he" guid="_db63ca81-0b9d-4790-b769-c8e759e1402d">Example of a person who may lawfully give a direction to a public service employee—</heading><block><txt break.before="1">The Minister administering a department may give a direction to the chief executive of the department under the <legref jurisd="QLD" guid="_e06a5958-b12a-43e0-96d7-9fa5da621abc" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, <intref refid="sec.40-ssec.1" check="valid" target.guid="_6e1732d6-9d46-44fd-90ff-c5251941c9ba">subsection&#160;(1)</intref> does not apply if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.40-ssec.2-para1.a" guid="_b9775fd0-103b-420a-a576-bf3d5a2d22d1" provision.type="other"><no>(a)</no><block><txt break.before="0">the staff member gave a complying statement to his or her employing member on or after 1 June last occurring before the commencement; and</txt></block></li><li id="sec.40-ssec.2-para1.b" guid="_9385c58e-4016-40bb-8014-16018deb2b5e" provision.type="other"><no>(b)</no><block><txt break.before="0">there has been no material change to the staff member’s interests since the last complying statement given to the employing member.</txt></block></li></list></block></subclause><subclause id="sec.40-ssec.3" guid="_7bcc8d39-0569-4723-a5da-761a38ddf898" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.40-ssec.3-def.complyingstatement_" guid="_6f32c503-4dc9-4460-9fc5-b7a8f2563a19" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.40-ssec.3-def.complyingstatement" guid="_f4ed51ed-8d7c-4b4a-9a01-6f63cd578140" type="definition">complying statement</defterm> means a statement, given before the commencement, that included all information of the type required to be included in a statement under <intref refid="sec.24" check="valid" target.guid="_3afabe06-e98b-4aee-873f-d807df61d3e8">section&#160;24</intref> given immediately after the commencement.</txt></definition><definition id="sec.40-ssec.3-def.materialchange_" guid="_fdafc1b8-9897-428d-859f-23ba457ccf98" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.40-ssec.3-def.materialchange" guid="_bdb6b828-0992-4e1d-b946-d9a315e2fcc3" type="definition">material change</defterm> means a change of the type mentioned in <intref refid="sec.24" check="valid" target.guid="_3afabe06-e98b-4aee-873f-d807df61d3e8">section&#160;24</intref><intref refid="sec.24-ssec.1" check="valid" target.guid="_5e785027-04ec-4460-ae6b-6e11314d6bcb">(1)</intref><intref refid="sec.24-ssec.1-para1.b" check="valid" target.guid="_07fb7090-0405-4388-bf23-2d6c797a00bf">(b)</intref> as in force immediately after the commencement.</txt></definition></deflist></block></subclause></clause><clause id="sec.41" guid="_7ac45fbb-e072-4b0e-bfce-fa172da12a5d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>41</no><heading id="sec.41-he" guid="_bbfba727-07dc-4814-9c8c-6935c9ccb102">Codes of conduct</heading><subclause id="sec.41-ssec.1" guid="_ddb13e04-fd0e-4365-86fa-3c659ab00c5c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A current code of conduct has effect, from the commencement until it is revoked under this Act, as if it were approved under <intref refid="pt.3" check="valid" target.guid="_8ba78b93-abb4-411b-823f-f0b349074e11">part&#160;3</intref>, <intref refid="pt.3-div.3" check="valid" target.guid="_d0ab24c8-ae78-454a-bacf-90e1de6f24bb">division&#160;3</intref>.</txt></block></subclause><subclause id="sec.41-ssec.2" guid="_837047d1-7de1-499a-9b05-858ec2a70d3c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.41-ssec.2-def.currentcodeofconduct_" guid="_062b2f58-f0cd-4fb3-b1bc-a93704d46c52" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.41-ssec.2-def.currentcodeofconduct" guid="_adf96942-eddf-4363-b810-b29e6f9744e5" type="definition">current code of conduct</defterm> means a code of conduct that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.41-ssec.2-def.currentcodeofconduct-para1.a" guid="_0a2f7a96-e496-469b-a4ff-872a17709899" provision.type="other"><no>(a)</no><block><txt break.before="0">is expressed to apply to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.41-ssec.2-def.currentcodeofconduct-para1.a-para2.i" guid="_7348125b-86c7-43fe-aaa6-3e5f12ac7733" provision.type="other"><no>(i)</no><block><txt break.before="0">persons employed in ministerial offices; or</txt></block></li><li id="sec.41-ssec.2-def.currentcodeofconduct-para1.a-para2.ii" guid="_65edac00-88eb-43a0-a9af-213c3a7b2032" provision.type="other"><no>(ii)</no><block><txt break.before="0">persons employed in the office of the Leader of the Opposition; and</txt></block></li></list></block></li><li id="sec.41-ssec.2-def.currentcodeofconduct-para1.b" guid="_4a9a0563-3d7e-4af6-aa61-905601f70392" provision.type="other"><no>(b)</no><block><txt break.before="0">was approved by the Premier before the commencement; and</txt></block></li><li id="sec.41-ssec.2-def.currentcodeofconduct-para1.c" guid="_f6de2b0a-a4a1-45c5-b587-32c031d8be66" provision.type="other"><no>(c)</no><block><txt break.before="0">was in force immediately before the commencement under administrative arrangements.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.42" guid="_bbada92d-cefd-4826-985b-67ba972dd7fc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>42</no><heading id="sec.42-he" guid="_f76deadf-39a3-4298-8ef3-4ddf5489d44a">Rulings</heading><subclause id="sec.42-ssec.1" guid="_f82afc1f-cc7d-48a9-8b51-f561294e8dfb" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a ruling (a <defterm id="sec.42-def.currentruling" guid="_5179667a-bf48-4b57-84f2-234f32bdfd47" type="definition">current ruling</defterm>) that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.42-ssec.1-para1.a" guid="_be4985eb-3f90-4530-a7da-0866690c1501" provision.type="other"><no>(a)</no><block><txt break.before="0">was made under the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref> before the commencement; and</txt></block></li><li id="sec.42-ssec.1-para1.b" guid="_6b86057b-b28e-4d0a-9a7d-014a943f2a0c" provision.type="other"><no>(b)</no><block><txt break.before="0">immediately before the commencement, applied to a person employed by the chief executive under a contract of employment under the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref>, <legref jurisd="QLD" type="act" refid="sec.147" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid" target.guid="_47e17912-334a-41be-a032-f742b30db202">section&#160;147</legref> or <legref jurisd="QLD" type="act" refid="sec.148" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid" target.guid="_8638359d-de7b-4e64-9084-626154d4efd1">148</legref> in the office of a Minister or the office of the Leader of the Opposition.</txt></block></li></list></block></subclause><subclause id="sec.42-ssec.2" guid="_4be57c65-98bd-4a5e-81cd-b2ea8c162509" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subject to <intref refid="sec.42-ssec.3" check="valid" target.guid="_ac5c92f0-defc-4d2a-8d14-2ad336b498ac">subsection&#160;(3)</intref>, the current ruling applies in relation to staff members, during the transitional period, as if a reference in it to a public service employee included a staff member and with any other necessary changes.</txt></block></subclause><subclause id="sec.42-ssec.3" guid="_ac5c92f0-defc-4d2a-8d14-2ad336b498ac" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The current ruling stops applying in relation to staff members under <intref refid="sec.42-ssec.2" check="valid" target.guid="_4be57c65-98bd-4a5e-81cd-b2ea8c162509">subsection&#160;(2)</intref> if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.42-ssec.3-para1.a" guid="_85f15056-78d7-4969-a88e-5351a9e97407" provision.type="other"><no>(a)</no><block><txt break.before="0">the current ruling is revoked under the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref>; or</txt></block></li><li id="sec.42-ssec.3-para1.b" guid="_6875d3f2-4b09-4f22-bd91-23ed052d7629" provision.type="other"><no>(b)</no><block><txt break.before="0">the chief executive makes a directive under <intref refid="sec.26" check="valid" target.guid="_14bc338a-5ce2-4b88-a6e4-8b46ee90958c">section&#160;26</intref> or guideline under <intref refid="sec.29" check="valid" target.guid="_2a86d2db-4e73-4478-90cb-3c7b438adadc">section&#160;29</intref>, whichever is relevant, ending the application of the current ruling in relation to staff members.</txt></block></li></list></block></subclause><subclause id="sec.42-ssec.4" guid="_d64790c6-7cfa-4c1f-ab49-89a8911b8ab0" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">This section does not affect the chief executive’s power to make a directive under <intref refid="sec.26" check="valid" target.guid="_14bc338a-5ce2-4b88-a6e4-8b46ee90958c">section&#160;26</intref> or guideline under <intref refid="sec.29" check="valid" target.guid="_2a86d2db-4e73-4478-90cb-3c7b438adadc">section&#160;29</intref> applying a current ruling in relation to staff members during or after the transitional period.</txt></block></subclause><subclause id="sec.42-ssec.5" guid="_4d8ad4ba-7c24-457b-ba4c-52c0217705c0" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A reference in this Act to a directive of the chief executive includes a directive under the <legref jurisd="QLD" type="act" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid"><name emphasis="yes">Public Service Act 2008</name></legref> applying in relation to a staff member under this
